Ûयायादेश के आलोक मɅ गृह मंğालय, भारत सरकार ɮवारा सेलेÈट ͧलèट-2009 2010 एवं 2011 के

ͪवǾɮध राÏय पुͧलस सेवा से भारतीय पुͧलस सेवा मɅ ĤोÛनत पदाͬधकाǐरयɉ के वरȣयता वष[/बैच का

पुनǓन[धा[रण ͩकया गया तथा वष[ 2002 से 2007 बैच आंवǑटत भारतीय पुͧलस सेवा के पदाͬधकाǐरयɉ को

13.05.2016 वापस करने का अनुरोध ͩकया गया है। उÈत कांड संÉया माननीय ͪवधायक (त×कालȣन)

डुमरȣ ͪवधान सभा èव० जगरनाथ महतो के नेतृ×व मɅ èथानीय नीǓत के ͪवरोध मɅ ͩकये गये आंदोलन के

Đम मɅ दज[ ͩकया गया है ।

3. उपायुÈत सह िजला दÖडाͬधकारȣ, धनबाद के पğांक-443/ ͪवͬध, Ǒदनांक-18.03.2023 एवं

पğांक-1423/ͪवͬध, Ǒदनांक-03.11.2023 (छायाĤǓतः संलÊन) के ɮवारा, Įीः हरेश कुमार राम, सहायक

अͧभयुÈतगण/ͪवप¢ी अͬधवÈता अपने ऊपर लगाये गये आरोप/आरोप गठन के ͪवǾɮध

माननीय उÍच Ûयायालय झारखÖड, राँची मɅ Criminal Revision 221/2018 दायर ͩकया गया। उसमɅ

माननीय उÍच Ûयायालय ɮवारा Ǒदनांक- 14.05.2019 के आदेश, से साêय कȧ कमी को देखते हुए

आरोͪपत धारा-304/149 तथा 328/149 भा०द०ͪव० को ͪवलोͪपत कर Ǒदया गया। त×पæचात माननीय

अपर सğ Ûयायाधीश 02 फाèट Ěैक कोट[ बेरमो (तेनुघाट) के ɮवारा माननीय Ûयायालय, झारखÖड, राँची

के आदेश से 18.09.2019 को, आरोप गǑठत धारा-304/149 तथा 328/149 को ͪवलोͪपत करते हुए केस

अͧभलेख को माननीय ÛयाǓयक दÖडाͬधकारȣ के कोट[ मɅ ͪवचारण हेतु भेज Ǒदया गया ।

केस/ɬयूटȣ मɅ गवाहɉ ने घटना का पूण[तः समथ[न नहȣं ͩकया है िजसके कारण

Cr.. Revision मɅ माननीय उÍच Ûयायालय ने गंभीर ĤकृǓत के धारा-304/149 तथा 328/149

भा०द० ͪव०. को ͪवलोͪपत कर Ǒदया गया ।

माननीय उÍचƣम Ûयायालय ͧशव नंदन पासवान बनाम् राÏय ǒबहार (A/P) 1987 SC.

के आलोक मɅ, The Government Appointed SPL P.P. and on the Govt- advise, he moved

an application u/s 321 CRPC before CIM Seeking court permission to withdrawal from

prosecution on four grands.

P Khalid and Natrajan JJ.

Section-321 of Cr. pc. needs 3 requites to make an order under it valid.

In my opinion lack of prospect of successful prosecution in the light of evidence.

(i) वादȣ ने पुͧलस कैͪपͧसटȣ मɅ रहकर यह वाद दायर ͩकया है और माननीय उÍचƣम Ûयायालय S.C के

उÈत चार ǒबÛदुओं मɅ पहला ǒबÛदु को इस वाद मɅ अÚययन ͩकया जाय तो मɇ अͧभयोजन कȧ ओर से

यह पाता हूँ, ͩक इस वाद मɅ उÍच Ûयायालय ने Criminal. Revision मɅ मुÉय धारा-304/149,

328/149 को ͪवलोͪपत कर Ǒदया है और 8 गवाहɉ कȧ गवाहȣ से यह वाद Lack of prosecution कȧ

Įेणी मɅ आता है तथा साêय के कमी दशा[ता है। िजसे अͧभयोजन, उपयु[Èत अͧभयुÈतगण के ͪवǾɮध

अͧभयोजन साǒबत कर सकता है, यह संदेह है ।

(ii) अतः, साêय के आधार पर ÛयाǓयक ĤͩĐया का पालन करते हुए यह वाद 'सरकार वापस कर सकती

है (यह वाद सरकार चाहे तो Withdrawal योÊय है)। यह वाद राजनीǓतक ɮवेष से माननीय ͪवधायक पर

ͩकया गया है ।

(iii) माननीय उÍचƣम Ûयायालय का तीसरा Point के अनुसार इस वादं मɅ Public Policy Involve नहȣं

है और न हȣ money matter Involve है तथा Public interest भी नहȣं दशा[ रहा है ।

केस कȧ वत[मान िèथǓत यह है ͩक उपरोÈत केस मɅ माननीय Ûयायालय Įीमती संतोषनी मुमू[ ͪवशेष,

ÛयाǓयक दÖडाͬधकारȣ M.P/M.L.A Court, धनबाद के कोट[ मɅ अͧभयोजन साêय हेतु चल रहा है। कुल 8

गवाहɉ कȧ गवाहȣ हो चुकȧ है िजसमɅ 4 * सरकारȣ तथा 4 गैर सरकारȣ गवाह है। सरकारȣ गवाहɉ ने केस

का अंशतः समथ[न ͩकया है • तथा अͧभयुÈत गुण के ͪवǾɮध पया[Üत साêय नहȣं आया है। चारɉ गैर

सरकारȣ गवाह 'प¢ġोहȣ घोͪषत ͩकये गये हɇ। Case Advance Stage मɅ है। चार सरकारȣ गवाह केवल

मशाल जुलूस Ǔनकालने का समथ[न ͩकये है। उÛहɉने घटना का पूण[तः संमथ[न नहȣं ͩकया है ।

साथ हȣ माननीय सवȾÍच Ûयायालय State of Kerala V/s K. Ajith S.C 510 के आलोक मɅ सहायक

लोक अͧभयोजक, धनबाद का मंतåय Ǔनàनवत् है :-

(i) Immunities and Privileges: The protest against the " STHANIYA NITI" by

M.L.A is proteted by immunities and Privilege under Art 194 (3) of the constitution.

(ii) Breach of previeges :- A vilation of the right and imunities granted to M.L.A.

is a breach of previleges.

(iii) Sanction of the speaker: An offence which is committed by M.L.A cann't be

registered by the Police without the permission of the speaker. Police Officer require

authorization from the competent Authority to investigate a breach of law.

(iv) Public Interest:- The freedom granted to M.L,A are necessary for the

functionity of the Democracy and are subject to the powers of the speaker. The

continues of the trail of M.L.A in absence of the sanction of the speaker lowers, the

dignity amonst citizen.

(v) Absent of mens rea:- According to chargesheet, the incident occurred during

a protest by the M.L.A aganist the "SHTANIYA NITI" This it is difficult to assess the

'reus' of the offence.

(vi) Lack ot evidence:- The statements of the witnesses under 161 of cr.p.c are

vague and there is an absence of proper identification of the person involved and the

participations of the alleged offence.

(vii) The Vediography/(C.D) Photographs at the incident lacks Certification under

section 65 (B) of the Indian evidence Act 1872 and the admissibility of this evidence

would be challenge in the trail.....".

अतः, सहायक लोक अͧभयोजक, धनबाद का मंतåय है ͩक अͧभलेख का अवलोकन, गवाहɉ का

बयान तथा माननीय उÍच Ûयायालय, राँची के ɮवारा ͩĐͧमनल ǐरͧभजन मɅ Ǒदये गये आदेश के आलोक

मɅ यह वाद धारा-321 CRPC के अंतग[त Ĥ×याहरण (Withdrawal) योÊय है ।

4. वͨण[त िèथǓत से èपçट है ͩक Ĥासंͬगक वाद के मुÉय आरोपी èव० जंगरनाथ महतो कȧ मृ×यु

हो चुकȧ है एवं वहȣ धरना के' नेतृ×वकता[ थे। èव० जगरनाथ महतो के नेतृ×व मɅ èथानीय नीǓत के

ͪवरोध मɅ ͩकये गये आंदोलन के Đम मɅ नावाडीह थाना कांड़ संÉया-19/2016, Ǒदनांक-13.05.2016 दर्ज

है। यह वाद राजनीǓतक ɮवेष से माननीय ͪवधायक पर दज[ ͩकया गया था। वाद मɅ Public Policy

Involve नहȣं हɇ और ना हȣ Money matter Involve है तथा Public interest भी नहȣं हɇ। यह

आंदोलन नीिज Ǒहत के ͧलए नहȣं हɇ। दज[ ͩकये गये कांड मɅ साêय कȧ कमी है। कांड वापसी से राÏय के

होने के Ǔतͬथ (22.12.2003) के पूव[ ǓनयुिÈत हेतु Ĥकाͧशत/अͬधसूͬचत पद/ǐरिÈत के ͪवǾɮध हुई है तथा

जो एन०पी०एस० से आÍछाǑदत है, को अͨखल भारतीय सेवाएँ (मृ×यु-सह-सेवाǓनवृत लाभ) Ǔनयमावलȣ,

1958 के अÛतग[त पुरानी पɅशन योजना हेतु Ǒदनांक-30.11.2023 तक ͪवकãप चुनने का अवसर Ĥदान

ͩकया गया है।

2 अतः काͧम[क, लोक ͧशकायत और पɅशन मंğालय, काͧम[क एवं Ĥͧश¢ण ͪवभाग, भारत सरकार,

नई Ǒदãलȣ के उÈत पǐरपğ मɅ ǓनǑहत शतɉ को पूण[ करने वाले भारतीय पुͧलस सेवा के Ǔनàनांͩकत

पदाͬधकारȣ, िजनकȧ ǓनयुिÈत Ǒदनांक-01.01.2004 के बाद हुई है, को अͨखल भारतीय सेवाएँ (मृ×यु-सह-

सेवाǓनवृत लाभ) Ǔनयमावलȣ, 1958 के अÛतग[त पुरानी पɅशन योजना का आÍछादन Ĥदान करते हुये

उसके सभी अनुवतȸ लाभ अनुमाÛय ͩकये जाते है –
