साधारण 8नवा9चन 2019 क> घोषण ेस नोट सं# या ईसीआई/े.नो./23/2019 Bदनांक 10 माच9, 2019 के जDरए
क> गई थी। काय9Hम के अनुसार, मतगणना क> तारIख 23 मई, 2019 थी ।
और यत:, लोक 8त8नKधL व अKध8नयम, 1951 क> धारा 78 के अनुसार, 8नवा9चन लड़ने वाले L येक
अP यथQ को, 8नवा9Kचत अP यथQ के 8नवा9चन क> तारIख से 30 BदनR के भीतर 8नवा9चन S यय के अपने लेखे क>
सहI 8त िजला 8नवा9चन अKधकारI को दाVखल करनी होती है;
और यत:, संबंKधत Dरट8नYग अKधकारI वारा 4-चतरा लोक सभा 8नवा9चन Zे[ सBहत, उ] त 8नवा9चन के
पDरणाम 23 मई, 2019 को घो^षत _कए गए थे। इस कार, 8नवा9चन S यय के लेखे दाVखल करने क> अं8तम
तारIख 22 जून, 2019 थी;

और यत:, िजला 8नवा9चन अKधकारI, चतरा, झारख ड वारा Bदनांक 24 जून, 2019 के प[
सं० 196/लेखा-) यय वारा 4 तुत और मु# य 8नवा9चन अKधकारI, झारख ड वारा अपने Bदनांक
05 जुलाई, 2019 के प[ स0 01/नवा .EEM-को0-23/2019/5197, के जDरए अbे^षत Dरपोट9 के अनुसार
0ी पवन कुमार, जो झारख ड के 4-चतरा लोकसभा 8नवा9चन Zे[ से 8नवा9चन लड़ने वाले नद ल4य अP यथQ हc,
^वKध वारा आपेdZत रI8त से अपने 8नवा9चन S यय का कोई भी लेखा दाVखल करने मe ^वफल रहे हc ।
और यत:, िजला 8नवा9चन अKधकारI, चतरा झारख ड और मु# य 8नवा9चन अKधकारI, झारख ड क> Dरपोट9
के आधार पर 8नवा9चन आयोग वारा 8नवा9चनR का संचालन 8नयम 1961 के 8नयम 89 के उप 8नयम (5) के
अंतग9त 8नवा9चन S यय 4 तुत नहIं करने के लए 0ी पवन कुमार को कारण बताओ नोBटस Bदनांक
23 अग5 त, 2019 को जारI _कया गया था;
और यत:, 8नवा9चनR का संचालन 8नयम 1961 के 8नयम 89 के उप-8नयम (6) के अनुसार, Bदनांक
23 अग5 त, 2019 के उपयु] त कारण बताओ नोBटस के जDरए 0ी पवन कुमार को 8नदेश Bदया गया था _क वे
इस नोBटस के ाi त होने के 20 BदनR के अंदर लेखे न 4 तुत कर पाने के कारणR को 4 पj ट करते हुए लVखत
+प मe अपना अP यावेदन 4 तुत करe और साथ हI, 8नवा9चन S यय का अपना लेखा दाVखल करe;
और यत:, उ] त नोBटस 0ी पवन कुमार के भाई 0ी सोनू कुमार वारा Bदनांक 26 जून, 2021 को ाi त
_कया था। अP यथQ से ाi त पावती रसीद िजला 8नवा9चन अKधकारI, चतरा वारा अपने Bदनांक 28 जून, 2021
के प[ सं० 208/िज०नवा ० के जDरए आयोग को 4 तुत कर दI गई है;
और यत:, िजला 8नवा9चन अKधकारI, चतरा वारा अपने Bदनांक 23 जुलाई, 2021 के प[
सं० 837/िज०नवा ० के जDरए 4 तुत क> गई अनुपूरक Dरपोट9 मe यह बताया गया है _क 0ी पवन कुमार ने
आज क> तारIख तक न तो कोई भी अP यावेदन और न हI अपने 8नवा9चन S यय का लेखा दाVखल _कया है।
इसके अ8तDर] त उk हRने 8नवा9चन आयोग का स- यक नोBटस मलने के उपरांत भी उ] त ^वफलता के लए न तो
कोई कारण बताया है और न हI कोई 4 पj टIकरण Bदया है;
और यत:, आयोग का यह समाधान हो गया है _क 0ी पवन कुमार 8नवा9चन S यय का लेखा दाVखल करने
मe ^वफल रहे हc और उनके पास इस ^वफलता के लए कोई भी उKचत कारण अथवा औKचL य नहIं है,
और यत:, लोक 8त 8नKधL व अKध8नयम, 1951 क> धारा 10क मe अनुबंKधत _कया गया है _क :-

''यBद 8नवा9चन आयोग का समाधान हो जाता है _क कोई S यि]त-
(क) 8नवा9चन S ययR का लेखा उस समय के भीतर और उस रI8त मe जैसी इस अKध8नयम के वारा या अधीन
उपेdZत है, दाVखल करने मe असफल रहा है: तथा
(ख) उस असफलता के लए कोई अm छा कारण या k यायोKचL य नहIं रखता है,
8नवा9चन आयोग शासक>य राजप[ मe काशत आदेश वारा उसको 8नरBह9त घो^षत करेगा और ऐसा
S यि]त उस आदेश क> तारIख से तीन वष9 क> कालावKध के लए 8नरBह9त होगा''
अत:, अब लोक 8त8नKधL व अKध8नयम, 1951 क> धारा 10क के अनुसरण मe 8नवा9चन आयोग
एतदवारा घोषणा करता है _क झारख ड रा; य के 4-चतरा लोक सभा 8नवा9चन Zे[ से लोक सभा के साधारण
8नवा9चन, 2019 मe 8नवा9चन लड़ने वाले नद ल4य अP य र्थी 0ी पवन कुमार, 8ाम-बरवाया, पो-बरवाया, थाना-
मनका, िजला-लातेहार, झारख< ड को इस आदेश क> तारIख से तीन वष9 क> अवKध के लए संसद के _कसी भी
सदन अथवा रा; य अथवा संघ रा; य-Zे[ क> ^वधान सभा अथवा ^वधान पDरषद का सद4 य चुने जाने अथवा होने
के लए 8नरBह9त है ।

ाKधकृत पाठ समझा जायगा ।

ELECTION COMMISSION OF INDIA

ORDER
19 August, 2021 / 28 Sravana, 1943 (Saka)
No. JKD-HP/ES-I/4/2019--WHEREAS, the General Election to Lok Sabha of Jharkhand, 2019
was announced by Election Commission vide Press Note No. ECI/PN/23/2019 dated 10th March, 2019.
As per the schedule, the date of Counting was 23rd May, 2019.
AND WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every
contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the
District Election Officer, concerned from the date of election of returned candidate;
AND WHEREAS, the result of the said election was declared by the concerned Returning
Officer including 4-Chatra Parliamentary Constituency in Jharkhand State on 23rd May, 2019. As such
the last date for lodging of account of election expenses was 22nd June, 2019.
AND WEHREAS, as per the report vide letter No. 196/लेखा-) यय dated 24th June, 2019
submitted by the District Election Officer, Chatra Jharkhand and forwarded by Chief Electoral Officer,
Jharkhand vide letter No. 01/नवा -ई.ई.एम-को.-23/2019/5197, dated 05th July, 2019, Sh. Pawan Kumar, an
Independent contesting candidate from 4-Chatra Parliamentary Constituency in Jharkhand State, has
failed to lodge any account of his election expenses as required by law.
AND WEHREAS, on the basis of the reports of the District Election Officer, Chatra, Jharkhand
and the Chief Electoral Officer, Jharkhand, a Show Cause Notice dated 23rd August, 2019 was issued
by Election Commission under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to
Sh. Pawan Kumar for non-submission of Election expenses;
AND WEHREAS, as per Sub Rule(6) of Rule 89 of the Conduct of Election Rules, 1961,
through the above said Show Cause Notice, dated 23rd August, 2019, Sh. Pawan Kumar, was directed
to submit his representation in writing to the Commission explaining the reason for non-submission of
accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and
submit the same to the District Election Officer concerned within 20 days from the date of receipt of the
notice;
AND WEHREAS, the said notice was received by Sh. Sonu Kumar brother of
Sh. Pawan Kumar, on 26th June, 2021. Acknowledgment receipt obtained from the candidate has been
submitted to the Commission by District Election Officer, Chatra vide his letter No. 208/िज०नवा ०
dated
28th June, 2021.
AND WEHREAS, in the supplementary report submitted by District Election Officer, Chatra
vide his letter No. 837/िज०नवा ० dated 23rd July, 2021 it has been stated that Sh. Pawan Kumar has not
submitted any representation or his account of election expenses, duly signed along with original
vouchers etc. till date. Further, he has furnished neither any reason nor explanation for the said failure
even after receipt of the due notice to the Election Commission of India as well;
AND WEHREAS, the Commission is satisfied that Sh. Pawan Kumar, has failed to lodge an
account of election expenses and has no good reason or justification for the failure;

AND WEHREAS, Section 10A of the Representation of the People Act, 1951 stipulates that:-
"If the Election Commission is satisfied that a person:
(a)
has failed to lodge an account of election expenses within the time and in the manner
required by law or under this Act, and
(b)
has no good reason or justification for the failure,
Election Commission shall, by order published in the Official Gazette, declare him to be
disqualified and any such person shall be disqualified for a period of three years from
date of the order."
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act,
1951, the Election Commission hereby declares Sh. Pawan Kumar, resident of Vill-Barwaya, PO-
Barwaya, PS-Manika, Dist-Latehar, Jharkhand and an Independent contesting candidate for
General Election to Lok Sabha of Jharkhand, 2019 from 4-Chatra Parliamentary Constituency in the
State of Jharkhand, to be disqualified for being chosen as and for being a member of either House of
Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period
of three years from the date of this order.
