ͪवǾƨ उपायुÈत, चतरा के पğांक-1774/गो०, Ǒदनांक 12.12.2009 एवं पğांक-215/गो०, Ǒदनांक

24.02.2010 ɮवारा Ĥपğ-‘क’ मɅ आरोप गǑठत कर उपलÞध कराया गया, िजसके आधार पर इनके

ͪवǾƨ ͪवभाग èतर से Ĥपğ-‘क’ का पुनग[ठन ͩकया गया, िजसमɅ Įी बारला के ͪवǾƨ कुल-15

आरोप ĤǓतवेǑदत है ।

Įी बारला के ͪवǾƨ Ĥपğ-‘क’ मɅ गǑठत आरोपɉ के समी¢ोपरांत ͪवभागीय संकãप सं०-3882,

Ǒदनांक 29.04.2014 ɮवारा इनके ͪवǾƨ ͪवभागीय काय[वाहȣ संचाͧलत कȧ गयी। संचालन

पदाͬधकारȣ के पğांक-521, Ǒदनांक 30.12.2016 ɮवारा ͪवभागीय काय[वाहȣ का जाँच ĤǓतवेदन

उपलÞध कराया गया है, िजसमɅ संचालन पदाͬधकारȣ ɮवारा इनके ͪवǾƨ Ĥपğ- ‘क’ मɅ ĤǓतवेǑदत

15 आरोपɉ मɅ से आरोप सं०-1, 4, 8, 9, 10, 11 एवं 12 को Ĥमाͨणत ĤǓतवेǑदत ͩकया गया है ।

Įी बारला के ͪवǾƨ ĤǓतवेǑदत आरोप, इनका बचाव-बयान एवं संचालन पदाͬधकारȣ के जाँच

ĤǓतवेदन के समी¢ोपरांत Ĥमाͨणत आरोपɉ हेतु झारखÖड सरकारȣ सेवक (वगȸकरण, Ǔनयंğण एवं

अपील) Ǔनयमावलȣ, 2016 के Ǔनयम-14(vi) के अÛतग[त संचया×मक Ĥभाव से इनकȧ दो वेतनवृͪƨ

रोकने का दÖड Ĥèताͪवत करते हुए ͪवभागीय पğांक-8195, Ǒदनांक 02.11.2018 ɮवारा Įी बारला

से ɮͪवतीय कारण पृÍछा कȧ माँग कȧ गयी, िजसके अनुपालन मɅ Įी बारला के पğांक-1/अ०,

Ǒदनांक 30.11.2018 ɮवारा ɮͪवतीय कारण पृÍछा का जवाब समͪप[त ͩकया गया।

Įी बारला से ĤाÜत ɮͪवतीय कारण पृÍछा के समी¢ोपरांत, ͪवभागीय संकãप सं०-447(HRMS),

Ǒदनांक 05.02.2019 ɮवारा झारखÖड सरकारȣ सेवक (वगȸकरण, Ǔनयंğण एवं अपील) Ǔनयमावलȣ,

2016 के Ǔनयम-14(vi) के तहत संचया×मक Ĥभाव से दो वेतन वृͪƨ रोक का दÖड

अͬधरोͪपत ͩकया गया। उÈत दÖड के ͪवǾƨ Įी बारला के पğांक-01, Ǒदनांक 15.02.2019

ɮवारा अपील अßयावेदन समͪप[त ͩकया गया, जो मुÉयमंğी सͬचवालय, झारखÖड के

पğांक-2701115,

Įी बारला ɮवारा समͪप[त अपील अßयावेदन के समी¢ोपरांत उनके अपील अßयावेदन को

अèवीकृत करते हुए ͪवभागीय संकãप सं0-1763(HRMS), Ǒदनांक 15.04.2019 ɮवारा झारखÖड

सरकारȣ सेवक (वगȸकरण, Ǔनयंğण एवं अपील) Ǔनयमावलȣ, 2016 के Ǔनयम-14(vi) के तहत

संचया×मक Ĥभाव से दो वेतनवृͪƨ रोक के दÖड को यथावत् रखा गया ।

Įी बारला के ͪवǾƨ अͬधरोͪपत उÈत दÖड (संचया×मक Ĥभाव से दो वेतन वृͪƨ पर रोक का दÖड)

एवं संकãप सं०-1763(HRMS), Ǒदनांक 15.04.2019, िजसके ɮवारा उनका अपील आवेदन

अèवीकृत ͩकया गया था, को माननीय झारखÖड उÍच Ûयायालय ɮवारा W.P.(S)No 4757/2021

एवं I.A.No. 7626/2022 मɅ Ǒदनांक 15.03.2023 को पाǐरत Ûयायादेश मɅ खाǐरज कर Ǒदया गया

है। मा० Ûयायालय ɮवारा Ǒदनांक 15.03.2023 को पाǐरत Ûयायादेश का काय[कारȣ अंश

Ǔनàनवत् है-

"18. The initiation of the departmental proceeding seems to be on account of an

enquiry conducted by the petitioner pursuant to the direction of the Member of

Parliament-cum-Chairman, District Vigilance-cum-Monitoring Committee, Chatra in

which certain financial irregularities were detected in the Public Distribution

System and since it was stated in the report submitted by the petitioner that the

matter is of serious nature in which there was involvement of the senior officers

of the department in illegal gratification, the same should be enquired into by the

CBI or the Vigilance Department. The fall out of such report of the petitioner led

to initiation of a departmental proceeding and its consequences of being inflicted

with stoppage of two increments with cumulative effect. The enquiry report as has

been stated above and at the cost of repetition would suggest that the same is

bereft of any oral evidence and the entire enquiry is based on documentary

evidence which is contrary to the law laid down by the Hon’ble Supreme Court in

the case of State of Uttar Pradesh and others v. Saroj Kumar Sinha (supra) and

Roop Singh Negi v. Punjab National Bank and others (supra). The act of the

enquiry officer in conducting the enquiry in a manner which is contrary to the

settled principles of law, has deprived the petitioner of a reasonable opportunity to

defend himself with respect to contents of the documents which forms the basis

of the enquiry report and the contents of which as noted above were not proved

by the concerned officials. On account of the continuation of the departmental

proceeding for almost a decade the petitioner has met with a deprivation of being

denied promotions on three occasions though juniors to the petitioner have been

granted promotion and one of the prayers made in this writ application is also

with respect to the same.

19. Thus in view of what has been discussed above, the order of punishment as

contained in Memo No. 5/Aarop-1-217/2014-447(HRMS)/Ranchi dated 05.02.2019

and the Resolution dated 15.04.2019 dismissing the appeal preferred by the

petitioner, are quashed and set aside with a further direction to the respondents

to pay all the consequential benefits on account of setting aside the impugned

orders. So far as the prayer for promotion and other consequential benefits

relating to such promotion are concerned, the petitioner is directed to submit a

detailed representation before the respondent No. 2 within a period of two weeks

and on submission of such representation, the respondent No. 2 shall pass a

detailed and speaking order within a period of six weeks thereafter."

अतः माननीय उÍच Ûयायालय झारखÖड ɮवारा W.P.(S) NO.4757/2021 एवं I.A.No.

7626/2022 मɅ Ǒदनांक 15.03.2023 को पाǐरत Ûयायादेश के आलोक मɅ Įी ͩफलǒबयूस बारला,

झा०Ĥ०से०, त×कालȣन िजला आपूǓत[ पदाͬधकारȣ, चतरा के ͪवǾƨ संकãप सं०-447(HRMS), Ǒदनांक

05.02.2019 ɮवारा अͬधरोͪपत संचया×मक Ĥभाव से दो वेतन वृͪƨ पर रोक का दÖड एवं अपील

आवेदन अèवीकृǓत संबंधी संकãप सं0-1763(HRMS) Ǒदनांक 15.04.2019 को ͪवलोͪपत ͩकया

जाता है ।
