संÉया- 576/3/ईवीएम/2024/एसडीआर/खÖड-। :- यतः, लोक ĤǓतǓनͬध×व अͬधǓनयम, 1951 कȧ धारा

61क मɅ यह उपबंध ͩकया गया है ͩक ऐसे Ǔनवा[चन ¢ेğ या Ǔनवा[चन ¢ेğɉ मɅ वोǑटंग मशीनɉ ɮवारा मतदान

और मतɉ के अͧभलेखन का यथाͪवǑहत ऐसा तरȣका अपनाया जाए, जैसा ͩक भारत Ǔनवा[चन आयोग ɮवारा

Ĥ×येक मामले कȧ पǐरिèथǓतयɉ को Úयान मɅ रखते हुए, ͪवǓनǑद[çट ͩकया जाए;

यतः, Ǔनवा[चनɉ का संचालन Ǔनयम, 1961 के Ǔनयम 49क के परÛतुक के अनुसार भारत Ǔनवा[चन

आयोग ɮवारा यथा-अनुमोǑदत ऐसे ͫडजाइन वाला Ĝॉप बॉÈस युÈत एक ͪĤंटर, ऐसे Ǔनवा[चन ¢ेğ या Ǔनवा[चन

¢ेğɉ या उसके भागɉ मɅ मत के पेपर Ěेल के मुġण के ͧलए मतदान मशीन के साथ भी जोड़ा जाए जैसा ͩक

भारत Ǔनवा[चन आयोग ɮवारा Ǔनदेश Ǒदया जाए;

यतः, Ǔनवा[चन आयोग ने अपने Ĥेस नोट सं. ईसीआई/पीएन/23/2024 और ईसीआई/पीएन/24/2024

Ǒदनांक 16 माच[, 2024 के जǐरए घोͪषत ͩकए लोक सभा के सभी संसदȣय Ǔनवा[चन ¢ेğɉ, आंĢ Ĥदेश,

अǽणाचल Ĥदेश, ओͫडशा और ͧसिÈकम कȧ सभी ͪवधान सभा Ǔनवा[चन ¢ेğɉ के वत[मान साधारण Ǔनवा[चन,

2024 और 13 राÏयɉ मɅ 26 ͪवधान सभा Ǔनवा[चन ¢ेğɉ (अनुलÊनक-1 के अनुसार) के वत[मान उप-Ǔनवा[चनɉ

मɅ सभी पǐरिèथǓतयɉ पर ͪवचार ͩकया है और इस बात का समाधान हो गया है ͩक सभी संसदȣय Ǔनवा[चन

¢ेğɉ और आंĢ Ĥदेश, अǽणाचल Ĥदेश, ओͫडशा और ͧसिÈकम के सभी ͪवधान सभा Ǔनवा[चन ¢ेğɉ और 13

राÏयɉ के 26 ͪवधान सभा Ǔनवा[चन ¢ेğɉ (अनुलÊनक-1 के अनुसार) मɅ मतदान कराने के ͧलए पया[Üत संÉया

मɅ इलेÈĚॉǓनक वोǑटंग मशीन (ईवीएम) और पेपर Ěेल [मतदाता स×यापनीय पेपर ऑͫडट Ěेल मशीन

(वीवीपैट)] मुǑġत करने के ͧलए ͪĤंटर उपलÞध हɇ। मतदान काͧम[क ईवीएम और वीवीपैट ͪĤंटरɉ को

कुशलतापूव[क संभालने मɅ अÍछȤ तरह से Ĥͧशͯ¢त हɇ और मतदाता भी ईवीएम और वीवीपैट ͪĤंटरɉ के

Ĥचालन से पूण[ Ǿप से अवगत हɇ।

अब, इसͧलए, भारत Ǔनवा[चन आयोग, लोक ĤǓतǓनͬध×व अͬधǓनयम, 1951 कȧ उÈत धारा 61क तथा

Ǔनवा[चनɉ का संचालन Ǔनयम, 1961 के Ǔनयम 49क के तहत अपनी शिÈतयɉ का Ĥयोग करते हुए,

एतɮɮवारा, Ǔनवा[चन आयोग ɮवारा Ǒदनांक 16 माच[, 2024 को घोͪषत काय[Đम के अनुसार, वत[मान साधारण

Ǔनवा[चन, 2024 मɅ लोक सभा के सभी संसदȣय Ǔनवा[चन ¢ेğɉ, आंĢ Ĥदेश, अǽणाचल Ĥदेश, ओͫडशा और

ͧसिÈकम कȧ ͪवधान सभाओं के सभी Ǔनवा[चन ¢ेğɉ और वत[मान उप-Ǔनवा[चन मɅ 13 राÏयɉ मɅ 26 ͪवधान

सभा Ǔनवा[चन ¢ेğɉ (अनुलÊनक-1 के अनुसार) को ऐसे Ǔनवा[चन ¢ेğɉ के Ǿप मɅ ͪवǓनǑद[çट करता है, िजनमɅ

Ǔनवा[चनɉ का संचालन Ǔनयम, 1961 और इस ͪवषय पर Ǔनवा[चन आयोग ɮवारा समय-समय पर जारȣ ͩकए

गए अनुपूरक अनुदेशɉ के अंतग[त ͪवǑहत तरȣके से इलेÈĚॉǓनक वोǑटंग मशीनɉ तथा वीवीपैट ͪĤंटरɉ के माÚयम

से मत डाले और अͧभͧलͨखत ͩकए जाएंगे।

Ǔनवा[चन आयोग, एतɮɮवारा भारत इलेÈĚॉǓनÈस ͧलͧमटेड, बंगलोर तथा इलेÈĚॉǓनÈस कापȾरेशन ऑफ

इिÖडया ͧलͧमटेड, हैदराबाद ɮवारा यथा-ͪवकͧसत इलेÈĚॉǓनक वोǑटंग मशीनɉ और वीवीपैट ͪĤंटरɉ, िजÛहɅ सभी

Ǔनवा[चन ¢ेğɉ मɅ मत डालने और अͧभͧलͨखत करने के ͧलए उÈत मशीनɉ से जोड़ा जाएगा, के ͫडजाइन को

भी अनुमोǑदत करता है।

No.576/3/EVM/2024/SDR-Vol.-I :- Whereas, Section 61A of the Representation of the People Act,

1951, provides that the giving and recording of votes by voting machines in such manner as may be

prescribed, may be adopted in such constituency or constituencies as the Election Commission of India may,

having regard to the circumstances of each case, specify;

Whereas, as per the proviso to Rule 49A of the Conduct of Elections Rules, 1961, a printer with a

drop box of such design, as may be approved by the Election Commission of India, may also be attached to

voting machine for printing a paper trail of the vote, in such constituency or constituencies or parts thereof

as the Election Commission of India may direct;

Whereas, the Election Commission has considered the circumstances in all the Parliamentary

Constituencies of Lok Sabha, all the Assembly Constituencies of Andhra Pradesh, Arunachal Pradesh,

Odisha & Sikkim at the current general elections, 2024 and in 26 Assembly Constituencies (as per

Annexure-1) in 13 States at the current bye-elections, announced vide the Election Commission’s Press

Notes No. ECI/PN/23/2024 & ECI/PN/24/2024 both dated 16^th, March 2024, and is satisfied that sufficient

number of Electronic Voting Machines (EVMs) and Printers for printing Paper Trail [Voter Verifiable Paper

Audit Trail(VVPAT)] are available for taking the poll in all the Parliamentary Constituencies and all the

Assembly Constituencies of Andhra Pradesh, Arunachal Pradesh, Odisha and Sikkim and in 26 Assembly

Constituencies (as per Annexure-1) of 13 States. The polling personnel are well trained in efficient handling

of EVMs and ‘VVPAT Printers’ and the electors are also fully conversant with the operation of the EVMs and

the VVPAT Printers;

Now, therefore, the Election Commission of India, in exercise of its powers under the said Section

61A of the Representation of the People Act, 1951, and Rule 49A of the Conduct of Elections Rules, 1961,

hereby specifies all the Parliamentary Constituencies of the Lok Sabha, all the Assembly Constituencies of

the legislative assemblies of Andhra Pradesh, Arunachal Pradesh, Odisha & Sikkim at the current General

Elections, 2024 and 26 Assembly Constituencies (as per Annexure-1) in 13 states at the current bye-

election, as per the schedule announced by the Election Commission on 16^th March, 2024, as the

constituencies in which the votes, shall be given and recorded by means of EVMs and VVPAT printers in the

manner prescribed, under the Conduct of Elections Rules, 1961, and the supplementary instructions issued

by the Election Commission from time to time on the subject.

The Election Commission also hereby approves the design of EVMs and VVPAT Printers as developed

by the Bharat Electronics Ltd., Bangalore and Electronics Corporation of India Ltd., Hyderabad, which shall be

attached to the said machines, to be used for the giving and recording of votes in all the Constituencies.
