1948 (11,1948) कȧ धारा-3 कȧ उप धारा-(1) के साथ के खÖड (बी) ɮवारा Ĥदƣ शिÈतयɉ का

Ĥयोग करते हुए राÏयपाल, झारखÖड ɮवारा राÏय मɅ Ǔनàनͧलͨखत अनुसूͬचत Ǔनयोजनɉ मɅ Ǔनयोिजत

कुछ कोǑट के कम[चाǐरयɉ के ͧलए Ǔनधा[ǐरत Ûयूनतम मजदूरȣ कȧ दरɉ को पुनरȣ¢ण करना चाहते हɇ।

इससे संबंͬधत Ĥèताव का Ǔनàनांͩकत ĤाǾप उÈत अͬधǓनयम कȧ धारा-5 कȧ उप धारा-(1) के खÖड

(ख) कȧ अपे¢ानुसार इसके ɮवारा Ĥभाͪवत हो सकने वाले åयिÈतयɉ कȧ जानकारȣ के ͧलए Ĥकाͧशत

ͩकया जाता है और यह सूचना दȣ जाती है ͩक झारखÖड गजट मɅ इस अͬधसूचना के Ĥकाशन कȧ

तारȣख से दो महȣने के बाद उÈत Ĥèताव पर ͪवचार ͩकया जायेगा ।

दो महȣने कȧ उÈत अवͬध कȧ समािÜत कȧ तारȣख को या इसके पहले इस Ĥèताव के संबंध

मɅ ͩकसी åयिÈत से जो भी आपͪƣ या सूझाव ĤाÜत होगा उस पर राÏय सरकार ͪवचार करेगी ।

Ǒदनांक 11 अÈटूबर 2023 को झारखÖड Ûयूनतम मजदूरȣ परामष[दातृ पष[द के बैठक मɅ हुए

सहमǓत के आलोक मɅ Ûयूनतम मजदूरȣ पुनरȣ¢ण हेतु Ǔनधा[ǐरत 90 अͬधसूͬचत Ǔनयोजनɉ (12 खÖड

दर Ǔनयोजन सǑहत) का वगȸकरण एवं झारखÖड राÏय के ¢ेğɉ का वगȸकरण Ǔनàनवत ͩकया जाता

है। इसमɅ “झारखÖड राÏय मɅ सरकारȣ काया[लयɉ /उपĐमɉ /बोड[ / èथानीय Ǔनकायɉ मɅ काय[रत

कम[चाǐरयɉ के Ǔनयोजन“ को भी शाͧमल कर ͧलया गया है ।

(ख) 1 अÈटूबर 2023 से Ǔनधा[ǐरत Ûयूनतम मजदूरȣ पर 15% वृɮͬध कर भाग ‘ख‘ के अतंग[त

आनेवाले ‘C‘ ¢ेğ के Ǔनयोजनɉ के मूल मजदूरȣ का Ǔनधा[रण ͩकया जाता है ।

(ग) भाग ‘ख‘ के अतंग[त ‘B‘ ¢ेğ के Ǔनयोजनɉ हेतु ‘C‘ ¢ेğ के पुनरȣͯ¢त मूल मजदूरȣ को 1.05

से गुणा कर मूल मजदूरȣ कȧ दरɅ Ǔनधा[ǐरत ͩकया जाता है। तथा

(घ) भाग ‘ख‘ के अतंग[त ‘A‘ ¢ेğ के Ǔनयोजनɉ हेतु ‘C‘ ¢ेğ के पुनरȣͯ¢त मूल मजदूरȣ को 1.10

से गुणा कर मूल मजदूरȣ कȧ दरɅ Ǔनधा[ǐरत ͩकया जाता है ।

(ङ) भाग ‘क‘ के अतंग[त वगȸकृत Ǔनयोजनɉ हेतु ‘C‘ ¢ेğ के ͧलए उपयु[Èत Đमांक (ख) ɮवारा

Ǔनधा[ǐरत ͩकए गए मूल मजदूरȣ को 1.05 से गुणा कर मूल मजदूरȣ कȧ दरɅ Ǔनधा[ǐरत ͩकया

जाता है ।

(च)

इस Ĥकार पुनरȣͯ¢त मजदूरȣ कȧ Ûयूनतम दरɅ उÈत अͬधǓनयम कȧ धारा-4 कȧ उप धारा-(1)

के खÖड-(III) के अंतग[त होगी ।

3. यह अͬधसूचना Ǔनग[त होने कȧ Ǔतͬथ से Ĥभावी होगी ।

ǑटÜपणी:-

(क)

Ûयूनतम मजदूरȣ कȧ दरɉ का पुनरȣ¢ण अͨखल भारतीय उपभोÈता मूãय सूचकांक 386, जो

जुन, 2023 के सूचकांक व झारखÖड Ûयूनतम मजदूरȣ परामष[दातृ पष[द कȧ बैठक मɅ हुए

सहमǓत/ͪवमश[ पर आधाǐरत है ।

(ख) झारखÖड Ûयूनतम मजदूरȣ परामष[दातृ पष[द कȧ सहमǓत के आलोक मɅ पुनरȣͯ¢त मजदूरȣ

कȧ दरɅ पूणाɍक (round off) मɅ पǐरवǓत[त कर Ǒदया गया है ।

(ग)

Ûयूनतम मजदूरȣ कȧ Ĥèताͪवत दरɅ Ûयूनतम मजदूरȣ अͬधǓनयम, 1948 कȧ धारा-4 कȧ उप

धारा-4(1) के खÖड (III) के अÛतग[त हɉगी ।

(घ)

माͧसक मजदूरȣ कȧ दरɉ का दैǓनक मजदूरȣ कȧ दरɉ मɅ तथा दैǓनक मजदूरȣ कȧ दरɉ का

माͧसक मजदूरȣ कȧ दरɉ मɅ ǽपांतरण Đमशः 26 से भाग दे कर और 26 से गुणा कर के

ͩकया जाएगा ।

(ङ)

Ûयूनतम मजदूरȣ कȧ उपयु[Èत Ĥèताͪवत दरɉ मɅ सात Ǒदनɉ कȧ अवͬध मɅ ͪवĮाम के Ǒदन के

ͧलए कम[चाǐरयɉ को देय पाǐरĮͧमक शाͧमल है ।

(च)

साÜताǑहक ͪवĮाम के Ǒदन काम करने वाला कम[चारȣ Ûयूनतम मजदूरȣ Ǔनयमावलȣ, 1951 के

Ǔनयम-25 मɅ ͪवǑहत दर से समयोपǐर काम का भुगतान पाने का हकदार होगा ।

(छ)

पुǽष या èğी कामगार एक हȣ काम या उसी Ĥकार के काम के ͧलए समान दर पर मजदूरȣ

पायɅगे ।

F.N-01/Shrama.ka./Jha.Nyu.Ma.Pra.Sh./02/2019 Shra.Ni. 09--In exercise of the powers

conferred by clause (b) of sub-section (1) of section 3 of the Minimum Wages Act, 1948(11,1948),

the Governor of Jharkhand, in the powers conferred by the Governor, Jharkhand on certain categories

of employees employed in the following scheduled employments in the state want to revise the basic

rate of minimum wages prescribed for. The following draft of the proposal related to this is published

as per the requirement of clause (b) of sub- section (1) of section 5 of the said Act for the information

of the persons who may be affected by it and is informed that in Jharkhand Gazette the said proposal

will be considered after two months from the date of publication of this notification.

On or before the date of expiry of the said period of two months, whatever objections or

suggestions are received from any person regarding this proposal, the state government will

consider it.

In the light of the consensus reaches in the meeting of Jharkhand Minimum Wages Advisory

Board on October 11, 2023, the classification of 90 notified schedule Employments (including 12

Piece rated schedule Employments) fixed for the minimum wage revision and the classification of

areas of Jharkhand state is made as follows. It also includes “Employment of employees working in

From October 1, 2023, the basic wage of the ‘C’ area employments falling under Part ‘[k’ are

determined by increasing the minimum wage by 15%.

(c)

Under part ‘[k’, for employments in ‘B’ area, the basic wage rates are determined by

multiplying the revised basic wage of ‘C’ area by 1.05 and

(d)

Under part ‘[k’, for employments in ‘A’ area, the basic wage rates are determined by

multiplying the revised basic wage of ‘C’ area by 1.10.

(e)

For employments classified under part ‘d’ , the basic wage rates for ‘C’ area are determined

by multiplying the basic wage determined by above mentioned number(e) by 1.10.

The Minimum rates of wages thus revised will be under clause(III) of sub-section (1)

section 4 of the said Act.

This notification will be effective from the date of issue.

NOTE:-

(a) The Basic rates of Minimum wages above are based on the All India Consumer Price

Index Number 386, which is Price Index of June, 2023

(b) In the light of the consent of Jharkhand Minimum wage Advisory Board, the revised wage

tax rates have been rounded off.

section (1) of section-4 of the Minimum Wages Act, 1948.

(d) Conversion of the monthly rates of wages into daily rates of wages and viceversa shall be

worked out by dividing the monthly rates by 26 and multiplying the daily rates by 26.

(e) The proposed rates of Minimum Wages above include the remuneration payable to the

employees in respect of the day of rest in every period of seven days.

(f) An employee shall, for the work done on the weekly day of rest, be entitled to overtime

payment of the rate prescribed in rule-25 of the Jharkhand Minimum Wages Rules-1951.

(g) Men and Women workers shall get the same rates of wages for the work ofa similar

nature .
