संÉया-3/Ǔन०सं०-09-16/2018 का॰ 1795--Įी रͪवरंजन कुमार ͪवĐम, भा०Ĥ०से०, संयुÈत

सͬचव, कृͪष, पशुपालन एवं सहकाǐरता ͪवभाग के ɮवारा उनके ͪवǾƨ लंǒबत RC Case No.

04(A)/2010-AHD-R-(C) मɅ आरोप मुÈत ͩकये जाने के फलèवǾप देय Ǔतͬथ को अपर समाहता[

एवं समक¢ कोǑट, संयुÈत सͬचव कोǑट एवं अपर सͬचव कोǑट मɅ ĤोÛनǓत Ĥदान करने का अनुरोध

ͩकया गया है ।

2. Įी ͪवĐम के ɮवारा RC Case No. 04(A)/2010-AHD-R-(C) के ͪवǾƨ माननीय

झारखÖड उÍच Ûयायालय मɅ Cr.MP 163/2013 दायर ͩकया गया है, िजसमɅ Ǒदनांक-

19.08.2020 को पाǐरत Ûयायादेश का काय[कारȣ अंश Ǔनàनवत है:-

Having heard rival submissions made at the Bar and after going through

the evidence in the records, it is crystal clear that it is not disputed that the

co-accused of this petitioner namely Mrs. Menon Ekka was residing in the official

residence of her husband- Enos Ekka within the local limit of jurisdiction of

Doranda Police Station. Merely because the information furnished in the check list

forwarded by the petitioner, it was mentioned that the co-accused Mrs. Menon

Ekka is not having any land within the jurisdiction of Doranda Police Station, that

does not necessarily mean that Mrs. Menon Ekka was not a resident of local

limits of the jurisdiction of Doranda Police Station, more so, when the said co-

accused Mrs. Menon Ekka undisputedly submitted an affidavit, which was

annexed with the check list, forwarded by the petitioner in the capacity of Circle

Officer, wherein she has categorically stated that she is a resident within the area

of Doranda Police Station. So in the absence of any material to show that the

petitioner was having knowledge that the co-accused purchaser Mrs. Menon Ekka

was not the resident with the area of Doranda Police Station its cannot be said

that he has committed any offence punishable in law. Thus this Court is of the

considered view that the allegation against the petitioner are at best on similar

footing as the allegations made against the co-accused Circle Officers, Ram

Kumar Mandal and Asif Ekram. As the same order taking cognizance, as against

the petitioner has already been quashed and the SLP have been dismissed by

Hon’ble Supreme Court of India, so far it relates to the co-accused Circle

Officers, Ram Kumar Mandal and Asif Ekram, hence the portion of the impugned

order dated 11.12.2012 passed by learned Special Judge CBI at Ranchi in

connection with R.C. case no. 04 (A) / 2010 –AHD-R-(C) by which, the

cognizance has been taken against this petitioner namely Ravi Ranjan Kumar

Vikram is not sustainable in law, hence, the same is quashed and set aside. In

view of observation made by the Hon’ble Supreme court of India in the Special

Leave to Appeal (Cr.) No. 9452 of 2016 dated 1.9.2017 the departmental action

may be initiated against the petitioner.

3. उÈत Ûयायादेश के आलोक मɅ ͪवभागीय संकãप संÉया- 2197(HRMS) Ǒदनांक

24.02.2022 के ɮवारा Įी ͪवĐम के ͪवǾƨ ͪवभागीय काय[वाहȣ संचाͧलत कȧ गई, िजसमɅ ͪवभागीय

संकãप संÉया 17972(HRMS) Ǒदनांक 10.11.2022 के ɮवारा Įी ͪवĐम को आरोप मुÈत ͩकया

गया है ।

4. उãलेखनीय है ͩक Įी ͪवĐम को ͪवभागीय अͬधसूचना संÉया 6085 Ǒदनांक

28.09.2021 के ɮवारा अपर समाह×ता[ एवं समक¢ कोǑट मɅ तथा अͬधसूचना संÉया 7496 Ǒदनांक

30.11.2022 के ɮवारा संयुÈत सͬचव एवं समक¢ कोǑट मɅ ĤोÛनǓत Ĥदान कȧ गई है ।

5. Įी रͪवरंजन कुमार ͪवĐम (कोǑट Đमांक 696/03) अनुसूͬचत जाǓत कोǑट के पदाͬधकारȣ

है एवं इस कोǑट मɅ इनसे कनीय Įी राकेश रौशन (कोǑट Đमांक 698/03) को अͬधसूचना संÉया

7742 Ǒदनांक 26.08.2013 के ɮवारा अपर समाह×ता[ एवं समक¢ कोǑट, अͬधसूचना £ापांक 5647

Ǒदनांक 27.07.2018 के ɮवारा संयुÈत सͬचव एवं समक¢ कोǑट मɅ एवं अͬधसूचना £ापांक 4776

Ǒदनांक 29.07.2022 के ɮवारा अपर सͬचव एवं समक¢ कोǑट मɅ ĤोÛनǓत Ĥदान कȧ गई है ।

6. उãलेखनीय है ͩक सàĤǓत Įी ͪवĐम वष[ 2021 के ǐरिÈत के ͪवǾƨ राÏय ĤशासǓनक

सेवा से भारतीय ĤशासǓनक सेवा मɅ ĤोÛनǓत ĤाÜत कर चुके है ।

7. उपयु[Èत वͨण[त पǐरĤेêय मɅ Įी रͪवरंजन कुमार ͪवĐम (कोǑट Đमांक 696/03) को

ͪवभागीय संकãप संकãप संÉया 6227 Ǒदनांक 20.11.2008 एवं ͪवभागीय पǐरपğ संÉया 4709

Ǒदनांक 13.08.2008 के Ĥावधान के आलोक मɅ झारखÖड ĤशासǓनक सेवा मɅ उनसे कनीय Įी

राकेश रौशन (कोǑट Đमांक 698/03) को ͪवͧभÛन कोǑटयɉ मɅ Ĥद×त ĤोÛनǓतयɉ के भूतल¢ी Ĥभाव

से èतàभ- iv मɅ अंͩकत Ǔतͬथ से वैचाǐरक ĤोÛनǓत Ĥदान कȧ जाती है :-
