और यत:, लोक 9त9नKधL व अKध9नयम, 1951 क> धारा 78 के अनुसार, 9नवा:चन लड़ने वाले L येक
अP यथQ को, 9नवा:Kचत अP यथQ के 9नवा:चन क> तारIख से 30 BदनR के भीतर 9नवा:चन S यय के अपने लेखे क>
सहI 9त िजला 9नवा:चन अKधकारI को दाVखल करनी होती है
और यत:, संबंKधत Cरट9नXग अKधकारI वारा, 25-हजार&बाग वधान सभा 9नवा:चन YेZ सBहत, उ\ त
9नवा:चन के पCरणाम 23 *दस, बर, 2019 को घो=षत ]कए गए थे। इस कार, 9नवा:चन S यय के लेखे दाVखल
करने क> अंि_तम तारIख 22 जनवरI, 2020 थी;

पZ स0 01/नवा -ई.ई.एम-को.-42/2019/201, के जCरए अbे=षत Cरपोट: के अनुसार 3ी शि7त कुमार पासवान, जो
झारख ड के 25-हजार&बाग =वधान सभा 9नवा:चन YेZ से 9नवा:चन लड़ने वाले नद ल&य अP यथQ हc, =वKध वारा
आपेdYत रI9त से अपने 9नवा:चन S यय का कोई भी लेखा दाVखल करने मe =वफल रहे हc ।
और यत:, िजला 9नवा:चन अKधकारI, हजार&बाग झारख ड और मु# य 9नवा:चन अKधकारI, झारख ड क>
Cरपोट: के आधार पर 9नवा:चन आयोग वारा 9नवा:चनR का संचालन 9नयम 1961 के 9नयम 89 के उप 9नयम
(6) के अंतग:त 9नवा:चन S यय 4 तुत नहIं करने के लए 3ी शि7त कुमार पासवान को कारण बताओ नोBटस
Bदनांक 08 जुलाई, 2020 को जारI ]कया गया था;
और यत:, 9नवा:चनR का संचालन 9नयम 1961 के 9नयम 89 के उप-9नयम (6) के अनुसार, Bदनांक
08 जुलाई, 2020 के उपयु\ त कारण बताओ नोBटस के जCरए 3ी शि7त कुमार पासवान को 9नदेश Bदया गया
था ]क वे इस नोBटस के ाi त होने के 20 BदनR के अंदर लेखे न 4 तुत कर पाने के कारणR को 4 पj ट करते
हुए लVखत +प मe अपना अP यावेदन 4 तुत करe और साथ हI, 9नवा:चन S यय का अपना लेखा दाVखल करe;
और यत:, उ\ त नोBटस 3ीमती नधी देवी, प; नी 3ी शि7त कुमार पासवान, वारा Bदनांक
4 <सत, बर, 2020 को ाi त ]कया था। अP यथQ से ाi त पावती रसीद िजला 9नवा:चन अKधकारI, हजार&बाग
वारा अपने Bदनांक 14 <सत, बर, 2020 के पZ सं० 330/नवा ० के जCरए आयोग को 4 तुत कर दI गई है;
और यत:, िजला 9नवा:चन अKधकारI, हजार&बाग वारा अपने Bदनांक 17 माच , 2020 के
पZ सं० 150/नवा ० के जCरए 4 तुत क> गई अनुपूरक Cरपोट: मe यह बताया गया है ]क
3ी शि7त कुमार पासवान ने आज क> तारIख तक न तो कोई भी अP यावेदन और न हI अपने 9नवा:चन S यय
का लेखा दाVखल ]कया है। इसके अ9तCर\ त उ_ हRने 9नवा:चन आयोग का स- यक नोBटस मलने के उपरांत भी
उ\ त =वफलता के लए न तो कोई कारण बताया है और न हI कोई 4 पj टIकरण Bदया है;
और यत:, आयोग का यह समाधान हो गया है ]क 3ी शि7त कुमार पासवान 9नवा:चन S यय का लेखा
दाVखल करने मe =वफल रहे हc और उनके पास इस =वफलता के लए कोई भी उKचत कारण अथवा औKचL य नहIं
है,
और यत:, लोक 9त 9नKधL व अKध9नयम, 1951 क> धारा 10क मe अनुबंKधत ]कया गया है ]क :-

''यBद 9नवा:चन आयोग का समाधान हो जाता है ]क कोई S यि\त-
(क) 9नवा:चन S ययR का लेखा उस समय के भीतर और उस रI9त मe जैसी इस अKध9नयम के वारा या अधीन
उपेdYत है, दाVखल करने मe असफल रहा है: तथा
(ख) उस असफलता के लए कोई अm छा कारण या _ यायोKचL य नहIं रखता है,
9नवा:चन आयोग शासक>य राजपZ मe काशत आदेश वारा उसको 9नरBह:त घो=षत करेगा और ऐसा
S यि\त उस आदेश क> तारIख से तीन वष: क> कालावKध के लए 9नरBह:त होगा''
अत:, अब लोक 9त9नKधL व अKध9नयम, 1951 क> धारा 10क के अनुसरण मe 9नवा:चन आयोग
एतदवारा घोषणा करता है ]क झारख ड रा< य के 25-हजार&बाग वधान सभा 9नवा:चन YेZ से =वधान सभा के
साधारण 9नवा:चन, 2019 मe 9नवा:चन लड़ने वाले नद ल&य अP य र्थी 3ी शि7त कुमार पासवान, >ाम-<संघानी,
पो@ ट-कोरा , थाना-मुCफसील, िजला-हजार&बाग, झारखE ड को इस आदेश क> तारIख से तीन वष: क> अवKध के
लए संसद के ]कसी भी सदन अथवा रा< य अथवा संघ रा< य-YेZ क> =वधान सभा अथवा =वधान पCरषद का
सद4 य चुने जाने अथवा होने के लए 9नरBह:त है ।

ELECTION COMMISSION OF INDIA

ORDER
23 August, 2021 / 1 Bhadra, 1943 (Saka)
No. JKD-LA/ES-I/25/2019--WHEREAS, the General Election to Jharkhand Legislative
Assembly 2019 was announced by Election Commission vide Press Note No. ECI/PN/102/2019 dated
1st November, 2019. As per the schedule, the date of Counting was 23rd December, 2019.
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every
contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the
District Election Officer, concerned from the date of election of returned candidate;
AND WHEREAS, the result of the said election was declared by the concerned Returning
Officer including 25-Hazaribagh Assembly Constituency in Jharkhand State on 23rd December, 2019.
As such the last date for lodging of account of election expenses was 22nd January, 2020.
AND WEHREAS, as per the report vide letter No. 42/नवा ० dated 25th January, 2020 submitted
by the District Election Officer, Hazaribag Jharkhand and forwarded by Chief Electoral Officer,

Sh. Shakti Kumar Paswan, an Independent candidate from 25-Hazaribagh Assembly Constituency
in Jharkhand State, has failed to lodge any account of his election expenses as required by law.
AND WEHREAS, on the basis of the reports of the District Election Officer Hazaribag,
Jharkhand and the Chief Electoral Officer, Jharkhand a Show Cause Notice, dated 8th July, 2020 was
issued by Election Commission under Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961 to
Sh. Shakti Kumar Paswan for non-submission of Election expenses;
AND WEHREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961,
through the above said Show Cause Notice, dated 8th July, 2020, Sh. Shakti Kumar Paswan, was
directed to submit his representation in writing to the Commission explaining the reason for non-
submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his
accounts and submit the same to the District Election Officer concerned within 20 days from the date of
receipt of the notice;
AND WEHREAS, the said notice was received by Smt. Nidhi Devi wife of Sh. Shakti Kumar
Paswan, on 4th September, 2020. Acknowledgment receipt obtained from the candidate has been
submitted to the Commission by District Election Officer, Hazaribag vide his letter No. 330/नवा ०
dated 14th September, 2020.
AND WEHREAS, in the supplementary report submitted by District Election Officer,
Hazaribag vide his letter No. 150/नवा ० dated 17th March, 2021 it has been stated that
Sh. Shakti Kumar Paswan has not submitted any representation or his account of election expenses,
duly signed along with original vouchers etc. till date. Further, he has furnished neither any reason nor
explanation for the said failure even after receipt of the due notice to the Election Commission of India
as well;
AND WEHREAS, the Commission is satisfied that Sh. Shakti Kumar Paswan, has failed to
lodge an account of election expenses and has no good reason or justification for the failure;

AND WEHREAS, Section 10A of the Representation of the People Act, 1951 stipulates that:-
"If the Election Commission is satisfied that a person:
(a)
has failed to lodge an account of election expenses within the time and in the manner
required by law or under this Act, and
(b)
has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to
be disqualified and any such person shall be disqualified for a period of three years from
date of the order."
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act,
1951, the Election Commission hereby declares Sh. Shakti Kumar Paswan, resident of Vill-Singhani,
P.O-Korrah, P.S.-Muffasil, District-Hazaribagh, Jharkhand and an Independent candidate for
General Election to Legislative Assembly of Jharkhand, 2019 from 25-Hazaribag Assembly
Constituency of the State of Jharkhand, to be disqualified for being chosen as and for being a member
of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union
Territory for a period of three years from the date of this order.
