Notification No.- 15/2023 – State Tax(Rate)

S.O. No. 62, Dated 05^th March, 2024--In exercise of the powers conferred by sub-section (3) of

section 54 of the Jharkhand Goods and Services Tax Act, 2017 (12 of 2017), the Government of

Jharkhand, on being satisfied that it is necessary in the public interest so to do, on the recommendations

of the Council, hereby makes the following amendments in the notification of the Government of

Jharkhand, in the Commercial Taxes Department No. 15/2017-State Tax (Rate), dated the 29^th June,

2017, published in the Gazette of Jharkhand, Extraordinary, vide S.O. No. 45, dated the 29^th June, 2017,

namely:-

In the said notification, in opening paragraph, for the words, brackets, letters and figures

“specified in sub-item (b) of item 5 of Schedule II of the Jharkhand Goods and Services Tax Act”, the

words, “of construction of a complex, building or a part thereof, intended for sale to a buyer, wholly or

partly, where the amount charged from the recipient of service includes the value of land or undivided

share of land, as the case may be, except where the entire consideration has been received after issuance

of completion certificate , where required , by the competent authority or after its first occupation ,

whichever is earlier”, shall be substituted.

This notification shall be deemed to be effective from the 20^th day of October, 2023.

(2017 का 12) कȧ धारा 54 कȧ उप-धारा (3) ɮवारा Ĥदƣ शिÈतयɉ का Ĥयोग करते हुए, झारखÖड

सरकार इस बात से संतुçट होने पर ͩक साव[जǓनक Ǒहत मɅ ऐसा करना आवæयक है और पǐरषद कȧ

ͧसफाǐरशɉ के आधार पर, एतदɮवारा, झारखÖड सरकार, वाͨणÏय-कर ͪवभाग कȧ अͬधसूचना संÉ या

15/2017- राÏय कर (दर), Ǒदनांक 29 जून, 2017, िजसे एस.ओ. सं. 45, Ǒदनांक 29 जून, 2017 के

तहत झारखÖड के राजपğ, असाधारण, मɅ Ĥकाͧशत ͩकया गया था, मɅ Ǔनàनͧलͨखत संशोधन करती है,

यथा:-

उÈत अͬधसूचना मɅ, शुǽआती पैराĒाफ मɅ, शÞदɉ, कोçठक, अ¢रɉ और अंकɉ के ͧलए " झारखÖड

माल और सेवा कर अͬधǓनयम कȧ अनुसूची 2कȧ मद 5 के उप-मद (ख) मɅ ǓनǑद[çट" है शÞद, "एक

पǐरसर, भवन या उसके एक Ǒहèसे का Ǔनमा[ण, जो खरȣदार को पूरȣ तरह या आंͧशक Ǿप से ǒबĐȧ के

ͧलए है, जहां सेवा के ĤाÜतकता[ से लȣ गई राͧश मɅ भूͧम का मूãय या भूͧम का अͪवभािजत Ǒहèसा

शाͧमल है, जैसा भी मामला हो हो सकता है, ͧसवाय इसके ͩक संपूण[ ĤǓतफल पूण[ता Ĥमाण पğ जारȣ

होने के बाद, जहां आवæयक हो, स¢म Ĥाͬधकारȣ ɮवारा या उसके पहले कÞजे के बाद, जो भी पहले हो,

ĤाÜत हो गया हो", ĤǓतèथाͪपत ͩकया जाएगा ।

2. यह अͬधसूचना Ǒदनांक 20 अÈटूबर, 2023 से लागू मानी जाएगी ।
