Ĥसाद बनाम झारखÖड राÏय एवं अÛय मɅ माननीय झारखÖड उÍच Ûयायलय, राँची ɮवारा Ǒदनांक-

25.07.2019 को पाǐरत नयायादेश के काय[कारȣ अंश Ǔनàनवत है:-

"Be that as it may, the case of the petitioner needs to be considered by

the respondents in view of kalawadhi. The case of the petitioner was

required to be considered three years earlier whereas the petitioners's

case has been considered later on. Accordingly, the matter is remitted

back to Respondent No.-2 who will take appropriate steps so that the

case of the petitioner may be considered at an early date. The

Respondent No.-2 will ensure that the case of the petitioner be placed

before the ensuing D.P.C. for consideration on the promotional post with

effect from the date the petitioner has prayed in the writ petition."

2. W.P. (S) No.- 454/2014- सदन Ĥसाद बनाम झारखÖड राÏय एवं अÛय मɅ माननीय

झारखÖड उÍच Ûयायलय ɮवारा Ǒदनांक-25.07.2019 को पाǐरत Ûयाय Ǔनण[य के आलोक मɅ

समी¢ोपराÛत ͪवɮवान महाͬधवÈता, झारखÖड उÍच Ûयायालय, राँची से परामश[ ĤाÜत कर उÈत

Ûयाय Ǔनण[य के ͪवǽɮध LPA 778/2019 झारखÖड राÏय एवं अÛय बनाम सदन Ĥसाद दायर ͩकया

गया, िजसमɅ Ǒदनांक-10.11.2022 को Ǔनàन आदेश पाǐरत हुआ :-

13. This Court, after considering the factual aspect in detail as above and

after going through the order contained in the impugned order has found

there from that there is no issue of writ petitioner having not eligible for

consideration of promotion, rather only ground taken by way of objection

on the part of the State authority that the Departmental Promotion

Committee since has not convened its meeting and since the writ

petitioner has retired, therefore, he cannot be considered for promotion to

the higher post and taking the same contrary to the position of law

conferring the public servant a right to be considered for promotion to be

a fundamental right, in the circumstances, it is due to laches committed

on the part of the State, the meeting of DPC could not be convened

and as such, for wrong committed by the State, the writ petitioner

cannot be denied from the chance of consideration for promotion,

The learned Single Judge if disposed of the writ petition while

directing the respondents to consider the case of the writ petitioner by

placing his case in the ensuing Departmental Promotion Committee,

which according to our considered view, cannot be said to suffer from

an error.

14. The said finding cannot be considered to be incorrect, for the reason that

the writ petitioner cannot be denied from the right of consideration of

promotion to the higher post, as per the ratio laid down by the Hon'ble

Apex Court in Deepak Agarwal & Anr. Vrs. State of Uttar Pradesh & Ors.

(Supra) and Subodh Kumar and Others Vrs. Commissioner of Police and

Others (Supra).

15. This Court, therefore, is of the view that the order passed by the learned

Single Jadge suffers from no error.

16. In the result, the instant appeal fails and is, dismissed.

17. In consequent to dismissal of this appeal, I.A. No. 10729 of 2019 stands

disposed of."

पदाͬधकारȣ, उ×पाद एवं मɮय Ǔनषेध ͪवभाग, झारखÖड, राँची सàĤǓत सेवाǓनवृƣ को उनके ɮवारा

याͬचत Ǔतͬथ Ǒदनांक 05.06.2013 के भूतल¢ी Ĥभाव से वैचाǐरक ĤोÛनǓत Ĥदान कȧ गई ।

4. W.P.(S) No. 454/2014 मɅ पाǐरत आदेश के अनुपालन हेतु याͬचकाकƣा[ Įी सदन Ĥसाद

के ɮवारा माननीय झारखÖड उÍय Ûयायालय मɅ Contempt (C) No. 818/2022, सदन Ĥसाद

बनाम झारखÖड राÏय एवं अÛय दायर ͩकया गया। माननीय झारखÖड उÍच Ûयायालय, राँची ɮवारा

Ǒदनांक-18.10.2024 को उÈत अवमाननावाद कȧ सुनवाई करते हुए Ǔनàनवत् Ǔनदेश Ǒदया गया :-

It has been pointed out in course of the argument that the persons who

have not approached the High Court, they have been provided with

benefit of Kalawadhi along with monetary benefits, however, in the case

of the petitioner, only notionally it has been provided. It was pointed out

that it has been done because the petitioner has approached the High

Court by way of filing the writ petition. It was further pointed out that

the writ Court's order is confirmed by the Division Bench in L.P.A.

No.778 of 2019 and the notification dated 17.8.2023 with regard to other

persons have been brought on record by the learned counsel for the

petitioner in supplementary affidavit contained in Annexure-4.

2. In view of above, by way of last indulgence, further time is granted to

the Opposite parties to comply the order.

3. Let this matter appear on 22.11.2024.

बैÖड ǽ० 15600-39100/-, Ēेड पे०- ǽ० 6600, पुनरȣͯ¢त वेतनमान मैǑĚÈस लेवल-11) कोǑट के

पद पर उनके ɮवारा याͬचत Ǔतͬथ Ǒदनांक-05.06.2013 के भूतल¢ी Ĥभाव से आͬथ[क लाभ सǑहत

आͬथ[क लाभ नहȣं Ǒदये जाने के Ĥावधान से सàबिÛधत है एवं अÛय संगत पǐरपğɉ को ͪवशेष

पǐरिèथǓत मɅ ͧशͬथल करने कȧ èवीकृǓत Ĥदान करने हेतु काͧम[क, ĤशासǓनक सुधार तथा राजभाषा

ͪवभाग, झारखÖड, राँची के संलेख £ापांक-37 Ǒदनांक-03.01.2025 मɅ सिÛनǑहत Ĥèताव पर
