यतः लोक ĤǓतǓनͬध×व अͬधǓनयम, 1951 कȧ धारा 61 मɅ यह उपबंͬधत है ͩक Ǔनवा[चकɉ के

ĤǓतǽपण का Ǔनवारण करने कȧ Ǻिçट से, ताͩक उÈत अͬधǓनयम कȧ धारा 62 के अधीन वाèतͪवक

Ǔनवा[चकɉ का उनके मत देने के अͬधकार को और अͬधक Ĥभावी बनाया जा सके, मतदान के समय

Ǔनवा[चकɉ कȧ पहचान सुǓनिæचत करने के साधन के ǽप मɅ Ǔनवा[चकɉ के ͧलए Ǔनवा[चक फोटो पहचान

पğ के उपयोग हेतु Ǔनयमɉ के ɮवारा उपबंध ͩकए जा सकते हɇ, तथा

यतः Ǔनवा[चकɉ का रिजिèĚकरण Ǔनयम, 1960 का Ǔनयम 28 Ǔनवा[चन आयोग को, इस Ǻिçट

से ͩक Ǔनवा[चकɉ के ĤǓतǽपण का Ǔनवारण हो सके तथा मतदान के समय उनकȧ पहचान को सरल

बनाया जा सके, Ǔनवा[चको को राÏय कȧ लागत पर फोटोयुÈत Ǔनवा[चक फोटो-पहचान पğ जारȣ करने के

ͧलए Ǔनदेश देने कȧ शिÈत Ĥदान करता है; तथा

यतः, Ǔनवा[चनɉ का संचालन Ǔनयम, 1961 के Ǔनयम 49 ज(3) और 49 ट(2) (ख) मɅ यह

उपबंͬधत है ͩक जहाँ ͩकसी Ǔनवा[चन ¢ेğ के Ǔनवा[चकɉ को Ǔनवा[चक रिजिèĚकरण Ǔनयम, 1960, के

Ǔनयम 28 के उÈत उपबंधɉ के अधीन Ǔनवा[चक फोटो पहचान-पğ Ǒदए गए हɇ, वहां Ǔनवा[चकɉ को

मतदान केÛġ मɅ अपना Ǔनवा[चक फोटो पहचान-पğ Ǒदखाना होगा तथा उनकȧ ओर से उन Ǔनवा[चक

फोटो पहचान पğɉ को नहȣं Ǒदखाए जाने या Ǒदखाने मɅ असमथ[ होने पर उÛहɅ मत डालने कȧ अनुमǓत

देने से इÛकार ͩकया जा सकता है; तथा

यतः, उÈत अͬधǓनयम, और Ǔनयमɉ के उपयु[Èत उपबंधɉ को ͧमलाकर एवं सामंजèयपूण[ ढंग से

उनके अÚययन से यह èÜषट होता है ͩक यɮयͪप मत देने का अͬधकार Ǔनवा[चक नामावलȣ मɅ नाम के

होने से हȣ होता हɇ, यह Ǔनवा[चन आयोग ɮवारा राÏय कȧ लागत पर, मतदान के समय उनकȧ पहचान

सुǓनिæचत करने के साधन के ǽप मɅ Ĥदान करवाए गए Ǔनवा[चक फोटो पहचान पğ के Ĥयोग पर भी

Ǔनभ[र करता है, तथा दोनɉ का एक साथ Ĥयोग करना होता है; तथा

यतः, Ǔनवा[चन आयोग ने एक समयबƨ काय[Đम के अनुसार सभी Ǔनवा[चकɉ को Ǔनवा[चक फोटो

पहचान-पğ ई०पी०आई०सी० जारȣ करने का Ǔनदेश देते हुए 28 अगèत, 1993 को एक आदेश जारȣ

ͩकया है; तथा

यतः, मेघालय, नागालɇड़, ǒğपुरा, अǽणाचल Ĥदेश, झारखÖड़, तͧमलनाड़ू, पिæचम बंगाल एवं महाराçĚ

राÏयɉ के Ǔनवा[चकɉ को 100% Ǔनवा[चक फोटो पहचान पğ जारȣ ͩकए जा चुके हɇ, तथा

अतः, अब, सभी संबƨ कारकɉ तथा ͪवͬधक एवं तØया×मक िèथǓतयɉ को Úयान मɅ रखते हुए,

Ǔनवा[चन आयोग, एतʊवारा, यह Ǔनदेश देता है ͩक Ǒदनांक 21.01.2023 को अͬधसूͬचत ǒğपुरा

ͪवधानसभा के चालू साधारण Ǔनवा[चन, Ǒदनांक 31.01.2023 को अͬधसूͬचत मेघालय और नागालैड़ कȧ

ͪवधान सभाओं के साधारण Ǔनवा[चन और अǾणाचल Ĥदेश के 01-लुàला (अ.ज.जा) ͪवधानसभा Ǔनवा[चन

¢ेğ, झारखÖड़ के 23-रामगढ़ ͪवधानसभा Ǔनवा[चन ¢ेğ, तͧमलनाड़ू के 98-इरोड (पूव[) ͪवधानसभा

Ǔनवा[चन ¢ेğ, पिæचम बंगाल के 60-सागरदȣघी ͪवधानसभा Ǔनवा[चन ¢ेğ और महाराçĚ के 215-कसबा

पेठ और 205-ͬचंचवड ͪवधानसभा Ǔनवा[चन ¢ेğɉ के उपचुनावɉ के ͧलए, सभी Ǔनवा[चक िजÛहɅ Ǔनवा[चक

फोटो पहचान पğ जारȣ ͩकए गए हɇ, मतदान èथल पर अपना मत डालने से पहले अपनी पहचान

सुǓनिæचत करने हेतु अपना Ǔनवा[चक फोटो पहचान पğ Ǒदखाएंगे। ऐसे Ǔनवा[चक जो अपना Ǔनवा[चक

फोटो पहचान पğ Ĥèतुत नहȣं कर पाते हɇ, उÛहɅ अपनी पहचान èथाͪपत करने के ͧलए Ǔनàनͧलͨखत

वैकिãपक फोटो पहचान दèतावेजɉ मɅ से कोई एक Ĥèतुत करना होगाः-

एͪपक के संबंध मɅ, लेखन अशुͪƨ, वत[नी कȧ अशुͪƨ इ×याǑद को नजरअंदाज कर देना चाǑहए

बशतɏ Ǔनवा[चक कȧ पहचान ईपीआईसी से सुǓनिæचत कȧ जा सके। यǑद कोई Ǔनवा[चक फोटो पहचान पğ

Ĥदͧशत[ करता है, जो ͩक ͩकसी अÛय सभा Ǔनवा[चन-¢ेğ के Ǔनवा[चक रिजèĚȣकरण अͬधकारȣ ɮवारा

जारȣ ͩकया गया है, ऐसे एͪपक भी पहचान èथाͪपत करने हेतू èवीकृत ͩकए जाएंगे बशतɏ उस Ǔनवा[चक

का नाम जहां वह मतदान करने आया है उस मतदान कɅ ġ से संबंͬधत Ǔनवा[चक नामावलȣ मɅ उपलÞध

हो। यǑद फोटोĒाफ इ×याǑद के बेमेल होने के कारण Ǔनवा[चक कȧ पहचान सुǓनिæचत करना संभव न हो

तब Ǔनवा[चक को उपयु[Èत पैरा 7 मɅ वͨण[त ͩकसी एक वैकिãपक फोटो दèतावेज को Ĥèतुत करना होगा।

उÈत पैरा 7 मɅ ͩकसी बात के होते हुए भी, Ĥवासी Ǔनवा[चकɉ को जो अपने पासपोट[ मɅ ͪववरणɉ

के आधार पर लोक ĤǓतǓनͬध×व अͬधǓनयम, 1950 कȧ धारा 20क के अधीन Ǔनवा[चक नामावͧलयɉ मɅ

पंजीकृत हɇ, मतदान केÛġ मɅ केवल उनके मूल पासपोट[ (तथा कोई अÛय पहचान दèतावेज नहȣं) के

आधार पर हȣ पहचाना जाएगा ।

Whereas, Section 61 of the Representation of the People Act, 1951 provides that with a view to

preventing impersonation of electors, so as to make the right of genuine electors to vote under section 62

of that Act more effective, provisions may be made by rules under that Act for use of Electors Photo

Identity Card for electors as the means of establishing their identity at the time of polling; and

Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the Election

Commission to direct, with a view to preventing impersonation of electors and facilitating their

identification at the time of poll, the issue of Electors Photo Identity Card to electors bearing their

photographs at State cost; and

Whereas, Rules 49H (3) and 49K (2) (b) of the Conduct of Elections Rules, 1961, stipulate that

where the electors of a constituency have been supplied with Electors Photo Identity Card under the said

provisions of Rule 28 of the Registration of Electors Rules, 1960, the electors shall produce their Elector

Photo Identity Card at the polling station and failure or refusal on their part to produce those Elector

Photo Identity Card may result in the denial of permission to vote; and

Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the

Rules, makes it clear that although the right to vote arises by the existence of the name in the electoral

roll, it is also dependent upon the use of the Elector Photo Identity Card, where provided by the Election

Commission at State cost, as the means of establishing their identity at the time of polling and that both

are to be used together; and

Whereas, the Election Commission made an Order on the 28^th August, 1993, directing the issue

of Elector Photo Identity Card (EPIC) to all electors, according to a time bound programme; and

Whereas, Elector Photo Identity Card have been issued to approximate 100% electors in the

States of Meghalaya, Nagaland, Tripura, Arunachal Pradesh, Jharkhand, Tamil Nadu, West Bengal &

Maharashtra; and

Now, therefore, after taking into account all relevant factors and the legal and factual position,

the Election Commission hereby directs that for the current General Election to the Legislative

Assembly of Tripura notified on 21-01-2023, General Election to the Legislative Assemblies of

Meghalaya & Nagaland and bye elections to 01-Lumla(ST) Assembly Constituency of Arunachal

Pradesh, 23-Ramgarh Assembly Constituency of Jharkhand, 98-Erode(East) Assembly

Constituency of Tamil Nadu, 60-Sagardighi Assembly Constituency of West Bengal and 215-

Kasba Peth & 205-Chinchwad Assembly Constituencies of Maharashtra notified on 31-01-2023,

all electors who have been issued EPIC shall produce the EPIC for their identification at the polling

stations before casting their votes. Those electors who are not able to produce the EPIC shall produce

one of the following alternative photo identity documents for establishing their identity:-

(iii)

Passbooks with photograph issued by Bank/Post Office,

(iv)

Health Insurance Smart Card issued under the scheme of Ministry of Labour,

(v)

Driving License,

(vi)

PAN Card,

(vii)

Smart Card issued by RGI under NPR,

(viii)

Indian Passport,

(ix)

Pension document with photograph,

(x)

Service Identity Cards with photograph issued to employees by Central/State

Govt./PSUs/Public Limited Companies,

(xi)

Official identity cards issued to MPs/MLAs/MLCs, and

(xii)

Unique Disability ID (UDID) Card, M/o Social Justice & Empowerment, Government of

India

In the case of EPIC, clerical errors, spelling mistakes, etc. should be ignored provided the

identity of the elector can be established by the EPIC. If an elector produces an EPIC which has been

issued by the Electoral Registration Officer of another Assembly Constituency, such EPIC shall also be

accepted for identification provided the name of that elector finds place in the electoral roll pertaining to

the polling station where the elector has turned up for voting. If it is not possible to establish the identity

of the elector on account of mismatch of photograph, etc. the elector shall have to produce one of the

alternative photo documents mentioned in Para 7 above.

Notwithstanding anything in Para 7 above, overseas electors who are registered in the electoral

roll under Section 20A of the Representation of the People Act, 1950, based on the particulars in their

Indian Passport, shall be identified on the basis of their original passport only (and no other identity

document) in the polling station.
