_वफल रहे हe।

और यत:, िजला 8नवा:चन अKधकारI, पूवQ संहभूम, जमशेदपुर, झारख ड और मु! य 8नवा:चन अKधकारI,

झारख ड क> Dरपोट: के आधार पर भारत 8नवा:चन आयोग वारा 8नवा:चनR का संचालन 8नयम 1961 के 8नयम

89 के उप 8नयम (5) के अंतग:त 8नवा:चन S यय 4 तुत नहIं करने के लए #ीमती स&वता कैब* त को कारण

बताओ नोBटस Bदनांक 16 माच:, 2020 जारI `कया गया था;

और यत:, 8नवा:चनR का संचालन 8नयम 1961 के 8नयम 89 के उप-8नयम (6) के अनुसार, Bदनांक

16 माच:, 2020 के उपयु^ त कारण बताओ नोBटस के जDरए #ीमती स&वता कैब* त को 8नदेश Bदया गया था `क

वे इस नोBटस के ाj त होने के 20 BदनR के अंदर लेखे न 4 तुत कर पाने के कारणR को 4 पk ट करते हुए

लWखत *प मg अपना अP यावेदन 4 तुत करg और साथ हI, 8नवा:चन S यय का अपना लेखा दाWखल करg;

और यत:, उ^ त नोBटस #ीमती स&वता कैब* त के पु[ वारा 6 अग4 त, 2020 को ाj त `कया था।

अP यथQ से ाj त पावती रसीद िजला 8नवा:चन अKधकारI, पूवQ संहभूम, जमशेदपुर, वारा अपने Bदनांक

17 माच:, 2021 के प[ सं० 136/िज.8न. के जDरए आयोग को 4 तुत कर दI गई है;

और यत:, िजला 8नवा:चन अKधकारI, पूवQ संहभूम, जमशेदपुर वारा अपने Bदनांक 17 माच:, 2021 के

प[ सं० 136/िज.8न. के जDरए 4 तुत क> गई अनुपूरक Dरपोट: मg यह बताया गया है `क #ीमती स&वता कैब* त

ने आज क> तारIख तक न तो कोई भी अP यावेदन और न हI अपने 8नवा:चन S यय का लेखा दाWखल `कया है।

इसके अ8तDर^ त उb हRने 8नवा:चन आयोग का स, यक नोBटस मलने के उपरांत भी उ^ त _वफलता के लए न तो

कोई कारण बताया है और न हI कोई 4 पk टIकरण Bदया है;

और यत:, आयोग का यह समाधान हो गया है `क #ीमती स&वता कैब* त 8नवा:चन S यय का लेखा

दाWखल करने मg _वफल रहI हe और उनके पास इस _वफलता के लए कोई भी उKचत कारण अथवा औKचL य नहIं

है,

और यत:, लोक 8त 8नKधL व अKध8नयम, 1951 क> धारा 10क मg अनुबंKधत `कया गया है `क :-

''यBद 8नवा:चन आयोग का समाधान हो जाता है `क कोई S यि^त-

(i)

8नवा:चन S ययR का लेखा उस समय के भीतर और उस रI8त मg जैसी इस अKध8नयम के वारा या अधीन

उपेfZत है, दाWखल करने मg असफल रहा है: तथा

(ii) उस असफलता के लए कोई अn छा कारण या b यायोKचL य नहIं रखता है,

8नवा:चन आयोग शासक>य राजप[ मg काशत आदेश वारा उसको 8नरBह:त घो_षत करेगा और ऐसा

S यि^त उस आदेश क> तारIख से तीन वष: क> कालावKध के लए 8नरBह:त होगा''

अत:, अब लोक 8त8नKधL व अKध8नयम, 1951 क> धारा 10क के अनुसरण मg भारत 8नवा:चन आयोग

एतदवारा घोषणा करता है `क झारख ड रा< य के 9-जमशेदपुर लोकसभा 8नवा:चन Zे[ से लोक सभा के

साधारण 8नवा:चन, 2019 मg 8नवा:चन लड़ने वालI ऐहरा नेशनल पाट0 अP य र्थी #ीमती स&वता कैब* त , 225,

4बरसानगर, जोन नं०-5, पो०-टे5 को, िजला पूव7 8संहभूम झारख: ड &पन-831004, इस आदेश क> तारIख से तीन

वष: क> अवKध के लए संसद के `कसी भी सदन अथवा रा< य अथवा संघ रा< य-Zे[ क> _वधान सभा अथवा

_वधान पDरषद का सद4 य चुने जाने अथवा होने के लए 8नरBह:त है ।

ELECTION COMMISSION OF INDIA

ORDER

16 August, 2021 / 25 Sravana, 1943 (Saka)

No. JKD-HP/ES-I/9/2019--WHEREAS, the General Election to Lok Sabha of Jharkhand, 2019

was announced by Election Commission vide Press Note No. ECI/PN/23/2019 dated 10^th March, 2019.

As per the schedule, the date of Counting was 23^rd May, 2019.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every

contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the

District Election Officer, concerned from the date of election of returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning

Officer including 9-Jamshedpur Parliamentary Constituency in Jharkhand State on 23^rd May, 2019. As

such the last date for lodging of account of election expenses was 22^nd June, 2019.

AND WEHREAS, as per the report vide letter No. 1779/िज०8न० dated 22 June, 2019 submitted

by the District Election Officer, East Singhbhum, Jamshedpur, Jharkhand and forwarded by Chief

Electoral Officer, Jharkhand vide letter No. 01/8नवा:-ई.ई.एम-को.-23/2019/5197, dated 5^th July, 2019,

Smt. Sabita Kaibarto, Aihra National Party, contesting candidate from 9-Jamshedpur Parliamentary

Constituency of Jharkhand State, has failed to lodge any account of his election expenses as required by

law.

AND WEHREAS, on the basis of the reports of the District Election Officer, East Singhbhum,

Jamshedpur, Jharkhand and the Chief Electoral Officer, Jharkhand a Show Cause Notice, dated

16^th March, 2020 was issued by Election Commission of India under Sub Rule (5) of Rule 89 of the

Conduct of Election Rules, 1961 to Smt. Sabita Kaibarto, for non-submission of Election expenses;

AND WEHREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961,

through the above said Show Cause Notice, dated 16^th March, 2020, Smt. Sabita Kaibarto, was

directed to submit his representation in writing to the Commission explaining the reason for non-

submission of accounts and also to lodge her accounts of election expenses/rectify the defects in his

accounts and submit the same to the District Election Officer concerned within 20 days from the date of

receipt of the notice;

AND WEHREAS, the said notice was received by the son of Smt. Sabita Kaibarto, on

6^th August, 2020. Acknowledgment receipt obtained from the candidate have been submitted to the

Commission by District Election Officer, East Singhbhum, Jamshedpur vide his letter No. 136/िज०8न०

dated 17^th March, 2021.

AND WEHREAS, in the supplementary report submitted by District Election Officer, East

Singhbhum, Jamshedpur vide his letter No. 136/िज०8न० dated 17^th March, 2021 it has been stated that

Smt. Sabita Kaibarto, has not submitted any representation or her account of election expenses, duly

signed along with original vouchers etc. till date. Further, she has furnished neither any reason nor

explanation for the said failure even after receipt of the due notice to the Election Commission of India

as well;

AND WEHREAS, the Commission is satisfied that Smt. Sabita Kaibarto, has failed to lodge an

account of election expenses and has no good reason or justification for the failure;

AND WEHREAS, Section 10A of the Representation of the People Act, 1951 stipulates that:-

"If the Election Commission is satisfied that a person:

(i)

has failed to lodge an account of election expenses within the time and in the manner

required by law or under this Act, and

(ii)

has no good reason or justification for the failure,

Election Commission shall, by order published in the Official Gazette, declare him to be

disqualified and any such person shall be disqualified for a period of three years from

date of the order."

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act,

1951, the Election Commission hereby declares Smt. Sabita Kaibarto, resident of 225 Birsanagar

Zone No. 5, Telco District-East Singhbhum, Jharkhand-831004 and Aihra National Party,

contesting candidate for General Election to Lok Sabha of Jharkhand, 2019 from 9-Jamshedpur

Parliamentary Constituency in the State of Jharkhand, to be disqualified for being chosen as and for

being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a

State or Union Territory for a period of three years from the date of this order.
