संया- झार.-लो.स./पूव अनु०-1/3/2019--यत: 7नवा9चन आयोग वारा झारख ड रा; य से लोक सभा का

साधारण 7नवा9चन 2019 क= घोषण ेस नोट सं! या ईसीआई/े.नो./23/2019 Aदनांक 10 माच9, 2019 के जCरए

क= गई थी। काय9Gम के अनुसार, मतगणना क= तारHख 23 मई, 2019 थी ।

और यत:, लोक 7त7नIधJ व अIध7नयम, 1951 क= धारा 78 के अनुसार, 7नवा9चन लड़ने वाले J येक

अN यथO को, 7नवा9Iचत अN यथO के 7नवा9चन क= तारHख से 30 AदनP के भीतर 7नवा9चन Q यय के अपने लेखे क=

सहH 7त िजला 7नवा9चन अIधकारH को दाUखल करनी होती है;

और यत:, संबंIधत Cरट7नXग अIधकारH वारा 3-गो$डा लोक सभा 7नवा9चन YेZ सAहत, उ\ त 7नवा9चन के

पCरणाम 23 मई, 2019 को घो]षत ^कए गए थे। इस कार, 7नवा9चन Q यय के लेखे दाUखल करने क= अं7तम

तारHख 22 जून, 2019 थी;

और यत:, िजला 7नवा9चन अIधकारH, गो$डा, झारख ड वारा Aदनांक 24 जून, 2019 के पZ सं

1580/नवा ० वारा 3 तुत और मु! य 7नवा9चन अIधकारH, झारख ड वारा अपने Aदनांक 05 जुलाई, 2019 के

पZ स0 01/नवा -EEM-को0-23/2019/5197, के जCरए अbे]षत Cरपोट9 के अनुसार /ी अनुप कुमार 2स3 हा, जो

झारख ड के 3-गो$डा लोकसभा 7नवा9चन YेZ से 7नवा9चन लड़ने वाले नद ल6य अN यथO हc, ]वIध वारा आपेdYत

रH7त से अपने 7नवा9चन Q यय का कोई भी लेखा दाUखल करने मe ]वफल रहे हc।

और यत:, िजला 7नवा9चन अIधकारH, गो$डा झारख ड और मु! य 7नवा9चन अIधकारH, झारख ड क= Cरपोट9

के आधार पर 7नवा9चन आयोग वारा 7नवा9चनP का संचालन 7नयम 1961 के 7नयम 89 के उप 7नयम (5) के

अंतग9त 7नवा9चन Q यय 3 तुत नहHं करने के लए /ी अनुप कुमार 2स3 हा को कारण बताओ नोAटस Aदनांक

23 अग7 त, 2019 को जारH ^कया गया था;

और यत:, 7नवा9चनP का संचालन 7नयम 1961 के 7नयम 89 के उप-7नयम (6) के अनुसार, Aदनांक

23 अग7 त, 2019 के उपयु\ त कारण बताओ नोAटस के जCरए /ी अनुप कुमार 2स3 हा को 7नदेश Aदया गया था

^क वे इस नोAटस के ाi त होने के 20 AदनP के अंदर लेखे न 3 तुत कर पाने के कारणP को 3 पj ट करते हुए

लUखत *प मe अपना अN यावेदन 3 तुत करe और साथ हH, 7नवा9चन Q यय का अपना लेखा दाUखल करe;

और यत:, उ\ त नोAटस /ी अनुप कुमार 2स3 हा वारा Aदनांक 28 2सत8 बर, 2019 से पूव9 ाi त ^कया

था। अN यथO से ाi त पावती रसीद िजला 7नवा9चन अIधकारH, गो$डा वारा अपने Aदनांक 28 2सत8 बर, 2019 के

पZ सं० 1629(ii)/नवा ० के जCरए आयोग को 3 तुत कर दH गई है;

और यत:, िजला 7नवा9चन अIधकारH, गो$डा वारा अपने Aदनांक 14 जून, 2021 के पZ सं०

154/िज०नवा ० के जCरए 3 तुत क= गई अनुपूरक Cरपोट9 मe यह बताया गया है ^क /ी अनुप कुमार 2स3 हा ने

आज क= तारHख तक न तो कोई भी अN यावेदन और न हH अपने 7नवा9चन Q यय का लेखा दाUखल ^कया है।

इसके अ7तCर\ त उk हPने 7नवा9चन आयोग का स+ यक नोAटस मलने के उपरांत भी उ\ त ]वफलता के लए न तो

कोई कारण बताया है और न हH कोई 3 पj टHकरण Aदया है;

और यत:, आयोग का यह समाधान हो गया है ^क /ी अनुप कुमार 2स3 हा 7नवा9चन Q यय का लेखा

दाUखल करने मe ]वफल रहे हc और उनके पास इस ]वफलता के लए कोई भी उIचत कारण अथवा औIचJ य नहHं

है,

और यत:, लोक 7त 7नIधJ व अIध7नयम, 1951 क= धारा 10क मe अनुबंIधत ^कया गया है ^क :-

''यAद 7नवा9चन आयोग का समाधान हो जाता है ^क कोई Q यि\त-

(क) 7नवा9चन Q ययP का लेखा उस समय के भीतर और उस रH7त मe जैसी इस अIध7नयम के वारा या अधीन

उपेdYत है, दाUखल करने मe असफल रहा है: तथा

(ख) उस असफलता के लए कोई अm छा कारण या k यायोIचJ य नहHं रखता है,

7नवा9चन आयोग शासक=य राजपZ मe काशत आदेश वारा उसको 7नरAह9त घो]षत करेगा और ऐसा

Q यि\त उस आदेश क= तारHख से तीन वष9 क= कालावIध के लए 7नरAह9त होगा''

अत:, अब लोक 7त7नIधJ व अIध7नयम, 1951 क= धारा 10क के अनुसरण मe 7नवा9चन आयोग

एतदवारा घोषणा करता है ^क झारख ड रा; य के 3-गो$डा लोक सभा 7नवा9चन YेZ से लोक सभा के साधारण

7नवा9चन, 2019 मe 7नवा9चन लड़ने वाले नद ल6य अN य र्थी /ी अनुप कुमार 2सन् हा, 76 कमला कुट6र, गोसाइ

टोल6, चुBटया के पास, थाना-चुBटया, रांची, झारखF ड-834001 को इस आदेश क= तारHख से तीन वष9 क= अवIध

के लए संसद के ^कसी भी सदन अथवा रा; य अथवा संघ रा; य-YेZ क= ]वधान सभा अथवा ]वधान पCरषद का

सद3 य चुने जाने अथवा होने के लए 7नरAह9त है ।

ELECTION COMMISSION OF INDIA

ORDER

05 August, 2021 / 14 Sravana, 1943 (Saka)

No. JKD-HP/ES-I/3/2019--WHEREAS, the General Election to Lok Sabha of Jharkhand, 2019

was announced by Election Commission vide Press Note No. ECI/PN/23/2019 dated 10^th March, 2019.

As per the schedule, the date of Counting was 23^rd May, 2019.

AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every

contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the

District Election Officer, concerned from the date of election of returned candidate;

AND WHEREAS, the result of the said election was declared by the concerned Returning

Officer including 3-Godda Parliamentary Constituency in Jharkhand State on 23^rd May, 2019. As such

the last date for lodging of account of election expenses was 22^nd June, 2019.

AND WEHREAS, as per the report vide letter No. 1580/नवा ० dated 24^th June, 2019 submitted

by the District Election Officer, Godda Jharkhand and forwarded by Chief Electoral Officer, Jharkhand

vide letter No. 01/नवा -ई.ई.एम-को.-23/2019/5197, dated 05^th July, 2019, Sh. Anup Kumar Sinha, an

Independent contesting candidate from 3-Godda Parliamentary Constituency in Jharkhand State, has

failed to lodge any account of his election expenses as required by law.

AND WEHREAS, on the basis of the reports of the District Election Officer Godda, Jharkhand

and the Chief Electoral Officer, Jharkhand a Show Cause Notice, dated 23^rd August, 2019 was issued

by Election Commission under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to

Sh. Anup Kumar Sinha for non-submission of Election expenses;

AND WEHREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961,

through the above said Show Cause Notice, dated 23^rd August, 2019, Sh. Anup Kumar Sinha, was

directed to submit his representation in writing to the Commission explaining the reason for non-

submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his

accounts and submit the same to the District Election Officer concerned within 20 days from the date of

receipt of the notice;

AND WEHREAS, the said notice was received by Anup Kumar Sinha, before on

28^th September, 2019. Acknowledgment receipt obtained from the candidate has been submitted to the

AND WEHREAS, in the supplementary report submitted by District Election Officer, Godda

vide his letter 154/िज०नवा ० dated 14^th June, 2021 it has been stated that Sh. Anup Kumar Sinha has

not submitted any representation or his account of election expenses, duly signed along with original

vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure

even after receipt of the due notice to the Election Commission of India as well;

AND WEHREAS, the Commission is satisfied that Sh. Anup Kumar Sinha, has failed to lodge

an account of election expenses and has no good reason or justification for the failure;

AND WEHREAS, Section 10A of the Representation of the People Act, 1951 stipulates that:-

"If the Election Commission is satisfied that a person:

(a)

has failed to lodge an account of election expenses within the time and in the manner

required by law or under this Act, and

(b)

has no good reason or justification for the failure,

Election Commission shall, by order published in the Official Gazette, declare him to be

disqualified and any such person shall be disqualified for a period of three years from

date of the order."

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act,

1951, the Election Commission hereby declares Sh. Anup Kumar Sinha, resident of 76, Kamla Kutir

Gosai Toli, Near Chutiya, P.S-Chutiya, Ranchi, Jharkhand-834001 and an Independent contesting

candidate for General Election to Lok Sabha of Jharkhand, 2019 from 3-Godda Parliamentary

Constituency in the State of Jharkhand, to be disqualified for being chosen as and for being a member of

either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union

Territory for a period of three years from the date of this order.
