आदेश सं0-1839/जे0, Ǒदनांक-28.05.2002 ɮवारा Įी ͧसंह के ͪवǾɮध अͧभयोजन èवीकृǓत Ĥदान
कȧ गयी एवं माननीय ͪवशेष Ûयायाधीश (Ǔनगरानी), पटना के Ûयायालय मɅ आरोप पğ सं0-
05/2002, Ǒदनांक 06.07.2002 समͪप[त ͩकया गया ।

3 पुͧलस अधी¢क, Ǔनगरानी अÛवेषण Þयूरो, ǒबहार, पटना के पğांक-751, Ǒदनांक-
27.08.2014 ɮवारा Ǔनगरानी थाना काÖड संÉया-48/92 मɅ माननीय ͪवशेष Ûयायालय Ǔनगरानी,
पटना ɮवारा Ǒदनांक- 30.03.2013 को पǐरत आदेश कȧ ĤǓत उपलÞध कराई गई, िजसका
operative part Ǔनàनवत है:-
“Considering the above facts and circumstances of the case and submissions
made on behalf of the parties, convicts namely 1. Chandra Shekhar Singh, 2.
Umesh Prasad Singh 3. Uma Shankar Yadav, 4. Manohar Prasad Gupta and 5.
Bageshwari Prasad Singh each of the convicts are hereby sentenced to undergo
Rigorous Imprisonment for a period of one (1) year under section 120-B I.P.C.
They are hereby further sentenced to undergo for a period of two (2) years
Rigorous Imprisonment U/S 420/34 I.P.C.. They are hereby further sentenced to
undergo Rigorous Imprisonment for a period of 3 (three) years U/S 468 I.P.C..
They all are hereby further sentenced to undergo Rigorous Imprisonment for a
period of 3 (three) years U/S 477-A I.P.C.. They all are hereby further sentenced
to undergo Rigorous Imprisonment for a period of (two) 2 years and a fine of Rs.
1000/- (Rs. One thousand) each only U/S 201 I.P.C and in default of payment of
fine three (3) months Rigorous Imprisonment. They are hereby further sentenced to
undergo Rigorous Imprisonment for a period of 2 (two) years U/S 5(2) of
Prevention of Corruption Act, 1947 corresponding to Section 13(2) of Prevention of
Corruption Act, 1988. All the sentences shall run concurrently. The period already
undergone as under trial prisoners shall be set off from the period of sentences
passed today under the provision of Section 428 Cr. P.C’’

Ǔनगरानी थाना कांड सं0-40/92 मɅ माननीय ͪवशेष Ûयायाधीश Ǔनगरानी, पटना के
Ûयायालय ɮवारा Įी ͧसंह को दिÖडत ͩकये जाने के कारण इनके ͪवǽɮध झारखÖड पɅशन Ǔनयमावलȣ
के Ǔनयम-43(क) के अंतग[त उनकȧ समूची पɅशन पर रोक के Ĥèताͪवत दÖड पर ͪवभागीय पğांक-
5927, Ǒदनांक 24.07.2019 ɮवारा Įी ͧसंह से कारण पृÍछा कȧ माँग कȧ गयी। इसके अनुपालन मɅ
Įी ͧसंह के पğ, Ǒदनांक 06.09.2019 ɮवारा कारण पृÍछा का जवाब समͪप[त ͩकया गया।

Įी ͧसंह ɮवारा समͪप[त कारण पृÍछा के समी¢ोपरांत, ͪवभागीय संकãप सं०- 8874, Ǒदनांक
06.11.2019 ɮवारा उनके ͪवǽɮध झारखÖड पɅशन Ǔनयमावलȣ के Ǔनयम-43(क) के अंतग[त उनकȧ
समूची पɅशन पर रोक का दÖड अͬधरोͪपत ͩकया जाता है ।
6. उÈत अͬधरोͪपत दÖड के ͪवǾɮध Įी ͧसंह ɮवारा माननीय उÍच Ûयायालय मɅ ǐरट
याͬचका सं०-W.P.(S) No. 7281/2019 दायर ͩकया गया, िजसमɅ माननीय उÍच Ûयायालय ɮवारा
Ǒदनांक 19.06.2023 को पाǐरत Ûयायादेश मɅ Įी ͧसंह के ͪवǾɮध ͪवभागीय संकãप सं0-8874,
Ǒदनांक 06.11.2019 ɮवारा झारखÖड पɅशन Ǔनयमावलȣ के Ǔनयम-43(क) के तहत् अͬधरोͪपत
आजीवन पɅशन के रोक के दÖड को रɮद कर Ǒदया गया। आदेश का काय[कारȣ अंश Ǔनàनवत् है-

"In the case in hand, it is evident that the impugned resolution, withholding
the entire pension of the petitioner, has been issued invoking the power under rule
43(a) of the Rules, 2000 on the ground of passing of the judgment of conviction
and order of sentence in Vigilance P.S. Case No. 48 of 1992 which has instituted
during the service period of the petitioner and, therefore, the same will be treated
as his past conduct and not future conduct while receiving pension.
In view of the aforesaid discussions, the impugned resolution as
contained in memo no. 8874 dated 6th November, 2019 (Annexure-6) issued under
the signature of the respondent no. 2 by the order of the Hon'ble Governor,
Jharkhand cannot be sustained in laws and the same is hereby quashed.
The respondent- State is, however, at liberty to take appropriate
recourse against the petitioner, if the same is permissible under law.
The writ petition is accordingly allowed."
7. उÈत पाǐरत Ûयायादेश के आलोक मɅ आरोपी पदाͬधकारȣ Įी ͧसंह, सेवाǓनवृƣ झा०Ĥ०से०
के ͪवǾɮध झारखÖड पɅशन Ǔनयमावलȣ के Ǔनयम-43(बी) के तहत् पुनः नये सीरे से ͪवभागीय
काय[वाहȣ Ĥारंभ करने के ǒबÛदु पर ͪवͬध ͪवभाग, झारखÖड के माÚयम से ͪवɮवान महाͬधवÈता का
परामश[ ĤाÜत ͩकया गया है ।
8. अतः माननीय उÍच Ûयायालय ɮवारा Ǒदनांक 19.06.2023 को पाǐरत Ûयायादेश एवं
ͪवɮवान महाͬधवÈता से ĤाÜत परामश[ के आलोक मɅ Įी ͧसंह के ͪवǾɮध ͪवभागीय संकãप सं०-
8874, Ǒदनांक 06.11.2019 ɮवारा झारखÖड पɅशन Ǔनयमावलȣ के Ǔनयम-43(क) के तहत् अͬधरोͪपत
आजीवन पɅशन रोकने से संबंͬधत दÖडादेश को रɮद ͩकया जाता है ।
आदेश :- आदेश Ǒदया जाता है ͩक इस संकãप को झारखÖड राजपğ के आसाधारण अंक मɅ Ĥकाͧशत
ͩकया जाय तथा इसकȧ एक ĤǓत Įी चÛġशेखर ͧसंह, सेवाǓनवृƣ झा०Ĥ०से० एवं अÛय
संबंͬधत को दȣ जाय ।
