है ǔजसमɅ Ǒहट एंड रन (Hit & Run) सड़क दुघ[टना मामलɉ मɅ पीǑड़तɉ को मुआवजा हेतु संबंिधत पदािधकारȣ एवं
मुआवजा आवेदन करने कȧ रȣित का िनàन Ǿपेण Ĥावधान Ǒकया गया हैः-

सामाÛय बीमा पǐरषद Ʈारा ‘‘मोटर वाहन (संशोधन) अिधिनयम 2019‘‘ कȧ धारा 161 और इस èकȧम
के अधीन दावɉ के िनपटान के िलए Ĥ×येक ǔजले मɅ अपने Ǒकसी अिधकारȣ को बीमा कàपनी मɅ नाम
िनǑद[ƴ करेगी।

आवेदक को इस योजना के तहत मुआवजा कȧ मांग करने हेतु एक आवेदन, Ĥपğ-1 मɅ, ǔजस
अनुमÖडल मɅ दुघ[टना हुई थी, वहाँ के दावा जांच अिधकारȣ (अनुमÖडल पदािधकारȣ) को Ĥèतुत
करना होगा।
दावा आवेदन ĤाƯ होने पर, दावा जांच अिधकारȣ तुरंत संबंिधत अिधकाǐरयɉ से Ĥथम दुघ[टना
ǐरपोट[ (एफएआर) , पोèटमाट[म ǐरपोट[ एवं अÛय आवæयक दèतावेज, जैसा भी मामला हो, कȧ एक
Ĥित ĤाƯ करेगा और Hit & Run से उ×पÛन होने वाले दावɉ के संबंध मɅ जांच करेगा तथा ĤाǾप-2
मɅ दावा िनपटान आयुƠ (उपायुƠ) को ǐरपȾट भेजेगा।
दावा जांच अिधकारȣ कȧ ǐरपोट[ ĤाƯ होने पर, दावा िनपटान आयुƠ (उपायुƠ) जहाँ तक संभव हो, ऐसी ǐरपोट[
कȧ ĤािƯ कȧ तारȣख से पंġह Ǒदनɉ कȧ अविध के भीतर दावे को मंजूरȣ देगा और कɅ ġȣय मोटर वाहन (मोटर
वाहन दुघ[टना कोष) िनयम, 2022 के िनयम 4 के तहत गǑठत Ěèट या सामाÛय बीमा पǐरषद को मंजूरȣ कȧ
सूचना देगा।
Ěèट कȧ ओर से, सामाÛय बीमा पǐरषद (जीआईसी), èवीकृित आदेश और दावेदार से Ĥपğ और दèतावेज ĤाƯ
होने पर, दावेदार या मृतक के कानूनी Ĥितिनिध Ʈारा Ĥदान Ǒकए गए बɇक खाते मɅ 15 Ǒदनो के भीतर ई-भुगतान
करेगा और साथ हȣ उन सभी संबंिधत अिधकाǐरयɉ को सूचना भेजेगा, ǔजÛहɅ èवीकृित आदेश कȧ Ĥित पृƵांǑकत
कȧ गई है।

section (2) of section 161 of The Motor Vehicles (Amendment) Act, 2019 (No. 32 of 2019) and
Notification No. G.S.R.-‘162(E) Central Motor Vehicles (Motor Vehicle Accident Fund) Rules, 2022’
and G.S.R – ‘163(E) Compensation to Victims of Hit and Run Motor Accidents Scheme, 2022’ of the
Ministry of Road Transport and Highways, process flow and the stakeholders involved for claiming
compensation by a victim in Hit and Run cases have been outlined below:
Stakeholders Involved:-
“Claims Enquiry Officer” means the Sub-Divisional Officer,
“Claims Settlement Commissioner” means the Deputy Commissioner,
District Level Committee:— There shall be a District Level Committee in each District
consisting of the following members, namely: —

Act, 2019 and this scheme.

The applicant shall submit an application in Form-I, seeking compensation under this scheme to
the Claims Enquiry Officer (Sub-Divisional officers) of the Sub-Division in which the accident
took place.
On receipt of claims application, the Claims Enquiry Officer shall immediately obtain a copy of
the First Accident Report (FAR), post mortem report and other necessary document, as the case
may be, from the concerned authorities and hold enquiry in respect of claims arising out of the hit
and run motor accident and forward report to Claims Settlement Commissioner (DC).
Hit and Run
On receipt of report of the Claims Enquiry Officer, the Claims Settlement Commissioner (DC) shall sanction
the claim, as far as possible, within a period not exceeding fifteen days from the date of receipt of such
report and communicate the sanction to the Trust constituted under rule 4 of the Central Motor Vehicles
(Motor Vehicle Accident Fund) Rules, 2022 or the General Insurance Council, as the case may be.
On behalf of the Trust, General Insurance Council (GIC), immediately on receipt of the sanction order, and
the Forms and documents from the claimant, shall make the e-payment to the bank account as provided by
the claimant or legal representative of the deceased, as the case may be, within 15 days and simultaneously
send intimation to all the concerned authorities to whom the copy of the sanction order is endorsed.
In case of death: Sum Allotted
