Notification No.- 5/2023 – State Tax(Rate)

S.O. No. 29, Dated 24^th July, 2023--In exercise of the powers conferred by sub-section (1), sub-

section (3) and sub-section (4) of section 9, sub-section (1) of section 11, sub-section (5) of section 15,

sub-section (1) of section 16 and section 148 of the Jharkhand Goods and Services Tax Act, 2017 (12 of

2017), the Government of Jharkhand, on being satisfied that it is necessary in the public interest so to

do, on the recommendations of the Council, hereby makes the following further amendments in the

notification of the Government of Jharkhand, in the Commercial Taxes Department, No. 11/2017-State

Tax (Rate), dated the 29^th June, 2017, published in the Gazette of Jharkhand, Extraordinary, vide S.O.

No. 41, dated the 29^th June, 2017, namely:-

In the said notification, in the Table, against serial number 9, in item (iii), in sub-item (b), in the entries

under column (5), in condition (2), after the second proviso, the following provisos shall be inserted,

namely:-

“Provided also that the option for the Financial Year 2023-2024 shall be exercised on or before

the 31^st May, 2023:

Provided also that a GTA who commences new business or crosses threshold for registration

during any Financial Year, may exercise the option to itself pay GST on the services supplied by

it during that Financial Year by making a declaration in Annexure V before the expiry of forty-

five days from the date of applying for GST registration or one month from the date of obtaining

registration whichever is later.”.

This notification shall be deemed to be effective from the 9^th May, 2023.

Note: -The principal notification number 11/2017 - State Tax (Rate), dated the 29^th June, 2017 was

published in the Gazette of Jharkhand, Extraordinary, vide S.O. No. 41, dated the 29^th June, 2017 and

last amended vide notification number 03/2022- State Tax (Rate), dated the 23^rd August, 2022 published

in the official gazette vide S.O. No. 24, dated the 23^rd August, 2022.

(2017 का 12) कȧ धारा 9 कȧ उप धारा (1), उप धारा (3) और उप धारा (4), धारा 11 कȧ उप धारा

का Ĥयोग करते हुए, झारखÖड सरकार, इस बात से संतुç ट होते हुए ͩक ऐसा करना जनǑहत मɅ

आवæ यक है, और जीएसटȣ पǐरषद कȧ ͧसफाǐरशɉ के आधार पर, एतदɮवारा, झारखÖड सरकार,

वाͨणÏय-कर ͪवभाग कȧ अͬधसूचना संÉ या 11/2017- राÏय कर (दर), Ǒदनांक 29 जून, 2017, िजसे

एस. ओ. सं. 41,Ǒदनांक 29 जून, 2017 के तहत झारखÖड के राजपğ, असाधारण, मɅ Ĥकाͧशत ͩकया

गया था, मɅ और आगे भी Ǔनà नͧलͨखत संशोधन करती है, यथा:-

उÈत अͬधसूचना मɅ, सारणी मɅ, Đम संÉ या 9 के सम¢, मद (iii), उप मद (ख) मɅ, कॉलम (5)

कȧ Ĥͪविçट के अंतग[त, शत[ (2) मɅ, दूसरे परÛतुक के पæचात, Ǔनàनͧलͨखत परÛतुकɉ को

अंतःèथाͪपत ͩकया जाएगा, यथा-

“बशतɏ और भी ͩक ͪव× तीय वष[ 2023-24 के ͧलए यह ͪवकãप 31 मई, 2023 को या उसके

पहले तक अपनाया जा सकेगा:

बशतȶ और भी ͩक यǑद कोई जीटȣए, ͩकसी ͪव×तीय वष[ के दौरान नया åयापार शुǾ करता है या

उस वष[ मɅ Ǔनधा[ǐरत पंजीकरण कȧ Ġेशोãड सीमा को पार करता है तो वह उस ͪव×तीय वष[ के

दौरान आपूǓत[ कȧ गई सेवाओं पर जीएसटȣ का è वयं भुगतान करने के ͪवकãप का Ĥयोग

जीएसटȣ पंजीकरण के आवेदन ͩकए जाने कȧ तारȣख से पɇतालȣस Ǒदन पूरे हो जाने के पहले या

ऐसे पंजीकरण के हो जाने कȧ तारȣख से एक माह कȧ अवͬध पूण[ हो जाने के पहले, दोनɉ मɅ

जो भी बाद मɅ हो, अनुबंध V मɅ इस Ĥकार कȧ घोषणा करके कर सकता है।”।

यह अͬधसूचना Ǒदनांक 9 मई, 2023 से लागू मानी जाएगी ।

ͩकया गया था, के ɮवारा संशोधन ͩकया गया था ।
