संÉया- 576/3/ईवीएम/2023/एसडीआर/खÖड–II--यत:, लोक ĤǓतǓनͬध×व अͬधǓनयम, 1951 कȧ
धारा 61क मɅ यह उपबंध ͩकया गया है ͩक ऐसे Ǔनवा[चन ¢ेğ या Ǔनवा[चन ¢ेğɉ मɅ वोǑटंग मशीनɉ
ɮवारा मतदान और मतɉ के अͧभलेखन कȧ यथाͪवǑहत ऐसी रȣǓत अपनाई जाए, जैसी ͩक भारत
Ǔनवा[चन आयोग Ĥ×येक मामले कȧ पǐरिèथǓतयɉ को Úयान मɅ रखते हुए ͪवǓनǑद[çट करे; और
2.
यत: Ǔनवा[चनɉ का संचालन Ǔनयम, 1961 के Ǔनयम 49क के परÛतुक के अनुसार भारत
Ǔनवा[चन आयोग ɮवारा यथाअनुमोǑदत ऐसे ͫडजाइन वाला Ĝाप बॉÈस युÈत एक ͪĤंटर, ऐसे Ǔनवा[चन
¢ेğ या Ǔनवा[चन ¢ेğɉ या उसके भागɉ मɅ मत के पेपर Ěेल के मुġण के ͧलए मतदान मशीन के
साथ भी जोड़ा जाए जैसा ͩक भारत Ǔनवा[चन आयोग ɮवारा Ǔनदेश Ǒदया जाए;

यत:, Ǔनवा[चन आयोग ने Ĥेस नोट संÉया ईसीआई/Ĥे.नो./47/2023 Ǒदनांक 8 अगèत, 2023
के तहत घोͪषत झारखंड़ के 33-डुमरȣ ͪवधानसभा ¢ेğ, केरल के 98-पुतुÜपलȣ ͪवधानसभा ¢ेğ, ǒğपुरा
के 20-बÈसनगर एवं 23-धनपुर ͪवधानसभा Ǔनवा[चन ¢ेğɉ, पिæचम बंगाल के 15-धूपगुड़ी(अ०जा०)

ͪवधानसभा ¢ेğ, उ×तर Ĥदेश के 354-घोसी ͪवधानसभा ¢ेğ और उ×तराखÖड के 47-
बागेæवर(अ०जा०) ͪवधानसभा ¢ेğ के ͧलए चालू उप Ǔनवा[चनɉ मɅ, सभी Ǔनवा[चन ¢ेğɉ कȧ
पǐरिèथǓतयɉ पर ͪवचार ͩकया है, और Ǔनवा[चन आयोग संतुçट है ͩक उपयु[Èत ͪवधान सभा
Ǔनवा[चन ¢ेğɉ मɅ मतदान करवाने के ͧलए पया[Üत संÉया मɅ इलेÈटॉǓनक वोǑटंग मशीनɅ तथा पेपर
Ěेल [वोटर वेǐरफायबल पेपर ऑͫडट Ěेल (वीवीपैट)] मुǑġत करने के ͧलए ͪĤंटर उपलÞध हɇ, मतदान
काͧम[क, इलेÈटॉǓनक वोǑटंग मशीनɉ तथा वीवीपैट ͪĤंटर के द¢तापूण[ संचालन करने के ͧलए पूण[
Ĥͧशͯ¢त हɇ तथा Ǔनवा[चक भी इलेÈĚॉǓनक वोǑटंग मशीनɉ(ई वी एम) एवं वीवीपैट ͪĤंटरɉ कȧ
काय[Ĥणालȣ से पूण[तया पǐरͬचत हɇ ।

अतः अब, भारत Ǔनवा[चन आयोग, लोक ĤǓतǓनͬध×व अͬधǓनयम, 1951 कȧ उÈत धारा 61क
तथा Ǔनवा[चनɉ का संचालन Ǔनयम, 1961 के Ǔनयम 49क के अंतग[त अपनी शिÈतयɉ का Ĥयोग
करते हुए एतƧवारा Ǒदनांक 10.08.2023 को अͬधसूͬचत झारखंड़ के 33-डुमरȣ ͪवधानसभा ¢ेğ,
केरल के 98-पुतुÜपलȣ ͪवधानसभा ¢ेğ, ǒğपुरा के 20-बÈसनगर एवं 23-धनपुर ͪवधानसभा Ǔनवा[चन
¢ेğɉ, पिæचम बंगाल के 15-धूपगुड़ी (अ०जा०)ͪवधानसभा ¢ेğ, उ×तर Ĥदेश के 354-घोसी ͪवधानसभा
¢ेğ और उ×तराखÖड के 47-बागेæवर (अ०जा०) ͪवधानसभा Ǔनवा[चन ¢ेğɉ को, ऐसे Ǔनवा[चन ¢ेğɉ के
Ǿप मɅ ͪवǓनǑद[çट करता है, िजनमɅ Ǔनवा[चनɉ का संचालन Ǔनयम, 1961 और इस ͪवषय पर
Ǔनवा[चन आयोग ɮवारा समय-समय पर जारȣ ͩकए गए अनुपूरक अनुदेशɉ के अंतग[त ͪवǑहत तरȣके
से इलेÈĚॉǓनक वोǑटंग मशीनɉ तथा वीवीपैट ͪĤंटर के माÚयम से मत डाले और ǐरकॉड[ ͩकए जाएंगे।

Ǔनवा[चन आयोग, भारत इलेÈĚॉǓनÈस ͧलͧमटेड, बंगलोर तथा इलेÈĚॉǓनÈस कापȾरेशन ऑफ
इिÖडया ͧलͧमटेड, हैदराबाद ɮवारा ͪवकͧसत ͩकए गए इलेÈĚॉǓनक वोǑटंग मशीनɉ और वीवीपैट
ͪĤंटरɉ, िजÛहɅ सभी Ǔनवा[चन ¢ेğɉ मɅ मत डालने और ǐरकॉड[ करने के ͧलए उÈत मशीनɉ से जोड़ा
जाएगा, के ͫडजाइन को भी एतʊवारा अनुमोǑदत करता है ।

अधीन अंĒेजी भाषा मɅ उसका Ĥाͬधकृत पाठ समझा जायगा ।

No. 576/3/EVM/2023/SDR-Vol.-II--Whereas, Section 61A of the Representation of the
People Act, 1951, provides that the giving and recording of votes by voting machines in such
manner as may be prescribed, may be adopted in such constituency or constituencies as the Election
Commission of India may, having regard to the circumstances of each case, specify;

Whereas, as per the proviso to Rule 49A of the Conduct of Elections Rules, 1961, a printer
with a drop box of such design, as may be approved by the Election Commission of India, may also
be attached to voting machine for printing a paper trail of the vote, in such constituency or
constituencies or parts thereof as the Election Commission of India may direct;

Whereas, the Election Commission has considered the circumstances in current bye
elections to the 33-Dumri Assembly Constituency in Jharkhand, 98-Puthuppally Assembly
Constituency in Kerala, 20-Boxanagar and 23-Dhanpur Assembly Constituencies in Tripura,
15-Dhupguri(SC) Assembly Constituency in West Bengal, 354-Ghosi Assembly Constituency
in Uttar Pradesh and 47-Bageshwar(SC) Assembly Constituency in Uttarakhand, and is
satisfied that sufficient number of Electronic Voting Machines (EVMs) and Printers for printing
Paper Trail [Voter Verifiable Paper Audit Trail(VVPAT)] are available for taking the poll in the
above said Assembly Constituencies, the polling personnel are well trained in efficient handling of
EVMs and ‘VVPAT Printers’ and the electors are also fully conversant with the operation of the
EVMs and the VVPAT Printers;

Now, therefore, the Election Commission of India, in exercise of its powers under the said
Section 61A of the Representation of the People Act, 1951, and Rule 49A of the Conduct of
Elections Rules, 1961, hereby specifies current bye elections to the 33-Dumri Assembly
Constituency in Jharkhand, 98-Puthuppally Assembly Constituency in Kerala, 20-Boxanagar
and 23-Dhanpur Assembly Constituencies in Tripura, 15-Dhupguri (SC) Assembly
Constituency in West Bengal, 354-Ghosi Assembly Constituency in Uttar Pradesh and 47-
Bageshwar (SC) Assembly Constituency in Uttarakhand, notified on 10th August, 2023, as the
constituencies in which the votes, shall be given and recorded by means of EVMs and VVPAT
printers in the manner prescribed, under the Conduct of Elections Rules, 1961, and the
supplementary instructions issued by the Election Commission from time to time on the subject.

The Election Commission also hereby approves the design of EVMs and VVPAT Printers as
developed by the Bharat Electronics Ltd., Bangalore and Electronics Corporation of India Ltd.,
Hyderabad, which shall be attached to the said machines, to be used for the giving and recording of
votes in all the Constituencies.
