झारख ड पंचायत राज अध(नयम, 2001 (झारख ड अध(नयम- 06, 2001) का संशोधन करने के .लए
अध(नयम

1.
संIJKत नाम, 7वLतार और ारंभ -
(1)
यह अ2ध8नयम झारखड पंचायत राज (संशोधन) अ2ध8नयम, 2021 कहा जायेगा ।
(2)
इसका 7वLतार स.पूणA झारखड रा<य म> होगा सवाय उन JेOP के जहाँ झारखड
नगरपालका अ2ध8नयम, 2011 (झारखड अ2ध8नयम 7, 2012) या केQटोनम>ट अ2ध8नयम,
1924 (अ2ध8नयम II, 1924) के उपबंध लागू हS ।
(3)
यह शासकBय राजपO म> काशन कB 8त2थ से वृVत होगा ।

झारखड पंचायत राज अ2ध8नयम- 2001 (अ2ध8नयम, 06, 2001) (िजसे इसके पWचात् मूल
अ2ध8नयम कहा गया है) कB धारा 24 का संशोधन । - (1) मूल अ2ध8नयम कB धारा 24 कB उप
धारा (4) 8न.नवत् 8तLथा7पत कB जाएगी:-
‘‘(4) य,द उपधारा (3) म> व9णAत अव2ध कB समािKत के पूवA, ाम पंचायत पुनगA,ठत नह[ं कB
जाती है तो वह अव2ध कB समािKत पर 7वघ,टत हो जाएगी और धारा (107) के उपबंध उस
पंचायत के संबंध म>, छः मास से अना2धक अव2ध के लए, िजस अव2ध के भीतर ाम पंचायत
इस अ2ध8नयम के उपबंधP के अनुसार पुनगA,ठत कB जाएगी, लागू हPगे ।’’
(2) मूल अ2ध8नयम कB धारा 24 कB उप धारा (4) के बाद एक नई उपधारा (5) 8न.नवत्
अंतःLथा7पत कB जायेगी:-
‘‘(5) महामार[ िजसम> ाम पंचायत या ाम पंचायतP के पुनगAठन के लए 8नवाAचन या उप
8नवाAचन स.पQन कराना संभव न हो, तो उ2चत कारणP का उ_लेख करते हुए रा<य सरकार, धारा
(107) के उपबंध उस ाम पंचायत या उन ाम पंचायतP के संबंध म>, छः मास से अ2धक अव2ध
अथवा आगामी 8नवाAचन पूणA होने तक कB अव2ध के लए लागू करने पर 8नणAय ले सकेगी।’’
3.
(1) मूल अ2ध8नयम कB धारा 42 कB उप धारा (4) 8न.नवत् 8तLथा7पत कB जाएगी:-
‘‘(4) उपधारा (3) म> 7व,हत अव2ध कB समािKत के पूवA पंचायत सम8त पुनगA,ठत नह[ं कB जाती
है तो वह उaत अव2ध के समािKत पर 7वघ,टत हो जाएगी और धारा (107) के उपबंध उसके
संबंध म> छः मास से अना2धक अव2ध के लए, िजस अव2ध के भीतर पंचायत सम8त इस
अ2ध8नयम के उपबंधP के अनुसार पुनगA,ठत कB जाएगी, लागू हPगे ।’’
(2) मूल अ2ध8नयम कB धारा 42 कB उप धारा (4) के बाद एक नई उपधारा (5) 8न.नवत्
अंतःLथा7पत कB जायेगी:
‘‘(5) महामार[ िजसम> पंचायत सम8त या पंचायत सम8तयP के पुनगAठन के लए 8नवाAचन या
उप 8नवाAचन स.पQन कराना संभव न हो, तो उ2चत कारणP का उ_लेख करते हुए रा<य सरकार,

अ2धक अव2ध अथवा आगामी 8नवाAचन पूणA होने तक कB अव2ध के लए लागू करने पर 8नणAय
ले सकेगी ।’’

4.
मूल अ2ध8नयम कB धारा 57 का संशोधन: (1) मूल अ2ध8नयम कB धारा 57 कB उप धारा (4)
8न.नवत् 8तLथा7पत कB जाएगी:
‘‘(4) उपधारा (3) म> 7व,हत अव2ध कB समािKत के पूवA िजला पbरष पुनगA,ठत नह[ं कB जाती है
तो वह उaत अव2ध कB समािKत पर 7वघ,टत हो जाएगी और धारा (107) के उपबंध उसके संबंध
म> छः माह से अना2धक अव2ध के लए, िजस अव2ध के भीतर िजला पbरष इस अ2ध8नयम के
उपबQधP के अनुसार पुनगA,ठत कB जाएगी, लागू हPगे ।’’
(2) मूल अ2ध8नयम कB धारा 57 कB उप धारा (4) के बाद एक नई उपधारा (5) 8न.नवत्
अंतःLथा7पत कB जायेगी:
‘‘(5) महामार[ िजसम> िजला पbरषद या िजला पbरषदP के पुनगAठन के लए 8नवाAचन या उप
8नवाAचन स.पQन कराना संभव न हो, तो उ2चत कारणP का उ_लेख करते हुए रा<य सरकार, धारा
(107) के उपबंध उस िजला पbरष या उन िजला पbरषदP के संबंध म>, छः मास से अ2धक अव2ध
अथवा आगामी 8नवाAचन पूणA होने तक कB अव2ध के लए लागू करने पर 8नणAय ले सकेगी ।’’
5. मूल अ2ध8नयम कB धारा 107 का संशोधन - मूल अ2ध8नयम कB धारा 107 कB उप धारा (5) के
बाद एक नई उपधारा (6) 8न.नवत् अंतःLथा7पत कB जायेगी:
‘‘(6) महामार[ िजसम> ाम पंचायत या पंचायत सम8त या िजला पbरष के पुनगAठन के लए
आम 8नवाAचन या उप 8नवाAचन स.पQन कराना संभव न हो, तो उ2चत कारणP का उ_लेख करते
हुए रा<य सरकार, धारा (107) कB उपधारा (3) (ख) (ग) एवं उपधारा (4) के उपबंध उस ाम
पंचायत या पंचायत सम8त या िजला पbरष के संबंध म>, छः मास से अ2धक अव2ध अथवा
आगामी 8नवाAचन अथवा उप 8नवाAचन पूणA होने तक कB अव2ध के लए लागू करने पर 8नणAय
ले सकेगी । ’’
6.
8नरसन एवं cयावृिVतयाँ:- झारखड पंचायत राज (संशोधन) अdयादेश, 2021 को एत वारा
8नरसत Dकया जाता है। ऐसे 8नरसन के होते हुए भी उaत अdयादेश के वारा अथवा के
अंतगAत दVत शिaतयाँ का योग करते हुए 8नगAत आदेश, अ2धसूचनाएं एवं अQय कोई
भी कायAवाह[ या अQय कोई कायA इस अ2ध8नयम वारा या के अंतगAत दVत शिaतयP के
अधीन Dकया गया था, कB गयी समझी जाएगी, मानो यह अ2ध8नयम उस ,दन वृVत था, िजस
,दन यह कायA Dकया गया था, अथवा कारAवाई कB गयी थी ।

रा<यपाल वारा ,दनांक-16/12/2021 को अनुमत झारख ड पंचायत राज (संशोधन) अध(नयम,
2021 का 8न.नांDकत अंेजी अनुवाद झारखंड रा<यपाल के ा2धकार से इसके वारा काशत Dकया
जाता है, िजसे भारत का सं7वधान के अनुgछेद 348 के खंड (3) के अधीन उaत अ2ध8नयम का
अंेजी भाषा म> ा2धकृत पाठ समझा जाएगा ।
Jharkhand Panchayat Raj (Amendment) Act, 2021
(Jharkhand Act - 13, 2021)
An Act, to amend the Jharkhand Panchayat Raj Act, 2001 (Jharkhand Act 06, 2001)
Be it enacted by the legislature of Jharkhand in the Seventy second years of the Republic of
India as follows-
1.
Short title, extent and commencement-
(1)
This Act may be called the Jharkhand Panchayat Raj (Amendment) Act, 2021
(2)
It shall extend to whole of the State of Jharkhand excepting the areas to which
the provisions of the Jharkhand Municipal Act, 2011 (Jharkhand Act No. 7 of
2012) or Cantonment Act, 1924, (Act II of 1924) apply.
(3)
It shall come into force from date of publication in the Official Gazette.
2.
Amendment of Section 24 of the Jharkhand Panchayat Raj Act, 2001 (Act 06 of 2001)
(hereinafter referred as the Principal Act ) - (1) sub-section (4) of Section 24 of the
Principal Act shall be substituted as follows :-
“(4) If the Gram Panchayat is not reconstituted before the expiry of the term mentioned in
sub-section (3), it shall stand dissolved on the expiry of the term, and the provisions of
section (107) shall apply to the said Panchayat for a term not exceeding six months within
which the Gram Panchayat shall be reconstituted according to the provisions of this Act.”
(2) A new sub-section (5) shall be inserted after sub-section (4) of Section 24 of the
Principal Act as Follows:-
“(5) If due to pandemic it is not possible to hold the General Election or bye Election for
reconstitution of Gram Panchayat or Gram Panchayats, citing proper causes the State
Government may take decision to enforce provisions of section (107) for that Gram
Panchayat or those Gram Panchayats for a period exceeding six months or up to
completion of next election or bye election”

Amendment of Section 42 of the Principal Act- (1) sub-section (4) of Section 42 of
the Principal Act as shall be substituted as follows :-

“(4) If the Panchayat Samiti is not reconstituted before the expiry of the term mentioned
in sub-section (3), it shall stand dissolved on the expiry of the term, and the provisions
of section (107) shall apply to the said Panchayat Samiti for a term not exceeding six
months within which the Panchayat Samiti shall be reconstituted according to the
provisions of this Act.”
(2) A new sub-section (5) shall be inserted after sub-section (4) of Section 42 of the
Principal Act as Follows:-
“(5) If due to pandemic it is not possible to hold the General Election or bye Election for
reconstitution of Panchayat Samiti or Panchayat Samities, citing proper causes the
State Government may take decision to enforce provisions of section (107) for that
Panchayat Samiti or those Panchayat Samities for a period exceeding six months or up
to completion of next election or bye election”

Amendment of Section 57 of the Principal Act- (1) sub-section (4) of Section 57 of the
Principal Act as shall be substituted as follows :-
“(4) If the Zila Parishad is not reconstituted before the expiry of the term mentioned in
sub-section (3), it shall stand dissolved on the expiry of the term, and the provisions of
section (107) shall apply to the said Zila Parishad for a term not exceeding six months
within which the Zila Parishad shall be reconstituted according to the provisions of this
Act.”
(2) A new sub-section (5) shall be inserted after sub-section (4) of Section 57 of the
Principal Act as Follows:-
“(5) If due to pandemic it is not possible to hold the General Election or bye Election for
reconstitution of Zila Parishad or Zila Parishads, citing proper causes State Government
may take decision to enforce provisions of section (107) for that Zila Parishad or those
Zila Parishads for a period exceeding six months or up to completion of next election or
bye election”
5.
Amendment of Section 107 of the Principal Act - A new sub-section (6) shall be
inserted after sub-section (5) of Section 107 of the Principal Act as follows :-
“(6) If due to pandemic, it is not possible to hold the General Election or bye Election for
reconstitution of Gram Panchayat or Panchayat Samiti or Zila Parishad, citing proper
causes the State Government may take decision to enforce provisions of sub section
(3) (b) (c) and sub section (4) of section (107) for that Gram Panchayat or Panchayat
Samiti or Zila Parishad for a period exceeding six months or up to completion of next
election or bye election ”
6.
Repeal and Saving: - Jharkhand Panchayat Raj (Amendment) Ordinance, 2021 is
hereby repealed. Notwithstanding such repeal, all rules, orders and notifications
published, proceedings and any other action taken in the exercise of powers conferred
by or under the said Ordinance shall be deemed to have been done or taken in exercise
of power conferred by or under this Act, as if, this Act was in force on the day on which
such thing were done or action taken.
