Notification No.- प0न0व0@ववध-06&143@2010 2280(S)--In exercise of the powers

conferred by section 2 of The Indian Tolls (Jharkhand Amendment) Act 2002, the Government of

Jharkhand has notified Jharkhand Highways fee (Determination of Rates and Collection) Amendment

Rules 2021 and Highways Fee (Determination of Rates and Collection) Amendment Rule, 2022 by

amending Jharkhand Highways fee (Determination of Rates and Collection) Rules, 2011. Further the

Government of Jharkhand hereby makes the following amendments by substituting the rules for levy

and collection of composition user fee under Jharkhand Highways Fee (Determination of Rates and

Collection) Amendment Rules, 2021.

1.

Short title and commencement –

(i)

These rules may be called the Jharkhand Highways Fee (Determination of Rates and

Collection) Amendment Rules, 2021 (substitution).

(ii)

They shall be deemed to have been come into force from the date of Gazette notification of

Jharkhand Highways Fee (Determination of Rates and Collection) Amendment Rules, 2021; that is

26.10.2021.

Amendments in Rule 2

Sub-rule (ca) of Rule 2 shall be substituted as under: -

Sub-rule (ca) of Rule 2 - “Composition User Fee” means the levy of consolidated user fee

payable under rule 3A of these Rules, for use of state roads and or commuting on roads and / or

bridges including interchanges, flyovers, ROB/RUB, bypasses and tunnels thereon in mining

areas.

Amendments in Rule 3A

Rule 3A shall be substituted as under: -

Rule 3A – Composition user fee

1) Notwithstanding anything contained in rule 3 of these rules; the State Government

may; in lieu of user fee payable under sub-rule(1) of rule 3, provide for a scheme for

payment of composition user fee payable by all such mechanical vehicles, for use of

any state roads or part thereof or commuting in mining areas as the case may be , in

the manner and at such rate as provided in these rules.

2) Deleted.

3) Any such mechanical vehicle liable to pay the composition user fee under these rules

contravenes any of the provisions of this rule for the payment of the composition user

fee, shall be liable to pay penalty, thrice the amount of such composition user fee

payable.

4) The levy of such composition user fee shall be based on the, “to and fro”, basis. Such

composition user fee shall be Rs. 600/- for each way; except for such mechanical

vehicles carrying goods less than 9 (nine) tonnes. For this purpose, the base year shall

be the year 2021.

Provided such composition user fee rate may be revised yearly at such rate not

exceeding @ 10% per year, on every first of April, each year.

Explanation: The Composition User Fee shall be deemed to have been payable immediately

with effect from the date of Gazette notification of Jharkhand Highways Fee (Determination of

Rates and Collection) Amendment Rule, 2021.

Amendments in Rule 6

Sub-rule (8) of Rule 6, shall be substituted as under: -

In addition to such user fee or the composition user fee, as collected through toll

plaza(s); the state government may implement the payment of such user fee or the composition

user fee, on-line / off-line, from such mechanical vehicles for the use of state roads and or for

transporting the goods and the payment of such user fee or the composition user fee shall be

mandatory for the issuance of e-challan/ challan, by the authority authorised for issuance of

such challan for transportation of the goods.

5. The remaining other sections of Jharkhand Highways Fee (Determination of Rates and

Collection) Amendment Rules, 2021 shall remain unchanged.

In anticipation of approval from the State Cabinet, this notification is issued with

approval of the hon’ble Chief Minister, Jharkhand.
