कराया गया है। आरोप पğ मɅ इनके ͪवǾɮध Ǔनàनवत् आरोप ĤǓतवेǑदत ͩकया गया-

1. Įी Ĥभात भूषण ͧसंह राँची िजला अÛतग[त कांके अंचल मɅ Ǒदनांक 12.05.2016 से 28.02.2019

तक अंचल अͬधकारȣ, कांके के पद पर पदèथाͪपत थे। उप समाहता[ भूͧम सुधार, सदर, राँची एवं

अंचल अͬधकारȣ, कांके के संयुÈत जाँच ĤǓतवेदन पğांक-1340(ii), Ǒदनांक 22.06.2019 मɅ èपçट है

ͩक मौजा-चामा, थाना नं0-55, खाता सं0-87, Üलॉट सं0-1232 मɅ संधाǐरत वष[ 2018-19 मɅ संǑदÊध

जमाबंदȣ को ǒबना सं£ान मɅ ͧलए गैरमजǾआ माͧलक खाते कȧ भूͧम का दाͨखल खाǐरज ͩकया गया

है। उÈत कृ×य एवं आचरण, कत[åय के ĤǓत असंवेदनशीलता को भी Ĥमाͨणत करता है। उÈत के

ͧलए Įी Ĥभात भूषण ͧसंह Ĥथम Ǻçɪया दोषी है ।

2. कांके अंचल अÛतग[त मौजा-चामा, थाना नं0-55, खाता सं0-87 सवȶ खǓतयान मɅ गैरमजǾआ

माͧलक परती कदȣम दज[ है। Įी Ĥभात भूषण ͧसंह, त×कालȣन अंचल अͬधकारȣ, कांके मौजा-चामा,

थाना नं0-55, खाता सं0-87, Üलॉट सं0-1232 अÛतग[त नामांतरण वाद संÉया-5238 R27/2018-

19, 5232 R27/2018-19, 5235 R27/2018-19, 5239 R27/2018-19, 5240 R27/2018-19,

åयिÈतयɉ के नाम से कागजातɉ का ǒबना जाँच ͩकये हȣ नामाÛतरण èवीकृत ͩकया गया है, िजसके

कारण पंजी-II के ͪवͧभÛन पृçठɉ पर जमाबंदȣ कायम हुई। उपरोÈत अंͩकत सभी जमाबंदȣ मौजा-चामा

के आनलाईन पंजी-II के भाग संÉया-2, पृçठ सं0-115 मɅ अंͩकत जमाबंदȣ रैयत आमोद कुमार,

ͪपता- रामनारायण शमा[ के जमाबंदȣ से घटाया गया है। मौजा-चामा के खाता सं0-87, Üलॉट सं0-

1232 भूͧम गैरमजǾआ माͧलक ͩकèम परती कदȣम भूͧम है। Ĥæनगत भूͧम के संदभ[ मɅ

ĤकृǓत/ͩकèम एवं उÈत भूͧम ĤǓतबंͬधत सूची मɅ इÛġाज है अथवा नहȣं का गहनतापूव[क जाँच नहȣं

ͩकया गया। गैरमजǾआ भूͧम पर ͪवĐेता आमोद कुमार के नाम कायम जमाबंदȣ Ǔनयͧमतकरण के

संदभ[ मɅ Įी Ĥभात भूषण ͧसंह, त×कालȣन अंचल अͬधकारȣ ɮवारा राजèव कागजातɉ का गहनापूव[क

ǒबना जाँच ͩकये हȣ नामाÛतरण èवीकृत ͩकया गया, िजसके कारण ͪवͧभÛन Đेताओं के नाम

आनलाईन पंजी-II के ͪवͧभÛन पृçठɉ पर नामाÛतरण उपरांत जमाबंदȣ कायम हुआ ।

Įी Ĥभात भूषण ͧसंह, त×कालȣन अंचल अͬधकारȣ, कांके अंचल ɮवारा नामाÛतरण कȧ èवीकृǓत हेतु

èथाͪपत ĤͩĐया, उपलÞध Ĥावधानɉ एवं राजèव कागजातɉ (खǓतयान/जमाबंदȣ पंजी-II /नÈशा/दज[

जमीन का ͩकèम/ĤकृǓत) से स×यापन कȧ अǓनवाय[ता को नजरअंदाज करते हुए Ǔनयम ͪवǾɮध

नामाÛतरण कȧ èवीकृǓत दȣ गयी। इस तØय को इंकार नहȣं ͩकया जा सकता है ͩक नामाÛतरण वादɉ

कȧ èवीकृǓत कȧ अनुशंसा करने के Đम मɅ राजèव उप Ǔनरȣ¢क एवं अंचल Ǔनरȣ¢क ɮवारा अपने

ͪवǑहत जाँच Ĥपğ मɅ अÍछाǑदत उÈत भूͧम का खǓतयान मɅ दज[ गैरमजǾआ माͧलक कȧ भूͧम को

अंͩकत नहȣं ͩकया गया होगा। अंचल अͬधकारȣ को अपने ¢ेğाÛतग[त सरकारȣ भूͧम के आंकड़ɉ को

सं£ान मɅ रखना ǓनताÛत आवæयक है ।

Ĥावधानानुसार गैरमजǾआ भूͧम इस मामले मɅ हèतांतरणीय नहȣं है। Ĥèतुत मामले मɅ

ĤǓतवेदनानुसार लगान Ǔनधा[रण वाद एवं भूͧम के रैयतीकरण से संदͧभ[त एम० फारम को Ĥथम

संǑदÊध बताया गया है। उÈत तØयɉ से अवगत रहते हुए नामाÛतरण वादɉ के Ǔनçपादन मɅ उपलÞध

Ĥावधानɉ एवं पǐरचाǐरत Ǔनदȶशɉ का अनुपालन नहȣं करते हुए ǓनयमͪवǾɮध नामाÛतरण वादɉ को

èवीकृǓत Ĥदान करने मɅ Įी ͧसंह Ĥथम Ǻçɪया दोषी हɇ ।

3. Įी Ĥभात भूषण ͧसंह, त×कालȣन अंचल अͬधकारȣ, कांके अंचल का उÈत आचरण Ĥथम Ǻçɪया

पूण[ शीलǓनçठा एवं कत[åय के ĤǓत Ǔनçठा मɅ अभाव को Ĥदͧश[त करता है, जो सरकारȣ सेवक आचार

Ǔनयामवलȣ के Ǔनयम-3(1)(i)(ii) एवं (iii) के ĤǓतकूल आचरण है ।

उÈत आरोपɉ के ͧलए ͪवभागीय अͬधसूचना सं0-5483, Ǒदनांक 27.05.2022 ɮवारा Įी ͧसंह को

Ǔनलंǒबत ͩकया गया तथा ͪवभागीय संकãप सं0-5484, Ǒदनांक 27.05.2022 ɮवारा इनके ͪवǾɮध

ͪवभागीय काय[वाहȣ संचाͧलत कȧ गई। संचालन पदाͬधकारȣ के पğांक-234, Ǒदनांक 06.10.2023

ɮवारा जाँच ĤǓतवेदन समͪप[त ͩकया गया है, िजसमɅ इनके ͪवǾɮध गǑठत सभी आरोप को Ĥमाͨणत

ĤǓतवेǑदत ͩकया गया ।

संचालन पदाͬधकारȣ से ĤाÜत जाँच ĤǓतवेदन के समी¢ोपरांत ͪवभागीय अͬधसूचना सं0-

25352(HRMS) Ǒदनांक 14.12.2023 ɮवारा Įी ͧसंह को Ǔनलंबन से मुÈत करते हुए यह Ǔनण[य

ͧलया गया ͩक Ǔनलंबन अवͬध मɅ जीवन Ǔनवा[ह भƣा के अǓतǐरÈत कुछ भी देय नहȣं होगा, परÛतु

उÈत अवͬध कȧ गणना पɅशन Ĥयोजनाथ[ कȧ जायेगी। साथ हȣ, ͪवभागीय जाँच पदाͬधकारȣ के

ĤǓतवेदन से सहमत होते हुए Įी ͧसंह के ͪवǾɮध झारखÖड सरकारȣ सेवक (वगȸकरण, Ǔनयंğण एवं

अपील) Ǔनयमावलȣ, 2016 के Ǔनयम- 14(iv) के तहत् असंचया×मक Ĥभाव से दो वेतन वृɮͬध पर

रोक का दÖड Ĥèताͪवत ͩकया गया ।

उÈत Ĥèताͪवत दÖड पर ͪवभागीय पğांक-7146, Ǒदनांक 21.12.2023 ɮवारा Įी ͧसंह से ɮͪवतीय

कारण पृÍछा कȧ माँग कȧ गयी। उÈत के अनुपालन मɅ Įी ͧसंह के पğ, Ǒदनांक 31.01.2024 ɮवारा

ɮͪवतीय कारण पृÍछा का जवाब समͪप[त ͩकया गया, िजसमɅ Ǔनàन तØयɉ का उãलेख ͩकया गया-

I very humbly submit that the proposed punishment may not be inflicted upon

me for the following facts and reasons:-

1. The 16 mutation cases, which are reflected in the memo of charge, were dealt

with by me as Circle officer, Kanke, Ranchi strictly in accordance with law. It

is not in dispute that the applicants who filed these cases were having the

registered sale deeds by the competent authority in their favour. It is also not

in dispute that the person from whom they purchase the land through

registered sale deeds, namely Amod Kumar, was also having the order of

mutation in his favour. Once there were registered sale deeds on favour of the

applicants and there was already a previous mutation in the name of the

Seller (Amod Kumar), and the Jamabandi was also recorded in favour of Shri

Amod Kumar, there was no option for me to deviate therefrom.

2. It is well settled that the mutation does not create right, title and interest in

favour of a person. However, once the sale deeds are produced and the

person who sold the lands, is having the mutation in his favour, the officer like

me, who was holding the post of Circle officer, before whom the mutation

cases were filed, is duty bound to issue an order for mutation. I discharged

my duty absolutely with devotion, diligently, sincerely and in accordance

with law.

3. Moreover, I was discharging the power of quasi judicial authority. My orders

are always subject to challenge before the appellate authority. Once I acted as a

quasi judicial authority, I cannot be punished for the order that I have passed in

favour of one or the other party. I exercised my wisdom based on the materials

on record. Not only this, there was recommendation for such mutation by the

concerned Halka Karamchari as also the Circle Inspector concerned. On the basis

of the materials on record and these two recommended for mutation, I, holding

the post of Circle officer, passed such order. This cannot become a subject

matter of misconduct against an officer who acted in capacity of a quasi judicial

authority.

4. Reference in this context, however, may be made to the judgement of

the Hon"ble High Court of Jharkhand at Ranchi in the case of Shobha

Singh Vs.The State of Jharkhand, decided on 05.04.2023 in W.P.(C) No.2073/2020

with its analogous case Punam Panday Vs. State of Jharkhand in W.P.(C)

No.3691/2020. There two writ petitions were preferred by those in whose favour

of sale deeds were there and I mutated their names. The Hon"ble High

Court of Jharkhand was pleased to hold that mutation neither creates

nor extinguishes right, title and interest of any person upon a land. It was

further held that cancellation of Jamabandi would not resolve the dispute

between the parties. The Hon"ble Court went on to further hold that the

State is calming its title upon the said land on the ground that the nature of

the land is 'Gairmajarua Malik'. While holding so, the Hon"ble High Court was

pleased to quash the proceeding for cancellation of such Jamabandi. In this view

of the matter also the proposed penalty may not be imposed upon me.

5. From perusal of the Enquiry Report dated 06.10.2023 which has been

forwarded to me along with letter dated 21st December 2023 it would be evident

that there is a finding recorded by the Enquiry officer in my favour to the effect

that the order of mutation was passed by me on the basis of the recommendation

of the Revenue Deputy Inspector (Halka Karamchari) and Circle Inspector. The

Enquiry officer came to this conclusion on the basis of various documents on

record. But, still the charges are said to be proved against me, which is a

complete miscarriage of justice.

6. Proving the charge against me without examining even a single witness is

contrary to law. Mere production of document would not be suffuicient to prove the

charge unless the same is proved by a witness.

7. Once the Halka Karamchari (Revenue Deputy Inspector) as also the Circle

Inspector of the area reported to me that there are registered sale deeds in favour

of the applicants and they are in possession of the property as also that there is

Jamabandi recorded in the name of the seller, I had no option, but to order

mutation in favour of the applicants. My this wisdom as a Quasi Judicial officer

cannot be termed as a misconduct under the law.

In the light of what has been stated above, I humbly request that the proposed

punishment of stoppage of two increments without cumulative effect may not be

inflicted

upon

and

may

exonerated

the

charges.

कारण पृÍछा कȧ समी¢ोपरांत Ĥमाͨणत आरोपɉ के ͧलए उनके ͪवǾɮध झारखÖड सरकारȣ सेवक

(वगȸकरण, Ǔनयंğण एवं अपील) Ǔनयमावलȣ, 2016 के Ǔनयम-14(iv) के तहत् असंचया×मक Ĥभाव

से दो वेतन वृɮͬध पर रोक का दÖड अͬधरोͪपत ͩकया जाता है ।

आदेश:- आदेश Ǒदया जाता है ͩक इस संकãप को झारखÖड राजपğ के आसाधारण अंक मɅ Ĥकाͧशत

ͩकया जाय तथा इसकȧ एक ĤǓत Įी Ĥभात भूषण ͧसंह, झा०Ĥ०से० एवं अÛय संबंͬधत को दȣ जाय।
