झारख ड के 78-छ&तरपुर (अ०जा०) >वधान सभा :नवा;चन XेY से :नवा;चन लड़ने वाले समाजवाद, पाट: के
अP यथQ हc, >वLध वारा आपेdXत रJ:त से अपने :नवा;चन S यय का कोई भी लेखा दाUखल करने मe >वफल रहे हc।
और यत:, िजला :नवा;चन अLधकारJ, पलामू झारखण् ड और मु# य :नवा;चन अLधकारJ, झारख ड क?
Dरपोट; के आधार पर :नवा;चन आयोग वारा :नवा;चनR का संचालन :नयम 1961 के :नयम 89 के उप :नयम
(5) के अंतग;त :नवा;चन S यय ` तुत नहJं करने के लए 4ी नरेश कुमार भारती को कारण बताओ नोCटस

02 माच , 2021 के उपयु\ त कारण बताओ नोCटस के जDरए 4ी नरेश कुमार भारती को :नदेश Cदया गया था
]क वे इस नोCटस के ाj त होने के 20 CदनR के अंदर लेखे न ` तुत कर पाने के कारणR को ` पk ट करते हुए
लUखत ,प मe अपना अP यावेदन ` तुत करe और साथ हJ, :नवा;चन S यय का अपना लेखा दाUखल करe;
और यत:, उ\ त नोCटस 4ी नरेश कुमार भारती क; प& नी वारा Cदनांक 07 अ<ैल, 2021 को ाj त
]कया था। अP यथQ से ाj त पावती रसीद िजला :नवा;चन अLधकारJ, पलामू वारा अपने Cदनांक 28 जून, 2021
के पY सं० 470/नवा ० के जDरए आयोग को ` तुत कर दJ गई है;
और यत:, िजला :नवा;चन अLधकारJ, पलामू वारा अपने Cदनांक 28 जून, 2021 के पY सं० 470/नवा ०
के जDरए ` तुत क? गई अनुपूरक Dरपोट; मe यह बताया गया है ]क 4ी नरेश कुमार भारती ने आज क? तारJख
तक न तो कोई भी अP यावेदन और न हJ अपने :नवा;चन S यय का लेखा दाUखल ]कया है। इसके अ:तDर\ त
उ_ हRने भारत :नवा;चन आयोग का स. यक नोCटस मलने के उपरांत भी उ\ त >वफलता के लए न तो कोई
कारण बताया है और न हJ कोई ` पk टJकरण Cदया है;
और यत:, आयोग का यह समाधान हो गया है ]क 4ी नरेश कुमार भारती :नवा;चन S यय का लेखा
दाUखल करने मe >वफल रहे हc और उनके पास इस >वफलता के लए कोई भी उLचत कारण अथवा औLचM य नहJं
है,
और यत:, लोक :त :नLधM व अLध:नयम, 1951 क? धारा 10क मe अनुबंLधत ]कया गया है ]क :-
''यCद :नवा;चन आयोग का समाधान हो जाता है ]क कोई S यि\त-

(क) :नवा;चन S ययR का लेखा उस समय के भीतर और उस रJ:त मe जैसी इस अLध:नयम के वारा या अधीन
उपेdXत है, दाUखल करने मe असफल रहा है: तथा
(ख) उस असफलता के लए कोई अn छा कारण या _ यायोLचM य नहJं रखता है,
:नवा;चन आयोग शासक?य राजपY मe काशत आदेश वारा उसको :नरCह;त घो>षत करेगा और ऐसा
S यि\त उस आदेश क? तारJख से तीन वष; क? कालावLध के लए :नरCह;त होगा''
अत:, अब लोक :त:नLधM व अLध:नयम, 1951 क? धारा 10क के अनुसरण मe भारत :नवा;चन आयोग
एतदवारा घोषणा करता है ]क झारख ड रा= य के 78-छ&तरपुर (अ०जा०) >वधान सभा :नवा;चन XेY से >वधान
सभा के साधारण :नवा;चन, 2019 मe :नवा;चन लड़ने वाले समाजवाद, पाट: के अP य र्थी 4ी नरेश कुमार भारती,
>ाम-बासावर (चुरादोहर), पोA ट-नावाजयपुर, थाना-पाटन, िजला-पलामू, पन-822123, झारखE ड को इस आदेश क?
तारJख से तीन वष; क? अवLध के लए संसद के ]कसी भी सदन अथवा रा= य अथवा संघ रा= य-XेY क? >वधान
सभा अथवा >वधान पDरषद का सद` य चुने जाने अथवा होने के लए :नरCह;त है ।

ELECTION COMMISSION OF INDIA

ORDER
1 September, 2021 / 10 Bhadrapada, 1943 (Saka)
No. JKD-LA/ES-I/78/2019-- WHEREAS, the General Election to Jharkhand Legislative
Assembly 2019 was announced by Election Commission vide Press Note No. ECI/PN/102/2019 dated
1st November, 2019. As per the schedule, the date of Counting was 23rd December, 2019.
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every
contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the
District Election Officer, concerned from the date of election of returned candidate;
AND WHEREAS, the result of the said election was declared by the concerned Returning
Officer
including
78-Chhatarpur
(SC)
Assembly
Constituency
in
Jharkhand
State
on
23rd December, 2019. As such the last date for lodging of account of election expenses was
22nd January, 2020.
AND WEHREAS, as per the report vide letter No. 61/नवा dated 29th January, 2020 submitted
by the District Election Officer, Palamu Jharkhand and forwarded by Chief Electoral Officer,
Jharkhand vide letter No. 01/नवा -ई.ई.एम-को.-42/2019/201, dated 3rd February, 2020, Sh. Naresh Kumar
Bharti, a contesting candidate of Samajwadi Party from 78-Chhatarpur (SC) Assembly
Constituency in Jharkhand State, has failed to lodge any account of his election expenses as required by
law.
AND WEHREAS, on the basis of the reports of the District Election Officer Palamu, Jharkhand
and the Chief Electoral Officer, Jharkhand a Show Cause Notice, dated 2nd March, 2021 was issued by
Election Commission under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to
Sh. Naresh Kumar Bharti for non-submission of Election expenses;
AND WEHREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961,
through the above said Show Cause Notice, dated 2nd March, 2021, Sh. Naresh Kumar Bharti, was
directed to submit his representation in writing to the Commission explaining the reason for non-
submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his
accounts and submit the same to the District Election Officer concerned within 20 days from the date of
receipt of the notice;
AND WEHREAS, the said notice was received by Wife of Sh. Naresh Kumar Bharti, on
7th April, 2021. Acknowledgment receipt obtained from the candidate have been submitted to the
Commission by District Election Officer, Palamu vide his letter No. 470/नवा ० dated 28th June, 2021.
AND WEHREAS, in the supplementary report submitted by District Election Officer, Palamu
vide his letter No. 470/नवा ० dated 28th June, 2021 it has been stated that Sh. Naresh Kumar Bharti
has not submitted any representation or his account of election expenses, duly signed along with original
vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure
even after receipt of the due notice to the Election Commission of India as well;

AND WEHREAS, the Commission is satisfied that Sh. Naresh Kumar Bharti, has failed to
lodge an account of election expenses and has no good reason or justification for the failure;
AND WEHREAS, Section 10A of the Representation of the People Act, 1951 stipulates that:-
"If the Election Commission is satisfied that a person:
(a)
has failed to lodge an account of election expenses within the time and in the manner
required by law or under this Act, and
(b)
has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to
be disqualified and any such person shall be disqualified for a period of three years from
date of the order."
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act,
1951, the Election Commission of India hereby declares Sh. Naresh Kumar Bharti, resident of Vill-
Basawar (Churadohar), Post-Nawajaipur, PS-Patan, Dist-Palamu, Jharkhand, Pin-822123 and a
contesting candidate of Samajwadi Party for General Election to Legislative Assembly of Jharkhand,
2019 from 78-Chhatarpur (SC) Assembly Constituency of the State of Jharkhand, to be disqualified
for being chosen as and for being a member of either House of Parliament or the Legislative Assembly
or Legislative Council of a State or Union Territory for a period of three years from the date of this
order.
