Notification No.- 36/2023 – State Tax

S.O. No. 47, Dated 12^th December, 2023--In exercise of the powers conferred by section 148 of the

Jharkhand Goods and Services Tax Act, 2017 (12 of 2017) (hereinafter referred to as the said Act), the

Government of Jharkhand, on the recommendations of the Council, hereby notifies the electronic

commerce operator who is required to collect tax at source under section 52 as the class of persons who

shall follow the following special procedure in respect of supply of goods made through it by the

persons paying tax under section 10 of the said Act (herein after referred to as the said person),

namely:—

(i) The electronic commerce operator shall not allow any inter-State supply of goods through it by the

said person;

(ii) the electronic commerce operator shall collect tax at source under sub-section (1) of section 52 of

the said Act in respect of supply of goods made through it by the said person and pay to the

Government as per provisions of sub-section (3) of section 52 of the said Act; and

(iii) the electronic commerce operator shall furnish the details of supplies of goods made through it

by the said person in the statement in FORM GSTR-8 electronically on the common portal.

2. This notification shall be deemed to be effective from the 1^st day of October, 2023.

एस. ओ. सं. 47, Ǒदनांक 12 Ǒदसàबर, 2023 --झारखÖड सरकार, झारखÖड माल और सेवा कर

अͬधǓनयम, 2017 (2017 का 12) (िजसे इसमɅ इसके पæचात् उÈत अͬधǓनयम कहा गया है) कȧ धारा

148 ɮवारा Ĥद× त शिÈ तयɉ का Ĥयोग करते हुए, पǐरषद कȧ ͧसफाǐरशɉ पर, इलैÈĚोǓनक वाͨणÏय

Ĥचालक को अͬधसूͬचत करती है िजससे ऐसे åयिÈतयɉ के वग[ के ǽप मɅ धारा 52 के अधीन İोत पर

कर का संĒहण ͩकया जाना अपेͯ¢त है जो उÈत अͬधǓनयम कȧ धारा 10 के अधीन कर का संदाय

करने वाले åयिÈत (िजसे इसमɅ इसके पæचात् उÈत åयिÈत कहा गया है) ɮवारा इसके माÚयम से कȧ

गई माल कȧ पूǓत[ के संबंध मɅ Ǔनàनͧलͨखत ͪवशेष ĤͩĐया का अनुसरण करɅगे, अथा[तः-

(i)

इलैÈĚाǓनक वाͨणÏय Ĥचालक उÈत åयिÈत ɮवारा इसके माÚयम से कȧ गई मालɉ कȧ ͩकसी

अंतर-राÏयीय पूǓत[ को अनु£ात नहȣं करेगा ;

(ii)

इलैÈĚाǓनक वाͨणÏय Ĥचालक उÈत åयिÈत ɮवारा इसके माÚयम से कȧ गई मालɉ कȧ पूǓत[

के संबंध मɅ उÈत अͬधǓनयम कȧ धारा 52 कȧ उपधारा (1) के अधीन İोत पर कर का

संĒहण करेगा और उÈत अͬधǓनयम कȧ धारा 52 कȧ उपधारा (3) के उपबंधɉ के अनुसार

सरकार को संदाय करेगा ; और

(iii)

इलैÈĚाǓनक वाͨणÏय Ĥचालक उÈत åयिÈत ɮवारा इसके माÚयम से कȧ गई मालɉ कȧ पूǓत[

के Þयौरे सामाÛय पोट[ल पर इलैÈĚाǓनक ǽप से Ĥǽप जीएसटȣआर-8 मɅ ͪववरण के ǽप मɅ

Ĥèतुत करेगा ।
