èवाèØय ͪव£ान कȧ åयावसाǓयक ͧश¢ा के पारàपǐरक एवं नये ¢ेğɉ मɅ आधुǓनक ͬचͩक×सा Ĥणालȣ, आयुष ͬचͩक×सा

Ĥणालȣ, नͧसɍग ͧश¢ा, फामȶसी ͧश¢ा, दÛत ͬचͩक×सा ͧश¢ा, Ĥयोगशाला तकनीकȧ ͧश¢ा ͩफिजयोथरेपी एवं आकुपेशनल

थरेपी èपीच थरेपी एवं अÛय पारामेͫडकल पाɫयĐम मɅ ͧश¢ा एवं अÛतर अनुशासन ¢ेğɉ यथा èवाèØय अथ[शाèğ,

èवाèØय Ĥशासन इ×याǑद मɅ सàबɮधता ͧश¢ण एवं उपयुÈत तथा åयविèथत Ǔनदȶश, Ĥͧश¢ण एवं अनुसंधान सुǓनिæचत

करने के Ĥयोजन से सरकार ɮवारा èथाͪपत संèथाओं तथा राÏय सरकार और / अथवा Ěèट या सोसाईटȣ ɮवारा èथाͪपत

èवायƣशासी संèथाओं के संचालन एवं सàबɮधता को सुगम बनाने हेतु झारखÖड èवाèØय ͪव£ान ͪवæवͪवɮयालय

èथाͪपत एवं Ǔनयͧमत करने के Ǔनͧमत यह अͬधǓनयम है।

और चूंͩक, ͧश¢कɉ एवं छाğɉ के ͧलए अकादͧमक èवतंğता एवं छाğवृͪƣ को संĤवǓत[त करने तथा या तो èवतंğ

Ǿप से या उ×कृçट उÍचतर ͪवɮया के अÛय केÛġɉ के साथ संयुÈत Ǿप से, छाğवृͪƣ एवं उ×कृçटता ĤाÜत करने हेतु साधक

बौɮͬधक वातावरण को पोͪषत एवं ͪवकͧसत करने के उɮदेæय से एक ͪवͧशçट èवायƣ संèथान कȧ èथापना वांछनीय है।

भारत गणराÏय के चौहतर वष[ मɅ झारखÖड राÏय ͪवधान मंडल ɮवारा Ǔनàनͧलͨखत Ǿप मɅ यह अͬधǓनयͧमत हो

1. संͯ¢Üत नाम, ͪवèतार एवं Ĥारàभ।-

(i) यह अͬधǓनयम "झारखÖड èवाèØय ͪव£ान ͪवæवͪवɮयालय अͬधǓनयम, 2023" कहा जायेगा।

(ii) इसका ͪवèतार सàपूण[ झारखÖड राÏय मɅ होगा।

(iii) यह उस Ǔतͬथ से Ĥवृƣ होगा, जो सरकार राजपğ मɅ अͬधसूचना ɮवारा Ǔनयत करे।

2. पǐरभाषाएँ –जब तक संदभ[ मɅ अÛयथा अपेͯ¢त न हो, इस अͬधǓनयम मɅ -

(i) ‘शै¢ͨणक पǐरषɮ' से अͧभĤेत है ͪवæवͪवɮयालय का शै¢ͨणक पǐरषदः

(ii) ‘संबɮध संèथान’ से अͧभĤेत है ͪवæवͪवɮयालय ɮवारा संबɮधता Ĥदƣ संèथान।

(iii) ‘शै¢ͨणक èटाफ’ से अͧभĤेत है èटाफ कȧ ऐसी कोǑट या जो पǐरǓनयम (èटेÍयूट) ɮवारा ͪवæवͪवɮयालय का शै¢ͨणक

èटाफ होना पदाͪवǑहत कȧ गयी है

(iv) ‘सàबɮधता’ से अͧभĤेत है पǐरǓनयम (èटैÍयूट) एवं इस Ĥयोजनाथ[ बनायी गयी ͪवǓनयमावͧलयɉ के अनुसार

ͪवæवͪवɮयालय ɮवारा कȧ गई संबɮधता

(v) ‘èवायƣशासी महाͪवɮयालय अथवा संèथान’ से अͧभĤेत है वैसे महाͪवɮयालय अथवा संèथान िजसे सुसंगत संͪवधी

मɅ ͪवǑहत Ĥावधान के अंतग[त राÏय सरकार / ͪवæवͪवɮयालय ɮवारा èवायƣशासी घोͪषत ͩकया गया हो

(vi) ‘कुलाͬधपǓत’ से अͧभĤेत है ͪवæवͪवɮयालय का कुलाͬधपǓत;

(vii) ‘राÏयपाल’ से अͧभĤेत है झारखÖड राÏय का राÏयपाल;

(viii) 'महाͪवɮयालय' से अͧभĤेत है ͪवæवͪवɮयालय अथवा राÏय सरकार ɮवारा संचाͧलत एवं Ǔनयंǒğत वैसे संèथान जो

ͬचͩक×सा कȧ आधुǓनक Ĥणालȣ, आयुष ͬचͩक×सा Ĥणालȣ, नͧसɍग ͧश¢ा, फामȶसी ͧश¢ा, दÛत ͬचͩकत् ͧश¢ा, Ĥयोगशाला

Ĥौɮयोͬगकȧ ͧश¢ा, ͩफिजयोथरेपी और ऑकुपेशनल थरेपी, èपीचथरेपी एवं अÛय पारामेͫडकल पाɫयĐम से संबंͬधत

ͧश¢ा और अंतर अनुशासǓनक ¢ेğ जैसे- èवाèØय अथ[शाèğ, èवाèØय Ĥशासन इ×याǑद के पाɫयĐम मɅ èनातक अथवा

उÍच ͫडĒी हेतु ͧश¢ा Ĥदान करते है :

(ix) ‘कुलपǓत’ से अͧभĤेत है ͪवæवͪवɮयालय का कुलपǓत ;

(x) 'पाɫयĐम' से अͧभĤेत है वैसे पाɫयĐम िजसके ͧलए èवाèØय ͪव£ान कȧ सुसंगत शाखाओं मɅ èनातक अथवा

उÍचतर उपाͬध Ĥदान कȧ जाती है एवं ऐसे अÛय पाɫयĐम जो सरकार ɮवारा भͪवçय मɅ अͬधसूͬचत ͩकया जाय

(xi) 'कोट[' से अͧभĤेत है ͪवæवͪवɮयालय का कोट[;

(xii) 'भारतीय दंत ͬचͩक×सा पǐरषɮ’ से अͧभĤेत है दंत ͬचͩक×सा अͬधǓनयम, 1948 (अͬधǓनयम 16, 1948 ) एवं इसके

संशोधन अͬधǓनयम 1993 कȧ धारा-3 के अधीन गǑठत दंत ͬचͩक×सा पǐरषɮ :

(xiii) ‘कम[चारȣ’ से अͧभĤेत है यथािèथǓत ͪवæवͪवɮयालय, महाͪवɮयालय या संèथा ɮवारा ǓनयुÈत कोई åयिÈत :

(xiv) 'काय[काǐरणी पǐरषɮ’ से अͧभĤेत है ͪवæवͪवɮयालय का काय[काǐरणी पǐरषɮ

(xv) ‘ͪवƣ सͧमǓत’ से अͧभĤेत है ͪवæवͪवɮयालय कȧ ͪवƣ सͧमǓत :

(xvi) ‘सरकार’ से अͧभĤेत है झारखÖड सरकार :

(xvii) 'Ĥशासी ͪवभाग’ से अͧभĤेत है èवाèØय ͬचͩक×सा ͧश¢ा एवं पǐरवार कãयाण ͪवभाग :

(xviii) 'èवाèØय ͪव£ान' से अͧभĤेत है ͬचͩक×सा कȧ आधुǓनक Ĥणालȣ, आयुष ͬचͩक×सा Ĥणालȣ, नͧसɍग ͧश¢ा, फामȶसी

ͧश¢ा, दंत ͬचͩक×सा ͧश¢ा Ĥयोगशाला Ĥौɮयोͬगकȧ. ͩफिजयोथरेपी, ऑकुपेशनल थरेपी, èपीच थरेपी एवं अÛय

पारामेͫडकल पाɫयĐमɉ से संबंͬधत ͧश¢ा और अंतरअनुशासǓनक ¢ेğ जैसे- èवाèØय अथ[शाèğ, èवाèØय Ĥशासन

इ×याǑद मɅ उनकȧ सभी शाखाओं मɅ Ǔनवारक, Ĥो×साहक उपचारा×मक और पूनवा[स सेवाएँ;

(xix) 'संèथा' से अͧभĤेत है शै¢ͨणक संèथा या महाͪवɮयालय, िजसे ͪवæवͪवɮयालय के ͪवशेषाͬधकार Ǒदये गये हɉगे :

(xx) 'भारतीय आयुͪव[£ान पǐरषɮ’ से अͧभĤेत है भारतीय आयुͪव[£ान पǐरषɮ अͬधǓनयम 1956 (अͬधǓनयम 1956 का

102) तथा इसके संशोधन अͬधǓनयम, 1993 ɮवारा गǑठत भारतीय आयुͪव[£ान पǐरषɮ

(xxi) 'कदाचार' से अͧभĤेत है पǐरǓनयम (èटेÍयूट) ɮवारा ͪवǑहत कोई कदाचार :

(xxii) 'आधुǓनक ͬचͩक×सा पɮधǓत’ से अͧभĤेत है ͫडÜलोमा और ͫडĒी èतर या उससे ऊपर के पूव[ नैदाǓनक, नैदाǓनक

पारामेͫडकल और पाराडेÛटल ͪवषयɉ से संबंͬधत आधुǓनक ͬचͩक×सा कȧ सभी शाखाएँ और ऐसे अÛय ͪवषय जो ͪवǑहत

ͩकये जाय

(xxiii) ‘राçĚȣय आयुͪव[£ान आयोग’ से अͧभĤेत है राçĚȣय आयुͪव[£ान आयोग अͬधǓनयम 2019 के ɮवारा गǑठत

राçĚȣय आयुͪव[£ान आयोग;

(xxiv) ‘अͬधसूचना’ से अͧभĤेत है राजपğ मɅ Ĥकाͧशत अͬधसूचना;

(xxv) ‘भारतीय भेषजी पǐरषɮ’ से अͧभĤेत है भेषजी अͬधǓनयम, 1948 कȧ धारा 3 के अधीन गǑठत केÛġȣय भेषजी

पǐरषद (फामȶसी काउिÛसल);

(xxvi) ‘योजना बोड[’ से अͧभĤेत है ͪवæवͪवɮयालय का योजना बोड[;

(xxvii) ‘Ĥाचाय[’ से अͧभĤेत है ͩकसी महाͪवɮयालय का Ĥधान और इसमɅ जहाँ Ĥाचाय[ न हɉ, वह åयिÈत जो त×समय के

ͧलए Ĥाचाय[ के Ǿप मɅ काय[ करने हेतु सàयक Ǿप से ǓनयुÈत ͩकया गया हो और Ĥाचाय[ या काय[कारȣ Ĥाचाय[ कȧ

अनुपिèथǓत मɅ यथा िèथǓत उप Ĥाचाय[, जो इस Ǿप मɅ सàयक Ǿप से ǓनयुÈत हो

(xviii) 'åयावसाǓयक ͧश¢ा' से अͧभĤेत है उस पेशे से जुड़ी ͧश¢ा िजसमɅ ͪवशेष Ĥͧश¢ण या कौशल कȧ आवæयकता होती

है और इसमɅ ͬचͩक×सा, दंत ͬचͩक×सा, फामȶसी, ͩफिजयोथेरापी, ऑकुपेशनल थेरापी एवं कानून ͧश¢ण आǑद शाͧमल है-

(xxix) ‘माÛयता ĤाÜत ͧश¢क’ से अͧभĤेत है ऐसे åयिÈत जो ͩकसी महाͪवɮयालय अथवा ͪवæवͪवɮयालय से

ͪवशेषाͬधकार ĤाÜत संèथा मɅ अनुदेश देने के Ĥयोजनाथ[ ͪवæवͪवɮयालय ɮवारा अनुमोǑदत ͩकये गये है

(xxx) 'èकूल' से अͧभĤेत है ͪवæवͪवɮयालय कȧ ͪवɮया शाखा :

(xxxi) 'अÚययन ͪवɮयालय’ से अͧभĤेत है ͪवæवͪवɮयालय का अÚययन ͪवɮयालय

(xxxii) 'èĐȧǓनंग सͧमǓत’ से अͧभĤेत है इस अͬधǓनयम कȧ धारा 11 (3) के तहत गǑठत सͧमǓत :

(xxxiii) ‘èवͪवƣ पोͪषत संèथा’ से अͧभĤेत है वैसी संèथाएँ जो ͩकसी Ûयास या सोसाईटȣ या कàपनी ɮवारा èथाͪपत हो

और èवͪवƣ पोͪषत हो एवं èवाèØय ͪव£ान के ͪवͧभÛन शाखाओं के ¢ेğ मɅ ͧश¢ा दे रहा हो

(xxxiv) ‘शासी Ǔनकाय' से अͧभĤेत है ͪवæवͪवɮयालय का शासी Ǔनकाय

(xxxv) 'पǐरǓनयम' एवं ͪवǓनयमावलȣ से अͧभĤेत है त×समय Ĥवृत् ͪवæवͪवɮयालय का Đमशः पǐरǓनयम एवं

ͪवǓनयमावलȣ

(xxxvi) 'तकनीकȧ कम[चारȣ’ से अͧभĤेत है, ऐसे कम[चारȣ जो ͪवæवͪवɮयालय के तकनीकȧ संवग[ मɅ काय[रत हो (xxxvii)

‘ͪवæवͪवɮयालय' से अͧभĤेत है इस अͬधǓनयम के अधीन यथा Ǔनगͧमत झारखÖड èवाèØय ͪव£ान ͪवæवͪवɮयालय

(xxxviii) ‘ͪवæवͪवɮयालय अनुदान आयोग’ से अͧभĤेत है ͪवæवͪवɮयालय अनुदान आयोग अͬधǓनयम 1956

(अͬधǓनयम- 3, 1956) कȧ धारा-4 के अधीन गǑठत आयोग :

(xxxix) 'ͪवæवͪवɮयालय ͧश¢क' से अͧभĤेत है ĤाÚयापक, रȣडर, सह-ĤाÚयापक, लैÈचरर, सहायक ĤाÚयापक और ऐसे

अÛय åयिÈत जो ͪवæवͪवɮयालय अथवा ͪवæवͪवɮयालय ɮवारा संचाͧलत ͩकसी महाͪवɮयालय या संèथा मɅ अनुदेश देने

या शोध संचालन के ͧलए ǓनयुÈत ͩकये गए हो और जो पǐरǓनयम के ɮवारा ͧश¢क मɅ नामǓनǑद[çट ͩकये गये हो।

(xl) ‘ͪवæवͪवɮयालय समी¢ा आयोग’ से अͧभĤेत है इस अͬधǓनयम कȧ धारा-38 के तहत पǐरभाͪषत आयोग

(xli) इसमɅ ĤयुÈत और इस अͬधǓनयम मɅ अपǐरभाͪषत शÞदɉ एवं अͧभåयिÈतयɉ के वहȣ अथ[ हɉगे जो उनके ͧलये Đमश

अͬधǓनयम मɅ समनुदेͧशत हो’

3. Ǔनगमन-

(i) झारखÖड èवाèØय ͪव£ान ͪवæवͪवɮयालय के नाम से एक ͪवæवͪवɮयालय, उस Ǔतͬथ के Ĥभाव से, जो राÏय सरकार

राजपğ मɅ अͬधसूचना ɮवारा Ǔनयत करे, èथाͪपत ͩकया जायेगा िजसमɅ सिàमͧलत हɉगे - कुलाͬधपǓत और कुलपǓत,

Ĥथम सदèय शासी Ǔनकाय, ͪवæवͪवɮयालय कȧ काय[काǐरणी पǐरषɮ एवं शै¢ͨणक पǐरषɮ और ऐसे सभी åयिÈत जो

एतɮपæचात ऐसे पद पर या सदèय के Ǿप मɅ ǓनयुÈत ͩकये जाय, तब तक के ͧलए जब तक ये ऐसे पद या सदèयता

धाǐरत करते हɇ:

(ii) ͪवæवͪवɮयालय इस अͬधǓनयम के Ĥावधानɉ के अधीन रहते हुए संपͪƣ को अिज[त करने, धाǐरत करने एवं åययǓनत

करने तथा संͪवदा करने और उÈत नाम से बाद लाने अथवा अपने ͪवǾɮध बाद लाये जाने कȧ शिÈत के साथ शाæवत्

उƣराͬधकार एवं सामाÛय मुहर धाǐरत करने वाला पूवȾÈत नाम से एक Ǔनगͧमत Ǔनकाय होगा

(iii) ͪवæवͪवɮयालय का मुÉयालय ऐसे èथान पर होगा जैसा ͩक सरकार, राजपğ मɅ अͬधसूचना ɮवारा ͪवǓनǑद[çट करे:

4. अͬधकाǐरता-

(i) ͪवæवͪवɮयालय कȧ अͬधकाǐरता का ͪवèतार संपूण[ झारखÖड राÏय मɅ होगा

(ii) सरकार ɮवारा èथाͪपत एवं राÏय के ͪवɮयमान ͪवæवͪवɮयालयɉ से सàबɮध या भͪवçय मɅ èथाͪपत होने वाले

èवाèØय ͪव£ान कȧ ͪवͧभÛन शाखाओं मɅ åयावसाǓयक ͧश¢ा देने वाले सभी महाͪवɮयालय एवं संèथाएँ.

ͪवæवͪवɮयालय से सàबɮधता के पाğ उस Ǔतͬथ से हɉगे, जैसा ͩक सरकार राजपğ मɅ अͬधसूचना ɮवारा Ǔनयत करɅ

तथा उस रȣǓत से हɉगे, जो इस संबंध मɅ Ǔनͧम[त पǐरǓनयम या अÚयादेश या ͪवǓनयमावलȣ ɮवारा ͪवǑहत कȧ जाय

(iii) त×समय Ĥवृƣ ͩकसी अÛय राÏय ͪवͬध मɅ अंतǓन[çट ͩकसी बात के होने पर भी राÏय सरकार ɮवारा, राजपğ मɅ

अͬधसूचना ɮवारा यथा ͪवǓनǑद[çट èवाèØय ͪव£ान कȧ ͪवͧभÛन शाखाओं मɅ åयावसाǓयक ͧश¢ा देने वाले और राÏय

ͪवधान मंडल कȧ ͪवͬध ɮवारा èथाͪपत ͩकसी अÛय ͪवæवͪवɮयालय ɮवारा संबɮध महाͪवɮयालयɉ अथवा संèथाओं कȧ

उस ͪवæवͪवɮयालय से संबɮधता समाÜत हो जायेगी, िजसमɅ ऐसे महाͪवɮयालय अथवा संèथाएँ संबɮध कȧ गयी हɉ

और ऐसे महाͪवɮयालय और संèथाएँ उÈत अͬधसूचना मɅ यथा ͪवǓनǑद[çट Ǔतͬथ से इस ͪवæवͪवɮयालय से संबɮध

समझे जायɅगे।

परÛतु यह ͩक यह Ĥावधान डीàड ͪवæवͪवɮयालय पर लागू नहȣं होगा ।

(iv) ͪवæवͪवɮयालय, महाͪवɮयालयɉ और संèथाओं पर ऐसे Ǔनबंधनɉ और शतɟ को अͬधरोͪपत कर सकेगा िजससे वह

(v) ͩकसी Ûयास अथवा सोसाईटȣ ɮवारा èवाèØय ͪव£ान कȧ ͪवͧभÛन शाखाओं मɅ åयावसाǓयक ͧश¢ा देने वालȣ

èवͪवƣपोͪषत संèथा के Ǿप मɅ èथाͪपत ͪवɮयमान महाͪवɮयालय अथवा संèथा इस ͪवæवͪवɮयालय से संबɮधता

ĤाÜत करɅगे। बशतȶ इस संबंध मɅ Ǔनͧम[त पǐरǓनयम एवं ͪवǓनयमावलȣ के अंतग[त अͬधकͬथत शतɏ पूरȣ कȧ जाय।

(vi) इस राÏय मɅ अविèथत èवाèØय ͪव£ान के ͩकसी ͬचͩक×सा महाͪवɮयालय या संèथान ɮवारा Ǔनयत Ǒदवस के पूव[

ͩकसी अÛय ͪवæवͪवɮयालय से उपयोग ͩकया जा रहा कोई ͪवशेषाͬधकार, ऐसी Ǔतͬथ के Ĥभाव से जैसी ͩक सरकार

ɮवारा अͬधसूͬचत कȧ जाय, वापस ले ͧलया गया समझा जायेगा ।

5. ͪवæवͪवɮयालय का उɮदेæय- ͪवæवͪवɮयालय का उɮदेæय èवाèØय ͪव£ान के ͪवͧभÛन शाखाओं के £ान को समृɮध

करना एवं संबɮध ¢ेğɉ मɅ शोध एवं उसके åयवहाǐरक अनुĤयोगɉ के ͧलए अनुकूल वातावरण का Ǔनमा[ण करना होगा।

ͪवæवͪवɮयालय का मुÉय उɮदेæय èवाèØय ͪव£ान के ͪवͧभÛन शाखाओं मɅ उ×कृçटता के केÛġ एवं संèथान

सृिजत करना होगा। ͪवæवͪवɮयालय के अÛय उɮदेæय इस Ĥकार होगɅ-

(i) आधुǓनक ͪवषय और समाज कȧ बदलती आवæयकताओं कȧ अनुͩĐया मɅ èवाèØय ͪव£ान कȧ ͪवͧभÛन शाखाओं मɅ

पेशेवर ͧश¢ा ͪवकͧसत करना।

(ii) èवाèØय ͪव£ान कȧ ͪवͧभÛन शाखाओं मɅ पेशेवर ͧश¢ण से जुड़े मामलɉ मɅ ͧश¢ण, अनुसंधान और ͪवèतार को

सुͪवधाजनक बनाना और Ĥो×साǑहत करना।

(iii) ͧश¢ण तथा सीखने कȧ ĤͩĐयाओं और Ĥणाͧलयɉ मɅ गुणा×मक सुधार को सुगम बनाना और सुǓनिæचत करना।

(iv) èवाèØय ͪव£ान के Ĥ¢ेğ मɅ £ान के समकालȣन और सीमांत ¢ेğɉ मɅ गुणवƣापूण[ अनुसंधान को सुगम बनाना और

सुǓनिæचत करना।

(v) आजीवन सीखने के ͧलए आवæयकताओं को सुगम बनाना और उसकȧ ĤͩĐया को åयविèथत करना ।

(vi) ͪवæवͪवɮयालय इसके संèथानɉ से या अÛयथा ĤाÜत £ान एवं शोध के ǓनçकषȾ का दुǓनया भर मɅ Ĥसार करना।

(vii) èवाèØय ͪव£ान के सभी संकायɉ, िजनमɅ आधुǓनक ͬचͩक×सा पɮधǓत, दंत ͬचͩक×सा उपचया[, औषͬध, ͪवͧभÛन

पैरामेͫडकल ͪवधाएँ, यथा-ͬचͩक×सा Ĥयोगशाला तकनीक, ͩफिजयोथेरापी एवं ऑकुपेशनल थेरापी. èपीच थेरापी,

आयुवȶǑदक, यूनानी एवं होͧमयोपैͬथक ͬचͩक×सा पɮधǓत अंतͪव[भागीय ¢ेğ यथा- èवाèØय ĤबÛधन, èवाèØय

अथ[åयवèथा शाͧमल है, कȧ ͧश¢ा के èतरमान मɅ एकǾपता èथाͪपत करना ऐसी ͧश¢ा कȧ गुणवƣा के संवध[न एवं

वृɮͬध को Ǻिçटगत रखते हुए और èवाèØय ͪव£ान कȧ सभी पɮधǓतयɉ कȧ आपसी समझ पर सभी èतरɉ पर

शै¢ͨणक उ×कृçटता के उÍचतम èतरमान को आधुǓनक बनाने, सुधा एवं उपलिÞध ĤाÜत करने का ǓनरÛतर लêय

रखना;

(viii) èवाèØय ͪव£ान से संबंͬधत एवं सुसंगत सभी ͪवधाओं, ͪवशेषतः ये जो सàĤǓत èनातक एवं èनातकोƣर पाɫयĐमɉ

के पाɫयͪववरण मɅ पया[Üत Ǿप से शाͧमल नहȣं है मɅ अ×याधुǓनक ͧश¢ा, Ĥͧश¢ण तथा अनुसंधान के ͧलये

उ×कृçटता के केÛġ ͪवकͧसत करना। इसमɅ जनसंÉया ͪव£ान, èवाèØय पɮधǓत शोध, èवाèØय सेवा शोष,

पǐरचालन शोध, èवाèØय पɮधǓतयाँ एवं èवाèØय सेवाएँ Ĥबंधन, èवाèØय संरचना सुधार, मानव संसाधन ͪवकास,

शै¢ͨणक Ĥौɮयोͬगकȧ जैव सूचना ͪव£ान दूरͬगǓतकȧ, मेͫडकल अनुͧलͪपकरण, महामारȣ ͪव£ान संबंधी शोध

Ĥावैͬधकȧ, èवाèØय ͪव£ान मɅ सतृत ͧश¢ण और ͪव£ान कȧ ऐसी शाखा, िजसे शाͧमल ͩकया जाना समीचीन समझा

जाय, शाͧमल ͩकये जायɅगे;

(ix) ͪवशेष£ता के ͪवͧभÛन ¢ेğɉ मɅ £ान केÛġɉ के सृजन को सुगम बनाना तथा बढ़ावा देना और Ēाहक को इलेÈĚोǓनक

Ǿप से आवæयकता आधाǐरत सुसंगत जानकारȣ Ĥसाǐरत करना;

(x) ͧश¢कɉ के ͧलए उनके संबंͬधत और अंत ͪवषय ¢ेğɉ मɅ गुणवƣा सुधार अͧभकरण के Ǿप मɅ काय[ करना।

(xi) ऐसे Ĥावधान करना िजसमे संबɮध महाͪवɮयालय अÚययन मɅ ͪवशेष£ता ĤाÜत कर सकɅ ।

6. ͪवæवͪवɮयालय कȧ शिÈतयाँ एवं कृ×य- ͪवæवͪवɮयालय के Ǔनàनͧलͨखत शिÈतयाँ एवं कृ×य हɉगे।

(i) £ान के ͪवकास तथा Ĥचार-Ĥसार के ͧलए åयावसाǓयक एवं तकनीकȧ ͧश¢ा देने, उ×कͧमत करने, Ĥͧश¢ण एवं शोध

को ͪवकͧसत एवं समुÛनत करने हेतु Ĥावधान करना

(ii) ͪवæवͪवɮयालय के शै¢ͨणक, तकनीͩक ĤशासǓनक Ĥबंधकȧय परामशȸ अनुसͬचवीय एवं अÛय समथ[न सेवाओं से

संबंͬधत पदɉ का सृजन एवं ǓनयुिÈत

(iii) उन शतɟ के अÚयधीन जो ͪवæवͪवɮयालय ͪवǓनæचत करे, परȣ¢ाओं का संचालन करना तथा परȣ¢ाओं, मूãयांकन

अथवा जाँच कȧ ͩकसी अÛय पɮधǓत के आधार पर ͫडÜलोमा अथवा सǑट[ͩफकेट Ĥदान करना एवं ͫडĒी या अÛय

शै¢ͨणक उपाͬध देना और ͩकसी समुͬचत एवं पया[Üत कारण से इस तरह के ͩकसी ͫडÜलोमा, सǑट[ͩफकेट, ͫडĒी एवं

अÛय शै¢ͨणक उपाͬधयाँ वापस लेना

(iv) पǐरǓनयम ɮवारा ͪवǑहत रȣǓत से मानद ͫडĒी या अÛय उपाͬध देना

(v) ͪवæवͪवɮयालय ɮवारा अपेͯ¢त आचाय[ पद, ͪĤͧसपलशीप Ĥोफेसरशीप, रȣडरशीप एवं लेÈचरशीप तथा अÛय ͧश¢ण

तथा शै¢ͨणक पद संिèथत करना तथा ऐसे आचाय[पद ͪĤंͧसपलशीप, रȣडरशीप, लेÈचरशीप तथा अÛय ͧश¢ण एवं

शै¢ͨणक पदो पर åयिÈतयɉ को ǓनयुÈत करना:

(vi) åयिÈतयɉ को ĤाÚयापक, रȣडर / सह-ĤाÚयापक या लेÈचरर / सहायक ĤाÚयापक के Ǿप मɅ एवं अÛय को

ͪवæवͪवɮयालय के ͧश¢क के Ǿप मɅ माÛयता देना

(vii) अǓतͬथ ĤाÚयापक, सेवामुÈत ĤाÚयापक, सलाहकार, ͪवɮवानɉ तथा ऐसे अÛय åयिÈतयɉ को संͪवदा पर अथवा

अÛयथा ǓनयुÈत करना जो ͪवæवͪवɮयालय के उɮदेæयɉ को अĒसर करने मɅ योगदान करɅ

(viii) अनुसंधान और अÛय कायɟ के मुġण, पुनǾपादन और Ĥकाशन कȧ åयवèथा करना और Ĥदश[Ǔनयɉ, काय[शालाओं,

संगोिçठयɉ, सàमेलनɉ आǑद का आयोजन करना।

(ix) èटाफ कȧ सभी कोǑटयɉ कȧ सेवा शतɟ को उनके आचार संǑहता सǑहत, अͬधकͬथत करना

(x) ͪवæवͪवɮयालय के ¢ेğीय अͬधकाǐरता के भीतर अविèथत महाͪवɮयालयɉ या संèथाओं को अपना ͪवशेषाͬधकार

सàबɮध के Ǿप मɅ देना तथा पǐरǓनयम या अÚयादेश या ͪवǓनयमावͧलयɉ ɮवारा यथा ͪवǑहत शतɉ के अनुसार पूण[

संबɮधता सǑहत सभी ͪवशेषाͬधकारɉ या उनमɅ से ͩकसी को वापस लेना;

(xi) भारत या ͪवदेश मɅ उÍचतर ͧश¢ण के ͩकसी अÛय ͪवæवͪवɮयालय या Ĥाͬधकार या संèथा अथवा शोध Ǔनकायɉ के

साथ यथा ͪवǑहत रȣǓत से इस Ĥयोजनाथ[ जो ͪवæवͪवɮयालय ͪवǓनæचत करे सहकार करना या सहयोग करना या

सहयुÈत करना;

(xii) èवͪवƣपोͪषत महाͪवɮयालयɉ तथा ͪवæवͪवɮयालय से संबɮध संèथाओं के छाğɉ पर Ĥाचाय[ परȣ¢ा शुãक एवं अÛय

सहयुÈत Ĥभार को ͪवǓनयͧमत करना

(xiii) परȣ¢ा, मूãयांकन अथवा जाँच कȧ ͩकसी अÛय पɮधǓत सǑहत ͪवæवͪवɮयालय अथवा ͪवæवͪवɮयालय का

ͪवशेषाͬधकार ĤाÜत संèथाओं मɅ नामांकन के मानकɉ का ͪवǓनæचय करना जबतक ͩक ऐसा ͪवǓनæचय संबंͬधत शीष[

åयावसाǓयक Ǔनयामक Ǔनकाय ɮवारा न ͩकया गया हो.

(xiv) ͧश¢क, कम[चारȣ एवं छाğɉ के èवाèØय एवं सामाÛय कãयाण को उÛनत करने कȧ åयवèथा करना तथा

ͪवæवͪवɮयालय के ͪवशेषाͬधकार ĤाÜत सàबɮध महाͪवɮयालय एवं संèथाओं को इसके ͧलये माग[दश[न करना

(xv) फेलोशीप, छाğवृͪƣ, अÚययन वृͪƣ पदक तथा पुरèकारɉ को संिèथत करना तथा देना;

(xvi) संबɮध महाͪवɮयालयɉ या संèथाओं के ĤबÛधन का आचार संǑहता बनाना;

(xvii) छाğɉ एवं कम[चाǐरयɉ के बीच अनुशासन ͪवǓनयͧमत तथा Ĥवृƣ करना और इस संबंध मɅ ऐसे अनुशासना×मक

अÚयुपाय करना जो ͪवæवͪवɮयालय ɮवारा आवæयक समझा जाय;

(xviii) उपकृǓत, चंदा और अनुदान ĤाÜत करना तथा Ûयास एवं दातåय संपͪƣयɉ सǑहत ͪवæवͪवɮयालय के Ĥयोजनाथ[

चल एवं अचल संपͪƣ को अिज[त करना, धाǐरत करना, Ĥबंधन करना तथा åययǓनत करना;

परÛतु राÏय सरकार के पूव[ अनुमोदन के ͧसवाय कोई अचल संपͪƣ åययǓनत नहȣं कȧ जायेगी।

(xix) काय[काǐरणी पǐरषɮ कȧ अनुमǓत से उधार लेना या देना तथा राÏय सरकार के पूव[ अनुमोदन से ͪवæवͪवɮयालय कȧ

संपͪƣ कȧ ĤǓतभूǓत पर ͪवæवͪवɮयालय के Ĥयोजनाथ[ धन उधार लेना;

(xx) मांग Ǔनयत करना तथा यथा ͪवǑहत शुãक एवं अÛय Ĥभार ĤाÜत तथा वसूल करना :

(xxi) पाǐरतोͪषक, पदक, शोध छाğवृͪƣ Ĥदश[नी तथा फेलोशीप संिèथत एवं Ĥदान करना

(xxii)अÚययन के ͪवषय, ͪवͧशçटȣकरण के ¢ेğ, ͧश¢ा के èतर, राÏय मɅ तकनीकȧ मानव शिÈत के कौशल एवं Ĥͧश¢ण

कȧ अãपकालȣन तथा दȣघ[कालȣन दोनɉ आधारɉ पर आवæयकताओं का Ǔनधा[रण करना तथा इन आवæयकताओं कȧ

पूǓत[ के ͧलए आवæयक काय[Đम आरàभ करना;

(xxiii) ͪवæवͪवɮयालय एवं संबɮध महाͪवɮयालयɉ एवं संèथानɉ के काय[रत ͧश¢कɉ तथा अÛय कम[चाǐरयɉ क जवाबदेहȣ

सुǓनिæचत करने हेतु एक तंğ का ͪवकास करना

(xxiv) ͪवæवͪवɮयालय के सभी अथवा ͩकसी उɮदेæय कȧ ĤािÜत हेतु सभी ऐसे अÛय काय[ तथा चीज़ करना जो आवæयक

आनुषांͬगक तथा सहायक हो

(xxv) पूरक सुͪवधाओं कȧ ĤािÜत हेतु उɮयोगɉ और सरकार कȧ सहकाǐरता को सूचीबɮध करने हेतु उपायɉ को आरàभ

करना।

(xxvi) £ान, Ĥͧश¢ण देने तथा पाɫयपुèतक एवं अनुदेशा×मक सामͬĒयɉ कȧ तैयारȣ करने मɅ लगातार Ĥयोग को सुकर

बनाना ͧलये;

(xxvii) शै¢ͨणक उपायɉ मɅ ǓनरÛतर मूãयाकन कȧ ĤगǓतशील Ĥèतुती तथा ͪवषयɉ के पुनः अͧभसंèकरण के åयवèथा

करना;

(xxviii) अपने ͧश¢कɉ एवं छाğɉ के बीच उɮयोग-उपĐमी योÊयता को अĒसर करना,

(xxix) èवाèØय ͪव£ान कȧ आवæयकता तथा उसके åयवसाय मɅ अवसर तथा उसके दाǓय×वɉ और समाज के ĤǓत सेवाओं

के संबंध मɅ जनता को ͧशͯ¢त करना

(xxx) ͪवæवͪवɮयालय के ͩकसी अÛय अͬधकारȣ या Ĥाͬधकरण को अपने सभी या ͩकसी भी शिÈत (संͪवͬध और ͪवǓनयम

बनाने कȧ शिÈत को छोड़कर) को सौपना और ऐसे अÛय काय[ और चीजɅ करना जो ͪवæवͪवɮयालय के सभी या

ͩकसी उɮदेæय को ĤािÜत या ͪवèतार के ͧलए ͪवæवͪवɮयालय आवæयक, अनुकूल या अनुषांͬगक समझे;

7. ͧलंग, वग[ या पंथ का Úयान न रखते हुए सभी åयिÈतयɉ के ͧलए ͪवæवͪवɮयालय का खुला रहना-ͪवæवͪवɮयालय

सभी åयिÈतयɉ के ͧलए चाहे उनके ͧलंग, जाǓत, पंथ, मूलवंश या वग[ जो भी हो खुला रहेगा और ͪवæवͪवɮयालय के

ͧलए यह ͪवͬधपूण[ नहȣं होगा ͩक ͪवæवͪवɮयालय मɅ कोई पद धाǐरत करने के ͧलए ǓनयुिÈत के हकदारȣ हेतु अथवा

ͪवæवͪवɮयालय के छाğ के Ǿप मɅ नामांͩकत होने या वहां èनातक करने के ͧलए अथवा उसके ͪवशेषाͬधकार का

उपयोग या Ĥयोग करने हेतु ͩकसी åयिÈत पर कोई जांच अͬधकार या अͬधरोͪपत ͩकया जाय चाहे उसका धाͧम[क

ͪवæवास एवं åयवसाय जो भी हो।

परÛतु इस धारा कȧ ͩकसी बात से यह नहȣं समझा जाएगा ͩक मǑहला, शारȣǐरक Ǿप से ǓनःशÈत åयिÈतयɉ

अथवा समाज के सामािजक एवं शै¢ͨणक Ǿप से ͪपछड़े वगɟ तथा अनुसूͬचत जाǓतयɉ या अनुसूͬचत जनजाǓतयɉ के

ͧलए Ǔनयोजन अथवा नामांकन के ͧलए ͪवशेष Ĥावधान करने से ͪवæवͪवɮयालय को रोका गया है।

8. नामांकन मɅ आर¢ण-ͪवæवͪवɮयालय सामािजक एवं शैͯ¢क Ǻिçट से ͪपछड़े वगɟ अनुसूͬचत जाǓतयɉ, अनुसूͬचत

जनजाǓतयɉ आͬथ[क Ǿप से ͪपछड़े वगɟ के सदèयɉ के ͧलए अंगीभूत महाͪवɮयालयɉ मɅ èथानɉ का आर¢ण सरकार

ɮवारा इस Ǔनͧमƣ समय-समय पर यथा अवधाǐरत ͧसɮधांतɉ के अनुसार करेगा।

9. कुलाͬधपǓत-

(i)

झारखÖड

के

मुÉयमंğी

अपने

पद

के

ͪवæवͪवɮयालय

कुलाͬधपǓत

हɉगे।

(ii) कुलाͬधपǓत, जब उपिèथत हो ͪवæवͪवɮयालय के दȣ¢ांत समारोह और शासी Ǔनकाय कȧ बैठकɉ कȧ अÚय¢ता करɅगे।

(iii) कुलाͬधपǓत को अͬधकार होगा ͩक ͪवæवͪवɮयालय, ͪवæवͪवɮयालय ɮवारा संबɮधता ĤाÜत, यथािèथǓत,

महाͪवɮयालय या संèथा तथा उसके भवनɉ, Ĥयोगशालाओं एवं उपकरणɉ और यथािèथǓत, ͪवæवͪवɮयालय

महाͪवɮयालय या संèथा ɮवारा संचाͧलत परȣ¢ा ͧश¢ण एवं ͩकये गये अÛय कायɟ का भी ऐसे åयिÈत या åयिÈतयɉ

ɮवारा िजसे या िजÛहɅ Ǔनदेͧशत करɅ Ǔनरȣ¢ण करवायɅ तथा यथािèथǓत ͪवæवͪवɮयालय, महाͪवɮयालय या संèथा के

Ĥशासन अथवा ͪवƣ से संबंͬधत ͩकसी ͪवषय के संबंध मɅ इसी Ĥकार से जोध पड़ताल करवायɅ।

(iv) कुलाͬधपǓत, Ĥ×येक मामले, मɅ ͪवæवͪवɮयालय अथवा महाͪवɮयालयɉ या संèथाओं के शासी Ǔनकाय को उनका

Ǔनरȣ¢ण या जाँच पड़ताल करवाने हेतु अपने आशय कȧ सूचना दɅगे तथा यथािèथǓत, ͪवæवͪवɮयालय या शासी

Ǔनकाय को ऐसी सूचना ĤाÜत होने पर कुलाͬधपǓत के सम¢, ऐसा अßयावेदन जो आवæयक ͪवचार ͩकया जाय

सूचना मɅ यथा ͪवǓनǑद[çट अवͬध के भीतर देने का अͬधकार होगा।

(v) ͪवæवͪवɮयालय या शासी Ǔनकाय ɮवारा Ǒदये गए अßयावेदन, यǑद कोई हो, पर ͪवचारण के बाद कुलाͬधपǓत उपधारा

(3) मɅ यथा Ǔनदȶͧशत Ǔनरȣ¢ण या जाँच पड़ताल करवा सकɅ गे।

(vi) जहाँ Ǔनरȣ¢ण या जांच-पड़ताल कुलाͬधपǓत ɮवारा करवायी जाय, वहाँ ͪवæवͪवɮयालय या शासी Ǔनकाय एक

ĤǓतǓनͬध ǓनयुÈत करने का हकदार होगा िजसे उस Ǔनरȣ¢ण अथवा जाँच पड़ताल मɅ उपिèथत होने और सुने जाने

का अͬधकार होगा।

(vii) कुलाͬधपǓत उपधारा (3) मे यथाǓनदेͧशत उस Ǔनरȣ¢ण या जाँच-पड़ताल के पǐरणाम के संबंध मɅ कुलपǓत को

संबोͬधत कर सकɅ गे और कुलपǓत कुलाͬधपǓत के ͪवचारɉ को, उस सलाह के साथ, उसपर कार[वाई करने हेतु

कुलाͬधपǓत ɮवारा Ǒदया गया हो, काय[काǐरणी पǐरषɮ को संसूͬचत कर दɅगे।

(viii) यǑद Ǔनरȣ¢ण या जाँच-पड़ताल, ͪवæवͪवɮयालय ɮवारा ͪवशेषाͬधकार ĤाÜत ͩकसी महाͪवɮयालय या संèथा के

संबंध मɅ कȧ गयी हो तो कुलाͬधपǓत उस Ǔनरȣ¢ण या जाँच पड़ताल के पǐरणाम के बारे मɅ अपने ͪवचार कुलपǓत के

माÚयम से शासी Ǔनकाय को संबोͬधत कर सकɅ गे तथा उस पर कार[वाई करने कȧ ऐसी सलाह दɅगे, जैसी चाहɅ।

(ix) काय[काǐरणी पǐरषद कुलपǓत के माÚयम से, उस कार[वाई को, यǑद कोई हो, जो उस Ǔनरȣ¢ण अथवा जाँच-पड़ताल के

पǐरणाम पर करने का Ĥèताव हो अथवा कȧ गयी हो, कुलाͬधपǓत को संसूͬचत करɅगे।

(x) जहाँ यथािèथǓत, काय[काǐरणी पǐरषɮ या शासी Ǔनकाय युिÈतयुÈत समय के भीतर, कुलाͬधपǓत के संतोष के अनुǾप

कार[वाई नहȣं करे वहाँ कुलाͬधपǓत काय[काǐरणी पǐरषɮ या शासी Ǔनकाय ɮवारा भेजे गए èपçटȣकरण अथवा Ǒदये

गए अßयावेदन पर ͪवचार करने के बाद ऐसे Ǔनदेश जारȣ कर सकɅ गे जैसा वे उͬचत समझɅ तथा यथािèथǓत

काय[काǐरणी पǐरषɮ अथवा शासी Ǔनकाय उन Ǔनदेशɉ का अनुपालन करेगा।

(xi)) इस धारा के पूव[वतȸ Ĥावधानɉ पर ĤǓतकूल Ĥभाव डाले ǒबना, कुलाͬधपǓत, ͧलͨखत आदेश ɮवारा ͪवæवͪवɮयालय कȧ

ͩकसी काय[वाहȣ को बातील (ǓनèĤभावी) कर सकɅ गे जो इस अͬधǓनयम, पǐरǓनयम, अÚयादेश के अनुǾप न हो;

परÛतु कोई ऐसा आदेश करने के पूव[, कुलाͬधपǓत, रिजèĚार को कारण दशा[ने हेतु कहɅगे ͩक Èयɉ नहȣं ऐसा

आदेश पाǐरत ͩकया जाय और यǑद युिÈतयुÈत समय-सीमा के भीतर कारण दशा[या जाय तो ये उस पर ͪवचार

करɅगे।

(xii) ͪवæवͪवɮयालय के Ĥाͬधकाǐरयɉ या अͬधकाǐरयɉ के बीच ͩकसी भी मामले पर मतभेद कȧ दशा मɅ िजसे अÛयथा हल

नहȣं ͩकया जा सकता है, कुलाͬधपǓत का Ǔनण[य अंǓतम होगा।

(xiii) कुलाͬधपǓत को ऐसी अÛय शिÈतयाँ ĤाÜत होगी जो पǐरǓनयम ɮवारा ͪवǑहत कȧ जाय।

10. ͪवæवͪवɮयालय के पदाͬधकारȣ ͪवæवͪवɮयालय के Ǔनàनͧलͨखत पदाͬधकारȣ हɉगे:-

(i) कुलपǓत,

(ii) संकायɉ के डीन,

(iii) रिजèĚार,

(iv) ͪवƣ पदाͬधकारȣ,

(v) परȣ¢ा Ǔनयंğक,

(vi) संपदा पदाͬधकारȣ,

(vii) डीन, छाğ कãयाण

(Vili) पुèतकालयाÚय¢,

(ix) ऐसे अÛय पदाͬधकारȣ िजÛहɅ पǐरǓनयम ɮवारा ͪवæवͪवɮयालय का पदाͬधकारȣ होना घोͪषत ͩकया जाय।

11. कुलपǓत-

(i) कुलपǓत, ͬचͩक×सा एवं èवाèØय ͪव£ान ͧश¢ा के ¢ेğ मɅ अनुभव रखने वाले ͧश¢ाͪवद अथवा ĤǓतिçठत ͬचͩक×सक

अथवा èवाèØय ͬचͩक×सा ͪव£ान कȧ अकादͧमक पृçठभूͧम के साथ मानव संसाधन ͪवकास मɅ पया[Üत अनुभव रखने

वाले एक Ĥशासक हɉगे।

(ii) कुलपǓत, कुलाͬधपǓत ɮवारा झारखÖड सरकार के परामश[ से इस धारा कȧ उपधारा (3) के अधीन गǑठत èĐȧǓनंग

सͧमǓत ɮवारा अनुशंͧसत तीन से अÛयून åयिÈतयɉ (नाम वणा[Đम से åयविèथत हɉगे) के पैनल से ǓनयुÈत ͩकये

जायɅगे;

परÛतु कुलाͬधपǓत उस Ĥकार अनुशंͧसत åयिÈतयɉ मɅ से ͩकसी को अनुमोǑदत नहȣं करɅ तो वे नयी अनुशंसाओं

कȧ माँग कर सकɅ गे।

(iii) इस धारा कȧ उपधारा (2) मɅ Ǔनदȶͧशत सͧमǓत मɅ तीन सदèय हɉगे िजनमɅ एक काय[काǐरणी पǐरषɮ ɮवारा, एक

कुलाͬधपǓत ɮवारा और एक सरकार ɮवारा नाम ǓनǑद[çट हɉगे और सरकार ɮवारा नाम ǓनǑद[çट åयिÈत सͧमǓत के

संयोजक हɉगे

परÛतु सͧमǓत का कोई भी सदèय ͪवæवͪवɮयालय का कम[चारȣ नहȣं होगा, परÛतु और ͩक पैनल जन अßयͬथ[यɉ

के बीच से तैयार ͩकया जायेगा जो अपना बायोडाटा समͪप[त करɅगे अथवा èवाèØय ͪव£ान के ¢ेğ मɅ कुछ ÉयाǓत

ĤाÜत åयिÈतयɉ अथवा संèथाओं ɮवारा अनुशंͧसत ͩकये जायɅगे।

(iv) Ĥथम कुलपǓत सरकार ɮवारा ǓनयुÈत ͩकये जायɅगे।

(v) कुलपǓत अपना पदधारण करने कȧ Ǔतͬथ से तीन वषɟ के ͧलये पद धारण करɅगे और अगले काय[काल के ͧलए

पुनǓन[युिÈत के पाğ हɉगे परÛतु कुलाͬधपǓत काय[काल कȧ समािÜत के बाद कुलपǓत से उस अवͬध तक, जो कुल एक

वष[ से अͬधक न हो, उनके ɮवारा यथा ͪवǓनǑद[çट पद पर बने रहने कȧ अपे¢ा कर सकɅ गे।

परÛतु यह भी ͩक कुलपǓत के पद पर बने रहने के ͧलये अͬधकतम आयु सीमा सƣर वष[ होगी।

(vi) कुलपǓत कȧ पǐरलिÞधयाँ एवं अÛय सेवाशत[ वहȣ हɉगी जो पǐरǓनयम ɮवारा ͪवǑहत कȧ जाय।

(vii) यǑद कुलपǓत का पद मृ×यु, पद ×याग, अथवा अÛयथा खालȣ हो जाय अथवा यǑद अèवèथता या ͩकसी अÛय कारण

से वे अपने कƣ[åयɉ का अनुपालन करने मɅ असमथ[ हो जाय तो कुलाͬधपǓत ͩकसी लÞधĤǓतिçठत åयिÈत जो

आवयæक पाğता धाǐरत करते हो, को कुलपǓत के कृ×यɉ का अनुपालन जब तक करने के ͧलए पदाǓनǑहत करɅगे तब

तक यथािèथǓत, नये कुलपǓत काय[भार Ēहण नहȣं कर लेते अथवा जब तक ͪवɮयमान कुलपǓत अपने कƣ[åय पर

उपिèथत नहȣं हो जाते।

12. कुलपǓत कȧ शिÈतयाँ, कƣ[åय एवं कृ×य –

(i) कुलपǓत ͪवæवͪवɮयालय के Ĥधान काय[पालक एवं शै¢ͨणक पदाͬधकारȣ हɉगे और ͪवæवͪवɮयालय के ͩĐयाकलापɉ पर

सामाÛय पय[वे¢ण और Ǔनयंğण का Ĥयोग करɅगे तथा ͪवæवͪवɮयालय के Ĥाͬधकारɉ के ͪवǓनæचयɉ को Ĥभावी करɅगे।

(ii) कुलपǓत, यǑद उनकȧ राय हो ͩक ͩकसी ͪवषय पर तुरÛत कार[वाई करना आवæयक है. इस अͬधǓनयम ɮवारा / के

अधीन ͪवæवͪवɮयालय के ͩकसी Ĥाͬधकार को Ĥदƣ ͩकसी शिÈत का Ĥयोग कर सकɅ गे और अगलȣ बैठक मɅ उस

Ĥाͬधकार को उनके ɮवारा उस ͪवषय मɅ कȧ गयी कार[वाई के संबंध मɅ ĤǓतवेदन दɅगे:

परÛतु शिÈत का इस Ĥकार Ĥयोग केवल आपात िèथǓतयɉ मɅ ͩकया जायेगा और ͩकसी भी दशा मɅ पद-सृजन

और उ×Đम तथा उसपर ǓनयुिÈतयɉ के संबंध मɅ नहȣं;

परÛतु और ͩक संबंͬधत Ĥाͬधकार कȧ राय हो ͩक ऐसी कार[वाई नहȣं कȧ जानी चाǑहए थी तो वह उस ͪवषय को

कुलाͬधपǓत को Ǔनदȶͧशत कर सकɅ गे िजनका ͪवǓनæचय उस पर अंǓतम होगा:

परÛतु और भी ͩक ͪवæवͪवɮयालय कȧ सेवा मɅ कोई åयिÈत जो इस उपधारा के अधीन कुलपǓत ɮवारा कȧ गई

कार[वाई से åयͬथत हो तो उसे िजस Ǔतͬथ को ͪवǓनæचय, उसे संसूͬचत ͩकया गया हो. उसके तीन माह के भीतर

कुलाͬधपǓत को उस कार[वाई के ͪवǽɮध अपील करने का अͬधकार होगा और तब कुलाͬधपǓत कुलपǓत ɮवारा कȧ गयी

कार[वाई को संपुçट, उपांतǐरत अथवा उलट सकɅ गे।

(iii) कुलपǓत, यǑद उनकȧ राय हो ͩक ͪवæवͪवɮयालय के ͩकसी Ĥाͬधकार का कोई ͪवǓनæचय इस अͬधǓनयम पǐरǓनयम

या अÚयादेश के Ĥावधानɉ ɮवारा Ĥदƣ Ĥाͬधकार कȧ शिÈतयɉ के बाहर है अथवा ͩकया गया कोई ͪवǓनæचय

ͪवæवͪवɮयालय के Ǒहत मɅ नहȣं है, तो संबंͬधत Ĥाͬधकार से उस ͪवǓनæचय का पुनरȣ¢ण उस ͪवǓनæचय कȧ Ǔतͬथ से

साठ Ǒदनɉ के भीतर करने हेतु कह सकɅ गे और यǑद वह Ĥाͬधकार उस ͪवǓनæचय का पुनरȣ¢ण पूण[तः या अंशतः करने

से इÛकार करे अथवा उसके ɮवारा उÈत साठ Ǒदनɉ के भीतर कोई Ǔनण[य नहȣं ͧलया जाय तो यह ͪवषय कुलाͬधपǓत

को Ǔनदȶͧशत कर Ǒदया जायेगा, िजनका उस पर ͪवǓनæचय अंǓतम होगा।

(iv) कुलपǓत ऐसी अÛय शिÈतयɉ का Ĥयोग एवं ऐसे अÛय कƣ[åयɉ का पालन करɅगे जो पǐरǓनयम या अÚयादेश ɮवारा

ͪवǑहत ͩकये जायɅ।

(v) कुलपǓत काय[काǐरणी पǐरषɮ, ͪवƣ सͧमǓत, एकेडͧमक काउिÛसल एवं ÜलाǓनंग बोड[ के अÚय¢ हɉगे।

(vi) कुलपǓत, कुलाͬधपǓत कȧ अनुपिèथǓत मɅ, ͪवæवͪवɮयालय के ͩकसी भी दȣ¢ांत समारोह एवं शासी Ǔनकाय कȧ बैठकɉ

कȧ अÚय¢ता करɅगे।

13. कुलपǓत को पद से हटाया जाना-

(i) ऐसी जाँच-पड़ताल के बाद जैसा आवæयक ͪवचार ͩकया जाय, यǑद कुलाͬधपǓत को ͩकसी भी समय यह Ĥतीत हो ͩक

कुलपǓत -

(a) इस अͬधǓनयम, पǐरǓनयम या अÚयादेश के अधीन उन पर अͬधरोͪपत ͩकसी कƣ[åय के Ǔनव[हन मɅ असफल हो

गये हɇ, अथवा

(b) ͪवæवͪवɮयालय के Ǒहतɉ के ĤǓतकूल रȣǓत से काय[ ͩकये हɇ, अथवा

कुलपǓत का काय[काल समाÜत नहȣं हुआ है, ͧलͨखत आदेश ɮवारा उसमɅ कारण अͬधकͬधत करते हुए और राÏय

सरकार के परामश[ से कुलपǓत से आदेश मɅ यथा ͪवǓनǑद[çट Ǔतͬथ से अपने पद से ×याग पğ देने कȧ अपे¢ा कर

सकɅ गे।

(ii) उपधारा (1) के अधीन तब तक कोई आदेश पाǐरत नहȣं ͩकया जायेगा जब तक ͪवǓनǑद[çट आधारɉ, िजस पर वह

कार[वाई Ĥèताͪवत हो, को अͬधकͬथत करते हुए एक सूचना ताͧमल न कȧ गयी हो और Ĥèताͪवत आदेश के ͪवǽɮध

कारण दशा[ने हेतु युिÈतयुÈत अवसर कुलपǓत को न दे Ǒदया गया हो।

(iii) इस धारा कȧ उपधारा (1) मɅ ͪवǓनǑद[çट Ǔतͬथ को / से यह समझा जायेगा ͩक कुलपǓत ने पद×याग कर Ǒदया है और

कुलपǓत का पद खालȣ समझा जायेगा।

14. डीन- डीन उस रȣǓत से ǓनयुÈत ͩकये जायɅगे और उन शिÈतयɉ का Ĥयोग करɅगे तथा उन कƣ[åयɉ का अनुपालन करɅगे

जो पǐरǓनयम ɮवारा ͪवǑहत ͩकये गए हो।

15. रिजèĚार -

(i) रिजèĚार उस रȣǓत से तथा सेवा के उन और शतɟ पर ǓनयुÈत ͩकये जायɅगे जो पǐरǓनयम ɮवारा ͪवǑहत ͩकये जायɅ।

तथाͪप, ͪवæवͪवɮयालय के Ĥथम पंिजèĚार सरकार ɮवारा ǓनयुÈत ͩकए जायɅगे न वषȾ अथवा पǐरǓनयम मɅ ͪवǑहत

रȣǓत के अनुसार ǓनयुिÈत होने तक जो पहले हो एक पद धारण करɅगे ।

(ii) रिजèĚार को ͪवæवͪवɮयालय कȧ ओर से एकरारनामा करने, दèतावेजɉ को हèता¢ǐरत करने तथा अͧभलेखɉ को

अͬधĤमाणीकृत करने कȧ शिÈत होगी तथा ऐसी शिÈतयɉ का Ĥयोग तथा ऐसे कत[åयɉ का पालन करɅगे जो पǐरǓनयम

ɮवारा ͪवǑहत ͩकये जाये।

16. ͪवƣ पदाͬधकारȣ-

(i) ͪवæवͪवɮयालय के काय[काǐरणी पǐरषद, सरकार ɮवारा Ǒदये गये राÏय/केÛġȣय ͪवƣ सेवा/केÛġȣय राजèव सेवा / लेखा

परȣ¢ा एवं लेखा सेवा से आने वाले पदाͬधकाǐरयɉ के नामɉ के पैनल मɅ से ͩकसी åयिÈत को ͪवæवͪवɮयालय के ͪवƣ

पदाͬधकारȣ के Ǿप मɅ Ǔनयमावलȣ ɮवारा यथाͪवǑहत अवͬध एवं शतɟ पर ǓनयुÈत करेगी। तथाͪप, ͪवæवͪवɮयालय के

Ĥथम ͪवƣ पदाͬधकारȣ सरकार ɮवारा ǓनयुÈत ͩकये जायɅगे तथा तीन वषȾ तक अथवा पǐरǓनयम मɅ ͪवǑहत रȣǓत के

अनुसार ͪवƣ पदाͬधकारȣ ǓनयुÈत होने तक जो पहले होत पद धारण करɅगे।

(ii) ͪवƣ पदाͬधकारȣ, ͪवæवͪवɮयालय का पूण[काͧलक पदाͬधकारȣ होगा एवं कुलपǓत के Ǔनयंğण के अÚयधीन यथाͪवǑहत

शिÈतयɉ का Ĥयोग तथा कत[åयɉ का संपादन करेगा।

17. परȣ¢ा Ǔनयंğक- परȣ¢ा Ǔनयंğक, उस रȣǓत से और उन Ǔनबंधन एवं सेवाशतɟ पर ǓनयुÈत ͩकये जायɅगे तथा ऐसी

शिÈतयɉ का Ĥयोग एवं ऐसे कƣ[åयɉ का पालन करɅगे जो पǐरǓनयम ɮवारा ͪवǑहत ͩकये जायɅ। तथाͪप ͪवæवͪवɮयालय

के Ĥथम परȣ¢ा Ǔनयंğक सरकार ɮवारा ǓनयुÈत ͩकए जायɅगे तथा तीन वषȾ तक अथवा पǐरǓनयम मɅ ͪवǑहत रȣǓत के

अनुसार परȣ¢ा Ǔनयंğक ǓनयुÈत होने तक जो पहले हो, तक पद धारण करɅगे।

18. संपदा अͬधकारȣ- ͪवæवͪवɮयालय के सभी भवनɉ, मैदान, बाग-बगीचे तथा अÛय अचल संपͪƣयɉ के भारसाधक

(इंचाज[) संपदा अͬधकारȣ होगे।

19. डीन छाğ कãयाण- डीन छाğ कãयाण का कत[åय होगा ͩक ͪवæवͪवɮयालय के छाğɉ के Ĥवासन हेतु सुͪवधायɅ

उपलÞध करायɅगे, छाğɉ को परामश[ हेतु काय[Đम आयोिजत करायɅगे, अǓतǐरÈत पाɫयĐम गǓतͪवͬधयɉ कȧ Ǔनगरानी

करɅगे तथा ͪवæवͪवɮयालय के पूव[वतȸ छाğɉ से सàपक[ èथाͪपत करने मɅ मदद करɅगे।

20.अÛय पदाͬधकारȣ- ͪवæवͪवɮयालय के अÛय पदाͬधकाǐरयɉ कȧ ǓनयुिÈत कȧ रȣǓत शिÈतयाँ तथा कत[åय वहȣ हɉगे जो

पǐरǓनयम ɮवारा ͪवǑहत ͩकए जायɅ।

21. ͪवæवͪवɮयालय के Ĥाͬधकार- ͪवæवͪवɮयालय के Ǔनàनͧलͨखत Ĥाͬधकार हɉगे :-

(i) शासी Ǔनकाय,

(ii) काय[काǐरणी पǐरषɮ

22. शासी Ǔनकाय

(i) शासी Ǔनकाय मɅ Ǔनàनͧलͨखत सदèय शाͧमल हɉगे-

(a) कुलाͬधपǓत,

(b) मंğी èवाèØय, ͬचͩक×सा ͧश¢ा एवं पǐरवार कãयाण ͪवभाग, झारखंड सरकार,

(d) मुÉय सͬचव, झारखÖड सरकार,

(e) कुलपǓत

(f) अपर मुÉय सͬचव / Ĥधान सͬचव / सͬचव, èवाèØय ͪवभाग, झारखÖड सरकार

(g) अपर मुÉय सͬचव / Ĥधान सͬचव / सͬचव, ͪवƣ ͪवभाग, झारखÖड सरकार या उनके ɮवारा नाͧमत

ĤǓतǓनͬध जो संयुÈत सͬचव के पद से अÛयून हो,

कॉलेज से एक Ĥाचाय[ तथा सरकारȣ फामȶसी महाͪवɮयालय / ͩफिजयोथेरापी और ऑÈयूपेशनल थेरापी /

पारामेͫडकल संèथानɉ मɅ से एक Ĥाचाय[ शाͧमल है। यह सरकार के ɮवारा चĐानुसार तीन वषɟ के ͧलये

नाͧमत हɉगे।

(p) èवाèØय ͪव£ान मɅ Ǿͬच रखने वाले ĤǓतिçठत åयिÈतयɉ मɅ से सरकार ɮवारा चार åयिÈतयɉ को इस शत[ के

साथ अͬधनाͧमत ͩकया जायेगा ͩक इनमɅ से एक अनुसूͬचत जाǓत / अनुसूͬचत जनजाǓत से संबंͬधत åयिÈत

होगा और उनमɅ एक मǑहला सदèय नाͧमत होगी.

(q) Ĥ×येक शीष[ åयावसाǓयक Ǔनयामक Ǔनकाय से एक ĤǓतǓनͬध और

(r) ͪवæवͪवɮयालय के शै¢ͨणक, ĤशासǓनक और ĤबÛधकȧय कम[चारȣ मɅ से Ǔनवा[ͬचत एक सदèय

(ii) रिजèĚार शासी Ǔनकाय का पदेन सͬचव होगा।

(iii) जब कोई åयिÈत धाǐरत पद या ǓनयुिÈत के कारण से शासी Ǔनकाय का सदèय बन जाता है तो उसकȧ सदèयता इस

पद या ǓनयुिÈत कȧ समािÜत के साथ समाÜत हो जायेगी।

(iv) पदेन सदèयɉ से अÛयथा शासी Ǔनकाय के मनोनीत और Ǔनवा[ͬचत सदèयɉ का काय[काल तीन वषɟ का होगा।

(v) शासी Ǔनकाय के ͩकसी सदèय कȧ सदèयता समाÜत हो जायेगी यǑद वह इèतीफा दे दे, ͪवकृत मिèतçक का हो जाय,

Ǒदवाͧलया हो जाय या नैǓतक अधमता से जुड़े दांͫडक अपराध के ͧलये दोषी ठहराया जाय। कुलपǓत कुलसͬचव से

अÛयथा कोई सदèय भी सदèय नहȣं रहेगा यǑद वह ͪवæवͪवɮयालय मɅ पूण[काͧलक ǓनयुिÈत èवीकार करता है या

यǑद वह पदेन सदèय न हो तो कुलाͬधपǓत कȧ अनुमǓत के ǒबना शासी Ǔनकाय कȧ बैठक मɅ लगातार तीन बार भाग

लेने मɅ असफल होता है।

(vi) पदेन सदèय से अÛयथा शासी Ǔनकाय का कोई सदèय कुलाͬधपǓत को संबोͬधत एक पğ के ɮवारा अपने पद से

इिèतफा दे सकता है और ऐसा इèतीफा èवीकार ͩकये जाने के तुरÛत बाद Ĥभावी होगा।

(vii) शासी Ǔनकाय मɅ ͩकसी भी ǐरिÈत को संबंͬधत नाम Ǔनदȶशन Ĥाͬधकारȣ ɮवारा काय[काल कȧ शेष अवͬध के ͧलये

मनोनयन ɮवारा भरा जायेगा और ǐरिÈत कȧ अवͬध कȧ समािÜत पर ऐसा मनोनयन ǓनèĤभावी हो जायेगा।

23. शासी Ǔनकाय कȧ शिÈतयाँ कृ×य एवं बैठक :--

(i) शासी Ǔनकाय ͪवæवͪवɮयालय का पूण[ Ĥाͬधकरण होगा और समय-समय पर ͪवæवͪवɮयालय कȧ åयापक नीǓतयɉ और

काय[Đमɉ का Ǔनमा[ण और समी¢ा करेगा और ͪवæवͪवɮयालय के सुधार और ͪवकास के ͧलए उपाय करेगा और उसके

पास Ǔनàनͧलͨखत शिÈतयाँ और काय[ भी हɉगे, यथा:-

(a) काय[काǐरणी पǐरषɮ ɮवारा तैयार ǐरपोट[, ͪवƣीय ͪववरण और बजट अनुमानɉ पर ͪवचार करना और उÛहɅ

पाǐरत करना और संशोधन के साथ या ǒबना उÛहɅ अंͬगकृत करना

(b) ͪवæवͪवɮयालय के काय[-कलापɉ के Ĥशासन से संबंͬधत पǐरǓनयम बनाना िजसमɅ ͪवæवͪवɮयालय के

Ĥाͬधकाǐरयɉ और अͬधकाǐरयɉ ɮवारा उनके कायɟ के Ǔनव[हन मɅ अपनाई जाने वालȣ ĤͩĐयाओं को ͪवǑहत

करना भी शाͧमल है।

(ii) शासी Ǔनकाय कȧ बैठक वष[ मɅ कम से कम दो बार होगी एवं इसकȧ Ǔतͬथ कुलाͬधपǓत ɮवारा Ǔनधा[ǐरत कȧ जायेगी तथा

उÈत मɅ से एक बैठक वाͪष[क बैठक कहȣ जायेगी।

(a) कुलाͬधपǓत, जब कभी वह ठȤक समझɅ और शासी Ǔनकाय के कम-से-कम 15 सदèयɉ ɮवारा हèता¢ǐरत ͧलͨखत

मांग पर शासी Ǔनकाय कȧ एक ͪवशेष बैठक बुला सकɅ गे।

(b) शासी Ǔनकाय कȧ Ĥ×येक बैठक के ͧलए चैदह Ǒदन का नोǑटस Ǒदया जाएगा तथाͪप आपात िèथǓत मɅ कुलाͬधपǓत

ɮवारा अãप सूचना पर शासी Ǔनकाय कȧ बैठक बुलाई जा सकती है।

(d) Ĥ×येक सदèयɉ के पास एक मत देने का अͬधकार होगा यǑद शासी Ǔनकाय ɮवारा Ǔनधा[ǐरत ͩकए जाने वाले ͩकसी

भी Ĥæन पर मतɉ कȧ समानता है तो बैठक कȧ अÚय¢ता करने वाले åयिÈत के पास इसके अǓतǐरÈत एक

Ǔनणा[यक मत होगा।

(e) ऐसी अÛय शिÈतयɉ का Ĥयोग करना और ऐसे अÛय कŧतåयɉ का पालन करना जो अͬधǓनयम या Ǔनयमɉ ɮवारा

Ĥदान ͩकया जाय या सौपɅ जाय।

24. काय[काǐरणी पǐरषɮ -

(i) काय[काǐरणी पǐरषɮ ͪवæवͪवɮयालय कȧ Ĥधान काय[काǐरणी Ǔनकाय होगी।

(ii) काय[काǐरणी पǐरषɮ मɅ Ǔनàनͧलͨखत åयिÈत हɉगे -

(a) ͪवæवͪवɮयालय के कुलपǓत;

(b) अपर मुÉय सͬचव/Ĥधान सͬचव/सͬचव, èवाèØय ͪवभाग, झारखÖड सरकार या उनका ĤǓतǓनͬध जो संयुÈत सͬचव

के पद से अÛयून हो ;

पद से अÛयून हो ;

(d) Ǔनदेशक Ĥमुख, èवाèØय सेवाएँ, झारखÖड सरकार ;

(e) Ǔनदेशक, ͬचͩक×सा ͧश¢ा, झारखÖड सरकार ;

(f) ͪवæवͪवɮयालय के कुलसͬचव (रिजèĚार);

(g) कुलाͬधपǓत ɮवारा नाͧमत ͩकये जाने वाले तीन ͧश¢क, िजनमɅ से एक ͪवभाग के Ĥमुखɉ मɅ से, एक ĤाÚयापकɉ मɅ से

और एक सह-ĤाÚयापकɉ मɅ से एक वष[ कȧ अवͬध के ͧलये चĐानुĐम मɅ सरकारȣ ͬचͩक×सा महाͪवɮयालयɉ/अÛय

महाͪवɮयालयɉ मɅ से होगा।

(iii)

कुलपǓत काय[काǐरणी पǐरषɮ के अÚय¢ हɉगे ;

(a) जहां कोई åयिÈत अपने पद या ǓनयुिÈत के कारण काय[काǐरणी पǐरषद का सदèय बन गया हो, उसकȧ सदèयता

समाÜत हो जाएगी जब वह उस पद पर नहȣं रहे या उसकȧ ǓनयुिÈत समाÜत हो जाय;

(b) पदेन सदèयɉ को छोड़कर काय[काǐरणी पǐरषɮ के मनोनीत सदèयɉ कȧ पदावͬध तीन वषɟ कȧ होगी ;

जाता है या Ǒदवाͧलया हो जाता है या नैǓतक अधमता से जुडे दांͫडक अपराध के ͧलए दोषी ठहराया जाता है।

कुलपǓत तथा रिजèĚार से अÛयथा कोई अÛय सदèय भी सदèय नहȣं रहेगा यǑद वह ͪवæवͪवɮयालय मɅ

पूण[काͧलक ǓनयुिÈत èवीकार करता है;

(d) पदेन सदèय के अलावा काय[काǐरणी पǐरषɮ का कोई सदèय कुलपǓत को संबोͬधत एक पğ ɮवारा अपने पद से

×यागपğ दे सकेगा और ऐसा ×यागपğ उसके ɮवारा èवीकार ͩकए जाने के तुरंत बाद Ĥभावी होगा ;

(e) काय[काǐरणी पǐरषɮ मɅ ͩकसी भी ǐरिÈत को संबंͬधत नाम Ǔनदȶशन Ĥाͬधकारȣ ɮवारा काय[काल कȧ शेष अवͬध के

ͧलए मनोनयन से भरा जाएगा तथा ǐरिÈत कȧ अवͬध कȧ समािÜत पर, ऐसा मनोनयन Ĥभावी नहȣं रहेगा।

(iv) काय[काǐरणी पǐरषɮ कȧ शिÈतयाँ, काय[ और बैठकɅ ;

(a) काय[काǐरणी पǐरषɮ ͪवæवͪवɮयालय का मुÉय काय[काǐरणी Ĥाͬधकरण होगा और इस Ĥकार इस अͬधǓनयम

और इसके तहत बनाए गये पǐरǓनयमɉ के Ĥावधानɉ के अधीन ͪवæवͪवɮयालय के Ĥशासन के ͧलए इसे आवæयक

सभी शिÈतयां हɉगी, और इस Ĥयोजन के ͧलए और इसमɅ उपबंͬधत ͪवषयɉ के संबंध मɅ भी ͪवǓनयम बना

सकेगी।

(b) काय[काǐरणी पǐरषɮ के पास Ǔनàनͧलͨखत शिÈतयाँ और काय[ हɉगे ;

(i) वाͪष[क बैठक ĤǓतवेदन तैयार करना ;

(ii) ͪवæवͪवɮयालय के कामकाज पर एक ǐरपोट[

(iii) खातɉ का ͪववरण ;

(iv) आगामी शै¢ͨणक वष[ के ͧलए बजट Ĥèताव ;

(v) ͪवæवͪवɮयालय के ͪवƣ, खातो, Ǔनवेशो संपͪƣयो, åयवसाय और अÛय सभी ĤशासǓनक काय[कलापɉ का Ĥबंधन और

ͪवǓनयमन करना और इस Ĥयोजन के ͧलए सͧमǓतयɉ का गठन करना और ऐसी सͧमǓतयɉ या ͪवæवͪवɮयालय के

ऐसे अͬधकाǐरयɉ को अͬधकार सɋपना जो वह उͬचत समझे ;

(vi) ͪवæवͪवɮयालय कȧ ओर से ͩकसी चल या अचल संपǓत का अंतरण करना या अंतरण èवीकार करना ;

(vii) ͪवæवͪवɮयालय कȧ ओर से संͪवदा करना, उसमɅ बदलाव करना, उसे पूरा करना और रɮद करना और इस Ĥयोजन के

ͧलए ऐसे पदाͬधकाǐरयɉ को ǓनयुÈत करना िजÛहɅ वह ठȤक समझे ;

(viii) ͪवæवͪवɮयालय के काय[ को चलाने के ͧलए आवæयक भवन, पǐरसर, उपèकर और उपकरण और अÛय साधन

उपलÞध कराना ;

(ix) ͪवæवͪवɮयालय के छाğɉ और कम[चाǐरयɉ कȧ ͩकसी भी ͧशकायत को लेना, उस पर Ûयाय Ǔनण[य करना और यǑद वह

ठȤक समझे तो उसका Ǔनवारण करना ;

(x) ĤशासǓनक, अनुसͬचवीय और अÛय आवæयक पदɉ का सृजन करना, ऐसे पदɉ कȧ संÉया और पǐरलिÞधयɉ का

Ǔनधा[रण करना, ऐसे पदɉ पर ǓनयुिÈत के ͧलए Ûयूनतम योÊयताएं सेवा के ऐसे Ǔनबंधन और शतɟ पर ͪवǓनǑद[çट

करना जो इस Ǔनͧमƣ बनाए गए पǐरǓनयमɉ एवं ͪवǓनयमɉ ɮवारा ͪवǑहत ͩकया जाय ;

(xi) परȣ¢कɉ और अनुसीमकɉ (माडरेटरɉ) को ǓनयुÈत करना, और यǑद आवæयक हो तो उÛहɅ हटाना और उनकȧ फȧस,

पǐरलिÞधयां और याğा एवं अÛय भƣे अकादͧमक पǐरषɮ से परामश[ करने के बाद Ǔनयत करना ;

(xii) ͪवæवͪवɮयालय के ͧलए एक सामाÛय मुहर का चयन करना; तथा

(xiii) ऐसी अÛय शिÈतयɉ का Ĥयोग करना और ऐसे अÛय कत[åयɉ का पालन करना जो आवæयक समझे जाएँ या इस

अͬधǓनयम के ɮवारा या इसके अधीन उस पर अͬधरोͪपत ͩकया जाय।

Ǒदन कȧ सूचना दȣ जायेगी ;

(ii) काय[काǐरणी पǐरषɮ कȧ बैठक कुलपǓत के Ǔनदȶशɉ के अधीन या काय[काǐरणी पǐरषɮ के कम से कम पांच सदèयɉ के

अनुरोध पर रिजèĚार ɮवारा बुलाई जाएगी;

(iii) काय[काǐरणी पǐरषɮ के आधे सदèय से ͩकसी भी बैठक कȧ गणपूǓत[ होगी ;

(iv) सदèयɉ के बीच मतभेद के मामले मɅ, बहुमत कȧ राय अͧभभावी होगी ;

(v) काय[काǐरणी पǐरषɮ के Ĥ×येक सदèय के पास एक मत होगा और यǑद काय[काǐरणी पǐरषɮ ɮवारा Ǔनधा[ǐरत ͩकए

जाने वाले ͩकसी भी Ĥæन पर मतɉ कȧ समानता हो, तो यथािèथǓत काय[काǐरणी पǐरषद के अÚय¢ या उस बैठक कȧ

अÚय¢ता करने वाला सदèय के पास अपने मत के अलावा एक Ǔनणा[यक मत होगा;

(vi) काय[काǐरणी पǐरषɮ कȧ Ĥ×येक बैठक कȧ अÚय¢ता कुलपǓत ɮवारा और उनकȧ अनुपिèथǓत मɅ उपिèथत सदèयɉ

ɮवारा चुने गए सदèय ɮवारा कȧ जाएगी ;

(vii) यǑद काय[काǐरणी पǐरषɮ ɮवारा त×काल कार[वाई आवæयक हो जाती है, तो कुलपǓत काय[काǐरणी पǐरषɮ के सदèयɉ

को कागजात के संचलन ɮवारा काय[ करने कȧ अनुमǓत दे सकɅ गे। इस Ĥकार ͧलए गए Ǔनण[य तब तक माÛय नहȣं

हɉगे जब तक ͩक काय[काǐरणी पǐरषɮ के सदèयɉ के बहुमत ɮवारा सहमǓत नहȣं दȣ जाती हो। ऐसे Ǔनण[य

काय[काǐरणी पǐरषɮ के सभी सदèयɉ को त×काल सूͬचत ͩकये जायɅगे। यǑद काय[काǐरणी पǐरषɮ Ǔनण[य लेने मɅ

ͪवफल रहती है तो मामला कुलाͬधपǓत को भेजा जाएगा िजनका Ǔनण[य अंǓतम होगा।

25. अकादͧमक पǐरषद -

(i)

अकादͧमक पǐरषɮ ͪवæवͪवɮयालय कȧ मुÉय शै¢ͨणक Ǔनकाय होगी और इस अͬधǓनयम, पǐरǓनयम और

ͪवǓनयमɉ के Ĥावधानɉ के अधीन, ͪवæवͪवɮयालय कȧ शै¢ͨणक नीǓतयɉ का समÛवय और सामाÛय पय[वे¢ण

करेगी।

(ii) अकादͧमक पǐरषɮ मɅ Ǔनàनͧलͨखत åयिÈत हɉगे, यथा:

(a) कुलपǓत-अÚय¢;

(b) सभी डीन;

(d) ĤǓतिçठत ͧश¢ाͪवदɉ से या साǑहि×यक åयिÈतयɉ से या पेशेवर ͪवɮवानɉ से या ĤǓतिçठत साव[जǓनक åयिÈतयɉ

मɅ से तीन åयिÈत जो सेवा मɅ नहȣं है, कुलाͬधपǓत ɮवारा मनोǓनत हɉगे ;

(e) शीष[ åयावसाǓयक Ǔनयामक Ǔनकायɉ मɅ से Ĥ×येक से एक मनोनीत ;

(f) Ǔनदेशक Ĥमुख, ͬचͩक×सा ͧश¢ा, झारखÖड सरकार;

(g) झारखÖड के सरकारȣ ͬचͩक×सा/अÛय èवाèØय ͪव£ान महाͪवɮयालयɉ के दस Ĥाचाय[ तीन वष[ कȧ अवͬध के

ͧलए चĐानुĐम से झारखÖड सरकार ɮवारा मनोनीत ͩकए जायɅगे;

(h) कुलपǓत ɮवारा नाͧमत सरकारȣ ͬचͩक×सा महाͪवɮयालय/अÛय èवाèØय ͪव£ान महाͪवɮयालय के शै¢ͨणक

चार सदèय- एक-एक ĐमशःĤाÚयापक, सह-ĤाÚयापक, सहायक ĤाÚयापक एवं सीǓनयर रेजीडेÛट/ɪयूटर के

ĤǓतǓनͬध हɉगे; और

(i) Ǔनदेशक, राजेÛġ आयुͪव[£ान संèथान (ǐरàस), रांची

(j) Ǔनदेशक, राँची Ûयूरो-मनोͬचͩक×सक और सहयोगी ͪव£ान संèथान (ǐरनपास), रांची हɉ;

(iii) अकादͧमक पǐरषɮ कȧ शिÈतयाँ, काय[ और बैठक -अͬधǓनयम, पǐरǓनयम और ͪवǓनयमɉ के Ĥावधानɉ और

काय[काǐरणी पǐरषɮ के समĒ पय[वे¢ण के अधीन, अकादͧमक पǐरषɮ ͪवæवͪवɮयालय मɅ शै¢ͨणक काय[कलापɉ का

Ĥबंधन करेगी और ͪवशेष Ǿप से Ǔनàनͧलͨखत शिÈतयɉ और कायɟ का Ĥयोग और पालन करेगी; यथा:-

(a) सामाÛय पǐरषɮ या काय[काǐरणी पǐरषɮ ɮवारा ǓनǑद[çट या सɋपे गए ͩकसी भी मामले पर ĤǓतवेदन देना ;

(b) ͪवæवͪवɮयालय मɅ पदɉ के सृजन, उÛमूलन या वगȸकरण और देय पǐरलिÞधयɉ और उससे जुड़े कत[åयɉ के संबंध

मɅ काय[काǐरणी पǐरषɮ को अनुशंसा करना ;

संकायɉ को उनसे संबंͬधत ͪवषयɉ को सɋपना और काय[काǐरणी पǐरषɮ को ͩकसी भी संकाय के उÛमूलन या उप-

ͪवभाजन या एक संकाय को दूसरे के साथ संयोजन कȧ समीचीनता के बारे मɅ ĤǓतवेदन देना ;

(d) ͪवæवͪवɮयालय के अधीन अनुसंधान को बढ़ावा देना और समय-समय पर इस तरह के अनुसंधान पर ĤǓतवेदन

कȧ अपे¢ा करना;

(e) संकायɉ ɮवारा Ĥèतुत Ĥèतावɉ पर ͪवचार करना;

(f) अÛय ͪवæवͪवɮयालयɉ और संèथाओं कȧ ͫडĒी कȧ माÛयता कȧ अनुशंसा करना और ͪवæवͪवɮयालय के Ĥमाण-

पğ, ͫडÜलोमा और ͫडĒी के संबंध मɅ उनकȧ समक¢ता का Ǔनधा[रण करना;

(g) सामाÛय पǐरषɮ ɮवारा èवीकार कȧ गई ͩकसी भी शत[ के अधीन, फेलोͧशप, छाğवृǓत और अÛय पुरèकारɉ के

ͧलए ĤǓतèपधा[ का समय, तरȣका और शतɏ तय करना और उसके पुरèकार के ͧलए अनुशंसा करना;

(h) परȣ¢कɉ कȧ ǓनयुिÈत और यǑद आवæयक हो, तो उÛहɅ हटाने और उनकȧ फȧस, पǐरलिÞधयां और याğा और

अÛय खचɟ के संबंध मɅ काय[काǐरणी पǐरषɮ को अनुशंसा करना;

(i) परȣ¢ाओं के संचालन कȧ åयवèथा और उÛहɅ आयोिजत करने कȧ तारȣख कȧ अनुशंसा करना;

(j) ͪवͧभÛन परȣ¢ाओं के पǐरणामɉ कȧ घोषणा या समी¢ा करना या ऐसा करने के ͧलए सͧमǓतयɉ या पदाͬधकाǐरयɉ

को ǓनयुÈत करना और ͫडĒी, सàमान, अनु£िÜत, उपाͬध और सàमान Ĥतीक Ĥदान करने या देने के संबंध मɅ

अनुशंसा करना;

(k) वृͪƣका (èटाइपेÛडस्), छाğवृͪƣ, पदक और पुरèकार कȧ अनुशंसा करना और ͪवǓनयमɉ के अनुसार और ऐसी

अÛय शतɟ पर अÛय पुरèकार देना जो पुरèकारɉ से संलÊन ͩकए जाये;

(l) ͪवǑहत या अनुशंͧसत पाɫय पुèतकɉ कȧ सूͬचयɉ को अनुमोǑदत या पुनरȣͯ¢त करना एवं Ĥकाͧशत करना और

अÚययन के ͧलए पाɫयĐमɉ एवं पाɫय ͪववरणɉ को अनुमोǑदत करना;

(m) ऐसे Ĥपğɉ और पंिजयɉ (रिजèटरɉ) को अनुमोǑदत करना जो समय- समय पर ͪवǓनयमɉ ɮवारा अपेͯ¢त हɉ;

(n) शै¢ͨणक मामलɉ के संबंध मɅ, ऐसे सभी कत[åयɉ का पालन करना और ऐसे सभी काय[ करना जो इस अͬधǓनयम,

पǐरǓनयम और इसके तहत बनाए गए ͪवǓनयमɉ के Ĥावधानɉ के उͬचत काया[Ûवयन के ͧलए आवæयक हो।

(iv)

(a) अकादͧमक पǐरषɮ िजतनी बार आवæयक हो, बैठक करेगी, लेͩकन एक शै¢ͨणक वष[ के दौरान कम से कम

दो बार बैठक होगी;

(b) अकादͧमक पǐरषɮ के वत[मान सदèयɉ मɅ से आधे सदèयɉ से अकादͧमक पǐरषɮ कȧ बैठक कȧ गणपूǓत[ होगी;

(d) अकादͧमक पǐरषɮ के अÚय¢ सǑहत अकादͧमक पǐरषɮ के Ĥ×येक सदèय के पास एक मत होगा और यǑद

अकादͧमक पǐरषɮ, ɮवारा Ǔनधा[ǐरत ͩकए जाने वाले ͩकसी भी Ĥæन पर मतɉ कȧ समानता होती है तो यथािèथǓत

अकादͧमक पǐरषɮ के अÚय¢ या बैठक कȧ अÚय¢ता करने वाले सदèय के पास अपने मत के अलावा एक

Ǔनणा[यक मत होगा;

(e) अकादͧमक पǐरषɮ कȧ Ĥ×येक बैठक कȧ अÚय¢ता कुलपǓत ɮवारा कȧ जाएगी और उनकȧ अनुपिèथǓत मɅ इस

अवसर पर अÚय¢ता करने के ͧलए बैठक मɅ चुने गए सदèय ɮवारा अÚय¢ता कȧ जाएगी;

(f) यǑद अकादͧमक पǐरषɮ ɮवारा त×काल कार[वाई आवæयक हो जाती है, तो अकादͧमक पǐरषɮ के अÚय¢

अकादͧमक पǐरषɮ के सदèयɉ को कागजात के संचलन ɮवारा काय[ करने कȧ अनुमǓत दे सकɅ गे। ͧलया गया

Ǔनण[य तब तक माÛय नहȣं होगा जब तक ͩक अकादͧमक पǐरषɮ के सदèयɉ के बहुमत ɮवारा सहमǓत नहȣं दȣ

जाती है। ऐसे Ǔनण[य कȧ सूचना अकादͧमक पǐरषɮ के सदèयɉ को त×काल दȣ जाएगी। यǑद अकादͧमक पǐरषɮ

Ǔनण[य लेने मɅ ͪवफल रहती है, तो मामला कुलाͬधपǓत को ǓनǑद[çट ͩकया जाएगा िजनका Ǔनण[य अंǓतम होगा।

26. योजना बोड[ -

(i) योजना बोड[ ͪवæवͪवɮयालय कȧ उÛनǓत और ͪवकास के ͧलए तथा इसके उɮदेæयɉ को ĤाÜत करने हेतु योजनाओं कȧ

तैयारȣ के ͧलए Ĥधान Ǔनकाय होगा।

अकादͧमक पǐरषɮ और काय[काǐरणी पǐरषɮ को इसकȧ अनुशंसा करेगा। यह जब कभी आवæयक हो ͪवæवͪवɮयालय

कȧ ͪवͧभÛन गǓतͪवͬधयɉ के संबंध मɅ दȣघ[कालȣन योजनाओं कȧ भी अनुशंसा करेगा।

27. संबɮधता बोड[ -

(i) संबɮधता बोड[ ͪवæवͪवɮयालय, महाͪवɮयालयɉ एवं संèथाओं को ͪवæवͪवɮयालय के ͪवशेषाͬधकार मɅ सिàमͧलत

करने के ͧलए उƣरदायी होगा।

(ii) संबɮधता बोड[ का गठन, इसके सदèयɉ का काय[काल तथा उसके कृ×य पǐरǓनयम ɮवारा ͪवǑहत ͩकये जायɅगे।

28. ͪवƣ सͧमǓत -ͪवƣ सͧमǓत का गठन, शिÈतयाँ एवं कृ×य पǐरǓनयम ɮवारा ͪवǑहत ͩकये जायɅगे।

29. अÛय Ĥाͬधकार -अÛय Ĥाͬधकारɉ, जो पǐरǓनयम ɮवारा ͪवæवͪवɮयालय के Ĥाͬधकार घोͪषत ͩकये जाये, के गठन,

शिÈतयाँ एवं कृ×य पǐरǓनयम ɮवारा ͪवǑहत ͩकये जायɅगɅ।

30. पǐरǓनयम बनाने कȧ शिÈत -इस अͬधǓनयम के Ĥावधानɉ के अधीन रहते हुए Ǔनàनͧलͨखत सभी ͪवषयɉ या ͩकसी के

ͧलए पǐरǓनयम मɅ Ĥावधान ͩकया जा सकेगा:-

(i) ͪवæवͪवɮयालय के Ĥाͬधकार तथा अÛय Ǔनकायɉ, जो समय- समय पर गǑठत ͩकया जाना आवæयक पाया जाय, के

गठन, शिÈतयाँ एवं कृ×य।

(ii)ͪवæवͪवɮयालय के उÈत Ĥाͬधकारɉ एवं Ǔनकायɉ के सदèयɉ कȧ ǓनयुिÈत तथा उÛहɅ पद पर बनाये रखना, सदèयɉ कȧ

ǐरिÈतयɉ को भरना तथा उन Ĥाͬधकारɉ एवं अÛय Ǔनकायɉ से संबंͬधत ͪवषय िजनके ͧलए Ĥावधान करना आवæयक एवं

वांछनीय हो ;

(iii) ͪवæवͪवɮयालय के पदाͬधकाǐरयɉ कȧ ǓनयुिÈत, शिÈतयाँ और कत[åय तथा उनकȧ सेवा के Ǔनयम एवं शतɏ ;

(iv) ͪवæवͪवɮयालयɉ के ͧश¢कɉ, अÛय शै¢ͨणक èटाफ अथवा अÛय कम[चाǐरयɉ कȧ ǓनयुिÈत कȧ रȣǓत तथा उनकȧ

पǐरलिÞधयां ;

(v) एक संयुÈत योजना हेतु ͪवǓनǑद[çट अवͬध के ͧलए ͩकसी अÛय ͪवæवͪवɮयालय मɅ काय[रत ͧश¢कɉ एवं अÛय

शै¢ͨणक èटाफ कȧ ǓनयुिÈत कȧ रȣǓत, उनकȧ सेवा के Ǔनयम एवं शतɏ तथा उनकȧ पǐरलिÞधयाँ ;

(vi)

पɅशन या भͪवçय Ǔनͬध का गठन तथा ͪवæवͪवɮयालय और महाͪवɮयालयɉ एवं संèथाओं के कम[चाǐरयɉ के लाभ

के ͧलए बीमा योजना कȧ èथापना ;

(vii)

ͪवæवͪवɮयालय, महाͪवɮयालयɉ तथा संèथाओं के कम[चाǐरयɉ कȧ वरȣयता को Ǔनधा[ǐरत करने वाले ͧसɮधांत ;

(viii)

कम[चाǐरयɉ अथवा छाğɉ तथा ͪवæवͪवɮयालय के बीच ͪववादɉ के मामलɉ मɅ माÚयèथम् कȧ ĤͩĐया;

(ix)

ͪवæवͪवɮयालय के ͩकसी पदाͬधकारȣ या Ĥाͬधकार के ͪवǾɮध कम[चारȣ अथवा छाğ ɮवारा काय[काǐरणी पǐरषɮ

के सम¢ अपील कȧ ĤͩĐया ;

(x)

शतɏ िजनके अधीन महाͪवɮयालय और संèथाओं को ͪवæवͪवɮयालय का ͪवशेषाͬधकार ͧमल सकेगा तथा शतɏ

िजनके अधीन ͪवशेषाͬधकार वापस ͧलया जा सकेगा ;

(xi)

ͪवशेषाͬधकार ĤाÜत महाͪवɮयालयɉ और संèथाओं के शासी Ǔनकाय का गठन तथा उन महाͪवɮयालयɉ और

संèथाओं का पय[वे¢ण तथा Ǔनरȣ¢ण ;

(xii)

èवायƣता का ͪवèतार, िजसे कोई महाͪवɮयालय या संèथा एक èवायƣ महाͪवɮयालय या संèथा के Ǿप मɅ

Ĥयोग कर सकɅ गɅ ;

(xiii)

मानɮ ͫडͬĒयाँ देना ;

(xiv)

ͫडĒी, ͫडÜलोमा, सǑट[ͩफकेट एवं अÛय शै¢ͨणक उपाͬधयɉ कȧ वापसी ;

(xv)

फेलोशीप, छाğवृͪƣ, अÚययनवृͪƣ, पदक तथा पुरèकार एवं अÛय Ĥो×साहन कȧ संिèथǓत ;

(xvi)

ͪवæवͪवɮयालय, महाͪवɮयालयɉ एवं संèथाओं के छाğɉ एवं कम[चाǐरयɉ के बीच अनुशासन बनाए रखना ;

(xvii)

आचाय[ पदɉ (चेयस[), अÚययन केÛġɉ, ͪवभागɉ, महाͪवɮयालयɉ और संèथाओं कȧ èथापना ;

(xviii) ͪवæवͪवɮयालय के Ĥाͬधकारɉ या पदाͬधकाǐरयɉ मɅ ǓनǑहत शिÈतयɉ का Ĥ×यायोजन, और ;

(xix)

सभी अÛय ͪवषय, जो इस अͬधǓनयम ɮवारा या उसके अधीन पǐरǓनयम ɮवारा उपबंध ͩकये गये हɉ अथवा ͩकये

जायɅ।

31. पǐरǓनयम बनाने कȧ ĤͩĐया -

(i)

Ĥथम पǐरǓनयम शासी Ǔनकाय कȧ अनुशंसा पर सरकार ɮवारा बनाया जायेगा।

(ii)

शासी Ǔनकाय, समय-समय पर, नया अथवा अǓतǐरÈत पǐरǓनयम बना सकेगा अथवा इस धारा कȧ उपधारा (1)

मɅ Ǔनदȶͧशत पǐरǓनयम को संशोͬधत अथवा Ǔनरͧसत कर सकेगा:

परÛतु शासी Ǔनकाय ͪवæवͪवɮयालय के ͩकसी Ĥाͬधकार कȧ िèथǓत, शिÈत अथवा गठन को Ĥभाͪवत

करने वाला कोई पǐरǓनयम तबतक नहȣं बनायेगा, न उसे संशोͬधत अथवा Ǔनरͧसत करेगा जब तक उस Ĥाͬधकार

को, Ĥèताͪवत पǐरवत[न पर, ͧलͨखत Ǿप से, अपनी राय अͧभåयÈत करने का अवसर न दे Ǒदया गया हो और उस

अͧभåयÈत राय पर शासी Ǔनकाय ɮवारा ͪवचारण न कर ͧलया गया हो।

(iii)

Ĥ×येक नया पǐरǓनयम या पǐरǓनयम मɅ पǐरवध[न अथवा उसके संशोधन या Ǔनरसन मɅ कुलाͬधपǓत कȧ सहमǓत

अपेͯ¢त होगी जो उस पर सहमǓत दे सकɅ गे या सहमǓत रोक सकेगɅ या उसे ͪवचारण के ͧलए शासी Ǔनकाय को

भेज सकेगɅ।

परÛतु यǑद कुलाͬधपǓत Ǔनदȶशन ĤाÜत होने के नÞबे Ǒदनɉ के भीतर अपना ͪवǓनिæचय सूͬचत नहȣं करते

हɇ तो समझा जायेगा ͩक कुलाͬधपǓत ने पǐरǓनयम मɅ अपनी सहमǓत दे दȣ है।

परÛतु यǑद पǐरǓनयम के अÛतग[त कोई ͪवƣीय पहलू उ×पÛन हो सकता हो तो यह तब तक लागू नहȣं

होगा जब तक ͩक राÏय सरकार का पूवा[नुमोदन ĤाÜत नहȣं कर ͧलया जाय।

32. ͪवǓनयम बनाने कȧ शिÈत- ͪवæवͪवɮयालय के Ĥाͬधकार, इस अͬधǓनयम और पǐरǓनयम के अनुǾप पǐरǓनयम मɅ

ͪवǑहत रȣǓत से अपने èवयं के काय[ के संचालन के ͧलए और सͧमǓतयɉ के ͧलए, यǑद कोई हो, जो उनके ɮवारा ǓनयुÈत

हɉ और इस अͬधǓनयम, पǐरǓनयम ɮवारा उपबंͬधत न हɉ तथा ऐसे ͪवषयɉ के ͧलए जो पǐरǓनयम ɮवारा ͪवǑहत ͩकये

जायɅ ͪवǓनयम बना सकɅ गे। परÛतु, यǑद कोई ͪवƣीय पहलू ͪवǓनयम के तहत उ×पÛन हो सकता हो, तो यह तब तक

लागू नहȣं होगा जब तक ͩक राÏय सरकार का पूव[ अनुमोदन ĤाÜत नहȣं कर ͧलया जाय।

वैसे संèथान जो वत[मान मɅ राÏय सरकार ɮवारा संचाͧलत है तथा भͪवçय मɅ Ĥèताͪवत झारखंड

èवाèØय ͪवæवͪवɮयालय मɅ समाǑहत हो जायɅगे, उनके Ĥशासकȧय तथा ͪवƣीय Ĥबंधन का समो×पǐरवत[न ͩकस Ĥकार

से होगा, इस पर Ĥशासी ͪवभाग Ĥèताव तैयार कर काͧम[क, ĤशासǓनक सुधार तथा राजभाषा ͪवभाग एवं ͪवƣ ͪवभाग

से सहमǓत ĤाÜत करेगा।

(I) ͪवǓनयम Ǔनàनͧलͨखत सभी ͪवषयɉ या उनमɅ से ͩकसी ͪवषय के ͧलए उपबÛध कर सकेगा, यथा:-

(a) ͪवæवͪवɮयालय तथा उससे ͪवशेषाͬधकार ĤाÜत एवं संचाͧलत संèथानɉ मɅ छाğɉ के Ĥवेश तथा नामांकन ;

(b) सभी ͫडĒी, ͫडÜलोमा एवं सǑट[ͩफकेट के ͧलए अͬधकͬथत ͩकये जाने वाले पाɫयĐम ;

(d) ͫडĒी, ͫडÜलोमा, सǑटͩफकेट एवं अÛय शै¢ͨणक उपाͬधयाँ, उसके ͧलए अह[ताएँ और उसे देने और ĤाÜत करने से

संबंͬधत साधन ;

(e) ͪवæवͪवɮयालयɉ मɅ अÚययन के पाɫयĐम एवं परȣ¢ाओं मɅ बैठने, ͫडͬĒयɉ, ͫडÜलोमाओं के ͧलए Ĥभाǐरत होने

वाला शुãक ;

(f) फेलोशीप, छाğवृͪƣ, अÚययनवृͪƣ, पदक एवं पाǐरतोͪषक संिèथत ͩकया जाना तथा उÛहɅ देने कȧ शतɏ;

(g) परȣ¢क Ǔनकायɉ, परȣ¢कɉ तथा माडरेटरɉ के पद कȧ अवͬध एवं ǓनयुिÈत कȧ रȣǓत तथा कत[åय सǑहत परȣ¢ाओं

का संचालन ;

(h) छाğɉ के आवास कȧ शतɏ तथा उनका सामाÛय अनुशासन ;

(i) ͪवæवͪवɮयालय ɮवारा संचाͧलत महाͪवɮयालयɉ एवं संèथाओं का Ĥबंधन ;

(j) केÛġɉ, संèथानɉ, अÚययन-बोड[, ͪवͧशçट Ĥयोगशालाओं एवं सͧमǓतयɉ कȧ èथापना;

(k) ͩकसी अÛय Ǔनकायɉ का, जो ͪवæवͪवɮयालयɉ के शै¢ͨणक जीवन के सुधार के ͧलए आवæयक ͪवचार ͩकया जाय,

सृजन, गठन एवं कृ×य ;

(l) ͪवɮधत Ǔनकायɉ अथवा संघɉ सǑहत अÛय ͪवæवͪवɮयालयɉ, संèथाओं एवं अÛय अͧभकरणɉ के साथ समÛवय एवं

सहयोग कȧ रȣǓत ;

(m) कम[चाǐरयɉ कȧ ͧशकायतɉ के Ǔनपटारे के ͧलए तंğ èथापन ;

(n) कदाचार कȧ कोǑट या िजसके ͧलए इस अͬधǓनयम, पǐरǓनयम या ͪवǓनयम के अधीन कार[वाई कȧ जा सके ;

(o) सभी अÛय ͪवषय, जो इस अͬधǓनयम या पǐरǓनयम ɮवारा या, के अधीन ͪवǓनयम ɮवारा उपबÛध ͩकये गये हɉ

अथवा ͩकये जायɅ।

(ii) Ĥथम ͪवǓनयम कुलपǓत ɮवारा, सरकार के पूव[ अनुमोदन से, बनाया जायेगा और उस Ĥकार बनाया गया ͪवǓनयम

ͩकसी भी समय, उस रȣǓत से, जो पǐरǓनयम ɮवारा ͪवǑहत ͩकया जाय, सरकार ɮवारा संशोͬधत, Ǔनरͧसत या पǐरवͬध[त

ͩकया जा सकेगा।

33. वाͪष[क ĤǓतवेदन-

(i) ͪवæवͪवɮयालय का वाͪष[क ĤǓतवेदन काय[काǐरणी पǐरषɮ के Ǔनदेशɉ के अधीन तैयार ͩकया जायेगा िजसमɅ अÛय

ͪवषयɉ के साथ ͪवæवͪवɮयालय ɮवारा इसके उɮदेæयɉ कȧ पूǓत[ के ͧलए उठाये गये कदम सिàमͧलत हɉगे तथा

पǐरǓनयम ɮवारा यथाͪवǑहत उस Ǔतͬथ को या उसके बाद शासी Ǔनकाय को समͪप[त ͩकया जायेगा और शासी Ǔनकाय

Ĥ×येक वष[ अगèत/ͧसतàबर माह मɅ अǓनवाय[ Ǿप से होने वालȣ अपनी वाͪष[क बैठक मɅ ͪवचार करेगा।

(ii) शासी Ǔनकाय अपनी ǑटÜपणी, यǑद कोई हो, के साथ वाͪष[क ĤǓतवेदन कुलाͬधपǓत को समͪप[त करेगा।

(iii) इस अͬधǓनयम कȧ उपधारा (1) के अधीन यथा तैयार ͩकये गए वाͪष[क ĤǓतवेदन कȧ एक ĤǓत सरकार को भी

समͪप[त कȧ जायेगी जो, यथाशÈय शीē, ͪवधानसभा के सम¢ रखी जायेगी।

34. Ǔनͬध -

(i) ͪवæवͪवɮयालय कȧ एक सामाÛय Ǔनͬध होगी िजसमɅ Ǔनàनͧलͨखत जमा ͩकये जायɅगे:-

(a) शुãक, अनुदान, दान एवं ͬगÝट, यǑद कोई हो से, ĤाÜत इसके आय ;

(b) राçĚȣय/अंतरराçĚȣय अͧभकरण, केÛġȣय सरकार, ͪवæवͪवɮयालय अनुदान आयोग, अͨखल भारतीय

तकनीकȧ ͧश¢ा पǐरषɮ अथवा ऐसे हȣ Ĥाͬधकार, ͩकसी èथानीय Ĥाͬधकार अथवा सरकार के èवाͧम×व या

Ǔनयंğण वाले ͩकसी Ǔनगम ɮवारा Ǒदया गया कोई अंशदान या अनुदान ;

(ii)

ͪवæवͪवɮयालय को ऐसी अÛय Ǔनͬध होगी जो पǐरǓनयम ɮवारा ͪवǑहत कȧ जाये।

(iii)

ͪवæवͪवɮयालय कȧ Ǔनͬध और सभी धनɉ का Ĥबंधन उस रȣǓत से ͩकया जायेगा जो पǐरǓनयम ɮवारा ͪवǑहत कȧ

जाय।

(iv)

सरकार, Ĥ×येक वष[, अÚययन एवं शोध के उÛनयन एवं संवɮ[धन के ͧलए अनुदान सहायता उपलÞध करा

सकेगी।

35. लेखा एवं लेखा परȣ¢ा-

(i)

ͪवæवͪवɮयालय का वाͪष[क लेखा एवं अͬधशेष पğ काय[काǐरणी पǐरषɮ के Ǔनदेशन के अधीन तैयार ͩकया

जायेगा और Ĥ×येक वष[ कम-से-कम एक बार एवं अͬधकतम पंġह माह के अÛतराल पर, भारत के Ǔनयंğक एवं

महालेखापरȣ¢क अथवा अÛय ऐसे åयिÈत ɮवारा, िजसे इस Ǔनͧमƣ अͬधकृत ͩकया जाय, लेखा परȣ¢ा कराया

जायेगा।

(ii)

वाͪष[क लेखा कȧ एक ĤǓत अंके¢ण ĤǓतवेदन के साथ, काय[काǐरणी पǐरषɮ कȧ अवधारणाओं के साथ, यǑद कोई

हो, सरकार के माÚयम से शासी Ǔनकाय और कुलाͬधपǓत को समͪप[त कȧ जायेगी।

(iii)

वाͪष[क लेखा पर कुलाͬधपǓत ɮवारा कȧ गयी कोई अवधारणा शासी Ǔनकाय कȧ जानकारȣ मɅ लायी जायेगी तथा

सभा कȧ अवधारणा, यǑद कोई हो, काय[काǐरणी पǐरषɮ ɮवारा ͪवचारण ͩकये जाने के बाद, सरकार के माÚयम से

कुलाͬधपǓत को समͪप[त कȧ जायेगी।

(iv)

वाͪष[क लेखा कȧ एक ĤǓत अंके¢ण ĤǓतवेदन के साथ, जो कुलाͬधपǓत को समͪप[त कȧ गयी हो, सरकार को भी

समͪप[त कȧ जायेगी।

36. ǐरटन[ आǑद Ĥेͪषत ͩकया जाना -ͪवæवͪवɮयालय ऐसे ǐरटन[ या अपनी सàपǓत या ͩĐयाकलापɉ के संबंध मɅ अÛय

जानकारȣ सरकार को Ĥेͪषत करेगा िजनकȧ सरकार समय- समय पर अपे¢ा करे।।

37. कम[चाǐरयɉ कȧ सेवाशतɏ -ͪवæवͪवɮयालय के पदाͬधकाǐरयɉ एवं कम[चाǐरयɉ कȧ सेवा कȧ शतɏ पǐरǓनयमɉ तथा

ͪवǓनयमɉ ɮवारा ͪवǓनǑद[çट होगी।

38. ͪवæवͪवɮयालय समी¢ा आयोग का गठन-

(i)

कुलाͬधपǓत, अपने èवयं के Ĥèताव पर या सरकार के अनुरोध पर, हर पांच साल मɅ कम से कम एक बार,

ͪवæवͪवɮयालय के कामकाज कȧ समी¢ा करने और अनुशंसा करने के ͧलए एक आयोग का गठन करɅगे।

(ii)

आयोग का गठन कम से कम तीन ĤÉयात ͧश¢ाͪवदɉ से होगा, िजनमɅ से एक सरकार के परामश[ से कुलाͬधपǓत

ɮवारा ǓनयुÈत ऐसे आयोग का अÚय¢ होगा।

(iii)

सदèयɉ कȧ ǓनयुिÈत के Ǔनयम और शतɏ ऐसी हɉगी जो कुलाͬधपǓत Ǔनधा[ǐरत करɅ।

(iv)

आयोग ऐसी जांच करने के बाद जो वह ठȤक समझे कुलाͬधपǓत को अपनी अनुशंसा देगा तथा उसकȧ ĤǓत

सरकार को देगा।

(v)

कुलाͬधपǓत अनुशंसाओं पर सरकार के परामश[ से ऐसी कार[वाई कर सकɅ गे जो वह ठȤक समझɅ।

39. अपील का अͬधकार-ͪवæवͪवɮयालय, महाͪवɮयालय या इसके ͪवशेषाͬधकार ĤाÜत संèथा के Ĥ×येक कम[चारȣ या

छाğ को, इस अͬधǓनयम मɅ अंतͪव[çट ͩकसी बात के होते हुए भी ͪवæवͪवɮयालय के ͩकसी पदाͬधकारȣ या Ĥाͬधकार के

ͪवǓनæचय के ͪवǾɮध कुलाͬधपǓत के सम¢, उस समय के भीतर, जो पǐरǓनयम ɮवारा ͪवǑहत ͩकया जाय, अपील करने

का अͬधकार होगा और उस पर कुलाͬधपǓत िजस ͪवǓनæचय के ͪवǾɮध अपील कȧ गयी हो, उसे संपुçट, उपांतǐरत कर

सकɅ गे अथवा उलट सकɅ गɅ।

40. पɅशन-झारखंड राÏय के अÛतग[त èवाèØय ͪव£ान से संबंͬधत सभी सरकारȣ संèथानɉ मɅ Ǒदनांक 01.12.2004 को

अथवा इसके पæचात् ǓनयुÈत कͧम[यɉ के ͧलए नयी पɅशन योजना तथा राÏय ɮवारा इनके मामले मɅ पɅशन के Ǔनͧमƣ

समय- समय पर ͧलए गये Ǔनण[य Ĥभावी हɉगे। Ǒदनांक 01.12.2004 के पूव[ ǓनयुÈत कͧम[यɉ के मामले मɅ पɅशन के पूव[

Ĥावधान यथावत् Ĥभावी रहɅगे। ͪवæवͪवɮयालय के गठन के उपरांत पɅशन के ͪवषय मɅ त×समय राÏय सरकार का

Ĥावधान, जो ͪवæवͪवɮयालय पर लागू हो, Ĥभावी हɉगा।

ͪवæवͪवɮयालय अपने कम[चाǐरयɉ के लाभ के ͧलए ऐसी भͪवçय Ǔनͬध या पɅशन Ǔनͬध का गठन अथवा ऐसी

बीमा èकȧम का Ĥावधान जो वह उपयुÈत समझɅ पǐरǓनयम ɮवारा यथाͪवǑहत रȣǓत से एवं यथाͪवǑहत शतɟ के अधीन

रहते हुए करेगा।

41. ͪवæवͪवɮयालय Ĥाͬधकारɉ एवं Ǔनकायɉ के गठन के संबंध मɅ ͪववाद-यǑद ऐसा कोई Ĥæन उ×पÛन हो ͩक कोई åयिÈत

ͪवæवͪवɮयालय के ͩकसी Ĥाͬधकार या Ǔनकाय का सदèय सàयक् Ǿप से Ǔनवा[ͬचत या ǓनयुÈत है या नहȣं अथवा सदèय

होने का हकदार है या नहȣं तो वह ͪवषय कुलाͬधपǓत का Ǔनदȶͧशत कर Ǒदया जायेगा िजनका ͪवǓनæचय उस पर अंǓतम

होगा।

42. आकिèमक ǐरिÈतयɉ को भरा जाना-ͪवæवͪवɮयालयɉ के ͩकसी Ĥाͬधकार या अÛय Ǔनकाय के पदेन सदèयɉ के

सदèयɉ को ǓनयुÈत, Ǔनवा[ͬचत या सहयुÈत करता हो िजसका èथान ǐरÈत हो गया हो और आकिèमक ǐरिÈत पर

ǓनयुÈत, Ǔनवा[ͬचत या सहयुÈत कोई åयिÈत इस अवͬध के अवͧशçट के ͧलए, िजस åयिÈत के èथान पर वह सदèय

होगा, उस Ĥाͬधकार या Ǔनकाय का सदèय होगा।

43. ͪवæवͪवɮयालय Ĥाͬधकारɉ या Ǔनकायɉ कȧ काय[वाहȣ का ǐरिÈतयɉ के कारण अͪवͬधमाÛय नहȣं होना -

ͪवæवͪवɮयालय के ͩकसी Ĥाͬधकार या अÛय Ǔनकाय कȧ कोई कार[वाई या काय[वाहȣ उसके सदèयɉ के बीच माğ कोई

ǐरिÈत या ǐरिÈतयाँ होने के कारण अͪवͬधमाÛय नहȣं होगी।

44. सदभावपूव[क कȧ गयी कार[वाई का संर¢ण -ͪवæवͪवɮयालय के ͩकसी पदाͬधकारȣ या अÛय कम[चारȣ अथवा ͩकसी

Ĥाͬधकार के ͪवǾɮध इस अͬधǓनयम, पǐरǓनयम या ͪवǓनयम के Ĥावधानɉ के अनुसरण मɅ सदभावपूव[क ͩकये गये या

ͩकये जाने को अभीçट कुछ भी के ͧलए कोई वाद या ͪवͬधक् काय[वाहȣ संिèथत नहȣं कȧ जायेगी।

45. ͪवæवͪवɮयालय अͧभलेख के सबूत के ढंग -भारतीय साêय अͬधǓनयम, 1872 या त×समय Ĥवृत ͩकसी ͪवͬध मɅ

अंतͪव[çट ͩकसी बात के होते हुए भी, ͪवæवͪवɮयालय के Ĥाͬधकार या अÛय Ǔनकाय कȧ कोई रसीद, आवेदन, नोǑटस,

आदेश, काय[वाहȣ या संकãप अथवा ͪवæवͪवɮयालय के कÞजे मɅ ͩकसी अÛय दèतावेज अथवा ͪवæवͪवɮयालय ɮवारा

सàयक् Ǿप से अनुरͯ¢त ͩकसी रिजèटर मɅ कोई Ĥͪविçट कȧ ĤǓत रिजèĚार ɮवारा यǑद अͧभĤमाͨणत हो तो वह रसीद,

आवेदन, नोǑटस, आदेश, काय[वाहȣ या संकãप या दèतावेज या रिजèटर मɅ ͪवɮयमान Ĥͪविçट कȧ कोई ĤǓत Ĥथम Ǻçटया

साêय के Ǿप मɅ ĤाÜत कȧ जायेगी और उसके ͪवषयɉ और उसमɅ संåयवहार के साêय के Ǿप मɅ èवीकार ͩकया जायेगा,

जहाँ उसका मूल, यǑद Ĥèतुत ͩकया जाता, तो साêय के Ǿप मɅ Ēाéय होता।

46. कǑठनाईयɉ को दूर करने कȧ शिÈत -इस अͬधǓनयम के Ĥावधानɉ को Ĥभावी करने मɅ यǑद कोई कǑठनाई उ×पÛन हो

तो सरकार राजपğ मɅ Ĥकाͧशत आदेश ɮवारा ऐसा Ĥावधान कर सकेगी जो इस अͬधǓनयम के Ĥावधानɉ के असंगत न हो

तथा उस कǑठनाई को दूर करने हेतु आवæयक या समीचीन Ĥतीत हो:

परÛतु इस धारा के अधीन कोई भी आदेश इस अͬधǓनयम के आरàभ से तीन वषɟ कȧ समािÜत के बाद

नहȣं ͩकया जायेगा।

परÛतु और ͩक इस धारा के अधीन Ǒदया गया Ĥ×येक आदेश, Ǒदये जाने के बाद यथाशीē, ͪवधानमंडल के सम¢ रखा

जायेगा।

47. संĐमणकालȣन उपबंध - इस अͬधǓनयम या पǐरǓनयम के अधीन अंतͪव[çट ͩकसी बात के होते हुए भी -

(i)

Ĥथम कुलपǓत, Ĥथम रिजèĚार एवं Ĥथम ͪवƣ पदाͬधकारȣ सरकार ɮवारा ǓनयुÈत ͩकये जायɅगे और Ĥ×येक

उÈत पदाͬधकारȣ तीन वषɟ के काय[काल तक अपना पद धारण करɅगे।

(ii)

Ĥथम कोट[ Ǔनकाय एवं Ĥथम काय[काǐरणी पǐरषɮ अͬधकतम Êयारह सदèयीय होगा िजनका नाम सरकार ɮवारा

नाͧमत होगा और तीन वषȾ के काय[काल के ͧलए अपना पद धाǐरत करɅगे।

परÛतु उपयु[Èत पदɉ एवं Ĥाͬधकारɉ मɅ यǑद कोई ǐरिÈत होती है तो वह सरकार ɮवारा, यथािèथǓत,

ǓनयुिÈत अथवा नामǓनदȶशन ɮवारा भरȣ जायेगी और उस Ĥकार ǓनयुÈत या नाम-ǓनǑद[çट åयिÈत उस

पदाͬधकारȣ या सदèय के Ǿप मɅ तबतक पदधारण करेगा, जबतक वह पदाͬधकारȣ या सदèय िजसके èथान पर

वह ǓनयुÈत या नाम-ǓनǑद[çट हुआ है, पद धारण करता यǑद वह ǐरिÈत नहȣ होती।

(iii)

इस अͬधǓनयम या ͪवǓनयमɉ मɅ ͩकसी बात के होते हुए भी, ͩकसी अÛय ͪवæवͪवɮयालय से संबɮध ͩकसी

महाͪवɮयालय या संèथान का कोई छाğ, जो ͪवæवͪवɮयालय से संबɮधता कȧ तारȣख से ठȤक पहले अÚययन कर

रहा था या अÛय ͪवæवͪवɮयालयɉ कȧ ͩकसी भी परȣ¢ा के ͧलए पाğ था, को पाɫयĐम कȧ तैयारȣ मɅ इसे पूरा करने

कȧ अनुमǓत दȣ जाएगी और ͪवæवͪवɮयालय अÛय ͪवæवͪवɮयालय के पाɫयĐम के अनुसार ऐसे छाğɉ के Ǔनदȶश,

ͧश¢ण, Ĥͧश¢ण और परȣ¢ा के ͧलए ऐसी अवͬध और रȣǓत का उपबंध करेगी जो ͪवǑहत कȧ जाय।

48. पǐरǓनयम तथा ͪवǓनयमावलȣ का राजपğ मɅ Ĥकाशन तथा ͪवधानमंडल के सम¢ रखा जाना-

(i)

इस अͬधǓनयम के अधीन बनाया गया Ĥ×येक पǐरǓनयम तथा ͪवǓनयमावलȣ राजपğ मɅ Ĥकाͧशत ͩकये जायɅगे।

(ii)

इस अͬधǓनयम के अधीन बनाया गया Ĥ×येक पǐरǓनयम तथा ͪवǓनयमावलȣ बनाये जाने के बाद, यथाशाÈय

शीē, ͪवधान मंडल के सम¢, जब वह सğ मɅ हो, कुल चौदह Ǒदनɉ कȧ अवͬध के ͧलए, जो एक सğ मɅ अथवा दो या

अͬधक अनुवतȸ सğɉ को ͧमलाकर हो, रखे जायेगɅ।

(iii)

यǑद िजस सğ मɅ यह ͪवधान मंडल के सम¢ रखा जाता है, उसकȧ समािÜत के पूव[ या ठȤक पæचातवतȸ सğɉ मɅ

ͪवधान मंडल पǐरǓनयम या ͪवǓनयमावलȣ मɅ कोई संशोधन करने के ͧलये सहमत होता है या सहमत होता है ͩक

पǐरǓनयम पर Ǔनयमावलȣ नहȣं बनायी जानी चाǑहये तो यथा िèथǓत पǐरǓनयम या ͪवǓनयमावलȣ केवल ऐसे

संशोͬधत Ǿप मɅ Ĥभावी होगी या Ĥभावी नहȣं होगी, तɮयͪप ऐसा कोई भी ǾपाÛतरण या संशोधन उस पǐरǓनयम

या ͪवǓनयमावलȣ कȧ संबंͬधत िèथǓत के तहत् पूव[ मɅ ͩकये गये ͩकसी भी चीज पर ĤǓतकूल Ĥभाव नहȣं डालेगा।

THE JHARKHAND UNIVESTIY OF HEALTH SCIENCES ACT, 2023

An Act to establish and incorporate a University in the name of the Jharkhand

University of Health Sciences to conduct and facilitate affiliation of institutions set up by the

Government and established Autonomous institutes by the State Government and/or Trust or

Society in the conventional as well as new frontiers of professional education in Health

Sciences for the purposes of Affiliating, teaching and ensuring proper and systematic

instruction, training and research in Modern System of Medicine, AYUSH systems of

Medicine, Nursing Education, Pharmacy Education, Dental Education, Education on

Laboratory Technology, Physiotherapy & Occupational Therapy, Speech Therapy and

Education on other Paramedical Courses and inter disciplinary areas such as Health

Economics, Health administration etc.

And, WHEREAS, it is considered desirable to establish a specialized autonomous

Institution with the objects of promoting academic freedom and scholarship for the teachers

as well as for the students and to foster and develop an intellectual climate conducive to the

pursuit of scholarship and excellence, either independently or jointly with other centers of

higher learning;

Be it enacted by the State legislature of Jharkhand in the Seventy Four year of the

Republic of India, as follows:-

1. Short title, extent and commencement.—

(i)

This Act may be called the Jharkhand University of Health Sciences Act, 2023.

(ii)

It shall extend to whole of the State of Jharkhand.

(iii) It shall come into force on such date as the Government may, by notification in

the official gazette, specify.

2. Definitions- In this Act, unless the context otherwise requires

(i)

‘Academic Council' means the Academic Council of the University;

(ii)

'Affiliated Institution' means an institution affiliated by the University

(iii) ‘Academic Staff’ means such categories of staff as are designated by the

Statutes to be the academic staff of the University;

(iv) 'Affiliation' means affiliation granted by the University in accordance with the

Statutes and Regulations made for the purpose;

(v)

'Autonomous College or Institutes’ means such College or Institute which has

been declared autonomous by the State Government/ University under the

provisions prescribed in the relevant statutes;

(vi) ‘Chancellor' means the Chancellor of the University;

(vii) ‘Governor’ means the Governor of the State of Jharkhand;

(viii) ‘College’ means an Institution teaching courses leading to a Bachelor or Higher

degree in Modern System of Medicine, AYUSH systems of Medicine, Nursing

Education, Pharmacy Education, Dental Education, Education on Laboratory

Technology, Physiotherapy & Occupational Therapy, Speech Therapy and

Education on other Paramedical Courses and inter disciplinary areas such as

Health Economics, Health administration etc. maintained and controlled by the

University or by the State Government;

(ix) 'Vice-Chancellor' means, the Vice-Chancellor of the University;

(x)

'Courses’ means courses leading to a Bachelor or Higher degree in relevant

streams of Health Sciences and such other courses as notified by the

Government in future;

(xi) ‘Court' means the Court of the University;

(xii) ‘Dental Council of India' means Dental Council constituted under section- 3 of the

Dentists Act – 1948 (Act 16 of 1948) and its amendment Act 1993;

(xiii) ‘Employee’ means any person appointed by the University, College or Institution

as the case may be;

(xiv) ‘Executive Council’ means the Executive Council of the University;

(xv) ‘Finance committee’ means the finance committee of the University;

(xvi) ‘Government' means the Government of Jharkhand;

(xvii) ‘Administrative Department’ means the Department of Health, Medical Education

& Family Welfare;

(xviii) 'Health Sciences' means the Modern system of Medicine, Ayush system of

Medicine]

Education,

Laboratory Technology, Physiotherapy and Occupational therapy, Speech

therapy and Education on other paramedical courses and inter disciplinary areas

such as Health Economics, Health Administration etc. in all their branches

concerning preventive, promotive, curative and rehabilitative services;

(xix) ‘Institution’ means an academic institution or a college admitted to the privileges

of the University;

(xx) ‘Medical Council of India' means Medical Council of India constituted by Indian

Medical council Act-1956 (Act 102 of 1956) and its amendment Act 1993;

(xxi) 'Misconduct' means a misconduct prescribed by the Statutes;

(xxii) 'Modern System of Medicine' means all branches of modern medicine dealing

with pre-clinical, clinical, para-medical and para-dental disciplines at diploma and

degree level or above and such other disciplines as may be prescribed;

(xxiii) 'National Medical Commission' means National Medical Commission constituted

by National Medical Commission Act, 2019 (Act 30 of 2019);

(xxiv) 'Notification' means a notification published in the official Gazette;

(xxv) ‘Pharmacy Council of India’ means the Central Council constituted under

Section-3 of the Pharmacy Act-1948;

(xxvi) "Planning Board" means the “Planning Board” of the University;

(xxvii) ‘Principal’ means the head of a college and includes, where there is no

principal, the person who is for the time being duly appointed to act as the

Principal, and, in the absence of the Principal or the acting Principal, as the case

may be, a Vice Principal duly appointed as such;

(xxviii)‘Professional Education’ means education connected with a job that needs

special training or skill, and includes Medical, Dental, Pharmacy, Physiotherapy,

Occupational Therapy, Law Teaching, etc.;

(xxix) ‘Recognized Teachers’ means such persons as are approved by the University

for the purpose of imparting instruction in a college or an institution admitted to

the privileges of the University;

(xxx) ‘School’ means a school of studies of the University;

(xxxi) ‘School of Studies’ means the School of Studies of the University;

(xxxii) “Screening committee” means the committee as constituted under section 11(3)

of this act ;

(xxxiii)‘Self-Financing Institution' means those institutions which are set-up by a Trust

or a Society or a Company and are Self Financing imparting education in the

field of different streams of Health Sciences;

(xxxiv)‘Governing Body’ means the Governing Body of the University;

(xxxv)‘Statutes’ and 'Regulations' mean respectively the Statutes and Regulations of

the University for the time being in force.

(xxxvi)‘Technical staff’ means employees working in the technical cadre of the

University;

(xxxvii)‘University’ means the Jharkhand University of Health Sciences as incorporated

under this Act;

(xxxviii)‘University Grants Commission' means the Commission established under

Section- 4 of the University Grants Commission Act, 1956 (Central Act 3 of 1956)

(xxxix)‘University teachers' means Professors, Readers/ Associate Professors,

Lecturers/Assistant Professors and such other persons as may be appointed for

imparting instruction or conducting research in the University, or in any college or

institution maintained by the University and are designated as teachers by the

Statutes.

(XL) University Review Commission means the commission defined under section- 38

of this Act;

(XLI) The words and expressions used herein and not defined in the Act shall have the

same meaning respectively assigned to them in the Act.

3. Incorporation-

(i)

With effect from such date as the Government may, by notification in the official

Gazette, specify, there shall be established a University by the name of

Jharkhand University of Health Sciences’ comprising the Chancellor and the

Vice-Chancellor, the first members of the Governing Body, the Executive Council

and the Academic Council of the University and all such persons as may

hereafter be appointed to such office or as members so long as they continue to

hold such office or membership.

(ii)

The University shall be a body corporate with the name aforesaid having

perpetual succession and a common seal with power, subject to the provisions of

this Act, to acquire, hold and dispose of property and to contract, and may by the

said name sue or be sued.

(iii) The headquarters of the University shall be at such place as the Government

may, by notification in the official Gazette specify.

4. Jurisdiction.—

(i)

The jurisdiction of the University shall extend to the whole of the State of

Jharkhand.

(ii)

All colleges and institutions established by the Government and affiliated to the

existing Universities of the State or to be established in future imparting

Professional Education in different streams of Health Sciences shall be eligible

for affiliation with the University from such date as the Government may, by

notification in the official Gazette appoint, and in the manner prescribed by the

Statutes or Ordinances or Regulations made in this regard.

(iii) Notwithstanding anything contained in any other State laws for the time being in

force, the Colleges or Institutions as may be specified by the State Government,

by notification in the Official Gazette, imparting Professional education in

different streams of Health Sciences and affiliated by any other University

established by law of the State Legislature shall cease to be affiliated from the

University to which such Colleges or Institutions have been affiliated and such

Colleges or Institutions shall be deemed to be affiliated to the University from

such date as specified in the said notification. Provided that this provision shall

not be applicable to Deemed Universities.

(iv) The University may impose such terms and conditions upon the colleges or

institutions as it may consider necessary, conducive or incidental to the

attainment of all or any of the objects of the University and then grant affiliation.

(v)

Existing college or institution set up by a Trust or a Society as a self financing

institution imparting Professional Education in different streams of Health

Sciences shall get affiliated with the University subject to fulfillment of conditions

laid down under Statutes and Regulations made in this regard.

(vi) Any privilege, enjoyed from any other University before the appointed day by any

Medical College or institution of Health Sciences situated in this State, shall be

deemed to be withdrawn with effect from such date as may be notified by the

Government.

5. Objectives of the University:— The objectives of the University shall be to enrich the

knowledge of different streams of Health Sciences and to develop an environment conducive

for research in the concerned fields and their practical applications.

The prime objective of the University shall be to create centers and Institutes of

excellence in different streams of Health Sciences. Other objectives of the University shall be

as follows, namely:

(i) To develop professional education in different streams of Health Sciences in response

to the changing demands of the modern world and society;

(ii) To facilitate and encourage teaching, research and extension in the matters

connected with professional education in different streams of Health Sciences;

(iii) To facilitate and ensure qualitative improvement in the teaching and learning

processes and methodologies;

(iv) To facilitate and ensure quality research in the contemporary and frontier areas of

knowledge in the field;

(v) To facilitate the needs for and organize the process thereof for lifelong learning;

(vi) To disseminate knowledge and research findings emerging from the University, its

institutions or otherwise across the world;

(vii) To establish uniformity in standards of education in all faculties of Health Sciences

including Modern System of Medicine, Ayush, Dentistry, Nursing, Pharmacy, Various

Paramedical disciplines such as Medical Laboratory Technology, Physiotherapy &

Occupational

therapy,

interdisciplinary fields like Health Economics, Health Administration, Public Health

Management etc. with a view to augmenting and enhancing the quality of such

education and consistently aiming at modernizing, improving and achieving the

highest standards of academic excellence at all levels on mutual understanding of all

the systems of Health Sciences;

(viii) To develop centres of excellence for imparting State-of the-art education, training

and research in the fields of Health Sciences specially those which are not adequately

included in the syllabi and curricula of undergraduate and post-graduate medical

courses. These shall include population sciences, health systems research, health

services research, operational research, health systems and health services

management, health structure reforms, human resource development, educational

technology, bioinformatics and telematics, medical transcription, epidemiological

research technology, continuing education in Health Sciences, and any other branch

of Science as may be deemed expedient to be included.

(ix) To facilitate creation and promote knowledge centres in various areas of

specialization and disseminate need based relevant information electronically to the

client;

(x) To serve as an agency of quality improvement for teachers in their respective and

interdisciplinary fields.

(xi) To make such provisions as would enable affiliated colleges to undertake

specialization of studies.

6. Powers and Functions of the University:— The University shall have the following

powers and functions, namely:-

(i)

To make provision for providing, upgrading and promoting professional and

technical education, training and research for advancement and dissemination of

knowledge;

(ii)

To create and appoint teaching, technical, administrative, managerial, advisory,

ministerial and other support services posts of the University;

(iii) To hold examinations and grant, subject to such conditions as the University may

determine, diplomas or certificates and confer degrees or other academic

distinctions on the basis of examinations, evaluations or any other method of testing

and to withdraw any such diplomas, certificates, degrees or other academic

distinctions for good and sufficient cause;

(iv) To confer honorary degrees or other distinctions in the manner prescribed by the

Statutes;

(v)

To institute Chairs, Principalships, Professorships, Readerships and Lectureships

and other teaching and academic positions, required by the University and to

appoint persons to such Chairs, Principalships, Readerships and Lectureships and

other teaching and academic positions;

(vi) To

recognize

persons

Professors,

Readers/Associate

Professor,

Lecturers/Assistant Professors and others as teachers of the University;

(vii) To appoint, on contract or otherwise, visiting Professors, Emeritus Professors,

Consultants, Scholars and such other persons who may contribute to the

advancement of the objects of the University;

(viii) To provide for printing, reproduction and publication of research and other works

and to organize exhibitions, workshops, seminars, conferences etc;

(ix) To lay down conditions of services of all categories of staff, including their code of

conduct;

(x)

To admit to its privileges, colleges or institutions situated within the territorial

jurisdiction of the University as its affiliate, and to withdraw all or any of those

privileges including the complete affiliation in accordance with such conditions as

may be prescribed by the Statutes or Ordinances or Regulations;

(xi) To cooperate or collaborate or associate with any other University or authority or

institutions of higher learning in India or abroad or research bodies in such manner

as may be prescribed and for such purpose as the University may determine;

(xii) To regulate examination fees and other associated charges to be levied on the

students of self-financing colleges and institutions affiliated to the University;

(xiii) To determine standards of admissions, examination, evaluation or any other

method of testing unless determined by the respective Apex Professional regulatory

body for the institutions admitted to the privileges of the University;

(xiv) To make arrangements for promoting the health and general welfare of the

teachers, staff and students and guide the affiliate colleges and institutions admitted

to the privileges of the University for the same;

(xv) To institute and award fellowships, scholarships, studentships, medals and prizes;

(xvi) To formulate code of conduct for management of affiliated colleges or institutions;

(xvii) To regulate and enforce discipline among students and employees, and to take

such disciplinary measures in this regard as may be deemed necessary by the

University;

(xviii) To receive benefactions, donations and gifts and to acquire, hold, manage and

dispose off any property, movable or immovable, including trust and endowment

properties, for the purpose of the University; Provided that no immovable property

shall be disposed off except with the prior approval of the State Government;

(xix) To lend and borrow, with the approval of the Executive Council, and in the matters

related to borrowing money for the purpose of the University on the security of the

property of the University prior approval of the State Government shall be obtained;

(xx) To fix, demand and receive or recover fees and such other charges as may be

prescribed;

(xxi) To institute and provide prizes, medals, research, scholarships, exhibitions and

fellowships;

(xxii) To assess the needs in terms of disciplines or subjects of studies, fields of

specialization, levels of education, skills and training of technical manpower in the

State, both on short term and long term basis, and to initiate necessary

programmes to meet these needs;

(xxiii) To evolve a mechanism for securing accountability of the teachers and other

employees working for the University, and for the affiliated colleges or institutions;

(xxiv)

To do all such other acts and things as may be necessary, incidental or

conducive to the attainment of all or any of the objects of the University;

(xxv) To initiate measures to enlist the co-operation of industries and Government to

provide complementary facilities;

(xxvi)

To facilitate continuous experimentation in imparting knowledge, training and

preparation of textbooks and instructional materials;

(xxvii)

To arrange for progressive introduction of continuous evaluation and

reorientation of the subjects in educational measures;

(xxviii)

To further entrepreneurial ability among its teachers and students;

(xxix)

To educate the public with regard to the requirement of, opportunities in the

profession of Health Science and its responsibilities and services to the society.

(xxx) To delegate all or any of its powers (except the power to make statutes and

regulations) to any other officer or authority of the University and to do such other

acts and things as the University may consider necessary, conducive or incidental

to the attainment or enlargement of all or any of the objects of the University;

7. University open to all persons irrespective of gender, class or creed.— The

University shall be open to all persons irrespective of sex, caste, creed, race or class and it

shall not be lawful for the University to adopt or impose on any person, any test whatsoever

of religious belief or profession in order to entitle him to be appointed to hold any office

therein or be admitted as a student in the University or to graduate there at or to enjoy or

exercise any privilege thereof;

Provided that nothing in this section shall be deemed to prevent the University from

making special provisions for the employment or admission of women, persons with physical

disabilities or persons belonging to socially and educationally backward classes of the

society or for the Scheduled Castes or the Scheduled Tribes.

8. Reservation in admissions.— The University shall reserve seats in constituent colleges

for the members of the socially and educationally backward classes, the Scheduled Castes,

Scheduled Tribes, EWS in accordance with such principles as may from time to time, be

determined by Government in this behalf.

9. The Chancellor.—

(i)

The Chief Minister of Jharkhand, by virtue of his office, shall be the Chancellor

of the University.

(ii)

The Chancellor, when present, shall preside over the convocations of the

University and the meetings of the Governing Body.

(iii)

The Chancellor shall have the right to cause an inspection, to be made by such

person or persons as he may direct, of the University, a college or an institution

affiliated by the University, their buildings, laboratories and equipment, and also

of the examination, teaching and other work conducted or done by the

University, college or institution, as the case may be, and to cause an inquiry or

to be made in the like manner in respect of any matter connected with the

administration or finances of the University, college or institution, as the case

maybe;

(iv)

The Chancellor shall, in every case, give notice to the University or to the

Governing Body of the colleges or institutions of his intention to cause an

inspection or inquiry to be made and the University or the Governing Body, as

the case may be, shall, on receipt of such notice, have the right to make such

representation to the Chancellor, as it may consider necessary, within such

period as specified in the notice.

(v)

After considering the representation, if any, made by the University or the

Governing Body, the Chancellor may cause to be made such inspection or

inquiry as is referred to in sub- section (3).

(vi)

Where an inspection or inquiry has been caused to be made by the Chancellor,

the University or the Governing Body shall be entitled to appoint a

representative who shall have the right to be present and be heard at such

inspection or inquiry.

(vii) The Chancellor may address the Vice-Chancellor with reference to the result of

such inspection or inquiry as is referred to in sub-section (3) and the Vice-

Chancellor shall communicate to the Executive Council the views of the

Chancellor with such advice as the Chancellor may be pleased to offer upon the

action to be taken thereon.

(viii) The Chancellor may, if the inspection or inquiry is made in respect of any

college or institution admitted to the privileges of the University, address the

Governing Body concerned through the Vice-Chancellor with reference to the

result of such inspection or inquiry, his views thereon and such advice as he

may be pleased to offer upon the action to be taken there on.

(ix)

The Executive Council shall communicate through the Vice-Chancellor to the

Chancellor such action, if any, as it proposes to take or has been taken by it

upon the result of such inspection or inquiry.

(x)

Where, the Executive Council or Governing Body does not, within a reasonable

time, take action to the satisfaction of the Chancellor, the Chancellor may, after

considering any explanation furnished or representation made by the Executive

Council or Governing Body, issue such directions as he may think fit and the

Executive Council or Governing Body shall comply with such directions.

(xi)

Without prejudice to the foregoing provisions of this section, the Chancellor may,

by order in writing, annul any proceeding of the University which is not in

conformity with this Act, the Statutes or the Ordinances;

Provided that before making any such order, the Chancellor shall call

upon the Registrar to show cause why such an order should not be made, and if

any cause is shown within a reasonable time, he shall consider the same.

(xii) In case of differences among the authorities or officers of the University on any

matter which cannot be otherwise resolved the decision of the Chancellor shall

be final.

(xiii) The Chancellor shall have such other powers as may be prescribed by the

Statutes.

10. Officers of the University-The following shall be officers of the University:

(i) The Vice-Chancellor;

(ii) The Deans of Faculties;

(iii) The Registrar;

(iv) The Finance Officer;

(v) The Examination Controller;

(vi) The Estate Officer;

(vii) Dean of Student Welfare;

(viii) The Librarian;

(ix)

Such other officers as may be declared by the Statutes to

be officers of the University.

11. Vice-Chancellor.—

(i)

The Vice-Chancellor shall be an academician and scholar of repute having

experience in the field of Medical and Health Sciences education or an eminent

Health Practitioner or an administrator with an academic background of Health

Medical Science having adequate experience in human resource development.

(ii)

The Vice Chancellor shall be appointed by the Chancellor in consultation with

the Government of Jharkhand from out of a panel of not less than three persons

recommended (the names being arranged in the alphabetical order) by a

Screening Committee constituted under sub-section (3);

Provided that if the Chancellor does not approve of any of the persons

so recommended, he may call for fresh recommendations;

(iii)

The Screening Committee referred to in sub-section (2) shall consist of three

members of - one shall be nominated by the Executive Council, - one by the

Chancellor and - one by the Government, and the member nominated by the

Government shall be Convener of the committee;

Provided that none of the members of the Committee shall be an

employee of the University; Provided further that the panel shall be prepared

from out of candidates who submit their curriculum vitae or are sponsored by

some reputed persons or institutions in the field of Health Sciences.

(iv)

The first Vice Chancellor shall be appointed by the Government.

(v)

The Vice Chancellor shall hold office for a term of three years from the date on

which he enters upon his office and he shall be eligible for reappointment for

further terms; Provided that the Chancellor may require the Vice-Chancellor

after his term has expired, to continue in office for such period, not exceeding a

total period of one year as may be specified by him;

Provided also that the maximum age limit for continuance upon the office

of the Vice Chancellor shall be seventy years.

(vi)

The emoluments and other conditions of service of the Vice Chancellor shall be

as prescribed by the Statutes;

(vii)

In the event of the Office of the Vice Chancellor becoming vacant due to death,

resignation or otherwise or if he is unable to perform his duties due to ill health

or any other cause, the Chancellor shall have the authority to designate any

eminent person with requisite eligibility to perform the functions of the Vice

Chancellor until the new Vice Chancellor assumes his office or until the existing

Vice Chancellor is in the capacity to attend to the duties of his office, as the

case may be.

12. Powers, duties and functions of the Vice-Chancellor.—

(i)

The Vice-Chancellor shall be the principal executive and academic officer of the

University and shall exercise general supervision and control over the affairs of

the University and give effect to the decisions of the authorities of the

University.

(ii)

The Vice-Chancellor may, if he is of the opinion that immediate action is

necessary on any matter, exercise any power conferred on any authority of the

University by or under this Act and shall report to such authority at its next

meeting of the action taken by him on such matter;

Provided that such exercise of power shall be made only in emergent

situations and in no case with respect to creation and up gradation of posts and

appointments thereto;

Provided further that if the authority concerned is of the opinion that such

action ought not to have been taken, it may refer the matter to the Chancellor

whose decision thereon shall be final; Provided also that if any person in the

service of the University who is aggrieved by the actions taken by the Vice-

Chancellor under this sub-section shall have the right to appeal against such

action to the Chancellor within three months from the date on which decision on

such action is communicated to him and there upon the Chancellor may

confirm, modify or reverse the action taken by the Vice-Chancellor.

(iii)

The Vice-Chancellor, if he is of the opinion that any decision of any authority of

the University is beyond the powers of the authority conferred by the provisions

of this Act, the Statutes, the Regulations or that, any decision taken is not in the

interest of the University, may ask the authority concerned to review its decision

within sixty days of such decision and if the authority refuses to review the

decision either in whole or in part or no decision is taken by it within the said

period of sixty days, the matter shall be referred to the Chancellor whose

decision thereon shall be final.

(iv)

The Vice-Chancellor shall exercise such other powers and perform such other

duties as may be prescribed by the Statutes or the Regulations.

(v)

The Vice-Chancellor shall be the chairman of the Executive Council, Finance

Committee, Academic Council and the Planning Board of the University.

(vi)

The Vice Chancellor shall, in the absence of the Chancellor, preside at any

convocation of the University and meetings of the Governing Body.

13. Removal of the Vice-Chancellor.—

(i)

If at any time and after such enquiry as may be considered necessary, it

appears, to the Chancellor that the Vice-Chancellor

a) Has failed to discharge any duty imposed upon him, by, or under this Act, the

Statutes and Regulations, or

b) Has acted in a manner prejudicial to the interests of the University, or

c) Has been incapable of managing the affairs of the University, the Chancellor

may, notwithstanding the fact that the term of office of the Vice-Chancellor

has not expired, require the Vice Chancellor, by an order in writing stating

the reasons thereof, and after consulting the State Government, to resign his

post from the date as may be specified in the order.

(ii)

No orders under sub-section (1) shall be passed unless a notice stating the

specific grounds on which such action is proposed has been served and a

reasonable opportunity to show cause against the proposed order has been

given to the Vice-Chancellor.

(iii)

On and from the date specified in sub-section (l), it shall be deemed that the

Vice-Chancellor has resigned his post and office of the Vice-Chancellor shall

be deemed vacant.

14. The Dean.— Every Dean shall be appointed in such manner, and shall exercise such

powers and perform such duties as may be prescribed by the Statutes.

15. The Registrar.—

(i)

The Registrar shall be appointed in such manner, on such terms and other

conditions of service as may be prescribed by the Statutes. However, the first

Registrar of the University shall be appointed by the Government and shall

hold office for a term of three years or till the appointment of the Registrar as

prescribed by the statutes, whichever is earlier;

(ii)

The Registrar shall have the power to enter into agreements, sign documents

and authenticate records on behalf of the University and shall exercise such

powers and perform such duties as may be prescribed by the Statutes.

16. The Finance Officer.—

(i)

The Executive Council of University shall appoint in a person selected from

among a panel containing the names of officers belonging to the State/Central

Finance Service/Central Revenue Service/Audit and Account Service,

furnished by the Government, as the Finance Officer of the University for such

period and on such terms as may be prescribed by the statutes. However, the

first Finance Officer of the University shall be appointed by the Government

and shall hold office for a term of three years or till the appointment of the

Finance Officer as prescribed by the statutes, whichever is earlier.

(ii)

The Finance Officer shall be a whole-time officer of the University and shall,

subject to the control of the Vice-Chancellor; exercise such powers and

perform such duties as may be prescribed.

17. The Examination Controller.— The Examination Controller shall be appointed in such

manner and on such terms and conditions of service, and shall exercise such powers and

perform such duties, as may be prescribed by the statutes. However, the first Examination

Controller shall be appointed by the Government and shall hold office for a term of three

years or till the appointment of the Examination Controller, as prescribed by the statutes,

whichever is earlier.

18. The Estate Officer.- The Estate Officer shall be In-charge of all the buildings, lawns,

gardens and other immovable property of the University.

19. Dean of Student Welfare.- The Dean of Student Welfare shall have the duties to make

arrangements of the housing of students, direct a programme of student counseling,

supervise the extra-curricular activities of the student and to organize and maintain contact

with the alumni of the University.

20. Other Officers.— The manner of appointment and powers and duties of other officers of

the University shall be prescribed by the Statutes.

21. Authorities of the University.— The following shall be the authorities of the University:

(i) The Governing Body;

(ii) The Executive Council;

(iii) The Academic Council;

(iv) The Board of Studies;

(v) The Board of Planning;

(vi) The Board of Affiliation;

(vii) The Finance Committee; and

(viii) Such other authorities as may be declared by the Statutes to be the authorities of

the University.

22. The Governing Body-

(i)

The Governing Body shall consist of the following members, namely–

The Chancellor;

Minister, Department of Health, Medical Education and Family Welfare,

Government of Jharkhand ;

Minister, Department of Higher and Technical Education, Government of

Jharkhand ;

Joint Secretary nominated by him;

Pharmacy College/Government Physiotherapy and Occupational Therapy

College/Government Paramedical Institutes to be nominated by the

Government in rotation for a period of 3 Years.

Four Persons to be nominated by the Government from amongst eminent

persons having knowledge or interest in Health Sciences, subject to the

condition that, out of these one shall be a person belonging to Scheduled

Castes/Scheduled Tribes, and one shall be a woman.

One representative each from all Apex Professional Regulatory Bodies.

One person elected from amongst the Academic, administrative and

Managerial employees to the University.

(ii)

The Registrar shall be the ex-officio Secretary of the Governing Body.

(iii)

Where a person has become a member of the Governing Body by reason of the

office or appointment he holds, his membership shall terminate when he ceases

to hold that office or appointment;

(iv)

The term of office of the nominated and elected members of Governing Body

other than the ex officio members shall be three years;

(v)

A member of the Governing Body shall cease to be a member if he resigns or

becomes of unsound mind, or becomes insolvent or is convicted of a criminal

offence involving moral turpitude. A member, other than the Vice- Chancellor,

Registrar shall also cease to be a member if he accepts a full- time appointment

in the university; or if he not being an Ex-Officio member fails to attend three

consecutive meetings of the Governing Body without the leave of the

Chancellor.

(vi)

A member of the Governing Body other than an ex-officio member may resign

his office by a letter addressed to the Chancellor and such resignation shall

take effect as soon as it has been accepted; and

(vii)

Any vacancy in the Governing Body shall be filled by nomination by the

respective nominating authority for the remaining period of the term and on

expiry of the period of the vacancy; such nomination shall cease to be effective.

23. Powers, Functions and meeting of the Governing Body:—

(i)

The Governing Body shall be the plenary authority of the University and shall

formulate and review from time to time, the broad policies and programmes of

the University and devise measures for the improvement and development of

the University and shall also have the following powers and functions namely:-

(a) To consider and pass the annual report, financial statement and the

Budget estimates prepared by the Executive Council and to adopt them

with or without modification;

(b) To make Statutes concerning the administration of the affairs of the

university including prescribe the procedures to be followed by the

authorities and the officers of the University in the discharge of their

function.

(ii) The Governing Body shall meet at least twice a year on dates to be fixed by the

Chancellor and one of such meetings shall be called the annual meeting.

(a) The Chancellor may, whenever he thinks fit and shall. Upon a requisition

in writing signed by not less than fifteen members of the Governing

Body, convene a special meeting of the Governing Body.

(b) For every meeting of the Governing Body, fourteen days notice shall be

given, However, in emergent situation the meeting of the Governing

Body may be called by the Chancellor at short notice;

shall form the quorum.

(d) Each member shall have one vote and if there be equality of votes on

any question to be determined by the Governing Body, the person

presiding over the meeting shall, in addition, have a casting vote;

(e) To exercise such other powers and perform such other duties as may be

conferred or assigned by this Act or the Rules.

24. The Executive Council.—

(i)

The Executive Council shall be the principal executive body of the University.

(ii)

The Executive Council shall consist of the following person; namely

(a) The Vice-Chancellor of the University

(b) Additional Chief Secretary/Principal Secretary /Secretary, Department of

Health, Government of Jharkhand or his representative not below the

rank of Joint Secretary;

Finance, Government of Jharkhand or his representative not below the

rank of Joint Secretary;

(d) Director in Chief, Health Services, Government of Jharkhand;

(e) Director, Medical Education, Government of Jharkhand.

(f) The Registrar of the University;

(g) Three teachers to be nominated by the Chancellor of whom, one shall be

from amongst Heads of Department, one from Professors and one from

Associate Professors by rotation for a period of one year Government

Medical/other colleges.

(iii)

The Vice-Chancellor shall be the chairman of the Executive Council.

(a) Where a person has become a member of the Executive Council by

reason of the office or appointment he holds, his membership shall

terminate when he ceases to hold that office or appointment;

(b) The term of office of the nominated members of the Executive council

other than ex officio members shall be three years;

resigns or becomes of unsound mind or becomes insolvent or is

convicted of a criminal offence involving moral turpitude. A member other

than the Vice-Chancellor and the Registrar shall also cease to be a

member if he accepts a full-time appointment in the University;

(d) A member of the Executive Council other than an ex-officio member may

resign his office by a letter addressed to the Vice-Chancellor and such

resignation shall take effect as soon as it has been accepted by him;

(e) Any vacancy in the Executive Council shall be filled by nomination by the

respective nominating authority for the remaining period of the term and

on expiry of the period of the vacancy, such nomination shall cease to be

effective.

(iv) Powers, functions and meetings of the Executive Council.—

(a)

The Executive Council shall be the Chief Executive Authority of the

University and as such shall have all powers necessary to administer

the University subject to the provisions of this Act and the Statutes

made there under, and may make Regulations for that purpose and

also with respect to matters provided here under.

(b)

The Executive Council shall have the following powers and functions.

(i)

To prepare annual meeting report.

(ii)

A report on the working of the University;

(iii) A Statement of accounts; and

(iv) Budget proposal for ensuing academic year.

(v)

To manage and regulate the finances, accounts, investments,

properties, business and all other administrative affairs of the

University and for that purpose, constitute committees and delegate

the powers to such committees or such officers of the University as

it may deem fit;

(vi) To transfer or accept transfers of any movable or immovable

property on behalf of the University;

(vii) to enter into, vary, carry out and cancel contracts on behalf of the

University and for that purpose to appoint such officers as it may

think fit;

(viii) To provide buildings, premises, furniture and apparatus and other

means needed for carrying on the work of the University;

(ix) To entertain, adjudicate upon, and if it thinks fit, to redress any

grievances of the students and the employees of the University;

(x)

To create administrative, ministerial and other necessary posts, to

determine the number and emoluments of such posts, to specify

the minimum qualifications for appointment to such posts on such

terms and conditions of service as may be prescribed by the

Statutes and Regulations made in this behalf;

(xi) To appoint examiners and moderators, and if necessary to remove

them and to fix their fees, emoluments and travelling and other

allowances, after consulting the Academic Council;

(xii) To select a common seal for the University; and

(xiii) To exercise such other powers and to perform such other duties as

may be considered necessary; or imposed on it by or under this

Act.

(c)

(i)

The Executive Council shall meet at least once in four months

and not less than fourteen days’ notice shall be given of such meetings;

(ii)

The meeting of the Executive Council shall be called by the

Registrar under instructions of the Vice-Chancellor or at the

request of not less than five members of the Executive Council;

(iii)

One half of members of the Executive Council shall form the

quorum at any meeting;

(iv)

In case of difference of opinion among the members, the opinion

of the majority shall prevail;

(v)

Each member of the Executive Council shall have one vote and if

there be equality of votes on any question to be determined by the

Executive Council, the Chairman of the Executive Council or as

the case may be, the member presiding over that meeting shall, in

addition, have a casting vote;

(vi)

Every meeting of the Executive Council shall be presided over by

the Vice- Chancellor and in his absence by a member chosen by

the members present;

(vii)

If urgent action by the Executive Council becomes necessary, the

Vice- Chancellor may permit the business to be transacted by

circulation of papers to the members of the Executive Council.

The decisions so taken shall not be valid unless agreed to by a

majority of members of the Executive Council. Such decisions

shall be forthwith intimated to all the members of the Executive

Council. In case the Executive Council fails to take decision, the

matter shall be referred to the Chancellor whose decision shall be

final.

25. The Academic Council.—

(i)

The Academic Council shall be the principal academic body of the University

and shall, subject to the provisions of this Act, the Statutes and the Regulations,

co- ordinate and exercise general supervision over the academic policies of the

University.

(ii)

The Academic Council shall consist of the following person, namely;

(a)

The Vice-Chancellor who shall be the Chairman;

(b)

All Deans

(c)

Chairperson, Board of Studies

(d)

Three person from amongst educationists of repute or men of letter or

members of the learned professions or eminent public men, who are not

in the service nominated by the Chancellor;

(e)

One Nominee each of the Apex Professional Regulatory Bodies;

(f)

Director in Chief, Medical Education, Government of Jharkhand;

(g)

Ten Principals of the Government Medical/other Health Sciences

Colleges of Jharkhand on rotation for a period of three years to be

nominated by Government of Jharkhand;

(h)

Four members of the teaching staff; one each respectively representing

the Professor, Associate Professor, Assistant Professors and one Senior

Resident/Tutor of Government Medical/other Health Science Colleges,

nominated by the Vice Chancellor;

(i)

(iii)

Powers, Functions and Meeting of the Academic council.—Subject to the

provisions of the Act, Statutes and Regulations and overall supervision of the

Executive Council, the Academic Council shall manage the academic affairs

and matters in the University and in particular shall exercise and perform the

following powers and functions namely:

(a) To report on any matter referred or delegated to it by the General Council or

the Executive Council;

(b) To make recommendations to the Executive Council with regard to the

creation, abolition or classification of posts in the University and the

emoluments payable and the duties attached thereto;

faculties, and to assign to such faculties their respective subjects and also

to report to the Executive Council as to the expediency of the abolition or

sub- division of any faculty or the combination of one faculty with another;

(d) To promote research under the University and to require from time to time,

reports on such research;

(e) To consider proposals submitted by the faculties;

(f) To recommend recognition of degrees of other Universities and institutions and

to determine their equivalence in relation to the certificates, diplomas and

degrees of the University;

(g) To fix subject to any conditions accepted by the General Council, the time,

mode and conditions of competition for Fellowships, Scholarships and other

prizes and to recommend for the award of the same;

(h) To make recommendations to the Executive Council in regard to the

appointment of examiners and if necessary, their removal and fixation of

their fees, emoluments and travelling and other expenses;

(i) To recommend arrangements for the conduct of examinations and the date for

holding them;

(j) To declare or review the result of the various examinations or to appoint

committees or officers to do so, and to make recommendations regarding the

conferment or grant of degrees, honours, licenses, titles and marks of

honours;

(k) To recommend stipends, scholarships, medals and prizes and to make other

awards in accordance with the regulations and such other conditions as may

be attached to the awards;

(l) To approve or revise lists of prescribed or recommended text books and to

publish the same and to approve syllabi and courses of study;

(m) To approve such forms and registers as are from time to time, required by the

Regulations; and

(n) To perform, in relation to academic matters, all such duties and to do all such

acts as may be necessary for the proper carrying out of the provisions of this

Act, the Statutes and the Regulations made there under.

(iv) (a) The Academic Council shall meet as often as may be necessary, but not less

than two times during an academic year;

(b) One half of the existing members of the Academic Council shall form the

quorum for a meeting of the Academic Council;

majority shall prevail;

(d) Each member of the Academic Council, including the Chairman of the

Academic Council, shall have one vote and if there be an equality of votes on

any question to be determined by the Academic Council, the Chairman of the

Academic Council, or as the case may be, the member presiding over the

meetings, shall in addition, have a casting vote;

(e) Every meeting of the Academic Council shall be presided over by the Vice

Chancellor and in his absence by a member chosen in the meeting to preside

on the occasion;

(f) If urgent action by the Academic Council becomes necessary, the Chairman of

the Academic Council may permit the business to be transacted by the

circulation of papers to the members of the Academic Council. The decision

taken shall not be valid unless agreed to, by a majority of the members of the

Academic Council. The decision so taken shall forthwith be intimated to all the

members of the Academic Council. In case the Academic Council fails to take

decision, the matter shall be referred to the Chancellor whose decision shall

be final.

26. The Board of Planning.—

(i)

The Board of Planning shall be the principal body for preparing plans for the

growth and development of the University to achieve its objectives.

(ii)

The Board of Planning shall be constituted consisting of the following:-

(a) The Chancellor

(b) The Minister, Department of Health, Government of Jharkhand

(d) The Chief Secretary, Government of Jharkhand

(e) Additional Chief Secretary/Principal Secretary/ Secretary, Department of

Finance, Government of Jharkhand;

(f) Additional Chief Secretary/Principal Secretary/Secretary, Department of

Health, Government of Jharkhand;

(g) Principal, MGM Medical College, Jamshedpur;

(h) Director, Rajendra Institute of Medical Sciences Ranchi

(i) Director, All India Institute of Medical Sciences, Deoghar.

(j) Director, RINPAS, Kanke, Ranchi;

(k) Director, Medical Education, Government of Jharkhand;

(l) Two eminent Professors nominated by the Chancellor

(m) Nominee of National Medical Commission;

(iii) The Planning Board shall meet once in a year and develop plans on the future

programmes of the University and recommend the same to the Academic

Council and Executive Council. It shall also recommend long term plans in

relation to the different activities of the University as and when found

necessary.

27. The Board of Affiliation.—

(i)

The Board of Affiliation shall be responsible for admitting colleges and

institutions to the privileges of the University.

(ii)

The constitution of the Board of Affiliation, the term of office of its members and

its functions shall be prescribed by the Statutes.

28. The Finance Committee.—The constitution, powers and functions of the Finance

Committee shall be prescribed by the Statutes.

29. Other Authorities.— The constitution, powers and functions of the other authorities as

may be declared by the Statutes to be the authorities of the University, shall be prescribed by

the Statutes.

30. Powers to make Statutes.— Subject to the provisions of this Act, the Statutes may

provide for all or any of the following matters, namely:

(i)

The constitution, powers and functions of the authorities and other bodies of the

University, as may be found necessary to be constituted from time to time;

(ii)

The appointment and continuance in office of the members of the said

authorities and bodies of the University, the filling up of vacancies of members,

and all other matters relating to those authorities and other bodies for which it

may be necessary or desirable to provide;

(iii) The appointment, powers and duties of the officers of the University, and terms

and conditions of their service;

(iv) The manner of appointment of the teachers of the University, other academic

staff or other employees and their emoluments;

(v)

The manner of appointment of teachers and other academic staff working in

any other university for a specified period for undertaking a joint project, their

terms and conditions of service and emoluments;

(vi) The constitution of the pension or the provident fund and the establishment of

an insurance scheme for the benefit of the employees of the University and

those of colleges and institutions;

(vii) The Principles governing the seniority of employees of the University, colleges

and institutions;

(viii) The procedure for arbitration in cases of dispute between employees or

students and the University;

(ix) The procedure for appeal to the Executive Council by an employee or student

against the action of any officer or authority of the University;

(x)

The conditions under which colleges and institutions may be admitted to the

privileges of the University and the conditions under which such privileges may

be withdrawn;

(xi) The constitution of governing bodies of colleges and institutions admitted to the

privileges of the University and the supervision and inspection of such colleges

and institutions;

(xii) The extent of the autonomy which a college or an institution declared as an

autonomous college or institution may be exercised;

(xiii) The conferment of honorary degrees;

(xiv) The withdrawal of degrees, diplomas, certificates and other academic

distinctions;

(xv) The institution of fellowships, scholarships, studentship, medals and prizes and

other incentives;

(xvi) The maintenance of discipline among the employees and students of the

University, and of colleges and institutions;

(xvii) The establishment of chairs, schools of studies, departments, colleges and

institutions;

(xviii) The delegation of powers vested in the authorities or the officers of the

University;

(xix) All other matters which, by or under this Act, are to be, or may be, provided for

by the Statutes.

31. Procedure to make Statutes-

(i)

The First Statutes shall be made by the Government on the recommendation of

the Governing Body.

(ii)

The Governing Body may, from time to time, make new or additional Statutes or

may amend or repeal the Statutes referred to in sub-section(1):

Provided that the Governing Body shall not make, amend or repeal any

Statute affecting the status, powers or constitution of any authority of the

University until such authority has been given an opportunity of expressing its

opinion in writing on the proposed change, and any opinion so expressed shall

be considered by the Governing Body.

(iii) Every new Statute or addition to the Statutes or any amendment or repeal

thereof a Statute shall require the assent of the Chancellor, who may assert

thereto or withhold his assent or remit it to the Governing Body for

reconsideration.

Provided that if the Chancellor does not convey his decision within ninety

days of the reference received by him, the Chancellor shall be deemed to have

given his assent to the Statute.

Provided that if there be any financial implication which may arise under

the statute, it shall not be enforceable unless prior approval of the State

Government has been obtained.

32. Powers to make Regulations.— The authorities of the University may make

Regulations consistent with this Act, and the Statutes, in the manner prescribed by the

Statutes for the conduct of their own business and that of the committees, if any, appointed

by them and not provided for by this Act, the Statutes and for such matters as may be

prescribed by the Statutes, provided that if there be any financial implication which may arise

under the regulation, it shall not be enforceable unless prior approval of the State

government has been obtained.

Administrative Department will prepare proposal and will take consent of Department

of Personnel, Administrative Reforms & Rajbhasha and Department of Finance regarding

management of Administrative and Financial transition of those institutions which are

currently run by State Government and will be absorbed in Jharkhand Health Science

University in future.

(i)

The Regulations may provide for all or any of the following matters, namely:

(a) the admission and enrolment of students to the University and institutions

maintained by or admitted to the privileges of the University;

(b) the courses of study to be laid down for all degrees, diplomas and

certificates;

(d) the award of degrees, diplomas, certificates and other academic

distinctions, the qualifications for the same and the means to be taken

relating to the granting and obtaining the same;

(e) the fees to be charged for courses of study in the University and for

admission to the examinations, degrees and diplomas of the University;

(f) the institutions of, and conditions for award of fellowships, scholarships,

studentships, medals and prizes;

(g) the conduct of examinations, including the terms of office and manner of

appointment and the duties of examining bodies, examiners and

moderators;

(h) the conditions of residence of students and their general discipline;

(i) the management of colleges and institutions maintained by the University;

(j) the establishment of Centres, Institutes, Board of Studies, Specialized

Laboratories and Committees;

(k) the creation, composition and functions of any other body which is

considered necessary for improving the academic life of the University;

(l) the manner of cooperation and collaboration with other Universities,

Institutions and other Agencies including learned bodies or associations;

(m) the setting up of a machinery of redressal of grievances of employees;

(n) the categories of misconduct for which action may be taken under this Act

or the Statutes or the Regulations; and

(o) All other matters which, by or under this Act or the Statutes, are to be or

may be, provided for by the Regulations.

(ii)

The first Regulations shall be made by the Vice-Chancellor with the prior

approval of the Government and the Regulations so made may be amended,

repealed or added to at any time by the Government in such manner as

prescribed by the Statutes.

33. Annual Report.—

(i)

The annual report of the University shall be prepared under the directions of the

Executive Council, which shall include, among other matters, the steps taken by

the University towards the ful- filment of its objects and shall be submitted to the

Governing Body on or after such date as may be prescribed by the Statutes and

the Governing Body shall consider in its annual meeting to be held compulsory

every year in the month of August/September.

(ii)

The Governing Body shall submit the Annual Report to the Chancellor along with

its comments, if any.

(iii) A copy of the annual report, as prepared under sub-section (1), shall also be

submitted to the Government. which will be putup before the Legislative

assambly as soon as possible

34. Funds.—

(i)

The University shall have a general fund to which the following shall be credited:

(a) its income from fees, grants, donations and gifts, if any;

(b) any contribution or grant made by national/international agencies, the

Central Government, University Grants Commission, All India Council for

Technical Education or like authority, any local authorities or any

corporation owned or controlled by the Government and;

(ii) The University may have such other funds as may be prescribed by the Statutes.

(iii) The funds and all moneys of the University shall be managed in such a manner

as may be prescribed by the Statutes.

(iv) The Government may, every year, provide grant-in-aid to facilitate and promote

studies and research.

35. Accounts and Audit.—

(i)

The annual accounts and the balance sheet of the University shall be prepared

under the direction of the Executive Council and shall once at least every year,

and at intervals of not more than fifteen months, be audited by the Comptroller

and Auditor General of India or by such person or such persons as he may

authorize on his behalf.

(ii)

A copy of the annual accounts together with the audit report thereon shall be

submitted to the Governing Body and the Chancellor through the Government,

along with the observations, if any, of the Executive Council.

(iii) Any observation made by the Chancellor on the annual accounts shall be

brought to the notice of the Governing Body and the observations of the

Governing Body, if any, shall, after being considered by the Executive Council,

be submitted to the Chancellor.

(iv) A copy of the annual accounts together with the audit report, as submitted to the

Chancellor, shall also be submitted to the Government.

36. Furnishing of Returns etc.— The University shall furnish to the Government such

returns or other information with respect to its property or activities as the Government may,

from time to time, require.

37. Conditions of service of employees.— The condition of the service of the officers and

staff of the University shall be as specified by the statutes and regulations.

38. Constitution of University Review Commission.—

(i)

Chancellor, on his own motion or on request from the Government, shall at least

once in every five years, constitute a commission to review the working of the

University and to make recommendations.

(ii)

The Commission shall be constituted consisting of not less than three eminent

educationists, one of whom shall be the Chairman of such Commission

appointed by the Chancellor in consultation with the Government.

(iii) The terms and conditions of the appointment of the members shall be such as

the Chancellor may determine.

(iv) The Commission shall after holding such enquiry as it deems fit, make its

recommendations to the Chancellor with a copy to the Government.

(v)

The Chancellor may take such action on the recommendations as he deems fit in

consultation with the government.

39. Right to appeal.— Every employee or student of the University, Colleges or of an

Institution admitted to its privileges shall, notwithstanding anything contained in this Act, have

a right to appeal within such time as may be prescribed by the Statutes, to the Chancellor

against the decision of any officer or authority of the University, and thereupon the

Chancellor may confirm, modify or reverse the decision appealed against.

40. Pension—For the employees appointed in all government institutions related to Health

Science of Jharkhand State as on or after 01.12.2004 will be covered under New Pension

Scheme and the decision taken by State will be effective time to time. In case of Employees

appointed before 01.12.2004, the earlier provision of pension will be effective as it is. In case

of Appointment after the formation of the University, the provision of the State Government

for the time being in respect of pension, which is applicable to the University, will be effective.

The University shall constitute for the benefits of its employee such provident fund or

pension fund or provide such insurance schemes as it may deem fit in such manner and

subject to such conditions as may be prescribed by the statutes.

41. Disputes as to constitution of University authorities and bodies— If any question

arises as to whether any person has been duly elected or appointed as, or is entitled to be, a

member of any authority or other body of the University, the matter shall be referred to the

Chancellor whose decision thereon shall be final.

42. Filling of casual vacancies— All the casual vacancies among the members, other than

ex-officio members, of any authority or other body of the University shall be filled, as soon as

may be, by the person or body who appoints; elects or co-opts the members whose place

has become vacant and any person appointed, elected or co-opted to a casual, vacancy

shall be a member of such authority or body for the residue of the term for which the person

whose place he fills would have been a member.

43. Proceedings of the University authorities or bodies not invalidated by vacancies.—

No act or proceedings of any authority or other body of the University shall be invalidated

merely by reason of the existence of any vacancy or vacancies among its members.

44. Protection of action taken in good faith.— No suit or other legal proceeding shall lie

against any officer or other employee or against any authority of the University for anything

which is in good faith done or intended to be done in pursuance of any of the provisions of

this Act, the Statutes or the Regulation.

45. Mode of proof of University record.— Notwithstanding anything contained in the Indian

Evidence Act, 1872 or in any other law for the time being in force, a copy of any receipt,

application, notice, order, proceedings or resolution of any authority or other body of the

University, or any other document in possession of the University, or any entry in any register

duly maintained by the University, if certified by the Registrar so designated shall be received

as prima facie evidence of such receipt, application, notice, order, proceeding, resolution or

document or the existence of entry in the register and shall be admitted as evidence of the

matters and transactions therein, where the original thereof would, if produced, have been

admissible in evidence.

46. Power to remove difficulties.— If any difficulty arises in giving effect to the provisions of

this Act, the Government may, by order published in the official Gazette, make such

provisions, not inconsistent with the provisions of this Act, as appear to it to be necessary or

expedient for removing the difficulty;

Provided that no such order shall be made under this section after the expiry of three

years from the commencement of this Act;

Provided further that every order made under this section shall be laid, as soon as it is

made, before Legislature.

47. Transitional Provisions.— Notwithstanding anything contained in this Act and the

Statutes;

(i)

The first Vice-Chancellor, the first Registrar and the first Finance Officer shall be

appointed by the Government and each of the said officers shall hold office for a

term of Three Years;

(ii)

The first Court and the first Executive Council shall consist of not more than

eleven members who shall be nominated by the Government and shall hold

office for a term of Three Years;

Provided that if, any vacancy occurs in the above-mentioned offices or

authorities, the same shall be filled by appointment or nomination, as the case

may be, by the Government, and the person so appointed or nominated shall

hold office for so long as the officer or member in whose place he is appointed or

nominated would have held office if such vacancy had not occurred.

(iii)

Notwithstanding anything contained in this act or the regulations, any student of

a college or institution affiliated to other University, who immediately before the

date of affiliation to the University, was studying or was eligible for any

examination of the other Universities shall be permitted to complete this course

in preparation thereof and the University shall provide for such period and in

such manner as may be prescribed for the instruction, teaching, training and

examination of such students in accordance with the course of studies of the

other University.

48. Statutes and Regulations to be published in the official Gazette and to be laid

before the Legislature.—

(i)

Every Statutes or Regulation made under this Act shall be published in the

official Gazette.

(ii)

Every Statute or Regulation made under this Act shall be laid, as soon as it is

made, before the Legislature, while it is in session, for a total period of fourteen

days which may comprise of one session or two or more successive sessions.

(iii)

If before the expiry of the session in which it is as laid, or the sessions

immediately following the Legislature agrees in making any modification in the

Statutes or Regulation or agrees that the Statute or Regulation should not be

made, the Statute or Regulation shall thereafter have effect only in such modified

form or be of no effect as the case may be. However, any such modification or

amendment shall be without prejudice to the validity of anything previously done

under the concerned position of that Statute or Regulation.
