माननीय झारखÖड उÍच Ûयायालय, राँची के ɮवारा W.P.(S) संÉया-1002/2022
सुͧमत कुमार ͧसंह बनाम् झारखÖड राÏय एवं अÛय मɅ Ǒदनांक-10.08.2023 को पाǐरत
Ûयायादेश के आलोक मɅ èव० उमेश कुमार ͧसंह, भूतपूव[ सहायक ͧश¢क, मÚय
ͪवɮयालय, बरकाकाना, रामगढ़ के आͬĮत पुğ Įी सुͧमत कुमार ͧसंह कȧ अनुकàपा
के आधार पर चतुथ[ वग[ (समूह 'घ') मɅ ǓनयुिÈत के पæचात् तृतीय वग[ (समूह 'ग') मɅ
पद पǐरवत[न हेतु ͪवभागीय पǐरपğ संÉया-10167, Ǒदनांक- 01.12.2015 कȧ
कंͫडका-15(ग) को ¢ांत करने के संबंध मɅ ।
संÉया-09/अनु०-01-05/2024 का०-3994--èव० उमेश कुमार ͧसंह, भूतपूव[ सहायक ͧश¢क,
मÚय ͪवɮयालय, बरकाकाना, रामगढ़ कȧ सेवाकाल मɅ Ǒदनांक-16.05.2018 को मृ×यु के उपरांत
उनके आͬĮत पुğ Įी सुͧमत कुमार ͧसंह के ɮवारा अनुकàपा के आधार पर ǓनयुिÈत का दावा ͩकया
गया था ।

Ǒदनांक-30.07.2019 को सàपÛन िजला अनुकàपा सͧमǓत कȧ बैठक मɅ Įी ͧसंह
कȧ शै¢ͨणक योÊयता इÛटरमीͫडएट रहने के कारण इÛहɅ समूह 'ग' अंतग[त Ǔनàनवगȸय ͧलͪपक के पद
पर ǓनयुिÈत कȧ अनुशंसा कȧ गयी थी। साथ हȣ मɅ िजला èथापना उपसमाहƣा[, रामगढ़ को Ǔनदेश

Ǒदया गया था ͩक समूह 'ग' अंतग[त Ǔनàनवगȸय ͧलͪपक के पद पर अनुशंͧसत अßयͬथ[यɉ का टंकण
£ान से संबंͬधत जाँच करना सुǓनिæचत करɅगे। टंकण परȣ¢ा उतीण[ करने के पæचात् हȣ ͧलͪपक पद
पर ǓनयुिÈत कȧ जाएगी। अनुतीण[ होने पर अनुशंसा èवतः चतुथ[ वग[ के ͧलए समझी जाएगी ।

Ǒदनांक-18.02.2020 को सàपÛन ͪवभागीय टंकण परȣ¢ा मɅ Įी सुͧमत कुमार
ͧसंह उतीण[ता ĤाÜत नहȣं कर सके। उÈत के आलोक मɅ Ǒदनांक 06.05.2020 को सàपÛन िजला
èथापना सͧमǓत कȧ बैठक मɅ सͧमǓत ɮवारा इनकȧ चतुथ[ वग[ (समूह 'घ') के पद पर ǓनयुिÈत कȧ
अनुशंसा कȧ गयी ।

चतुथ[ वग[ (समूह 'घ') के पद पर ǓनयुिÈत कȧ अनुशंसा ͩकये जाने के कारण
Įी सुͧमत कुमार ͧसंह के ɮवारा माननीय झारखÖड उÍच Ûयायालय, राँची मɅ W.P.(S)
संÉया-1002/2022 दायर ͩकया गया। उÈत वाद मɅ माननीय झारखÖड उÍच Ûयायालय, राँची के
ɮवारा Ǒदनांक-22.09.2022 को Ǔनàन अंतǐरम Ûयायादेश पाǐरत ͩकया गयाः-
"The petitioner is directed to join his service, subject to final decision of
this case. His joining will be without prejudice to his rights in this writ application.
The petitioner will file an affidavit intimating his joining.
List this case after three weeks under the heading for Orders."

उÈत अंतǐरम Ûयायादेश के आलोक मɅ Įी सुͧमत कुमार ͧसंह के ɮवारा चतुथ[
वग[ (समूह 'घ') के पद पर योगदान समͪप[त ͩकया गया ।

W.P.(S) संÉया-1002/2022 मɅ माननीय झारखÖड उÍच Ûयायालय, राँची के
ɮवारा Ǒदनांक-10.08.2023 को अंǓतम Ûयायादेश पाǐरत ͩकया गया, िजसका Operative Part
Ǔनàनवत् हैः-
"It appears that during the pendency of this writ application an order
was passed on 22.09.2022 wherein the petitioner was directed to join his service
subject to final decision of the case. The petitioner had thereafter joined in a Class-
IV post and working on the same till date.
It appears from the submissions advanced by the learned counsel for
the respective sides and the averments made in the writ application that the only
grievance of the petitioner is that he has not been appointed in a Class-III post
though a recommendation was made by the District Compassionate Committee and
instead the petitioner is being forced to work in a Class-IV post. The petitioner
appears to have already submitted an application before the concerned respondents

for holding a typing test so as to enable him to make an attempt and if he qualifies
it will smoothen the process of his appointment in a Class-III post.
Mr. Sahani in course of his submission has also referred to an instance
of one Ujawal Kumar who is working in a Class-III post and whose case is almost
similar to that of the petitioner.
Mr. Ashok Kr. Singh, learned A.C. to S.C. (L&C)-III, has in course of
dictating this order submitted that the typing tests are regularly held and if a
direction be given to the concerned respondent the petitioner can appear in the
typing text.
In view of the above, therefore, this writ application stands disposed of
with a direction to the respondent no. 3 to consider afresh the application preferred
by the petitioner for holding a typing test as it appears that on account of not being
successful in the typing test the same has caused an impediment for the petitioner
for being appointed in a Class-III post.
It goes without saying that the petitioner has been appointed on
compassionate ground and the respondent no. 3 while considering the application
submitted by the petitioner for holding of a fresh typing test should also consider it
sympathetically. The respondent no. 3 shall conclude the aforesaid exercise within a
period of three weeks from the date of receipt/production of a copy of this order.
This writ application stands disposed off.
Pending I.A., if any, also stands disposed off."

माननीय झारखÖड उÍच Ûयायालय, राँची के ɮवारा पाǐरत उÈत Ûयायादेश के
आलोक मɅ आवेदक हेतु पुनः टंकण द¢ता परȣ¢ा का आयोजन Ǒदनांक-14.10.2023 को ͩकया गया,
िजसमɅ Įी सुͧमत कुमार ͧसंह उतीण[ हुए ।

उपायुÈत, रामगढ़ के ɮवारा ͪवभागीय पǐरपğ संÉया-10167, Ǒदनांक-
01.12.2015 कȧ कंͫडका-15(ग) मɅ ǓनǾͪपत Ĥावधान का उãलेख करते हुए ĤǓतवेǑदत ͩकया गया है
ͩक माननीय झारखÖड उÍच Ûयायालय, राँची के ɮवारा आलोÍयवाद मɅ पाǐरत Ûयायादेश मɅ आवेदक
का पुनः टंकण परȣ¢ा ͧलए जाने का आदेश Ǒदया गया है, परÛतु तृतीय वग[ के पद पर ǓनयुिÈत ͩकये
जाने के संबंध मɅ ͩकसी तरह का उãलेख नहȣं ͩकया गया है ।
उÈत के आलोक मɅ उपायुÈत, रामगढ़ के ɮवारा आवेदक कȧ सेवा चतुथ[ वग[ से तृतीय
वग[ मɅ संवग[ / पद पǐरवत[न के संबंध मɅ माग[दश[न देने का अनुरोध ͩकया गया ।

ͪवभागीय पǐरपğ संÉया-10167, Ǒदनांक- 01.12.2015 कȧ कंͫडका-15 (ग) मɅ
Ǔनàन Ĥावधान ǓनǾͪपत है:-
"ǓनयुिÈत के बाद ͩकसी भी िèथǓत मɅ अनुकàपा सͧमǓत पुनͪव[चार नहȣं करेगी अथा[त
संवग[ / पद पǐरवत[न कȧ सुͪवधा नहȣं दȣ जा सकेगी ।"
10. त×पæचात् ͪवभागीय पǐरपğ संÉया-3004, Ǒदनांक- 06.07.2021 के ɮवारा अनुकàपा
के आधार पर ǓनयुिÈत हेतु टंकण कȧ शत[ को भी ͧशͬथल ͩकया गया है ।
11. W.P.(S) संÉया-1002/2022 मɅ Ǒदनांक-10.08.2023 को पाǐरत Ûयायादेश के
आलोक मɅ उपायुÈत, रामगढ़ ɮवारा माग[दश[न हेतु ĤाÜत पğ के संदभ[ मɅ पद पǐरवत[न बाÚयकारȣ होने
के ǒबÛदु पर ͪवͬध ͪवभाग के माÚयम से ͪवɮवान महाͬधवÈता का परामश[ ĤाÜत ͩकया गया, िजसका
मुÉय ǒबÛदु Ǔनàनवत् हैः-
"I am of the opinion, that in view of the aforesaid facts and order of the
Hon'ble Court order dated 10.08.2023 as taking into consideration that the Petitioner
has already passed in the re-test organized thereupon, the appropriate authorities
may take all due measures, including of the relaxation of the Clause 15(c) of the
Department of Personnel, Administrative Reforms and Rajbhasha Letter No. 10167
dated 01.12.2015, in the instant case to ensure the compliance of the Hon'ble Court
aforesaid order dated 10.08.2023."

अतः सàयक ͪवचारोपराÛत माननीय झारखÖड उÍच Ûयायालय, राँची के ɮवारा
पाǐरत Ûयायादेश के आलोक मɅ èव० उमेश कुमार ͧसंह, भूतपूव[ सहायक ͧश¢क, मÚय ͪवɮयालय,
बरकाकाना, रामगढ़ के आͬĮत पुğ Įी सुͧमत कुमार ͧसंह कȧ अनुकàपा के आधार पर चतुथ[ वग[
(समूह 'घ') मɅ ǓनयुिÈत के पæचात् तृतीय वग[ (समूह 'ग') मɅ पद पǐरवत[न के मामले मɅ ͪवभागीय
पǐरपğ संÉया-10167, Ǒदनांक-01.12.2015 कȧ कंͫडका-15(ग) को ¢ांत ͩकया जाता है ।
