ददनाॊक-07.05.2024 की अशधसूचना सॊ0 आ.अ.119 (अ) के अनुसयण भें झायखण् ड के 01-याजभहर

रोकसबा शनवााचन ऺेत्र के शरए साधायण शनवााचन 2024 आमोजजत दकमा गमा था; औय

मत:रोक प्रशतशनशधत् व अशधशनमभ, 1951 की धाया 78 के अनुसाय, दकसी शनवााचन भें, शनवााचन

रड़ यहा प्रत् मेक अ‍ मथी, शनवााशचत अ‍ मथी के शनवााचन की तायखख से 30 ददनों के बीतय शनवााचन

व् मम का रेखा जजरा शनवााचन अशधकायख के ऩास दाजखर कयेगा जो उ्‍ त अशधशनमभ की धाया 77 के

अॊतगात उसके द्वाया मा उसके शनवााचन अशबकताा (एजेंट) द्वाया यखे गए रेखे की एक सत् म प्रशत होगी;

औय

मत: झायखण् ड के 01-याजभहर सॊसदखम शनवााचन ऺेत्र के साधायण शनवााचन का ऩरयणाभ

रयटशनिंग ऑदपसय द्वाया ददनाॊक 04.06.2024 को घोषित दकमा गमा था औय इस प्रकाय शनवााचन व् मम

रेखे दाजखर कयने की अजततभ तायखख 04.07.2024 थी; औय

मत:, शनवााचनों का सॊचारन शनमभ, 1961 के शनमभ 89 के उऩ-शनमभ (1) अॊतगात, जजरा

शनवााचन अशधकायख, साहेफगॊज की रयऩोटा ददनाॊक 20.07.2024 जो भुख् म शनवााचन अशधकायख, झायखण् ड

से ददनाॊक 17.10.2024 के ऩत्र सॊ0 02/शन.-EEM-24-24/2024/5593 को प्राप् त हुई थी, के अनुसाय

श्री ऩार सोयेन जो झायखॊड के 01-याजभहर सॊसदखम शनवााचन ऺेत्र 2024 से शनवााचन रड़ने वारे

अ‍ मथी है, षवशध द्वाया मथाऩेजऺत यखशत से अऩने शनवााचन व् मम के रेखे दाजखर कयने भें असपर यहे

हैं; औय,

मत:, जजरा शनवााचन अशधकायख की उ्‍ त रयऩोटा के आधाय ऩय बायत शनवााचन आमोग द्वाया

शनवााचनों का सॊचारन शनमभ, 1961 के शनमभ 89 के उऩ-शनमभ (5) के अॊतगात श्री ऩार सोयेन को

अऩने शनवााचन व् मम रेखे प्र्‍ तुत नहखॊ कयने के शरए कायण फतान नोदटस सॊ. 76/झायखॊड-

रो.स./01/2024/सी.ई.एभ.एस.-।।। ददनाॊक 11.12.2024 जायख दकमा गमा था; औय,

मत:, उऩमु्‍ त कायण फतान नोदटस के जरयए औय शनवााचनों का सॊचारन शनमभ, 1961 के

शनमभ 89 के उऩ-शनमभ (6) के अनुसाय श्री ऩार सोयेन को व् मम रेखा प्र्‍ तुत न दकए जाने सॊफॊधी

कायणों को ्‍ ऩष् ट कयते हुए, आमोग को अऩना अ‍ मावेदन शरजखत प ऩ भें प्र्‍ तुत कयने औय नोदटस

के प्राप् त होने की तायखख से 20 ददनों के बीतय जजरा शनवााचन अशधकायख, साहेफगॊज को अऩने

शनवााचन व् मम का ऩूणा रेखा प्र्‍ तुत कयने का शनदेि ददमा गमा था; औय

मत:, भुख् म शनवााचन अशधकायख, झायखण् ड से ददनाॊक 06.03.2025 के ऩत्र सॊ. 02/शन.- EEM

-24-54/2024/468 के द्वाया सूशचत दकमा है दक उ्‍ त कायण फतान नोदटस श्री ऩार सोयेन के

ददनाॊक 11.02.2025 को घय ऩय नहखॊ होने के कायण नोदटस उनके घय ऩय च्‍ ऩा दकमा गमा था; औय

मत:, जजरा शनवााचन अशधकायख, साहेफगॊज ने ऩत्र सॊ. 234/शनवाा. ददनाॊक 04.04.2025 के

द्वाया प्र्‍ तुत की गई अनुऩूयक रयऩोटा भें मह फतामा गमा है दक श्री ऩार सोयेन ने शनवााचन व् मम का

रेखा प्र्‍ तुत नहखॊ दकमा है। इसके अशतरय्‍ त, उ्‍ त नोदटस की च्‍ ऩा के उऩयाॊत, श्री ऩार सोयेन ने

षवशध के अॊतगात मथा षवदहत रेखा दाजखर कयने भें असपरता के शरए बायत शनवााचन आमोग को न

तो काई कायण फतामा औय न हख कोई ्‍ ऩष् टखकयण ददमा है; औय

मत:, रोक प्रशतशनशधत् व अशधशनमभ, 1951 की धाया 10क भें उऩफॊशधत दकमा गमा है दक:-

‘’मदद शनवााचन आमोग का सभाधान हो जाता है दक कोई व् मषि-

(क)

शनवााचन व् ममों का रेखा उस सभम के बीतय औय उस यखशत भें जैसी इस अशधशनमभ

के द्वाया मा अधीन अऩेजऺत है, दाजखर कयने भें असपर यहा है; औय

(ख)

उस असपरता के शरए कोई अच् छा कायण अथवा त मामोशचत् म नहखॊ यखता है, तो

शनवााचन आमोग, िासकीम याजऩत्र भें प्रकाशित आदेि द्वाया उसको शनयदहात घोषित कयेगा औय

ऐसा व् मषि उस आदेि की तायखख से तीन विा की कारावशध के शरए शनयदहात होगा।

मत:, तथ् मों औय उऩरध ध रयकाडडों के आधाय ऩय आमोग का मह सभाधान हो गमा है दक

श्री ऩार सोयेन अऩने शनवााचन व् मम के रेखे दाजखर कयने भें असपर यहे हैं उनके ऩास ऐसा कयने भें

असपर यहने के शरए कोई बी उशचत कायण अथवा औशचत् म नहखॊ है, औय

अत:, अफ रोक प्रशतशनशधत् व अशधशनमभ, 1951 की धाया 10क के अनुसयण भें बायत शनवााचन

आमोग एतदद्वाया घोिणा कयता है दक झायखण् ड याज् म के साधायण शनवााचन, 2024 के 01-याजभहर

सॊसदखम शनवााचन ऺेत्र से शनवााचन रड़ने वारे अ‍ मथी श्री ऩार सोयेन, ग्राभ-अठगाभा, ऩो.-फयतल् रा,

थाना-याॊगा, जजरा-साहेफगॊज, षऩन 816101 (झायखण् ड) इस आदेि की तायखख से तीन विा की अवशध

के शरए सॊसद के दकसी बी सदन अथवा याज् म अथवा सॊघ याज् म-ऺेत्र की षवधान सबा अथवा षवधान

ऩरयिद् का सद्‍ म चुने जाने अथवा होने के शरए शनयदहात होंगे।

ORDER

13 May, 2025/23 Vaisakha, 1947 (Saka)

No. 76/Jharkhand-PC/01/2024/CEMS-III--WHEREAS, the General Election to LokSabha

Assembly of Chhattisgarh, 2024 for 01-Rajmahal Parliamentary Constituency was held in pursuance

of the Election Commission of India Notification No. O.N. 119(E), dated 07.05.2024; and

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting

candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge

with the District Election Officer an account of his election expenses which shall be true copy of the

account kept by him or his election agent under Section 77 of the said act; and

WHEREAS, the result of the elections for 01-Rajmahal Parliamentary Constituency of

Jharkhand 2024 was declared by the Returning Officer on 04.06.2024 and hence the last date for

lodging the account of Election Expenses was 04.07.2024; and

WHEREAS, as per the District Election Officer Sahibganj report dated 20.07.2024 forwarded by the

Chief Electoral Officer, Jharkhand vide its letter no. 02/शन.-EEM-24-24/2024/5593,dated

17.10.24, under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Paul Soren a

contesting candidate from 01-Rajmahal Parliamentary Constituency of Jharkhand has failed to lodge

his account of election expenses, as required under law; and

WHEREAS, on the basis of the said report of the District Election Officer, Sahibganj, a Show-Cause

notice No.76/Jharkhand-PC/01/2024/CEMS-III, dated 11.12.2024 was issued under sub-rule (5)of

Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Paul

Soren for not lodging of his account of Election Expenses; and

WHEREAS, through the above said Show Cause Notice and under sub-rule (6) of Rule 89 of the

Conduct of Elections Rules, 1961, Sh. Paul Soren, was directed to submit representation in writing to

the Commission explaining the reasons for not lodging the account and also to lodge account of

election expenses with the District Election Officer, Sahibganj within 20 days from the date of receipt

of the Notice; and

WHEREAS, the Chief Election Officer, Jharkhand, vide its letter No. 02/शन.-EEM-24-

54/2024/468, dated 06.03.2025 has informed that notice was pasted in front of the house of Sh.

Paul Soren on 11.02.2025 as he was not available at his residence; and

WHEREAS, the District Election Officer, Sahibganj in his Supplementary Report, vide its letter no.

234/शनवाा., dated 04.04.2025 has reported that Sh. Paul Soren, has not submitted his account of

election expenses. Further, after receipt of the said notice, Sh. Paul Soren, has neither furnished any

reason nor explanation to the Election Commission of India, for failure to lodge the account as

prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that:-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required

by or under this Act, and

(b) has no good reason or justification for the failure, the Election Commission shall, by order

published in the Official Gazette, declare him to be disqualified and any such person shall

be disqualified for a period of three years from the date of the order. "

WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh.

Paul Soren, has failed to lodge his account of election expenses and has no good reason or

justification for the failure to do so; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951,

the Election Commission of India hereby declares Sh. Paul Soren resident of Vill –Athgama, PO-

Bartalla, Dist.-Sahibganj, Pin 816101 (Jharkhand), a contesting candidate in 01-Rajmahal

Parliamentary Constituency of General Election to the LokSabha of Jharkhand, 2024 to be disqualified

for being chosen as and for being a member of either House of the Parliament or the Legislative

Assembly or the Legislative Council of a State or Union Territory for a period of three years from the

date of this order.
