Ĥदेश के 01-लुà ला (अ.ज.जा) ͪवधानसभा Ǔनवा[चन ¢ेğ, झारखÖ ड़ के 23-रामगढ़ ͪवधानसभा Ǔनवा[चन ¢ेğ,
तͧमलनाडू के 98-इरोड (पूव[) ͪवधानसभा Ǔनवा[चन ¢ेğ, पिæचम बंगाल के 60-सागरदȣघी ͪवधानसभा Ǔनवा[चन
¢ेğ और महाराç Ě के 215-कसबा पेठ & 205-ͬचंचवड ͪवधानसभा Ǔनवा[चन ¢ेğɉ के उप-Ǔनवा[चनɉ के काय[Đमɉ
कȧ घोषणा कर दȣ गई है।

यतः, लोक ĤǓतǓनͬध× व अͬधǓनयम 1951 (सं¢ेप मɅ लो.Ĥ.अͬधǓनयम, 1951) कȧ धारा 126क मɅ यह
ǓनǑद[ç ट ͩकया गया है ͩक ''(1) कोई भी å यिÈत कोई Ǔनग[म मत सवȶ¢ण नहȣं करेगा और ͩकसी Ǔनग[म मत
सवȶ¢ण के पǐरणाम का, ऐसी अवͬध के दौरान जो Ǔनवा[चन आयोग ɮवारा इस संबंध मɅ अͬधसूͬचत कȧ जाए,

ͪĤंट या इलैÈ ĚॉǓनक मीͫडया के माÚ यम से Ĥकाशन या Ĥचार या ͩकसी भी Ĥकार कȧ अÛ य रȣǓत मɅ Ĥसार नहȣं
करेगा।
(2) Ǔनवा[चन आयोग, उपधारा (1) के Ĥयोजन के ͧलए, Ǔनà नͧलͨखत को Ú यान मɅ रखते हुए साधारण
आदेश ɮवारा तारȣख और समय अͬधसूͬचत करेगा, अथा[त :-
(क) साधारण Ǔनवा[चन कȧ दशा मɅ, वह अ वͬध मतदान के पहले Ǒदन को मतदान के ͧलए Ǔनयत समय
के आरंभ होने से Ĥारंभ हो सकेगी और सभी राÏ यɉ और संघ राÏ य ¢ेğɉ मɅ मतदान समाÜ त होने के आधे घंटे
तक जारȣ रह सकेगी;
(ख) ͩकसी उप-Ǔनवा[चन या एक साथ कराए जाने वाले अनेक उप-Ǔनवा[चनɉ कȧ दशा मɅ वह अवͬध
मतदान के पहले Ǒदन से हȣ मतदान के ͧलए Ǔनयत समय के आरंभ होने से Ĥारंभ हो सकेगी और मतदान
समाÜ त हाने के पæ चात् आधे घंटे तक जारȣ रह सकेगी:
परंतु ͧभÛ न-ͧभÛ न Ǒदनɉ पर एक साथ कराए जाने वाले अनेक उप-Ǔनवा[चनɉ कȧ दशा मɅ, वह अ वͬध
मतदान के पहले Ǒदन को मतदान के ͧलए Ǔनयत समय के आरंभ होने से Ĥारंभ हो सकेगी और अंǓतम मतदान
समाÜ त होने के पæ चात आधे घंटे तक जारȣ रह सकेगी।
(3) ऐसा कोई å यिÈत, जो इस धारा के उपबंधɉ का उã लंघन करेगा ऐसी अवͬध के कारावास से, जो दो
वष[ तक कȧ हो सकेगी या जुमा[ने से या दोनɉ से, दंडनीय होगा।''

अब, इसͧलए लोक ĤǓतǓनͬध× व अͬधǓनयम, 1951 कȧ धारा 126क कȧ उपधारा (1) के अधीन शिÈतयɉ
का Ĥयोग करते हुए Ǔनवा[चन आयोग उÈ त धारा कȧ उप-धारा (2) के उपबंधɉ के Ǻिçटगत, 16 फरवरȣ, 2023
(गुǾवार) को पूवा[éन 7:00 बजे और 27 फरवरȣ, 2023 (सोमवार) को अपराéन 7:00 बजे के बीच कȧ अवͬध
को, ऐसी अवͬध के Ǿप मɅ अͬधसूͬचत करता है िजसके दौरान उपर उिãलͨखत साधारण Ǔनवा[चनɉ और उप-
Ǔनवा[चनɉ के संदभ[ मɅ ͩकसी भी Ĥकार के एिÊजट पोल का आयोजन करने तथा ͪĤंट या इलेÈ ĚॉǓनक मीͫडया
ɮवारा इसके पǐरणाम के Ĥकाशन या Ĥचार अथवा ͩकसी भी अÛ य तरȣके से उसका Ĥचार-Ĥसार करने पर ĤǓतबंध
होगा।

यह भी è पç ट ͩकया जाता है ͩक लोक ĤǓतǓनͬध× व अͬधǓनयम, 1951 कȧ धारा 126(1) (ख) के अधीन
उपयु[È त साधारण और उप-Ǔनवा[चनɉ मɅ संबंͬधत मतदान ¢ेğɉ मɅ मतदान कȧ समािÜत के ͧलए Ǔनयत समय पर
समाÜ त होने वाले 48 घंटɉ के दौरान ͩकसी भी इलेÈ ĚॉǓनक मीͫडया मɅ ͩकसी भी ओͪपǓनयन पोल या ͩकसी अÛ य
मतदान सवȶ¢ण के पǐरणामɉ सǑहत ͩकसी भी Ĥकार के Ǔनवा[चन संबंधी मामले के Ĥदश[न पर ĤǓतबंध होगा।

उपरोÈत अͬधसूचना का अंĒेजी मɅ Ǔनàनͧलͨखत अनुवाद झारखÖड राÏयपाल के Ĥाͬधकार से इसके ɮवारा
Ĥकाͧशत ͩकया जाता है जो भारतीय संͪवधान के अनुÍछेद 348 के खÖड (3) के अधीन अंĒेजी भाषा मɅ उसका

No. 576/EXIT/2023/SDR/Vol.I-- Whereas, the schedule for the General Elections to the
Legislative Assemblies of Meghalaya, Nagaland & Tripura have been announced by the
Commission vide Press Note No. ECI/PN/1/2023 dated 18th January, 2023 and bye elections to 01-
Lumla(ST) Assembly Constituency of Arunachal Pradesh, 23-Ramgarh Assembly Constituency of
Jharkhand, 98-Erode(East) Assembly Constituency of Tamil Nadu, 60-Sagardighi Assembly
Constituency of West Bengal and 215-Kasba Peth & 205-Chinchwad Assembly Constituencies of
Maharashtra have been announced by the Press Note No. ECI/PN/2/2023 dated 18th January, 2023.

Whereas, Section 126A of The Representation of the People Act, 1951 (in short R.P. Act, 1951)
specifies that "(1)No person shall conduct any exit poll and publish or publicise by means of the print or
electronic media or disseminate in any other manner, whatsoever, the result of any exit poll during such
period, as may be notified by the Election Commission in this regard.
(2) For the purposes of sub-section (1), the Election Commission shall, by a general order,
notify the date and time having due regard to the following, namely:-
(a) in case of a general election, the period may commence from the beginning of the hours fixed
for poll on the first day of poll and continue till half an hour after closing of the poll in all the States and
Union territories;
(b) In case of a bye-election or a number of bye-elections held together, the period may
commence from the beginning of the hours fixed for poll on and from the first day of poll and continue
till half an hour after closing of the poll;
Provided that in case of a number of bye-elections held together on different days, the period
may commence from the beginning of the hours fixed for poll on the first day of poll and continue till
half an hour after closing of the last poll.
(3) Any person who contravenes the provisions of this section shall be punishable with
imprisonment for a term which may extend to two years or with fine or with both."

Now, therefore, in exercise of the powers under sub-Section (1) of Section 126A of the R.P. Act,
1951, the Election Commission, having regard to the provisions of sub-Section (2) of the said Section,
hereby notifies the period between 7:00 A.M. on 16th February, 2023 (Thursday) and 7.00 P.M. on
27th February, 2023 (Monday), as the period during which conducting and publishing or publicizing
exit poll by means of the print or electronic media or dissemination in any other manner whatsoever, the
result of any exit poll in connection with the aforesaid General Elections and bye elections, shall be
prohibited.

It is further clarified that under Section 126(1)(b) of the R.P. Act, 1951, displaying any election
matter including results of any opinion poll or any other poll survey, in any electronic media, would be
prohibited during the period of 48 hours ending with the hours fixed for the conclusion of the poll in
connection with the aforesaid General and bye elections.
