Notification No.- 3/2023 – State Tax

S.O. No. 19, Dated 5^th June, 2023-- In exercise of the powers conferred by section 148 of the

Jharkhand Goods and Services Tax Act, 2017 (12 of 2017) (hereinafter referred to as the said Act), the

Government of Jharkhand, on the recommendations of the Council, hereby notifies that the registered

person, whose registration has been cancelled under clause (b) or clause (c) of sub-section (2) of section

29 of the said Act on or before the 31^stday of December, 2022, and who has failed to apply for

revocation of cancellation of such registration within the time period specified in section 30 of the said

Act as the class of registered persons who shall follow the following special procedure in respect of

revocation of cancellation of such registration, namely:–

(a) the registered person may apply for revocation of cancellation of such registration upto the 30^th day

of June, 2023;

(b) the application for revocation shall be filed only after furnishing the returns due upto the effective

date of cancellation of registration and after payment of any amount due as tax, in terms of such returns,

along with any amount payable towards interest, penalty and late fee in respect of the such returns;

shall be available in such cases.

Explanation: For the purposes of this notification, the person who has failed to apply for revocation of

cancellation of registration within the time period specified in section 30 of the said Act includes a

person whose appeal against the order of cancellation of registration or the order rejecting application

for revocation of cancellation of registration under section 107 of the said Act has been rejected on the

ground of failure to adhere to the time limit specified under sub-section (1) of section 30 of the said Act.

This notification shall be deemed to be effective from 31^st March, 2023.

(2017 का 12) (िजसे इसमɅ इसके पश् चात् उक् त अͬधǓनयम कहा गया है), पǐरषɮ कȧ ͧसफाǐरशɉ पर, रिजस् Ěȣकृत

व् यक् Ǔत, िजनका रिजस् Ěȣकरण उक् त अͬधǓनयम कȧ धारा 29 कȧ उपधारा (2) के खंड (ख) या खंड (ग) के अधीन 31

Ǒदसंबर, 2022 को या उससे पहले रƧ ͩकया गया है और जो उक् त अͬधǓनयम कȧ धारा 30 मɅ ͪवǓनǑद[ष् ट पǐरसीमा के

भीतर ऐसे रƧकरण के ĤǓतसंहरण के ͧलए आवेदन करने मɅ असफल रहे हɇ, को रिजस् Ěȣकृत व् यक् Ǔत के Ĥवग[ के Ǿप मɅ

अͬधसूͬचत करती है जो ऐसे रिजस् Ěȣकरण के रƧकरण के ĤǓतसंहरण के संबंध मɅ Ǔनम् नͧलͨखत ͪवशेष ĤͩĐया का पालन

करɅगे, अथा[त् :-

(क) रिजस् Ěȣकृत व् यक् Ǔत, 30 जून, 2023 तक ऐसे रिजस् Ěȣकरण के रƧकरण के ĤǓतसंहरण के ͧलए आवेदन कर

सकɅ गे;

(ख) ĤǓतसंहरण के ͧलए आवेदन, रिजस् Ěȣकरण के रƧकरण कȧ Ĥभावी तारȣख तक देय ͪववरणी Ĥèतुत करने और ऐसी

ͪववरणी के Ǔनबंधनɉ के अनुसार करके Ǿप मɅ देय रकम का, ब् याज, शास् Ǔत और ऐसी ͪववरणी के संबंध मɅ ͪवलंब फȧस के

ͧलए संदेय रकम सǑहत, संदाय करने के पश् चा×हȣ फाइल ͩकया जाएगा;

(ग) रिजस् Ěȣकरण के रƧकरण के ĤǓतसंहरण के ͧलए आवेदन Ĥस् तुत करने के ͧलए ऐसे मामलɉ मɅ और पǐरसीमा

ͪवस् तार, उपलब् ध नहȣं होगा।

स् पष् टȣकरण—इस अͬधसूचना के Ĥयोजनɉ के ͧलए, व् यक् Ǔत, जो उक् त अͬधǓनयम कȧ धारा 30 मɅ ͪवǓनǑद[ष् ट पǐरसीमा

के भीतर रिजस् Ěȣकरण के रƧकरण के ĤǓतसंहरण के ͧलए आवेदन करने मɅ असफल रहता है, इसके अंतग[त ऐसा व् यक् Ǔत

भी सिàमͧलत है, िजसकȧ रिजस् Ěȣकरण के रƧकरण के आदेश या उक् त अͬधǓनयम कȧ धारा 107 के अधीन

रिजस् Ěȣकरण के रƧकरण के ĤǓतसंहरण के ͧलए आवेदन खाǐरज करने के आदेश के ͪवǽƨ अपील उक् त अͬधǓनयम कȧ

धारा 30 कȧ उपधारा (1) के अधीन ͪवǓनǑद[ष् ट पǐरसीमा का पालन करने मɅ असफल रहने के आधार पर खाǐरज कȧ गई

है।

यह अͬधसूचना 31 माच[, 2023 से लागू मानी जाएगी।
