माननीय राÏयपाल Ǒदनांक-21/03/2018 को अनुमǓत दे चुकȧं है, इसके ɮवारा सव[साधारण कȧ सूचना के ͧलए
Ĥकाͧशत ͩकया जाता है ।

झारखÖड राÏय मɅ ''झारखÖड राÏय खेल ͪवæवͪवɮयालय'' कȧ èथापना एवं समावेश के ͧलए तथा उसे एक Ǔनजी
ͪवæवͪवɮयालय कȧ िèथǓत Ĥदान करने हेतु एवं उससे संबंध अनुषांͬगक मामलɉ हेतु एक ͪवधेयक ।
जबͩक राँची मɅ ‘‘झारखÖड राÏय खेल Ĥो×साहन सͧमǓत ɮवारा ĤवǓत[त‘‘ झारखÖड राÏय खेल ͪवæवͪवɮयालय कȧ
èथापना एवं समावेश लाभकारक/युिÈतसंगत है।
एतɮ ɮवारा भारतीय गणराÏय के अड़सठवɅ वष[ मɅ, झारखÖड ͪवधान-सभा ɮवारा Ǔनàनͧलͨखत Ǿप मɅ
अͬधǓनयͧमत ͩकया जाता है:-

1.
संͯ¢Üत नाम, ͪवèतार एवं Ĥारंभ
1.1
यह अͬधǓनयम ‘‘झारखÖड राÏय खेल ͪवæवͪवɮयालय अͬधǓनयम, 2017” कहलायेगा।
1.2
इसका Ĥसार-ͪवèतार सàपूण[ झारखÖड राÏय मɅ होगा।
1.3
यह उस Ǔतͬथ से Ĥवृत होगा जैसा ͩक राÏय सरकार ɮवारा शासकȧय राजपğ मɅ अͬधसूचना जारȣ कर
Ǔनयत ͩकया जाय।
2.
पǐरभाषा
2.1
इस अͬधǓनयम मɅ जब तक ͩक संदभ[ से अÛयथा अपेͯ¢त न हो:-
2.2.1
‘‘शै¢ͨणक पǐरषɮ’का अथ[, ͪवæवͪवɮयालय के शै¢ͨणक पǐरषद से है, जो अͬधǓनयम ͩक
धारा 22 मɅ वͨण[त है;
2.2.2
‘‘वाͪष[क ĤǓतवेदन’का आशय, ͪवæवͪवɮयालय के वाͪष[क ĤǓतवेदन से है, जो अͬधǓनयम ͩक
धारा 36 मɅ वͨण[त है;
2.2.3
‘‘Ĥबंधन पǐरषɮ’का अथ[, ͪवæवͪवɮयालय के Ĥबंधन पǐरषद से है, जो अͬधǓनयम ͩक धारा 21
मɅ वͨण[त है;
2.2.4
‘‘पǐरसर’ का आशय, ͪवæवͪवɮयालय के ¢ेğफल से है, जहाँ यह अविèथत है
2.2.5
‘‘कुलाͬधपǓत’ का आशय, ͪवæवͪवɮयालय के कुलाͬधपǓत से है, जो अͬधǓनयम ͩक धारा 12 के
अधीन ǓनयुÈत हɉगे;
2.2.6
‘‘मुÉय ͪवƣ एवं लेखा पदाͬधकारȣ’का अथ[, ͪवæवͪवɮयालय के मुÉय ͪवƣ एवं लेखा
पदाͬधकारȣ से है, जो अͬधǓनयम ͩक धारा 16 के अधीन हɉगे;
2.2.7
‘‘परȣ¢ा Ǔनयंğक’का अथ[, ͪवæवͪवɮयालय के परȣ¢ा Ǔनयंğक से है, िजनकȧ ǓनयुिÈत
अͬधǓनयम ͩक धारा 17 के अधीन हुई हो;
2.2.8
‘‘अंगीभूत महाͪवɮयालय’से आशय, वैसे महाͪवɮयालय अथवा संèथान से है, जो
ͪवæवͪवɮयालय ɮवारा संपोͪषत हो ;
2.2.9
‘‘कम[चारȣ’से आशय, ͪवæवͪवɮयालय अथवा अंगीभूत महाͪवɮयालय ɮवारा ǓनयुÈत कम[चारȣ
से है, तथा इसमɅ ͧश¢क एवं अÛय कमȸ सिàमͧलत है;
2.2.10 ‘‘èथायी Ǔनͬध’से आशय, ͪवæवͪवɮयालय कȧ èथायी Ǔनͬध से है, िजसकȧ èथापना
अͬधǓनयम ͩक धारा 34 के अधीन हुई हो;
2.2.11 ‘‘संकाय’से आशय, समान अनुशासनɉ से शै¢ͨणक ͪवभाग के समूह से है;

2.2.12 ‘‘शुãक’से आशय, ͪवæवͪवɮयालय मɅ ͩकसी पाɫयĐम के अÚययन एवं Ĥसंगाधीन काय[ हेतु
ͪवɮयाͬथ[यɉ से लȣ गयी राͧश से है;
2.2.13 ‘‘सामाÛय Ǔनͬध’से आशय, ͪवæवͪवɮयालय के सामाÛय Ǔनͬध से है, िजसकȧ èथापना
अͬधǓनयम ͩक धारा 35 के अधीन हुई हो;
2.2.14 ‘‘शासी Ǔनकाय’का अथ[, ͪवæवͪवɮयालय के शासी Ǔनकाय से है, िजसका गठन अͬधǓनयम ͩक
धारा 20 कȧ अधीन हुआ हो;
2.2.15 ‘‘राçĚȣय मूãयांकन एवं Ĥमाणन’ से आशय, ͪवæवͪवɮयालय के राçĚȣय मूãयांकन एवं
Ĥमाणन पǐरषद, बɇगलूǾ से है, जो ͪवæवͪवɮयालय अनुदान आयोग कȧ एक èवाय×व संèथान है;
2.2.16 ‘‘ͪवǑहत’ का अथ[ अͬधǓनयम के अÛतग[त ͪवǑहत पǐरǓनयम और Ǔनयमावलȣ से है;
2.2.17 ‘कुल सͬचव’का अथ[, ͪवæवͪवɮयालय के कुल सͬचव से है तथा िजनकȧ ǓनयुिÈत अͬधǓनयम
कȧ धारा-15 के तहत हुई हो;
2.2.18 ‘Ǔनयामक Ǔनकाय’का आशय, भारत सरकार ɮवारा उÍच ͧश¢ा के शै¢ͨणक èतर के
सुǓनæचयन हेतु मानकɉ एवं शतɟ के Ǔनधा[रण के ͧलए èथाͪपत Ǔनकाय, यथा- ͪवæवͪवɮयालय
अनुदान आयोग, अͨखल भारतीय तकनीकȧ ͧश¢ा पǐरषɮ, भारतीय नͧसɍग पǐरषɮ, भारतीय
कृͪष अनुसंधान पǐरषɮ, वै£ाǓनक एवं औɮयोͬगक शोध पǐरषɮ आǑद तथा इसके अलावा
सरकार अथवा कोई वैसे Ǔनकाय, जो भारत सरकार अथवा कोई वैसा Ǔनकाय, जो भारत सरकार
या राÏय सरकार ɮवारा गǑठत ͩकया गया हो;
2.2.19 ‘Ǔनयमावलȣ’से आशय, इस अͬधǓनयम के अÛतग[त Ǔनͧम[त ͪवæवͪवɮयालय कȧ Ǔनयमावलȣ
से है;
2.2.20 ‘अनुसूची’का अथ[, इस अͬधǓनयम के तहत् संलÊन अनुसूची से है;
2.2.21 ͪवæवͪवɮयालय से संबंͬधत Ĥायोजक Ǔनकाय का अथ[ है -
सोसाईटȣज रिजèĚेशन एÈट, 1860 के अÛतग[त पंजीकृत झारखÖड राÏय खेल
संवɮ[धन साईटȣ।
2.2.22 ‘राÏय सरकार’ से आशय, झारखÖड कȧ राÏय सरकार से है; जो Ĥधान सͬचव / सͬचव,
पय[टन, कला संèकृǓत, खेलकूद एवं युवा काय[ ͪवभाग ɮवारा ĤǓतǓनͬध×व हɉ।
2.2.23 ‘‘पǐरǓनयम’ अÚयादेश एवं ͪवǓनयम से आशय, ͪवæवͪवɮयालय के Đमशः पǐरǓनयम,
अÚयादेश एवं ͪवǓनयम से है, जो इस अͬधǓनयम के अÛतग[त बनाई गई है;
2.2.24 ‘‘ͪवæवͪवɮयालय के ͪवɮयाथȸ’ से आशय, ऐसा åयिÈत अͧभĤेत है, जो ͪवæवͪवɮयालय ɮवारा
सàयक Ǿप से संिèथत ͩकसी उपाͬध, ͫडÜलोमा या अÛय ͪवɮया संबंधी उपाͬध के ͧलए, िजसमɅ

अनुसंधान उपाͬध सिàमͧलत है, पाɫयĐमानुसार अÚययन करने हेतु ͪवæवͪवɮयालय मɅ
नामांͩकत हो;
2.2.25 ‘‘ͧश¢क’ से आशय, Ĥोफेसर, एसोͧसएट Ĥोफेसर, सहायक Ĥोफेसर अथवा इस तरह के अÛय
åयिÈत, िजनकȧ ǓनयुिÈत ͪवæवͪवɮयालय या अंगीभूत महाͪवɮयालय या संèथा से है, ͧश¢ण मɅ
Ǔनदȶͧशत अथवा शोध काय[ संचालन हेतु उपाͬध, सिàमͧलत है, पाɫयĐमानुसार अÚययन करने
हेतु ͪवæवͪवɮयालय मɅ नामांͩकत हो; इसमɅ अंगीभूत महाͪवɮयालय संèथान जो ͪवæवͪवɮयालय
अनुदान आयोग के Ǔनयम/शतɟ के अधीन संचाͧलत हो के Ĥाचाय[ भी सिàमͧलत है।
2.2.26 ‘‘ͪवæवͪवɮयालय अनुदान आयोग’से आशय, ͪवæवͪवɮयालय अनुदान आयोग अͬधǓनयम,
1956 के अधीन èथाͪपत ͪवæवͪवɮयालय अनुदान आयोग से है;
2.2.27 ‘‘ͪवæवͪवɮयालय’का अथ[, इस अͬधǓनयम के अÛतग[त झारखÖड मɅ èथाͪपत झारखÖड राÏय
खेल ͪवæवͪवɮयालय से है;
2.2.28 ‘‘कुलपǓत’से आशय, ͪवæवͪवɮयालय के कुलपǓत से है तथा िजनकȧ ǓनयुिÈत इस अͬधǓनयम
कȧ धारा - 13 के तहत् हुई हो;
2.2.29 ‘‘ͪविजटर/‘‘अǓतͬथ/‘‘आगंतुक
से
आशय,
ͪवæवͪवɮयालय
के
‘‘ͪविजटर/‘‘अǓतͬथ/
‘‘आगंतुक’से है तथा जो इस अͬधǓनयम कȧ धारा - 10 मɅ वͨण[त है।
3.
ͪवæवͪवɮयालय कȧ èथापना -
3.1
ͪवæवͪवɮयालय कȧ èथापना ‘झारखÖड राÏय खेल ͪवæवͪवɮयालय’के नाम से होगी।
3.2
ͪवæवͪवɮयालय का मुÉयालय झारखÖड राÏय के अÛतग[त होगा तथा यह राँची मɅ अविèथत होगा।
3.3
राÏय सरकार ɮवारा Ĥाͬधकार पğ जारȣ ͩकए जाने के बाद हȣ खेल ͪवæवͪवɮयालय का संचालन आरंभ
ͩकया जायेगा।
3.4
इस अͬधǓनयम कȧ अनुसूची ‘ए मɅ सिàमͧलत Ĥावधानɉ को खेल ͪवæवͪवɮयालय Ǔनधा[ǐरत समयावͬध मɅ
पूरा करेगा।
3.5
ͪवæवͪवɮयालय के शासी Ǔनकाय, Ĥबंधन सͧमǓत, शै¢ͨणक पǐरषɮ, कुलाͬधपǓत, कुलपǓत, कुल सͬचव,
ͧश¢क, मुÉय ͪवƣ एवं लेखा पदाͬधकारȣ एवं अÛय अͬधकारȣ या सदèय या Ĥाͬधकार एतɮ
ͪवæवͪवɮयालय के नाम से गǑठत Ǔनकाय बनाएगे; जब तक वे इस पद पर हɇ अथवा उनकȧ सदèयता बनी
रहेगी।
3.6
खेल ͪवæवͪवɮयालय एक असàबɮध ͪवæवͪवɮयालय के Ǿप मɅ काय[ करेगा तथा जो ͪवɮयाͬथ[यɉ को
उपाͬध, ͫडÜलोमा अथवा Ĥमाण-पğ Ĥदान करने हेतु ͩकसी अÛय महाͪवɮयालय या संèथान को संबɮध
नहȣं कर सकेगा।

3.7
‘‘झारखÖड राÏय खेल ͪवæवͪवɮयालय’के नाम से एक Ǔनकाय होगा और इस अͬधǓनयम के Ĥावधानɉ
के अनुǾप उसके पास सतत् उƣराͬधकार और सामाÛय ĤǓत£ा Ĥमाणन तथा सàपͪƣ Ēहण व उस पर
आͬधप×य रखने तथा अनुबंध/संͪवदा पर देने अथवा कͬथत नाम से वाद चलाने या वाद करने का
अͬधकार होगा।
3.8
‘‘ͪवæवͪवɮयालय’राÏय सरकार अथवा केÛġ सरकार से ͩकसी भी Ĥकार के अनुदान अथवा ͪवƣीय
सहायता ĤाÜत करने का हकदार नहȣं होगा। बशतȶ कȧ राÏय सरकार अथवा केÛġ सरकार अनुदान या
अÛय तरȣके से इन कायɟ के ͧलए दे सकती है ;
3.8.1
शोध, ͪवकास और अÛय गǓतͪवͬधयɉ के ͧलए, जैसे राÏय सरकार के अÛय संगठनɉ को ͪवƣीय
सहायता उपलÞध करायी जाती है अथवा
3.8.2
ͪवͧशçट शोध अथवा काय[Đम आधाǐरत कोई गǓतͪवͬध के ͧलए ͪवƣीय सहायता दे सकती है;
4.
ͪवæवͪवɮयालय कȧ सàपͪƣ एवं इसके अनुĤयोग:-
4.1
ͪवæवͪवɮयालय के ͧलए अͬधĒǑहत भूͧम, भवन और अÛय सàपǓतयाँ ͩकसी अÛय उɮदेæय के ͧलए
इèतेमाल नहȣं होगी ͧसवा िजस उɮदेæय के ͧलए वे अͬधĒǑहत कȧ गयी है।
4.2
ͪवæवͪवɮयालय कȧ चल अथवा अचल सàपǓतयɉ का Ĥबंधन शासी Ǔनकाय ɮवारा ͪवǓनयमɉ मɅ Ĥदƣ रȣǓत
के अनुǾप ͩकया जायेगा, जो ͪवæवͪवɮयालय कȧ èथापना के उɮदेæय कȧ पूǓत[ के ͧलए ͩकया जायेगा।
5.
ͪवæवͪवɮयालय के Ǔनबंधन/अवरोध और बाÚयताएँ:-
5.1
ͪवæवͪवɮयालय के खेल मɅ åयवसाǓयक पाɫयĐम, यथा खेल औषͬध, योगा आǑद के ͧलए ͧश¢ण-शुãक
का Ǔनधा[रण ͪवæवͪवɮयालय के ɮवारा राÏय सरकार ɮवारा अͬधसूͬचत समय समय पर Ǔनयामक
Ǔनकाय, के पय[वे¢ण मɅ ͩकया जाएगा।
5.2
ͪवæवͪवɮयालय मɅ Ĥवेश-नामांकन पूरȣ तरह योÊयता के आधार पर होगा। ͪवæवͪवɮयालय मɅ नामांकन
कȧ योÊयता का Ǔनधा[रण ĤाÜतांक या अह[ता परȣ¢ा मɅ ĤाÜत Ēेड और पाɫयेतर और अǓतǐरÈत पाɫयचया[
ͩĐयाकलापɉ मɅ उपलिÞधयɉ के आधार पर या समान पाɫयĐम संचाͧलत करने वाले ͪवæवͪवɮयालयɉ के
संगठन ɮवारा या राÏय के ͩकसी एजेÛसी ɮवारा संचाͧलत ͩकसी Ĥवेश परȣ¢ा मɅ अͧभĤाÜत अंकɉ या Ēेड
के आधार पर अवधाǐरत कȧ जायेगी।
5.3
ͪवæवͪवɮयालय के पूरȣ छाğ ¢मता का कम से कम पाँच ĤǓतशत छाğɉ को मेधा छाğवृͪƣ Ĥदान करेगी।
5.4
ͪवæवͪवɮयालय, ͪवɮयाͬथ[यɉ कȧ कुल संÉयाओं मɅ से झारखÖड राÏय के मूल Ǔनवाͧसयɉ के ͧलए 50
ĤǓतशत का आर¢ण का Ĥावधान अǓनवाय[ Ǿप से करेगी।
5.5
ͪवæवͪवɮयालय को ͪवæवͪवɮयालय के ͧश¢केƣर पदɉ के कम से कम पचास ĤǓतशत ͧश¢केƣर पदɉ को
झारखÖड राÏय के मूल Ǔनवासी के ͧलए आरͯ¢त करने का Ĥावधान होगा। सीटɉ के आर¢ण का Ǔनयमन
झारखण्ड सरकार के Ǔनयम और समय-समय पर जारȣ आदेशɉ के ɮवारा ͩकया जाएगा।

5.6
ͪवæवͪवɮयालय के अकादͧमक èतर को बनाए रखने के ͧलए यथेçट/पया[Üत संÉया मɅ ͧश¢कɉ एवं
अͬधकाǐरयɉ कȧ ǓनयुिÈत करनी होगी और यह सुǓनिæचत करना होगा ͩक उन ͧश¢कɉ या अͬधकाǐरयɉ
कȧ योÊयता Ĥासंͬगक Ǔनयामक Ǔनकाय ɮवारा Ǔनधा[ǐरत मानक से Ǔनàन न हो।
5.7
ͪवæवͪवɮयालय को ͪवæवͪवɮयालय से जुड़ी तमाम सूचनाएँ ͪवɮयाͬथ[यɉ एवं अÛय èटेक होãडर के Ǒहत मɅ
साव[जǓनक करनी होगी, जैसे ͩक संचाͧलत पाɫयĐम, अलग-अलग कोǑट (Įेणी), के तहत् सीटɅ, शुल्क
एवं अÛय पǐरåयय, Ĥदƣ सहूͧलयतɅ एवं सुख सुͪवधाएँ,उपलÞध संकाय/ĤाÚयापक वग[ एवं अÛय
Ĥासंͬगक सूचनाएँ।
5.8
पǐरǓनयमɉ मɅ वͨण[त रȣǓत के अनुǾप ͪवæवͪवɮयालय Ĥ×येक अकादͧमक वष[ मɅ उपाͬध, ͫडÜलोमा Ĥदान
करने एवं अÛय उɮदेæय से दȣ¢ांत समारोह आयोिजत कर सकेगा। ͪवæवͪवɮयालय का दȣ¢ांत समारोह
Ĥ×येक शै¢ͨणक वष[ मɅ उपाͬधयɉ/ͫडÜलोमा Ĥदान करने या ͩकसी भी अÛय Ĥयोजन के ͧलए पǐरǓनयमɉ
ɮवारा यथाͪवǑहत रȣǓत से आयोिजत ͩकया जायेगा।
5.9
ͪवæवͪवɮयालय को èथापना के Ĥदƣ पाँच वषɟ के भीतर राçĚȣय मूãयांकन एवं Ĥ×यायन पǐरषɮ (NAAC)
से Ĥ×यायन ĤाÜत करना होगा और भारत सरकार कȧ अÛय Ǔनयामक संèथाएँ, जो ͪवæवͪवɮयालय के
ɮवारा संचाͧलत पाɫयĐमɉ से संबंध हɇ, के ɮवारा Ĥदƣ Ēेड कȧ सूचना राÏय सरकार को देनी होगी।
ͪवæवͪवɮयालय को समय-समय पर ऐसे Ĥ×यायन का नवीकरण कराना होगा।
5.10
इस अͬधǓनयम मɅ वͨण[त कोई भी अंश जबतक अÛयथा/आवæयक उिãलͨखत ना हो, ͪवæवͪवɮयालय
ͧसɬयूल - A मɅ उिãलͨखत शतɟ को मानने के ͧलए बाÚय होगी तथा भारत सरकार या राÏय सरकार के
Ǔनयामक संèथा ɮवारा èथाͪपत सभी Ǔनयम, पǐरǓनयम तरȣके को मानेगी एवं ऐसी अÛय संèथा को
अपने कŧतåयɉ के Ǔनव[éन करने के ͧलए आवæयक सभी सुͪवधा/सहयोग Ĥदान करेगी।
6.
ͪवæवͪवɮयालय के उɮदेæय - ͪवæवͪवɮयालय के Ǔनàन उɮदेæय है -
6.1
शारȣǐरक ͧश¢ा एवं खेल ͪव£ान के £ान को ͪवकͧसत करना, शारȣǐरक ͧश¢ा एवं खेल ͪव£ान के
ͪवͧभÛन ¢ेğɉ मɅ ͪवशेष Ǿप से ͪवकͧसत शै¢ͨणक Ĥͧश¢ण कȧ åयवèथा करना तथा खेल Ĥͧश¢ण कȧ
उÛनत तकनीकȧ को भी Ĥदान करना तथा िजसमɅ सैɮधांǓतक जानकारȣ, åयवहाǐरक Ĥͧश¢ण भी
उपलÞध करवाना तथा िजससे ͪवशेष£ता का सृजन हो, शारȣǐरक ͧश¢ण मɅ संवɮ[धन Ĥदान करना एवं
खेल के Ĥदश[न को बेहतर करने के ͧलए Ĥͧश¢ण काय[Đमɉ कȧ åयवèथा करना।
6.2
शारȣǐरक ͧश¢ा एवं खेल ͪव£ान, खेल तकनीकȧ के ¢ेğ मɅ हर èतर पर £ान, कौशल और ¢मता कȧ
अͧभवृɮͬध करना तथा सभी तरह के खेल ͪवधाओं, गेàस मɅ उÍच èतरȣय Ĥͧश¢ण Ĥदान करना।
6.3
शारȣǐरक ͧश¢ा एवं खेल ͪव£ान के ¢ेğ मɅ उÍच द¢ता ĤाÜत नायकɉ को तैयार करना खेल तकनीकȧ तथा
सभी खेलɉ मɅ उÍच èतरȣय Ĥदश[न Ĥͧश¢ण कȧ åयवèथा करना।
6.4
शारȣǐरक ͧश¢ण एवं Đȧड़ा ͪव£ान, खेल तकनीकȧ एवं सभी खेलɉ मɅ उÍच उपलिÞध परक Ĥͧश¢ण देने के
ͧलए अĒणी İोत केÛġ के Ǿप मɅ èथाͪपत करना।

6.5
शारȣǐरक ͧश¢ा, खेल ͪव£ान, खेल तकनीकȧ एवं उÍच Ĥदश[न Ĥͧश¢ण सभी खेलɉ के ͧलये अÛतरा[çĚȣय
संयोजन/सहयोग Ĥदान करना।
6.6
शारȣǐरक ͧश¢ण, खेल ͪव£ान, तकनीकȧ एवं उÍच èतरȣय Ĥदश[न Ĥͧश¢ण सभी खेलɉ मɅ ͧश¢ण,
Ĥͧश¢ण एवं अनुसंधान के ͧलये ͪवɮयालयɉ/महाͪवɮयालयɉ, खेल एवं मनोरंजन संèथाओं, खेल
संèथानɉ, शारȣǐरक ͧश¢ा एवं खेल ͪव£ान के शोध एवं Ĥͧश¢ण संèथाओं एवं अÛतरा[çĚȣय संघɉ के साथ
घǓनçठ संबंध èथाͪपत करना।
7.
ͪवæवͪवɮयालय ͧलंग, धम[, वग[, रंग, पंथ अथवा मत से परे सबके ͧलए खुला होगा -
ͩकसी भी åयिÈत के साथ ͪवæवͪवɮयालय के ͩकसी काया[लय अथवा उसके ͩकसी अÛय Ĥाͬधकार कȧ सदèयता से
अथवा ͩकसी ͫडĒी, ͫडÜलोमा अथवा अÛय अकादͧमक वैͧशçɪय पाɫयĐम मɅ नामांकन से ͧलंग, मत, वग[, जाǓत,
जÛम के èथान और धाͧम[क ͪवæवास अथवा राजनीǓतक या अÛय मत के आधार पर प¢पात या भेदभाव नहȣं
ͩकया जाएगा।
8.
ͪवæवͪवɮयालय के काय[ एवं शिÈतयाँ -
8.1
ͪवæवͪवɮयालय का Ĥशासन एवं Ĥबंधन, इसके अंगीभूत महाͪवɮयालय कȧ èथापना, Ĥशासन एवं Ĥबंधन
तथा शोध, ͧश¢ण, Ĥͧश¢ण केÛġɉ का ͪवèतार एवं सतत् ͧश¢ा, दूरèथ अͬधगम एवं ई-लǓनɍग के ͪवèतार
एवं पहुँच को, झारखÖड राÏय मɅ अविèथत इसके पǐरसर मɅ संचालन व Ĥबंधन करना;
8.2
खेल ͪव£ान एवं ͧश¢ा, Ĥबंधन एवं खेल ͪवषय से संबंͬधत अÛय ¢ेğɉ मɅ शोध, उÍच ͧश¢ा, åयवसाǓयक
ͧश¢ा, ͧश¢ण - Ĥͧश¢ण, सतत् ͧश¢ा, दूरèथ अͬधगम एवं ई-लǓनɍग के संसाधनɉ को उपलÞध करना;
8.3
शैͯ¢क Ĥौɮयोͬगकȧ, ͧश¢ण एवं अͬधगम ĤͩĐया मɅ Ĥेरणादायक Ĥयोग, राçĚȣय एवं अÛतरा[çĚȣय खेल
संèथाओं के साथ सहयोग एवं वैसी संèथाओं को संयुÈत काय[Đमɉ का Ĥèताव देना िजससे खेल ͧश¢ा
Ĥदान करने एवं अÛतरा[çĚȣय मानकɉ को ͪवकͧसत एवं ĤाÜत ͩकया जा सके;
8.4
खेल ͧश¢ा Ĥदान करने मɅ लचीलापन के ͧलए Ǔनधा[ǐरत पाɫयĐम, पाɫयचया[ एवं ͧश¢ा Ĥणालȣ मɅ
इलेÈĚोǓनक अͬधगम ͪवǑहत करना;
8.5
ͩकसी åयिÈत को खेल ͪवæवͪवɮयालय ɮवारा तय शतɟ के साथ उपाͬध, ͫडÜलोमा या Ĥमाण - पğ और
अÛय शै¢ͨणक ͪवͧशçटता Ĥदान करने हेतु परȣ¢ा/जाँच का आयोजन करना अथवा ͪवǓनयमɉ मɅ वͨण[त
तरȣके से उस उपाͬध, ͫडÜलोमा या Ĥमाण - पğ और अÛय शै¢ͨणक ͪवͧशçटता या नाम को वापस लेना;
8.6
फेलोͧशप (ͧश¢ावृǓत), छाğवृǓत, पदक और पुरèकार Ǔनधा[ǐरत एवं Ĥदान करना;
8.7
पǐरǓनयम मɅ वͨण[त तरȣके के अनुǾप मानद उपाͬध या अÛय ͪवͧशçटता Ĥदान करना;

सàमेलनɉ, काय[शालाओं एवं संगोिçठयɉ का आयोजन करना;

खेल £ान संसाधन केÛġ कȧ èथापना करना;
8.11
खेल Ĥौɮयोͬगकȧ, ͧश¢ा Ĥबंधन एवं खेल से संबंध अÛय ¢ेğɉ मɅ अनुसंधान तथा शैͯ¢क काय[Đमɉ का
Ĥ्रायोजन एवं दाǓय×व वहन करना;
8.12
समान उɮदेæयɉ के ͩकसी शैͯ¢क संèथान के साथ सहयोग व सàबɮधता;
8.13
खेल ͪवæवͪवɮयालय के उɮदेæयɉ कȧ ĤािÜत के ͧलए आभासी (वचु[अल) पǐरसर समेत पǐरसरɉ कȧ
èथापना;
8.14
शोध काय[ आरàभ करना तथा ऐसे शोध के ͧलए स¢म Ĥाͬधकारɉ से पेटेÛट, योजना अͬधकारɉ एवं ऐसे
समान अͬधकारɉ कȧ ĤकृǓत के पंजीकरण ĤाÜत करना;
8.15
ͪवæवͪवɮयालय के आंͧशक अथवा पूण[ उɮदेæयɉ कȧ ĤािÜत हेतु ͪवæव के ͩकसी भी Ǒहèसे के शैͯ¢क एवं
अÛय संèथानɉ, ͪवæवͪवɮयालयɉ के साथ ͪवɮयाͬथयɉ, शोधाͬथ[यɉ, ͧश¢कɉ, कम[चाǐरयɉ का अदान-Ĥदान
के ɮवारा अनुकूल एवं èवीकाय[ तरȣके से एवं सहयोग सामंजèय èथाͪपत करना;

अनुसंधान, Ĥͧश¢ण, परामश[ तथा इस Ĥकार कȧ अÛय सेवाएँ देना, जो ͪवæवͪवɮयालय के Ĥयोजन के
ͧलए आवæयक हो;

ͧश¢कɉ, शोधाͬथ[यɉ, Ĥशासकɉ एवं खेल ͪवशेष£ɉ एवं खेल Ĥबंधन Ĥोɮयौͬगकȧ तथा अÛय संबंɮध ¢ेğɉ के
ͪवशोष£ɉ के बीच ͪवæवͪवɮयालय के लêयɉ कȧ ĤािÜत के ͧलए संबंध बनाना एवं ͪवकͧसत करना;
8.18
मǑहलाओं एवं अÛय वंͬचत ͪवɮयाͬथ[यɉ के ͧलए ͪवæवͪवɮयालय ɮवारा यथासंभव वांछनीय ͪवशेष
åयवèथा करना;
8.19
खेल ͪवæवͪवɮयालय के åयय का Ǔनयमन, ͪवƣ का Ĥबंधन एवं लेखा का रख-रखाव;

ͪवæवͪवɮयालय के उɮदेæयɉ एवं लêय ĤािÜत के ͧलए åयवसाय, उɮयोग, समाज के अÛय वगȾ, राçĚȣय

भवनɉ, èटेͫडयमɉ का Ǔनमा[ण, Ĥबंधन तथा रख-रखाव करना;
8.23
खेल ͪवæवͪवɮयालय के अͬधवासी ͪवɮयाͬथ[यɉ, ͧश¢कɉ तथा कम[चाǐरयɉ मɅ अनुशासन बनाये रखना और
उनके èवाèØय, सामाÛय कãयाण, सामािजक एवं सांèकृǓतक गǓतͪवͬधयɉ के Ĥो×साहन, संवɮ[धन हेतु
आवास का पय[वे¢ण एवं Ǔनयंğण करना;
8.24
पǐरǓनयम ɮवारा Ǔनधा[ǐरत फȧस एवं अÛय शुãक Ǔनधा[ǐरत करना तथा वसूलȣ/ĤािÜत करना;
8.25
फेलोͧशप (शोधवृǓत), छाğवृǓत, पुरèकार, पदक एवं अÛय पुरèकारɉ कȧ संèथापना एवं Ĥदान करना;
8.26
ͪवæवͪवɮयालय, आवæयकता या उɮदेæय पूǓत[ हेतु ͩकसी भूͧम या भवन को खरȣदने, पɪटे पर लेने या
उपहार व वसीयत या अÛय तरȣके से उपयोग हेतु ĤाÜत कर सकेगा और यह उन Ǔनयमɉ व शतɟ के Ǿप मɅ
èवीकाय[ हो सकता है, िजसे ͩकसी भवन को बनाने या काय[ करने, उसमɅ पǐरवत[न करने और रख-रखाव
हेतु उͬचत समझे;
8.27
ͪवæवͪवɮयालय के Ǒहत, उɮदेæयɉ कȧ पूǓत[ हेतु माÛय तरȣके से ͪवæवͪवɮयालय कȧ चल या अचल सàपͪƣ
या उसके ͩकसी अंश को झारखÖड राÏय खेल Ĥो×साहन सͧमǓत (J.S.S.P.S) के परामश[ से बेचना,
ͪवǓनमय करना, पɪटा या अÛय तरȣके से Ĥबंͬधत करना;
8.28
ͪवæवͪवɮयालय के सभी खचɟ को पूरा करने के ͧलए ͪवæवͪवɮयालय कȧ Ǔनͬध को संवɮ[ͬधत करना,
अनुबंध (बोÛड) पर उधार लेना, बंधक, वचनपğ नोट या अÛय दाǓय×वɉ या ĤǓतभूǓतयɉ कȧ वृɮͬध करना
या सàपूण[ अथवा ͪवæवͪवɮयालय कȧ ͩकसी संपͪƣ और पǐरसàपͪƣ अथवा ǒबना ͩकसी ĤǓतभूǓत और
माÛय Ǔनयमɉ और शतɟ के अनुǾप åयविèथत एवं संवɮ[ͬधत करना;
9.
सàबɮधता के Ǔनषेधः-
9.1
ͪवæवͪवɮयालय ͩकसी महाͪवɮयालय या संèथा को सàबɮधता लेने के ͪवशेषाͬधकार को èवीकार नहȣं
करेगा।
9.2
ͪवæवͪवɮयालय अनुदान आयोग अथवा सरकार ɮवारा èथाͪपत ऐसे अÛय Ǔनयामक Ǔनकायɉ अथवा
केÛġ या राÏय सरकार, जैसा भी हो, के पूव[ èवीकृǓत के पæचात् ͪवæवͪवɮयालय अपने पǐरसर के अलावा
कोई दूरवतȸ पǐरसर, अÚययन केÛġ एवं परȣ¢ा केÛġ झारखÖड राÏय के अंदर या बाहर शुǾ कर सकेगा।
9.3
दूरèथ Ĥणालȣ से पाɫयĐमɉ कȧ शुǾआत ͪवæवͪवɮयालय अनुदान आयोग अथवा सरकार ɮवारा èथाͪपत
ऐसी Ǔनयामक संèथा कȧ पूव[ èवीकृǓत के उपरांत हȣ कȧ जाएगी।

10.
आगंतुक (ͪविजटर):-
10.1
झारखÖड के राÏयपाल ͪवæवͪवɮयालय के ͪविजटर (आगंतुक) हɉगे।
10.2
आगंतुक (ͪविजटर) जब उपिèथत रहɅगे, तो ͫडĒी (उपाͬध), ͫडÜलोमा, चाट[र ओहदा (पदनाम) और Ĥमाण
पğ Ĥदान करने के ͧलए दȣ¢ांत समारोह कȧ अÚय¢ता करɅगे।
10.3
आगंतुक को ͪवæवͪवɮयालय अथवा ͪवæवͪवɮयालय ɮवारा सàपोͪषत ͩकसी संèथान के ͧश¢ा के èतर,
अनुशासन, ͧशçटाचार और समुͬचत ͩĐयाशीलता को बनाये रखने हेतु ħमण करने का अͬधकार होगा।

ͪवæवͪवɮयालय के अͬधकारȣ:-
ͪवæवͪवɮयालय के Ǔनàनͧलͨखत अͬधकारȣ हɉगेः-

12.
कुलाͬधपǓत:-
12.1
झारखÖड राÏय खेल Ĥो×साहन सͧमǓत (J.S.S.P.S) के शासी Ǔनकाय के अÚय¢ खेल ͪवæवͪवɮयालय के
पदेन कुलाͬधपǓत हɉगे।
12.2
कुलाͬधपǓत पदेन Ǿप से ͪवæवͪवɮयालय के Ĥधान हɉगे।
12.3
कुलाͬधपǓत शासी Ǔनकाय कȧ बैठकɉ कȧ अÚय¢ता करɅगे और जब आगंतुक (ͪविजटर) मौजूद नहȣं रहɅगे
तब उपाͬध (ͫडĒी), ͫडÜलोमा या अÛय शै¢ͨणक ͪवͧशçटता Ĥदान करने हेतु दȣ¢ांत समारोह कȧ
अÚय¢ता करɅगे।
12.4
कुलाͬधपǓत अपने हाथ से ͧलͨखत एवं Ĥायोजक Ǔनकाय के Ĥमुख को संबोͬधत करते हुए अपने पद से
इèतीफा दे सकते है।
12.5
कुलाͬधपǓत को Ǔनàनͧलͨखत अͬधकार हɉगे, यथाः-
(a)
ͩकसी भी जानकारȣ या अͧभलेख कȧ माँग करनाय
(b)
कुलपǓत कȧ ǓनयुिÈत करनाय
(c)
इस अͬधǓनयम के Ĥावधानɉ के अनुǾप कुलपǓत को काय[मुÈत करना और
(d)
इस अͬधǓनयम या पǐरǓनयमɉ के ɮवारा Ĥदƣ अÛय शिÈतयɉ का उपयोग करना

13.
कुलपǓत:-
13.1
कुलाͬधपǓत, कुलपǓत कȧ ǓनयुिÈत, ͪवæवͪवɮयालय अनुदान आयोग ɮवारा Ǔनधा[ǐरत योÊयताओं के
अनुǾप एवं Ĥायोजक Ǔनकाय के सलाह पर करɅगे और ये पाँच साल कȧ अवͬध के ͧलए अपने पद पर बने
रहɅगे, परÛतु 70 वष[ कȧ आयु पूरȣ करने के बाद अपने पद से काया[वͬध के दौरान या ͪवèताǐरत काय[काल
से सेवाǓनवृत हो जायɅगे।
परÛतु कुलपǓत Ĥथम पाँच वष[ कȧ अवͬध पूरȣ होने के पæचात् भी अगले पाँच वष[ के एक और
काय[काल के ͧलए पुनǓन[युिÈत के पाğ हो सकते है।
13.2
कुलपǓत ͪवæवͪवɮयालय के Ĥधान काय[पालक और शै¢ͨणक अͬधकारȣ हɉगे और ͪवæवͪवɮयालय के
मामलɉ मɅ सामाÛय अधी¢ण और Ǔनयंğण करɅगे तथा ͪवæवͪवɮयालय के ͪवͧभÛन Ĥाͬधकारɉ ɮवारा ͧलए
गए Ǔनण[यɉ को काया[िÛवत करɅगे।
13.3
आगंतुक (ͪविजटर) और कुलाͬधपǓत कȧ अनुपिèथǓत मɅ ͪवæवͪवɮयालय के दȣ¢ांत समारोह कȧ
अÚय¢ता करɅगे।
13.4
कुलपǓत यǑद इस Ǔनçकष[ पर पहुँचते हɇ ͩक ͩकसी मामले पर त×काल कार[वाई आवæयक है; तो वे
ͪवæवͪवɮयालय के ͩकसी Ĥाͬधकार का इस अͬधǓनयम के तहत Ĥदƣ शिÈतयɉ का इèतेमाल कर सकते हɇ
और उस Ĥाͬधकार को संबɮध मामले मɅ उनके ɮवारा कृत कार[वाई कȧ जानकारȣ दे सकते हɇ।
बशतȶ ͩक ͪवæवͪवɮयालय का वह Ĥाͬधकार या ͪवæवͪवɮयालय मɅ सेवारत कोई अÛय åयिÈत,
जो कुलपǓत ɮवारा कृत कार[वाई से असंतुçट हो, तो वे इस उपधारा के तहत Ǔनण[य के संĤेͪषत होने कȧ
Ǔतͬथ के एक माह के भीतर कुलाͬधपǓत के सम¢ अपील कर सकता है। कुलाͬधपǓत, कुलपǓत ɮवारा कȧ
गयी कार[वाई को सàपुçट, संशोͬधत या पǐरवǓत[त कर सकते है।
13.5
कुलपǓत अͬधǓनयम के तहत् ͪवǓनǑद[çट अÛय शिÈतयɉ और इस संबंɮध अÛय काय[ Ǔनधा[ǐरत दायरे मɅ
कर सकते हɇ।
14.
कुलपǓत कȧ पदÍयुǓत:-
14.1
कुलाͬधपǓत को यǑद ͩकसी समय ͩकसी जाँच के पæचात आवæयक लगे या Ĥतीत हो ͩक कुलपǓतः-
(a)
इस अͬधǓनयम, पǐरǓनयम, अÚयादेश के तहत Ĥदत कत[åयɉ के Ǔनव[हन मɅ ͪवफल रहे हɉ, अथवा
(b)
ͪवæवͪवɮयालय के Ǒहतो के ͪवपरȣत पूवा[Ēह से Ĥेǐरत होकर काय[ ͩकये हो, या
(c)
ͪवæवͪवɮयालय के मामलɉ को सुलझाने मɅ अ¢म हɉ, तो कुलाͬधपǓत इस तØय के बावजूद ͩक
कुलपǓत का काया[लय पूरा नहȣं हुआ है, ͧलͨखत कारण बताते हुए आदेश मɅ Ǔनधा[ǐरत Ǔतͬथ से
पद से इèतीफा देने के ͧलए ͧलͨखत आदेश दे सकते है।
14.2
कुलपǓत को उपधारा (1) के तहत ͪवशेष आधार पर कार[वाई के ͩकसी Ĥèताव कȧ ǒबना सूचना Ǒदए और
ǒबना कारण पृÍछा का अवसर Ǒदये, कोई आदेश पाǐरत नहȣं ͩकया जाएगा।

15.
कुलसͬचव:-
15.1
कुल सͬचव Ĥायोजक Ǔनकाय के अÚय¢ ɮवारा पǐरǓनयम मɅ ǓनǑद[çट Ĥावधानɉ के अनुसार ǓनयुÈत ͩकये
जाएगɅ। कुल सͬचव ͪवæवͪवɮयालय अनुदान आयोग ɮवारा Ǔनधा[ǐरत योÊयता धारक हɉगे।
15.2
कुल सͬचव को ͪवæवͪवɮयालय कȧ ओर से अͧभलेखɉ, दèतावेजɉ को अͧभĤमाͨणत करने, Ĥमाण-पğɉ पर
हèता¢र करने तथा एकरारनामा करने कȧ शिÈत होगी तथा वे ऐसी अÛय शिÈतयɉ का Ĥयोग एवं कायɟ
को पूरा करɅगे जो उनके ͧलए ǓनǑद[çट ͩकया गया हो।
15.3
कुल सͬचव, काय[कारȣ पǐरषɮ एवं अकादͧमक पǐरषɮ के पदेन सदèय सͬचव हɉगे लेͩकन उÛहɅ मत देने
का अͬधकार नहȣं होगा।
16.
मुÉय ͪवƣ तथा लेखा अͬधकारȣः-
16.1
Ĥायोजक Ǔनकाय के अÚय¢ ɮवारा मुख्य ͪवƣ तथा लेखा पदाͬधकारȣ कȧ ǓनयुिÈत इस Ĥकार कȧ जाएगी,
जैसा पǐरǓनयम मɅ ǓनǑद[çट हो।
16.2
मुÉय ͪवƣ एवं लेखा पदाͬधकारȣ ऐसी शिÈतयɉ को Ĥयोग तथा दाǓय×वɉ का Ǔनव[हन कर सकɅ गे जैसा ͩक
पǐरǓनयम मɅ ǓनǑद[çट है।
17.
परȣ¢ा Ǔनयंğकः-
17.1
परȣ¢ा Ǔनयंğक ͪवæवͪवɮयालय का पूण[काͧलक पदाͬधकारȣ होगा तथा पǐरǓनयम के अनुǾप Ĥायोजक
Ǔनकाय के अÚय¢ ɮवारा ǓनयुÈत ͩकया जाएगा।
17.1.1 परȣ¢ा Ǔनयंğक के काय[ हɉगेः-
(a)
अनुशाͧसत एवं कुशल तरȣके से परȣ¢ा संचाͧलत करना
(b)
सÉत गोपनीयता से Ĥæन-पğɉ का चयन एवं संकलन कȧ åयवèथा करना
(c)
परȣ¢ाफल हेतु Ǔनधा[ǐरत समय साǐरणी के अंतग[त उƣर पुिèतकाओं के मूãयांकन कȧ åयवèथा करना।
(d)
परȣ¢ा-Ĥणालȣ कȧ Ǔनçप¢ता और ͪवषयǓनçठा को उÛनत बनाने तथा ͪवɮयाͬथ[यɉ कȧ योÊयता के अनुǾप
आकलन कȧ Ǻिçट से बेहतर साधन अपनाने के ͧलए सतत् समी¢ा करना।
(e)
कुलपǓत के ɮवारा समय-समय पर सɋपे गए उन सारे दाǓय×वɉ का Ǔनव[हन करना जो परȣ¢ा से संबंͬधत
हɉ।
18.
अÛय अͬधकारȣ:-
ͪवæवͪवɮयालय के अÛय अͬधकाǐरयɉ कȧ ǓनयुिÈत उनके अͬधकार कत[åयɉ का Ǔनधा[रण वैसा होगा, जैसा ͩक
ǓनǑद[çट ͩकया गया हो।

20.4
बैठक का कोरम चार होगा;
बशतȶ Ĥधान सͬचव/सͬचव, पय[टन, कला संèकृǓत, खेलकूद एवं युवाकाय[ ͪवभाग, झारखÖड सरकार या उनकȧ
अनुपिèथǓत मɅ Ǔनदेशक, खेल, खेल Ǔनदेशालय Ĥ×येक बैठक मɅ उपिèथत हो, िजसमɅ कȧ खेल ͪवæवͪवɮयालय कȧ सरकारȣ
नीǓतयɉ या Ǔनदेशɉ से संबंͬधत Ǔनण[य ͧलये जाना हो।
21.
Ĥबंध सͧमǓतः-
21.1
Ĥबंधन सͧमǓत Ǔनàनͧलͨखत सदèयɉ के योग से गǑठत होगा, यथाः
21.1.1 काय[कारȣ पǐरषद के अÚय¢ (अथा[त् सरकार के Ĥधान सͬचव/सͬचव, पय[टन, कला संèकृǓत, खेलकूद
एवं युवाकाय[ ͪवभाग, झारखÖड)

22.1
अकादͧमक पǐरषɮ मɅ कुलपǓत तथा वैसे सदèय हɉगे, जैसा पǐरǓनयम मɅ ǓनǑद[çट है।

अकादͧमक पǐरषɮ के अÚय¢ कुलपǓत हɉगे।
22.3
अकादͧमक पǐरषɮ ͪवæवͪवɮयालय कȧ Ĥधान Ǔनकाय होगी और इस अͬधǓनयम, पǐरǓनयमɉ, अÚयादेशɉ
के Ĥावधानɉ के अधीन या ͪवæवͪवɮयालय कȧ अकादͧमक नीǓतयɉ का समाÛय पय[वे¢ण तथा समÛवय
करेगी।
22.4
अकादͧमक पǐरषɮ कȧ बैठक का कोरम अͬधǓनयम मɅ उãलेͨखत पǐरǓनयम के अनुǾप होगा।
23.
ͪवƣ सͧमǓत:
23.1
ͪवƣ सͧमǓत ͪवçवͪवɮयालय कȧ मुÉय ͪवƣीय Ǔनकाय होगी, जो ͪवƣ संबंधी मामलɉ कȧ देख-रेख करेगी।
23.2
ͪवƣ सͧमǓत का संͪवधान, शिÈतयाँ और काय[ अͬधǓनयम के Ĥावधानɉ के अनुǾप हɉगे।
24.
अÛय Ĥाͬधकार
ͪवæवͪवɮयालय के अÛय Ĥाͬधकारɉ का गठन, शिÈतयाँ तथा काय[ Ĥावधान के अनुǾप होगा।
25.
ͩकसी Ĥाͬधकार अथवा Ǔनकाय कȧ सदèयता के ͧलए अयोÊयताः-
वह åयिÈत ͪवæवͪवɮयालय के ͩकसी Ĥाͬधकार या Ǔनकाय कȧ सदèयता के अयोÊय होगा, जो:-
25.1
अèवèथ मानस का है और उसे स¢म Ûयायालय ɮवारा ऐसा घोͪषत ͩकया गया है।
25.2
Ǒदवाͧलया घोͪषत हो।
25.3
यǑद नैǓतक èखलन (अधमता) के अपराध का दोषी पाया गया हो।

25.4
ͩकसी परȣ¢ा के संचालन मɅ ͩकसी Ĥकार या कहȣं भी अनुͬचत åयवहार करने अथवा Ĥो×साǑहत करने के
ͧलए दंͫडत ͩकया गया हो।
25.5
ͩकसी ǓनयोÈता ɮवारा बखा[èत ͩकया गया हो, हटाया गया हो या उसे दंड Ǒदया गया हो।
26.
ǐरिÈतयाँ ͪवæवͪवɮयालय के संèथान Ĥाͬधकार अथवा Ǔनकाय के गठन या काय[वाहȣ को अमाÛय नहȣं
करेगी:-
ͪवæवͪवɮयालय के ͩकसी Ĥाͬधकार का काय[ या काय[वाहȣ ͧसफ[ इस कारण अमाÛय नहȣं होगी, जो ͩक
ͪवæवͪवɮयालय के ͩकसी Ĥाͬधकार या संगठन मɅ ǐरिÈत अथवा ͪवæवͪवɮयालय के ͩकसी Ĥाͬधकार कȧ संरचना मɅ दोष के
कारण हुआ हो।
27.
सͧमǓतयɉ का गठन:-
ͪवæवͪवɮयालय के Ĥाͬधकार ऐसी शतȾ के साथ जो ͪवशेष काम के ͧलए आवæयक हɉ तथा जो पǐरǓनयमɉ ɮवारा
अनुमोǑदत हɉ, ऐसी सͧमǓतयाँ का गठन कर सकɅ गे।
28.
पǐरǓनयम, अÚयादेश और ͪवǓनयम:
28.1
Ĥथम पǐरǓनयम:-
28.1.1 इस अͬधǓनयम के Ĥावधानɉ तथा इसके अÛतग[त बनाये गए Ǔनयमो के अनुकूल पहला
पǐरǓनयम Ǔनàनͧलͨखत मामलɉ मɅ से सभी या ͩकसी एक का Ǔनधा[रण करेगा, यथा:-
28.1.1.1
ͪवæवͪवɮयालय के Ĥाͬधकारɉ और अÛय Ǔनकायɉ के ͧलए समय-समय पर
गठन, शिÈतयɉ और काय[वाǑहयɉ का Ǔनधा[रण।
28.1.1.2
कुलाͬधपǓत, कुलपǓत कȧ ǓनयुिÈत कȧ अह[ƣा, शतȾ और उनकȧ शिÈतयɉ तथा
कायȾ का Ǔनधा[रण।
28.1.1.3
कुल सͬचव और मुÉय ͪवƣ तथा लेखा पदाͬधकारȣ कȧ ǓनयुिÈत कȧ ĤͩĐया
और अह[ता/ शतȾ उनकȧ शिÈतयɉ और काय[ का Ǔनधा[रण।
28.1.1.4
अÛय अͬधकाǐरयɉ तथा ͧश¢कɉ कȧ ǓनयुिÈत कȧ पɮधǓत, अह[ता, शतɟ तथा
शिÈतयɉ और काय[ का Ǔनधा[रण।
28.1.1.5
खेल ͪवæवͪवɮयालय के कम[चाǐरयɉ कȧ सेवा शतȾ का Ǔनधा[रण।
28.1.1.6
कम[चाǐरयɉ अथवा ͪवɮयाͬथ[यɉ और खेल ͪवæवͪवɮयालय के बीच ͩकसी Ĥकार
के ͪववाद कȧ िèथǓत मɅ मÚयèथता कȧ ĤͩĐया का Ǔनधा[रण।
28.1.1.7
मानद उपाͬधयाँ Ĥदान करना।

ͪवɮयाͬथ[यɉ के ͧश¢ण शुãक मɅ छूट, छाğवृǓत तथा फेलोͧशप

28.1.1.9
सीटɉ के आर¢ण/ Ĥवेश (नामांकन) का नीǓत का Ǔनधा[रण
तथा
28.1.1.10
ͪवɮयाͬथ[यɉ से ͧलया जाने वाला शुãक का Ǔनधा[रण
28.2
ͪवæवͪवɮयालय का पहला पǐरǓनयम शासी Ǔनकाय ɮवारा बनाया जाएगा और èवीकृǓत हेतु राÏय सरकार को
समͪप[त ͩकया जाएगा।
28.3
खेल ͪवæवͪवɮयालय ɮवारा समͪप[त ͩकए गए पहले पǐरǓनयम पर राÏय सरकार ͪवचार करेगी और इसकȧ ĤािÜत
के साठ Ǒदनɉ के भीतर इसकȧ èवीकृǓत, संशोधनɉ अथवा ǒबना संशोधन के साथ जैसा वह आवæयक समझे, देगी।
28.4
सरकार ɮवारा èवीकृत पहले पǐरǓनयम पर ͪवæवͪवɮयालय अपनी सहमǓत संĤेͪषत करेगा अथवा राÏय
सरकार ɮवारा उप धारा-3 के अÛतग[त ͩकये गये ͩकसी संशोधन या सभी संशोधनɉ को नहȣं लागू करने का कारण
बतायेगी। राÏय सरकार ऐसे कारणɉ पर ͪवचार करने के बाद ͪवæवͪवɮयालय के सुझावɉ को माÛय या अमाÛय कर
सकती है।
28.5
राÏय सरकार ने पहले पǐरǓनयम को िजस Ǿप मɅ अंततः èवीकार ͩकया है, उसे शासकȧय राजपğ मɅ Ĥकाͧशत
करेगी और यह Ĥकाशन कȧ Ǔतͬथ से लागू माना जायगा।
29.
परवतȸ पǐरǓनयम:-
29.1
इस अͬधǓनयम और इसके बाद बनाये गये Ǔनयमɉ के तहत ͪवæवͪवɮयालय के परवतȸ
पǐरǓनयमɉ मɅ Ǔनàनͧलͨखत सभी या ͩकसी एक के बारे मɅ åयवèथा दे सकती है यथाः-
(a)
खेल ͪवæवͪवɮयालय के नये Ĥाͬधकारɉ का सृजन।
(b)
लेखा नीǓत और ͪवƣीय ĤͩĐया।
(c)
खेल ͪवæवͪवɮयालय के Ĥाͬधकारɉ मɅ ͧश¢कɉ का ĤǓतǓनͬध×व।
(d)
नए ͪवभागɉ का Ǔनमा[ण और वत[मान ͪवभागɉ का उÛमूलन अथवा पुन[गठन
(e)
पदकɉ और पुरèकारɉ का Ǔनधा[रण
(f)
पदɉ के Ǔनमा[ण और ͪवलोपन कȧ ĤͩĐया
(g)
शुãक का पुनरȣ¢ण
(h)
ͪवͧभÛन ͪवषयɉ मɅ सीटɉ कȧ संÉया मɅ बदलाव तथा

(i)
अÛय सभी मामलɉ का पǐरǓनयम ɮवारा Ǔनधा[रण, जो इस अͬधǓनयम मɅ वͨण[त Ĥावधान के
अÛतग[त आवæयक हɉ।
29.2
पहले पǐरǓनयम से ͧभÛन ͪवæवͪवɮयालय के अÛय पǐरǓनयमो का Ǔनमा[ण शासी Ǔनकाय कȧ सहमǓत से Ĥबंधन
बोड[ ɮवारा ͩकया जाएगा।
29.3
उप धारा (2) के अÛतग[त Ǔनͧम[त पǐरǓनयम को राÏय सरकार के सम¢ Ĥèतुत ͩकया जाएगा, िजसे वह
èवीकृत करेगी अथवा यǑद आवæयक समझे तो संशोधन के ͧलए परामश[, पǐरǓनयम कȧ ĤािÜत कȧ Ǔतͬथ से
यथासंभव दो महȣने के भीतर देगी।
29.4
राÏय सरकार ɮवारा सुझाये गये संशोधनɉ पर शासी Ǔनकाय ͪवचार करेगी और पǐरǓनयमɉ मɅ ͩकये गये
संशोधनɉ पर सहमǓत देगी अथवा राÏय सरकार ɮवारा सुझाये संशोधनɉ पर ǑटÜपणी के साथ उसे वापस कर देगी।
29.5
राÏय सरकार शासी Ǔनकाय ɮवारा कȧ गयी ǑटÜपͨणयɉ पर ͪवचार करेगी तथा पǐरǓनयमɉ को ǒबना संशोधन अथवा
संशोधनɉ के साथ èवीकृत करेगी और इसे शासकȧय राजपğ मɅ Ĥकाͧशत करायेगी जो Ĥकाशन कȧ Ǔतͬथ से Ĥभावी
होगा।
30.
Ĥथम अÚयादेश:-
30.1
इस अͬधǓनयम के Ĥावघानɉ के अधीन Ǔनͧम[त Ǔनयमɉ, पǐरǓनयमɉ के तहत, Ĥथम अÚयादेश सभी मामले
या Ǔनàनͧलͨखत मɅ से कोई एक अथवा सभी कȧ åयवèथा के ͧलए ĤावधाǓनत ͩकया जा सकता है, यथाः-
30.1.1 ͪवæवͪवɮयालय मɅ ͪवɮयाͬथ[यɉ का Ĥवेश और तदनुसार नामांकन
30.1.2 ͪवæवͪवɮयालय कȧ ͫडĒी, ͫडÜलोमा एवं अÛय Ĥमाण पğɉ के अÚययन हेतु पाठयĐम का
Ǔनधा[रण
30.1.3 ͫडĒी, ͫडÜलोमा, Ĥमाण पğ और अÛय अकादͧमक Ĥदान करने हेतु Ûयूनतम योÊयता।
30.1.4 फेलोͧशप, छाğवृǓत, वजीफा, पदक और पुरèकार Ĥदान करने हेतु शतȾ 30.1.5 परȣ¢ा चालन
Ǔनयमɉ के अनुसार संचालक Ǔनकाय परȣ¢कɉ तथा मÚयèथɉ कȧ ǓनयुिÈत कȧ ĤͩĐया एवं
कत[åयɉ का Ǔनधा[रण।
30.1.6 ͪवͧभÛन पाɫयĐमɉ कȧ परȣ¢ाओं, उपाͬधयɉ और ͫडÜलोमा के ͧलए खेल ͪवæवͪवɮयालय ɮवारा
ͧलया जाने वाला शुãक Ǔनधा[रण
30.1.7 खेल ͪवæवͪवɮयालय के ͪवɮयाͬथ[यɉ के आवासन कȧ शतȶ
30.1.8 ͪवɮयाͬथ[यɉ के ͪवǾɮध अनुशासना×मक कार[वाई संबंधी Ĥावधान
30.1.9 ͪवæवͪवɮयालय के अकादͧमक पǐरवेश कȧ उÛनǓत के ͧलए आवæयक ͩकसी Ǔनकाय के सृजन
संरचना और काय[ पर ͪवचार

30.1.10 दूसरे खेल ͪवæवͪवɮयालय, उÍच ͧश¢ा के अÛय ͪवæवͪवɮयालयɉ (राçĚȣय एवं अंतरा[çĚȣय
दोनो) एवं संèथानɉ के साथ सहकाǐरता और सहयाग के तरȣके, 30.1.11 ऐसे अÛय मामले िजनकȧ
åयवèथा अËयादेश के ɮवारा इस अͬधǓनयम के अÛतग[त आवæयक हो।
30.2
खेल ͪवæवͪवɮयालय का Ĥथम अÚयादेश कुलाͬधपǓत ɮवारा बनाया जायगा जो शासी Ǔनकाय ɮवारा
अनुमोदन के बाद राÏय सरकार के सम¢ èवीकृǓत हेतु Ĥèतुत ͩकया जाएगा।
30.3
उप धारा (2) के तहत राÏय सरकार कुलाͬधपǓत ɮवारा सɋपे गये अÚयादेश पर ͪवचार करेगी और इसकȧ ĤािÜत के
साठ Ǒदनɉ के भीतर वह इसे èवीकृत करेगी या इसमɅ संशोधन हेतु सुझाव भी देगी।
30.4
कुलाͬधपǓत अÚयादेश के संदभ[ मɅ राÏय सरकार ɮवारा Ǒदये गये संशोधन के सुझावɉ को शाͧमल करɅगे अथवा
राÏय सरकार ɮवारा Ǒदये गये संशोधन के सुझावɉ को शाͧमल नहȣं करने के कारण बताते हुए Ĥथम अÚयादेश को
वापस राÏय सरकार के पास भेजɅगे। राÏय सरकार इसकȧ ĤािÜत के बाद कुलाͬधपǓत कȧ ǑटÜपणी पर ͪवचार
करेगी और संशोधन के साथ या ǒबना ͩकसी संशोधन के ͪवæवͪवɮयालय के Ĥथम अÚयादेश को शासकȧय
राजपğ मɅ Ĥकाͧशत करेगी और यह Ĥकाशन कȧ Ǔतͬथ से Ĥभावी होगा।
31.
परवतȸ अÚयादेश -
31.1
Ĥथम अÚयादेश के अलावा अÛय सभी अÚयादेश अकादͧमक पǐरषɮ ɮवारा बनाये जाऐंगे जो शासी
Ǔनकाय ɮवारा अनुमोǑदत ͩकये जाने के बाद राÏय सरकार के सम¢ अनुमोदन हेतु Ĥèतुत ͩकये जाऐंगे।
31.2
उप धारा (1) के तहत अकादͧमक पǐरषɮ ɮवारा सौपे गये अÚयादेश पर जहाँ तक सàभव हो राÏय
सरकार इसकȧ ĤािÜत के दो माह के भीतर ͪवचार करेगी और इसे èवीकृत कर सकती है या इसमɅ संशोधन
हेतु सुझाव दे सकेगी।
31.3
अकादͧमक पǐरषɮ या तो राÏय सरकार के सुझावɉ के अनुǾप अÚयादेश को संशोͬधत करेगी या राज्य
सरकार के सुझावɉ को शाͧमल नहȣं करने का कारण बताएगी और अÚयादेश को राÏय सरकार को पुनः
वापस सɋपेगी। राÏय सरकार अकादͧमक पǐरषɮ कȧ ǑटÜपणी पर ͪवचार करेगी और अÚयादेषɉ को
संशोधन के साथ या ǒबना ͩकसी संशोधन के èवीकृत करेगी, शासकȧय राजपğ मɅ Ĥकाͧशत करेगी और
यह Ĥकाशन कȧ Ǔतͬथ से Ĥभावी हो जाएगा।
32.
ͪवǓनयम:
खेल ͪवæवͪवɮयालय के Ĥाͬधकारȣ ऐसे Ĥ×येक Ĥाͬधकार और ऐसे Ĥाͬधकार ɮवारा बनायी गयी सͧमǓतयɉ के ͧलए
शासी Ǔनकाय कȧ पूव[ èवीकृǓत से इस अͬधǓनयम के अनुकूल, Ǔनयम, पǐरǓनयमɉ और अÚयादेशɉ के संगत
ͪवǓनयम बना सकेगे।

33.
Ǔनदȶश देने के राÏय सरकार के अͬधकार:
33.1
ͧश¢ण, परȣ¢ा और शोध का èतर तथा ͩकसी अÛय मामले कȧ जाँच करने के उɮदेæय से राÏय सरकार
ͪवæवͪवɮयालय से संबंͬधत ऐसे लोगɉ के ɮवारा िजÛहɅ वह उपयुÈत समझती है ǓनǑद[çट तरȣके से

राÏय सरकार ऐसे मूãयांकन के आधार पर सुधारा×मक कार[वाई के ͧलए अपनी अनुशंसाएँ
ͪवæवͪवɮयालय को संĤेͪषत करेगी। ͪवæवͪवɮयालय ऐसे सुधारा×मक उपायɉ को अपना सकती है और इन
अनुशंसाओं का अनुपालन सुǓनिæचत करने का Ĥयास करेगी।
33.3
यǑद ͪवæवͪवɮयालय उपधारा (2) के अंतग[त राÏय सरकार ɮवारा कȧ गई अनुशंसा का पालन करने मɅ
उͬचत समयावͬध मɅ ͪवफल रहती है तो राÏय सरकार उसे उपयुÈत Ǔनदȶश देगी। राÏय सरकार ɮवारा Ǒदये
गये ऐसे Ǔनदȶशɉ का अनुपालन ͪवæवͪवɮयालय अͪवलंब करेगा।
ͪवæवͪवɮयालय कȧ Ǔनͬधयाँ
34.
èथायी (अ¢य) Ǔनͬध:-
34.1
उɮदेæय-पğ मɅ ǓनǑद[çट राͧश के अंतग[त Ĥवत[क (Ĥायोजक) Ǔनकाय खेल ͪवæवͪवɮयालय के ͧलए एक
èथायी कोष कȧ èथापना करेगा।
34.2
खेल ͪवæवͪवɮयालय ɮवारा इस अͬधǓनयम का अनुपालन तथा अͬधǓनयम के पǐरǓनयम तथा अÚयादेशɉ
के अनुसार संचालन को सुǓनिæचत करने हेतु èथायी Ǔनͬध का उपयोग जमानत जमा राͧश के Ǿप मɅ
होगा। यǑद ͪवæवͪवɮयालय अथवा Ĥवत[क Ǔनकाय इन अͬधǓनयम, पǐरǓनयमɉ और अÚयादेशɉ के
अनुकूल Ĥावधानɉ का उãलंघन करता है तब राÏय सरकार को यह पूरȣ राͧश अथवा इसका एक
Ǒहèसा/अंश जÞत कर लेने का अͬधकार होगा।
34.3
ͪवæवͪवɮयालय इस èथायी कोष से हुई आमदनी का उपयोग ͪवæवͪवɮयालय के आधारभूत संरचना के
ͪवकास के ͧलए कर सकेगा लेͩकन इसे ͪवæवͪवɮयालय के ǑदनानुǑदन खच[ पर åयय नहȣ करेगी।
34.4
ͪवæवͪवɮयालय के ͪवघटन तक èथायी कोष कȧ राͧश ऐसे साधनɉ मɅ Ǔनवेͧशत कȧ जाएगी जैसे ͩक
सरकार ɮवारा Ǔनवेश हेतु Ǔनधा[ǐरत ͩकया जाएगा।
34.5
दȣघा[वͬध कȧ ĤǓतभूǓत कȧ िèथǓत मɅ ĤǓतभूǓतयɉ का Ĥमाण-पğ सरकार के सुरͯ¢त संर¢ण मɅ रखा
जाएगा और सरकारȣ खजाने मɅ Þयाज धाǐरत åयिÈतगत जमा खातɉ मɅ जमा करने कȧ िèथǓत मɅ शत[ यह
होगी ͩक सरकार के आदेश के ǒबना यह राͧश Ǔनकालȣ नहȣं जा सकेगी।
35.
सामाÛय Ǔनͬध:-
35.1
खेल ͪवæवͪवɮयालय एक कोष कȧ èथापना करेगा, िजसे सामान्य Ǔनͬध कहा जाएगा, िजसमɅ Ǔनàनांͩकत
राͧशयाँ जमा होगी:-

35.1.2 Ĥवत[क Ǔनकाय ɮवारा Ĥदƣ कोई भी राͧश
35.1.3 अपने लêय ͧसɮͬध के Đम मɅ खेल ͪवæवͪवɮयालय के ͩकसी भी काय[ यथा - परामश[ आǑद से
ĤाÜत आय:
35.1.4 Ûयासɉ, वसीयतɉ, दान, वृͪƣदान और ͩकसी भी अÛय Ĥकार का अनुदान तथा
35.1.5 खेल ͪवæवͪवɮयालय ɮवारा ĤाÜत अÛय सारȣ धनराͧश।
35.2
सामाÛय Ǔनͬध का उपयोग Ǔनàनͧलͨखत मदɉ मɅ ͩकया जाएगा, यथा-
35.2.1 इस अͬधǓनयम और इसके अंतग[त पǐरǓनयमɉ, अÚयादेशɉ, ͪवǓनयमɉ एवंǓनयमɉ हेतु शाहȣ
Ǔनकास कȧ पूव[ èवीकृǓत के साथ खेल ͪवæवͪवɮयालय ɮवारा ͧलए गये ऋण तथा उसके Þयाज
के भुगतान हेतु:
35.2.2 खेल ͪवæवͪवɮयालय कȧ पǐरसंपǓतयɉ के रख-रखाव हेतु ,
35.2.3 धारा 7 एवं 8 के अंतग[त ͪवǓनͧम[त Ǔनͬधयɉ के लेखा-परȣ¢ण के ͧलए भुगतान ͩकया गया शुãक,
35.2.4 खेल ͪवæवͪवɮयालय के प¢ अथवा ͪवप¢ मɅ दायर वादɉ पर हुए खच[ के Ǔनçपादन हेतु ,
35.2.5 अͬधकाǐरयɉ, कम[चाǐरयɉ, ͧश¢कɉ गैर शै¢ाͨणक कͧम[यɉ एवं शोध-अͬधकाǐरयɉ के वेतन, भƣे,
भͪवçय-Ǔनͬध अंशदान, गैÍयूटȣ और अÛय लाभɉ के भुगतान हेतु,
35.2.6 Ĥबंधन Ǔनकाय, काय[कारȣ पǐरषɮ एवं अकादͧमक पǐरषɮ के सदèय, अÛय Ĥाͬधकारɉ तथा
Ĥवत[क Ǔनकायɉ के अÚय¢ अथवा कुलाͬधपǓत अथवा ͩकसी स¢म अͬधकारȣ ɮवारा ǓनयुÈत
ͩकसी सͧमǓत के सदèय ɮवारा ͩकये गये याğा-åयय एवं अÛय भƣɉ के भुगतान हेतु,
35.2.7 फेलोͧशप, Ǔनशुãक ͧश¢ण, छाğवृǓतयɉ, अͧसèटɅटͧशप तथा समाज के कमजोर आͬथ[क वग[ के
छाğɉ को Ǒदये गये पुरèकारɉ और शोध सहायकɉ Ĥͧश¢ुओं (जो भी हो) ͪवधेयकɉ, पǐरǓनयमɉ एवं
Ǔनयमɉ के अनुकूल ͩकसी भी अह[ता ĤाÜत ͪवɮयाथȸ के पुरèकार के भुगतान हेतु
35.2.8 अͬधǓनयम के Ĥावधानɉ, पǐरǓनयामɉ, अÚयादेशɉ, ͪवǓनयमɉ एवं Ǔनयमɉ के अनुपालन मɅ
ͪवæवͪवɮयालय ɮवारा åयय कȧ गयी ͩकसी भी राͧश के भुगतान हेतु ,
35.2.9 Ĥवत[क Ǔनकाय ɮवारा ͪवæवͪवɮयालय कȧ èथापना और इस संदभ[ मɅ ͩकये गये Ǔनवेशो कȧ
मूल लागत, जो समय समय पर भारतीय èटेट बɇक के ऋण Ĥदान करने कȧ दर से अͬधक नहȣं
हो, के भुगतान के ͧलए,
35.2.10 इस अͬधͪपयम के Ĥावधानɉ, पǐरǓनयामɉ, अÚयादेशɉ, ͪवǓनयमɉ एवं Ǔनयमɉ के अनुपालन
मɅ ͪवæवͪवɮयालयɉ ɮवारा ͧलए गए परामष[ से संबंͬधत कायɟ पर ͩकये åयय के भुगतान हेतु ,

35.2.11 ͩकसी संèथान ɮवारा ͪवæवͪवɮयालय को Ĥायोजक Ǔनकाय के बदले मɅ Ǒहत मɅ दȣ गयी Ĥबंधन
सेवा सǑहत ͪवशेष सेवा देने हेतु देय सेवा शुãक तथा शाहȣ Ǔनकाय ɮवारा ͪवæवͪवɮयालय के ͧलए
èवीकृत ऐसे åययɉ अथवा संबंɮध अÛय कायɟ के भुगतान हेतु ,
बशतȶ ͩक कुल आवतȸ/åयय और उस वष[ के ͧलए Ǔनधा[ǐरत अनावतȸ åयय जैसा शासी Ǔनकाय ɮवारा
Ǔनिæचत ͩकया गया है, से अͬधक åयय ǒबना शासी Ǔनकाय कȧ पूव[ èवीकृǓत के नहȣं ͩकया जा सकेगा।
लेखा, अंके¢ण एवं वाͪष[क ĤǓतवेदन
36.
वाͪष[क ĤǓतवेदन:-
खेल ͪवæवͪवɮयालय का वाͪष[क ĤǓतवेदन ͪवæवͪवɮयालय ɮवारा तैयार ͩकया जाएगा िजसमɅ अÛय मामलɉ समेत,
ͪवæवͪवɮयालय ɮवारा उɮदेçयɉ कȧ पूǓत[ के ͧलए उठाये गये कदम शाͧमल हɉगे और इस राÏय सरकार को सɋपा जाएगा।
37.
अंके¢ण एवं वाͪष[क लेखा -
37.1
ͪवæवͪवɮयालय का वाͪष[क लेखा परȣ¢ा (बɇलेस शीट सǑहत), वष[ मɅ कम-से-कम एक बार
ͪवæवͪवɮयालय के माँग पर योजना -सह- ͪवƣ ͪवभाग ɮवारा गǑठत अंके¢ण दल ɮवारा ͩकया
जायेगा।
37.2
वाͪष[क लेखा कȧ एक ĤǓत अंके¢ण ĤǓतवेदन के साथ राÏय सरकार के सम¢ Ĥèतुत करनी होगी।
ͪवæवͪवɮयालय का समापन
38.
ͪवæवͪवɮयालय का समापन:-
38.1
यǑद Ĥायोजक Ǔनकाय ͪवͬध सàमत ĤावधाǓनत तरȣके से इसके गठन तथा Ǔनगमीकरण से èवयं को भंग
करना चाहे, तो इसकȧ सूचना कम से कम छह महȣने पहले राÏय सरकार को देनी होगी।
38.2
राÏय सरकार ऐसी सूचना (भंग करने संबंधी) ĤाÜत करने के पæचात, ͪवæवͪवɮयालय के Ĥशासन कȧ
आवæयकता अनुसार, उपयुÈत åयवèथा, Ĥवत[क Ǔनकाय के ͪवघटन कȧ Ǔतͬथ से आͨखरȣ सğ के
ͪवɮयाͬथ[यɉ (जो ͪवæवͪवɮयालय मɅ नामांͩकत है) के पाɫयĐम पूरा होने तक करेगी तथा सरकार Ĥवत[क
Ǔनकाय के èथान पर ͪवæवͪवɮयालय के आगे का संचालन के ͧलए एक Ĥशासक कȧ ǓनयुिÈत कर सकेगी,
िजसे Ĥवत[क Ǔनकाय के अͬधकार, कत[åय और काय[ सɋपे जाएँगे, जैसा इस अͬधǓनयम मɅ वͨण[त है।
39. ͪवæवͪवɮयालय का ͪवघटन:-
39.1
Ĥायोजक Ǔनकाय यǑद ͪवæवͪवɮयालय को भंग करने कȧ इÍछा åयÈत करता है, तो उसे राÏय सरकार को
एतत्-संबंधी सूचना Ǔनधा[ǐरत तरȣके से देनी होगी। राÏय सरकार यथोͬचत ͪवचार के पæचात् ͪवǑहत
तरȣके से ͪवæवͪवɮयालय को ͪवघǑटत कर सकती है।

बशतȶ ͩक खेल ͪवæवͪवɮयालय का ͪवघटन तभी Ĥभावी होगा जब तक ͩक Ǔनयͧमत पाɫयĐम के
ͪवɮयाͬथ[यɉ का आͨखरȣ सğ पाɫयĐम पूरा न कर लɅ और उन सबको ͫडĒी (उपाͬध), ͫडÜलोमा अथवा
िजस तरह के Ĥमाण हो, ĤाÜत न हो जायɅ।
39.2
ͪवǓनǑद[çट ĤͩĐया अनुसार ͪवæवͪवɮयालय का ͪवघटन होने पर उसकȧ सभी सàपǓतयाँ और देनदाǐरयाँ
Ĥवत[क Ǔनकाय मɅ ǓनǑहत हो जाएगी।
39.3
यǑद उप-धारा (1) के तहत राÏय सरकार ͪवæवͪवɮयालय को ͪवघǑटत करने का Ǔनण[य लेती है, तो
Ǔनधा[ǐरत तरȣके से समान उɮदेæय वालȣ अÛय Ǔनकायɉ को ͪवæवͪवɮयालय के ͪवघटन तक उपधारा (1)
के Ĥावधानɉ के तहत इसके शाहȣ Ǔनकास कȧ शिÈतयɉ ǓनǑहत कर सकेगी।
40.
ͪवशेष पǐरिèथǓतयɉ मɅ राÏय सरकार कȧ ͪवͧशçट शिÈतयाँ:-
40.1
राÏय सरकार यǑद आæवèत होती है ͩक ͪवæवͪवɮयालय ने अͬधǓनयम, Ǔनयम के Ĥावधानɉ, अÚयादेशɉ
मɅ से ͩकसी का उãलंघन ͩकया है अथवा उसके ɮवारा इस अͬधǓनयम के तहत जारȣ ͩकसी भी Ǔनदȶश का
उãलंघन ͩकया है अथवा ͪवƣीय कुĤबंधन या कुĤशासन कȧ िèथǓत ͪवæवͪवɮयालय मɅ उ×पÛन हो गई है,
तो वह ͪवæवͪवɮयालय को कारण बता सूचना जारȣ कर पɇतालȣस Ǒदनɉ के भीतर इस आशय का उƣर
मांगेगी ͩक Èयɉ नहȣं एक Ĥशासक कȧ ǓनयुिÈत कर दȣ जाय।
40.2
ͪवæवͪवɮयालय ɮवारा उप-धारा (1) के अंतग[त दȣ गयी सूचना पर Ǒदये गये उƣर से यǑद राÏय सरकार
संतुçट होती है ͩक इस अͬधǓनयम, Ǔनयमɉ, पǐरǓनयमɉ और अÚयादेशɉ के ͩकसी भी Ĥावधान का Ĥथम
Ǻçटया उãलंघन हुआ है अथवा इस अͬधǓनयम के ɮवारा Ǒदये गये Ǔनदȶशɉ के ĤǓतकूल ͪवƣीय कुĤबंधन या
कुĤशासन है तो वह आवæयक एवं उपयुÈत जाँच का आदेश देगी।
40.3
उपधारा (2) के तहत राÏय सरकार ऐसी ͩकसी जाँच के उɮदेæय से जाँच अͬधकारȣ या अͬधकाǐरयɉ को ऐसे
आरोपɉ कȧ जाँच कर ĤǓतवेदन Ĥèतुत करने हेतु ǓनयुिÈत करेगी।
40.4
उपधारा (4) के अंतग[त ǓनयुÈत जाँच अͬधकारȣ या अͬधकाǐरयɉ के पास वहȣ शिÈतयाँ होगी, जो दȣवानी
अदालत ɮवारा दȣवानी वाद के मामलɉ कȧ सुनवाई के दौरान दȣवानी ĤͩĐया संǑहत। 1908 मɅ Ĥदƣ हɇ,
यथा -
40.4.1 ͩकसी åयिÈत को बुलाने और उसकȧ उपिèथǓत को अǓनवाय[ करने और शपथ के साथ उनका
परȣ¢ण करना।
40.4.2 Ĥमाण के ͧलये आवæयक दèतावेज या दूसरȣ अÛय सामĒी कȧ खोज करने/ Ĥèतुत करने का
Ǔनदȶश देना;
40.4.3 ͩकसी भी अदालत या काया[लय से कोई दèतावेज मंगाना।
40.5
उप धारा (3) के अंतग[त ǓनयुÈत अͬधकारȣ या अͬधकाǐरयɉ कȧ जाँच ǐरपोट[ ĤाÜत होने के बाद यǑद राÏय
सरकार संतुçट है ͩक ͪवæवͪवɮयालय ने इस अͬधǓनयम के ͩकसी Ĥावधान, Ǔनयमɉ, पǐरǓनयमɉ अथवा
अÚयादेषɉ का उãलंघन ͩकया है अथवा सरकार ɮवारा Ĥदƣ Ǔनदȶशɉ का उãलंघन ͩकया है या ͪवƣीय
कुĤबधंन या कुĤशासन कȧ िèथǓत ͪवæवͪवɮयालय मɅ उ×पÛन हो गयी है िजससे ͩक अकादͧमक èतर पर
Ĥæन - ͬचÛह खड़ा हो गया हो, तो सरकार एक Ĥशासक ǓनयुÈत कर सकती है।

40.6
उपधारा (5) के अंतग[त ǓनयुÈत Ĥशासक इस अͬधǓनयम के तहत बनाये गये शासी Ǔनकाय अथवा Ĥबंधन
बोड[ कȧ सारȣ शिÈतयɉ का Ĥयोग करेगा एवं उसके सारे कत[åयɉ का Ǔनर्वहन करेगा और तब तक
ͪवæवͪवɮयालय कȧ गǓतͪवͬधयɉ का संचालन करेगा जब तक Ǔनयͧमत पाɫयĐम के ͪवɮयाͬथ[यɉ का
आͨखरȣ सğ अपना पाɫयĐम पूरा नहȣं कर लेता और उÛहɅ ͫडĒी या ͫडÜलोमा न दे दȣ जाएँ।
40.7
Ǔनयͧमत पाɫयĐम के ͪवɮयाͬथ[यɉ का आͨखरȣ सğ का ͫडĒी या ͫडÜलोमा या जैसी िèथǓत हो, Ĥदान
करने के बाद Ĥशासक इस आशय कȧ ǐरपोट[ राÏय सरकार को देगा।
40.8
उपधारा (7) के अंतग[त ǐरपोट[ ĤाÜत होने पर राÏय सरकार ͪवæवͪवɮयालय को ͪवघǑटत कर देगी और
ͪवæवͪवɮयालय के ͪवघटन के बाद इसकȧ सारȣ पǐरसàपिǂयाँ और देनदाǐरयाँ Ĥायोजक Ǔनकाय मɅ ǓनǑहत
हो जायɅगी।
अÛयाÛय
41. Ǔनयम बनाने के ͧलए सरकार कȧ शिÈतः-
41.1
इस अͬधǓनयम के उɮदेæयɉ के Ǔनव[हन के ͧलये शासकȧय राजपğ मɅ अͬधसूचना जारȣ करके राÏय
सरकार Ǔनयम बना सकती है।
41.2
इस अनुÍछेद के तहत् बनाये गये सारे Ǔनयम 30 Ǒदनɉ के अÛदर राÏय ͪवधानमंडल के सम¢ रखे जायेगे
या राÏय ͪवधानमंडल उसी सğ मɅ या अगले सğ ͩकसी तरह का सुधार/संसोधन कर सकती है।
42.
ͪवɮयाͬथ[यɉ के पाɫयĐम का समापनः-
इस अͬधǓनयम अथवा पǐरǓनयम मɅ ͩकसी बात के होते हुए भी, अंगीभूत महाͪवɮयालयɉ अथवा खेल
ͪवæवͪवɮयालय कȧ अनुसूची मɅ ͪवǓनǑद[çट संèथाओं का कोई ͪवɮयाथȸ जो इस अͬधǓनयम के लागू होने के तुरंत
पहने अÚययनरत था या जो उस ͪवæवͪवɮयालय कȧ ͩकसी परȣ¢ा मɅ सिàमͧलत होने का योÊय था, उसे उसे अपना
पाɫयĐम पूरा करने कȧ अनुमǓत दȣ जाएगी और ͪवæवͪवɮयालय ɮवारा ऐसे ͪवɮयाͬथ[यɉ के ͧश¢ण, Ĥͧश¢ण और
परȣ¢ा कȧ सुͪवधा संबɮध ͪवæवͪवɮयालय के पाɫयĐम के अनुǾप Ǔनधा[ǐरत तरȣके से तथा Ǔनधा[ǐरत समयावͬध
के ͧलए उपलÞध करायी जायगी।
43.
कǑठनाइयɉ को दूर करने कȧ शिÈतः-
43.1
यǑद इस अͬधǓनयम के ͩकसी Ĥावधान को लागू करने मɅ कǑठनाई उ×पÛन हो तो शासकȧय राजपğ मɅ
Ĥकाͧशत आदेश के ɮवारा राÏय सरकार इस अͬधǓनयम के Ĥावधानɉ के Úयान मɅ रखते हुए कǑठनाईयɉ
को शीē दूर करने के ͧलए Ĥावधान करेगी।
बशतȶ इस अͬधǓनयम के Ĥारंभ से तीन वषȾ के बाद उप धारा (1) के अंतग[त ऐसा कोई आदेश
पाǐरत नहȣं ͩकया जाएगा।
43.2
इस धारा के अंतग[त पाǐरत Ĥ×येक आदेश को अͪवलंब राÏय ͪवधानमंडल के सम¢ रखा जाएगा।

अनुसूची -ए
1.
एकल Ĥभाव ¢ेğ के ͧलए इनका मुÉय पǐरसर मɅ कम से कम 10 एकड़ जमीन उपलÞध कराया जा सकेगा।
2.
शै¢ͨणक भवन, िजसमɅ पुèतकालय, åयाÉयान क¢ Ĥयोगशालाएँ हɉगी, ͧश¢कɉ के ͧलए पया[Üत आवासीय
åयवèथा, अǓतͬथ गृह, छाğावास िजसे Đमशः इतना बढ़ाया जाये ͩक ͪवɮयाͬथ[यɉ कȧ कुल संÉया का कम से कम
25 ĤǓतशत का आवासन हो सके, का Ǔनमा[ण करना होगा, ऐसा अिèत×व मɅ आने के तीन वषɟ के भीतर करना
होगा। यǑद खेल ͪवæवͪवɮयालय åयावसाǓयक ͧश¢ा का काय[Đम कराता है तो उसके ͧलए वैधाǓनक Ǔनकाय ɮवारा
Ǔनधा[ǐरत मानकɉ तथा मानदंडɉ को èवीकार करना होगा। पूव[ को ͪवघमान संèथान को राÏय सरकार ɮवारा
Ǔनधा[ǐरत मान के के अनुसार ͪवèतार, पुनǾɮवार एवं पुनर[चना अवæय करना होगा।

An Act to provide for the establishment and incorporation of the Jharkhand State Sports University
in the State of Jharkhand, and to confer the status of a Private University thereon and for matters
connected therewith and incidental thereto;
WHEREAS it is expedient to provide for the establishment and incorporation of the JSSU
UNIVERSITY at RANCHI, Jharkhand promoted by Jharkhand State Sports Promotion Society
(JSSPS)
It is hereby enacted in the Sixty-Eighth year of the Republic of India, by the Legislature of
Jharkhand, as follows :
1.
Short Title, Extent and Commencement
1.1
This Act may be called “JHARKHAND STATE SPORTS UNIVERSITY ACT, 2017”.
1.2
It shall extend to the whole of the State of Jharkhand.
1.3
It shall come into force on such date as the State Government may, by notification in
the
official Gazette, appoint.
2.
Definitions.
2.1 In this Act, unless the context otherwise requires:
2.2.1 “Academic Council” means the Academic Council of the University as
specified in section 22 of the Act;
2.2.2 “Annual Report” means the Annual report of the University as referred to in
section 36 of the Act;

2.2.3 Board of Management” means the Board of Management of the University as
constituted under section 21 of the Act;
2.2.4 “Campus” means the area of the university in which it is established;
2.2.5 “Chancellor” means the Chancellor of the University appointed under section
12 of the Act;
2.2.6 “The Chief Finance and Accounts Officer” means the Chief Finance and
Accounts Officer” of the University appointed under section 16 of the Act;
2.2.7 “Controller of Examinations” means the Controller of Examinations of the
University appointed under section 17 of the Act;
2.2.8 “Constituent College” means a college or an institution maintained by the
University;
2.2.9 “Employee” means employee appointed by the University; and includes
teachers and others staff of the University or of a constituent college;
2.2.10 “Endowment fund” means the endowment fund of the University establishment
under section 34 of the Act;
2.2.11 “Faculty” means group of academic department of similar disciplines;
2.2.12 “Fee” means collection made by the university from the students for the
purpose of any course of study and incidental thereto, in the University;
2.2.13 “General Fund” means the General fund of the University established under
section 35 of the Act;
2.2.14 “Governing Body” means the governing Body of the University constituted
under section 20 of the Act;
2.215 “National Assessment and Accreditation Council” means National Assessment
and Accreditation Council, Bengaluru, an autonomous institution of the
University Grants Commission;
2.2.16 “Prescribed” means prescribed by the Statutes and the rules made under this
Act;
2.2.17 “Registrar” means the Registrar of the University appointed under section 15 of
the Act;
2.2.18 “Regulatory Body” means a body established by the Government of India for
laying down norms and conditions for ensuring academic standards of higher
education, such as University Grants Commission, All India Council for
Technical Education, National Council for Teacher Education, Medical Council
of India, Nursing Council, Indian Council of Agriculture Research, Council of
Scientific and Industrial Research, etc. and includes the Government or any
such body constituted by the Government of India or the State Government;
2.2.19 “Rules” means the rule of the University made under this Act;
2.2.20 “Schedule” means schedule appended to this Act;

2.2.21 “Sponsoring Body” in relation to the university means Jharkhand State Sports
Promotion Society (JSSPS) a society registered under Societies Registration
Act 1860;
2.2.22 “State Government” means the State Government of Jharkhand, represented
by Principal Secretary/Secretary Tourism, Art Culture, Sports & Youth Affairs
Department.
2.2.23 “Statutes”, “Ordinances”, and “Regulations” mean respectively, the Statutes,
Ordinances and Regulations of the University made under this Act;
2.2.24 “Student of the University” means a person enrolled in the university for taking
a course of study for a degree, diploma, or other academic distinction duly
instituted by the university, including a research degree;
2.2.25 “Teacher” means a professor, Associate professor, Assistant Professor or such
of the other person as may be appointed for imparting instruction or conducting
research in the University or in a Constituent College or Institution and includes
the Principal of a Constituent College or institution, in conformity with the
norms prescribed by the University Grants Commission;
2.2.26 “University Grants Commission” means the University grants Commission
established under the university Grants commission Act, 1956;
2.2.27 “University” means the Jharkhand State Sports University, Jharkhand
established under this Act.
2.2.28 “Vice-Chancellor” means the Vice-Chancellor of the University appointed under
section 13 of the Act;
2.2.29 “Visitor” mean the Visitors of the University referred to in section 10 of the Act.
3.
Establishment of University.
3.1
There shall be established the University by the name ‘Jharkhand State Sports
University’.
3.2
The headquarters of the University shall be within the State of Jharkhand and shall be
situated at Ranchi.
3.3
The Sports University shall start operation only after the State Government issues the
letter of authorization.
3.4
The sports University shall meet the conditions mentioned in the schedule A of the Act
within the stipulated time.
3.5
The Governing Body, the Board of Management, the Academic Council, the
Chancellor, the Vice Chancellor, the Registrar, the Teachers, the Chief Finance and
Accounts Officer and such other Officers or members or authorities so long as they
continue to hold such office or membership of the University hereby constitute a body
corporate by the name or the University.

3.6
The Sports University shall function as non-affiliating University and they shall not
affiliate any other college or institute for the conferment of degree, diploma and for
grant of certificate to the student admitted therein.
3.7
The university shall be a body corporate by the name ‘JHARKHAND STATE SPORTS
UNIVERSITY’ and will have perpetual succession and common seal with power,
subject to the provision of this Act, to acquire and hold property, to contract and shall,
by the said name, sue or be sued.
3.8
The University shall not receive any grant-in-aid or other financial assistance from the
State Government or the Central Government.
Provided that, the State Government or the Central Government may provide
financial support, including through grants or otherwise
3.8.1 For research, development and other activities for which other State
Government Organization are provided financial assistance, or
3.8.2 For any specific research or programme based activity.
4.
Properties of the University and its Application.
4.1
The land, building and other properties acquired for the University shall not be used for
any purpose other than that for which the same is acquired.
4.2
The properties, movable or immovable, of the university shall be administered by the
Governing Body in such manner as may be provided for by the regulations in the
furtherance of the objectives of the establishment of the University.
5.
Restrictions and obligations of the University.
5.1
The tuition fees for professional courses in Sports such as Sports medicine, yoga, etc.,
in the university shall be determined by the University under the supervision of the
regulatory body notified by the State Government from time to time.
5.2
Admission in the University shall be strictly on the basis of merit. Merit for admission in
the University may be determined either on the basis of marks or grade obtained in the
qualifying examination and achievement on co-curricular and extra-curricular activities
or on the basis of marks or grade obtained in the entrance test conducted at State
level either by the University or an association of the Universities conduction similar
courses or by any agency of the State Government.
5.3
The University shall allow merit scholarship at least five percent of the total strength,
to the students.
5.4
The university shall compulsorily make provision for reservation of seats for the
students domiciled in the State of Jharkhand to the extent of at least fifty percent.

5.5
The university shall make provisions for reservation of non-teaching posts in the
university for the persons domiciled in the State of Jharkhand to the extent of at least
fifty percent of the total number of non-teaching posts of the university. The reservation
of seats shall be regulated by the laws and orders of the State Government from time
to time.
5.6
The university shall appoint adequate number of teachers and officers in the University
for maintaining the academic standards specified and shall ensure that the
qualifications of such teachers or officers of the university shall not be lower than
prescribed by the relevant Regulatory Bodies.
5.7
The university shall compulsorily place in the public domain every information in
relation to the University which would be of interest to the students and other
Stakeholders inter alia, including the courses offered, number of seats under different
categories, fees and other charges, facilities and amenities offered, faculty in place
and such other relevant information.
5.8
The Convocations of the University may, for conferring degrees, diplomas or for any
other purpose, be held in every academic year in the manner as may be prescribed by
the Statues.
5.9
The university shall obtain accreditation from the National Council of Assessment and
Accreditation (NAAC) within five years of its establishment and such other regulating
bodies of Government of India which are connected with the courses taken up by the
University and inform the State Government about the grade provided to the
University. The University shall get renewed such accreditation from time to time.
5.10
Notwithstanding anything contained in this Act, the University shall be bound to comply
the conditions mentioned in Schedule A of this Act, and all the rules, regulations,
norms, etc. of the regulating bodies of Government of India and State Government
and provide all such facilities and assistance to such bodies as are required by them
to discharge their duties and carry out their functions.
6.
Object of the University:
The Object of the University is as follows namely:
6.1
To develop the knowledge of physical education and sports science, providing
specially designed academic training programme in various areas of physical education
and sports science and also advance technologies sports training which includes
theoretical inputs practical training to generate expertise and strengthening physical
education and sports training program to promote sports performance.

6.2
To generate capabilities for the development of knowledge, skills and competency at
various levels in the field of physical education and sports science, sports technology,
and high performance training for all sports and games
6.3
To prepare highly qualified leaders in the field of physical education and sports
science, sports technology, and high performance training for all sports and games
6.4
To function as a leading resource center in the field of physical education and sports
science, sports technology, and high performance training for all sports and games
6.5
To provide international collaboration in the field of physical education and sports
science, sports technology, and high performance training for all sports and games
6.6
To establish close linkage with schools, colleges, sports and recreational clubs, sports
associations and international federations for the purpose of teaching, training and
research in physical education and sports science, sports technology, and high
performance training for all sports and games
7.
University open to all irrespective of sex, religion, class, colour, creed, or opinion.
No person shall be discriminated against or be excluded from any office of the university or
from membership of any of its authorities or from admission to any course of study leading to a
degree, diploma or other academic distinction on the ground of sex, race, creed, class, caste, place of
birth and religious belief or political or other opinion.
8.
Powers and functions of the University.
8.1
To administer and manage the University, establish, administer and manage its
constituent colleges and centers for research, education, training, extension and
outreach including continuing education, and e-learning in sports at its campus within
the State of Jharkhand;
8.2
To provide for research, higher education, professional education, teaching training,
extension and outreach including continuing education and e-learning in the fields of
sports sciences and education, management, and any other fields related to sports
discipline.
8.3
To conduct innovative experiments in educational technologies, teaching and learning
methods in sporting discipline to collaborate with national and international sports
institutions and to offer joint programmes with such institutes to constantly improve the
delivery of sports education and to achieve international standards of sports education;
8.4
To prescribe curricula and methodologies including electronic means provide for
flexibility in the delivery of sports education.

8.5
To hold examination and confer degree, diploma or grant certificate and other
academic distinctions or title on persons subject to such condition as the sports
University may determine and to withdraw or cancel any such degree, diploma or
certificates and other academic distinction or titles in the manner prescribed by the
Regulations;
8.6
To institute and award fellowships, scholarships, medals and prizes;
8.7
To confer honorary degree or other distinction on the manner prescribed by the
Statues;
8.8
To establish schools, centers, sports institutes, sports college and conduct the sports
programme and sports courses of study as are in the opinion of the sports University,
necessary for the furtherance of its objects;
8.9
To provide for printing, publication and reproduction of research, educational material
and other works and to organize exhibition, conferences, workshops and seminars in
sports;
8.10
To establish sports knowledge resource centre;
8.11
To sponsor and undertake research and educational programmes in the fields of
sports, technology, and education management, and other allied areas on the various
fields of sports.
8.12
To collaborate or associate with any educational institution with like or similar objects;
8.13
To establish campuses including virtual campus for the purpose of achieving the
objectives of the Sports University;
8.14
To undertake research and to obtain registration in respect of such research in the
nature of patents, design rights and such or similar rights with the competent
authorities;
8.15
To maintain linkages and collaborate with educational or other institutions in any part
of
the world having objects wholly or partially similar to those of the sports University,
through exchange of students, researchers, faculty and staff and generally in such
manner as may be conducive to their common objects developing sports discipline and
its technical Education;
8.16
To render services of research, training, consultancy and such other services as
required for the purposes of the Sports University;
8.17
To develop and maintain relationships with faculty, researchers, administrators and
domain experts in sports science & technology, Sports management, and allied areas
for achieving the object of the University;
8.18
To make special arrangement in respect to women and other disadvantaged students
as the Sports University may consider desirable;
8.19
To regulate the expenditure and to manage the finances and to maintain the accounts
of the Sports University;

8.20
To receive funds, movable and immovable properties, equipments, software and other
resources from business, industry, other sections of society, national and international
organization or any other source by transfers or as gifts, donations, benefactions or
bequests for the purposes and objects of the Sports University;
8.21
To establish, maintain and manage halls, hostels for students and quarters for the
residence of faculty and staff;
8.22
To construct, manage and maintain centers, complexes, auditorium, buildings,
stadiums for the advancement of sports, co-curricular and extra-curricular activities;
8.23
To supervise and control the residence and regulate the discipline of students, faculty
and staff of the Sports University and to make arrangements for promoting their health,
general welfare, social and cultural activities conduct awareness programmes in sports
etc;
8.24
To fix, demand and receive or recover fees and such other charges as may be
prescribed by the Statues;
8.25
To institute and award fellowships, scholarships, prizes, medals and other awards;
8.26
To purchase or to take on lease or accept as gifts, bequests, legacies or otherwise any
land or building or work which may be necessary or convenient for the purpose of the
Sports University and on such terms and conditions as it may think fit and proper and
to construct or alter and maintain any such building or works;
8.27
To sell, exchange, lease or otherwise dispose of all or any portion of the properties of
the University, movable or immovable, on such terms as it may think fit and consistent
with the interest, activities and objects of the Sports University in consultation with
JSSPS;
8.28
To raise and borrow money on bond, mortgages, promissory notes or other obligations
or securities founded or based upon all or any or the properties and assets of the
Sports University or without any securities and upon such terms and conditions as it
may think fit and to pay all expenses out of the funds of the University.
9.
Bar to affiliation.
9.1
The Sports University shall not admit any college or institution to the privilege of
affiliation.
9.2
The Sports University may open any off campus, offshore campus, and study centre,
examination centers in or out of the State of Jharkhand only after the prior approval of
University Grants Commission or such regulatory body established by the government
or State or Central Government, as the case may be.
9.3
Courses under Distance mode can be started only after the prior approval of University
Grants Commission or such regulatory body established by the Government.

10
The Visitors.
10.1
The Governor of Jharkhand will be the Visitor of the university.
10.2
The Visitor shall, when present, preside at the convocation of the University for
Conferring Degrees, Diplomas, Charters, Designation and certificates.
10.3
The Visitor shall have the right to visit the University or any institution maintained by
the University to ensure the standard of education, discipline, decorum and proper
functioning of the university.
11
Officers of the University:
The following shall be the officers of the University:
(a)
The Chancellor
(b)
The Vice Chancellor
(c)
The Registrar
(d)
The Chief Finance and Accounts Officer
(e)
The Controller of Examinations
12.
The Chancellor:
12.1
The President of Governing Council of Jharkhand State Sports Promotion Society shall
be Ex-Officio Chancellor of the Sports University
12.2
The Chancellor by virtue of his office shall be the Head of the University.
12.3
The Chancellor shall preside over the meetings of the Governing Body and shall, when
the Visitor is not present, preside over the convocation of the University for conferring
degree, diplomas, or other academic distinctions.
12.4
The Chancellor may in writing under his hand addressed to the head of the sponsoring
body resign his office.
12.5
The Chancellor shall have the following powers, namely:
(a)
To call for any information or record;
(b)
To appoint the vice Chancellor;
(c)
To remove the Vice Chancellor in accordance with the provisions of this Act;
and
(d)
Such other powers as may be conferred on him by this Act or Statues made
there under.
13.
The Vice Chancellor:
13.1
The Vice Chancellor shall be appointed by the Chancellor in consultation with the
sponsoring body as per the qualification prescribed by the University Grants
Commission and shall hold office for a period of five years. Provided that a person
appointed as Vice chancellor shall retire from office during tenure of his office or
extension thereof, if any when he completes the age of 70 years.

Provided further that after the expiry of the term of five years, the Vice
Chancellor shall be eligible for re-appointment for another term of five years.
13.2
The Vice Chancellor shall be the Principal executive and academic officer of the
University and shall exercise general superintendence and control over the affairs of
the university and shall execute the decisions of various authorities of the university.
13.3
In the absence of both Visitor and the Chancellor, the Vice Chancellor shall preside
over the convocation of the university.
13.4
The Vice Chancellor may, if he/she is of the opinion that immediate action is necessary
on any matter, exercise any power conferred on any authority of the University by or
under this Act and shall convey to such authority the action taken by him on such
matters;
Provided that if the authority of the University or any person in the service of
the University who is aggrieved by the action taken by the Vice Chancellor under this
sub section may prefer an appeal to the Chancellor within one month from the date of
communication of such decision. The Chancellor may confirm, modify or reverse
action taken by the Vice-Chancellor.
13.5
The Vice Chancellor shall exercise such powers and perform such other functions as
may be prescribed.
14. Removal of Vice Chancellor:
14.1
If at any time and after such inquiry as may be considered necessary, it appears to
the Chancellor that the Vice Chancellor:
(a)
Has failed to discharge any duty imposed upon him by or under this Act, the
Statutes, the Ordinances, or
(b)
Has acted in a manner prejudicial to the interests of the university, or
(c)
Is incapable of managing the affairs of the university, then the Chancellor may,
notwithstanding the fact that the term of office of the Vice Chancellor has not
expired, require the Vice Chancellor, by an order in writing stating the reason
there for, to resign his post from the date as may be specified in the order.
14.2
No orders under sub-section (1) shall be passed unless a notice stating the specific
grounds on which such action is proposed, has been served and a reasonable
opportunity to show cause against the proposed order has been given to the Vice
Chancellor.
15.
Registrar:
15.1
The Registrar shall be appointed by the President of the sponsoring body in such
manner, as may be specified in the statutes. The Registrar shall possess the
qualifications prescribed by the University Grants Commission.

15.2
The Registrar shall have the power to enter into agreements, sign documents and
authenticate records on behalf of the University and shall exercise such other power
and perform such other functions as may be prescribed.
15.3
The Registrar shall be the ex officio Member Secretary of the Executive Council and
the Academic Council but shall not have a right to vote.
16.
The Chief Finance and Accounts Officer:
16.1
The appointment of the Chief Finance and Accounts Officer shall be made by the
President of the Sponsoring Body in such manner as may be specified by the Statutes.
16.2
The Chief Finance and Accounts Officer shall exercise such powers and perform such
duties as may be specified by the Statutes.
17.
The Controller of Examinations:
17.1
The Controller of Examinations shall be whole time officer of the University and shall
be appointed by the President of the Sponsoring Body.
17.1.1 It shall be the duty of the controller of Examinations:
a)
To conduct examinations in a disciplined and efficient manner;
b)
To arrange for the setting of question papers with strict regards to
secrecy;
c)
To arrange for the evaluation of answer sheets in accordance with the
planned time schedule for results;
d)
To constantly review the system of examinations in order to enhance
the level of impartiality and objectivity with a view to make it better
instrument for assessing the attainments of students;
e)
To deal with any other matter connected with examinations which may,
from time to time be assigned to him by the Vice Chancellor.
18. Other Officers:
Manner of appointment and power and duties of the other officers of the University, if
requirement arises in the future, shall be such as may be prescribed.
19.
Authorities of the University:
The Following shall be the authorities of the University:

Such Other authorities as may be declared by the Statutes to be the authorities of the
University.
20.
The Governing Body:
20.1
The Governing Body shall have the following members, namely:
(a)
The Chancellor
(b)
The Vice-Chancellor
(c)
The Principal Secretary /Secretary to the Government, Department of Tourism,
Art Culture, Sports & Youth Affairs.
(d)
CMD, CCL
(e)
The Principal Secretary/ Secretary to the Government, Department of Higher
and Technical Education, Jharkhand, or his nominee.
(f)
The Principal Secretary/ Secretary to the Government Planning-cum-Finance,
Jharkhand.
(g)
Director (Finance), CCL
(h)
Executive Director, Sports Authority of Jharkhand.
(i)
Three persons nominated by the Chancellor on the recommendation of
Jharkhand State Sports Promotion Society (JSSPS), out of which two shall be
eminent sports personality.
(j)
One expert of management or technology from outside the University,
nominated by the Chancellor; and
(k)
Joint secretary, Minister of Sports, GOI.
(l)
One expert of Sports from Indian Olympic Association (IOA)/ Sports Authority
of India (SAI)/ National Institute of Sports (NIS)/Other important bodies.
(m)
One representative from Lakshmi Bai National College of Physical Education,
Gwalior.
20.2
The Governing Body Shall be the supreme authority and principal governing
body of the Sport University. It shall have the following power, namely:
A.
To provide general superintendence and directions and to control the
functioning of the University by using all such powers as are provided by this
Act, Statutes, Ordinance Regulations or Rules;
B.
To review the decisions of other authorities of the University in case they are
not in conformity with the provisions of Act, Statutes, Ordinances, Regulations
or Rules;
C.
To approve the budget and annual report of the University;
D.
To lay down the extensive policies to be followed by the University;
E.
To recommend to the sponsoring body for the dissolution of the University if a
situation arises when there is no smooth functioning of the University in spite of
best efforts; and

F.
Such other powers may be specified by the statutes.
20.3
The Governing Body shall meet at least three times in a calendar year.
20.4
The quorum of the meeting shall be four;
Provided that the Principal Secretary/Secretary to the Government, Department
of Tourism, Art Culture, Sports & Youth Affairs, Jharkhand, or in his absence, Director, Sports
shall be present in each meeting in which decisions on issues involving Government
policies/instructions are to be taken for the sports University.
21.
The Board of Management:
21.1
The Board of Management shall consist of the following members, namely;
21.1.1 The President of Executive Council (i.e. Secretary Art Culture Sports, Tourism,
& Youth Affairs, Govt. Of Jharkhand.)
21.1.2 The Secretary to the Government, Department of Higher and Technical
Education Jharkhand or his nominee.
21.1.3 CEO, LMC, JSSPS.
21.1.4 RD, SAI, Kolkata
21.1.5 Director (Sports), Directorate of Sports, Govt. Of Jharkhand.
21.1.6 Executive Director, SAJHA, Govt. Of Jharkhand.
21.1.7 Two members of the Governing Council, nominated by the JSSPS.
21.1.8 Director (Finance), CCL.
21.1.9 Registrar
21.1.10
Chief Finance & Accounts Officer.
21.2
The President of Executive Council shall be the Chair person of the Board of
Management.
21.3
The Powers and functions of the Board of Management shall be such as may be
specified by the statutes.
21.4
The quorum of the meeting shall be four;
22.
The Academic Council:
22.1
The Academic Council shall consist of the Vice Chancellor and such members as may
be specified by the statutes.
22.2 The Vice-Chancellor shall be the Chair person of the Academic Council.

22.3
The Academic Council shall be the principal academic body of the university and shall
subject to the provisions of this Act, Statutes, Ordinances, Regulations or Rules,
Coordinate and exercise general supervision over the academic policies of the sports
university.
22.4
The quorum for meetings of the Academic Council shall be such as may be specified
by the Statutes.
23.
The Finance Committee:
23.1
The Finance Committee shall be the principal financial body of the University to take
care of the financial matters.
23.2
The Constitution, powers and functions of the Finance Committee shall be such as
may be prescribed.
24.
Other Authorizes:
The constitution, powers and functions of other authorities of the University shall be
such as may be prescribed.
25.
Disqualification for membership of an authority or body.
A person shall be disqualified from being a member of any of the authorities or bodies of the
university, if he/she:
25.1
Is of unsound mind and stands so declared by a competent court;
25.2 Is an adjudged insolvent;
25.3
Has been convicted of any offence involving moral turpitude;
25.4
Has been punished for indulging or in promoting unfair practice in the conduct of any
examination, in any form, anywhere;
25.5
Dismissed, removed or imposed major punishment by his erstwhile employer.
26.
Vacancies not to invalidate the constitution of, or the proceedings of any authority or body of
university.
No Act or proceeding of any authority of the sports university shall be invalid merely by
reason of any vacancy in or defect in the constitution of any authority or body of the sports
university .
27.
Constitution of Committees:
The authorities of the University may constitute such committee with such terms of reference
as may be necessary for specific tasks to be performed shall be such as may be prescribed by
the Statutes.

28.
STATUTES, ORDINANCE AND REGULATIONS
28.1
First Statute.
28.1.1 Subject to the provisions of this Act, and the rules made there under, the First statutes
may provide for all or any of the following matters , namely:
28.1.1.1
The constitution, power and functions of the authorities and other
bodies of the University as may be constituted from time to time;
28.1.1.2
The terms and conditions of appointment of the Chancellor, the Vice
Chancellor, and their powers and functions;
28.1.1.3
The manner and terms and conditions of appointment of the Registrar
and Chief Finance and Accounts Officer, their powers and functions;
28.1.1.4
The manner and terms and conditions of appointment of other Officers
and Teachers and their powers and functions;
28.1.1.5
The terms and conditions of service of employees of the Sports
University;
28.1.1.6
The procedure for arbitration in cases of dispute between employees or
student and the Sports University;
28.1.1.7
The conferment of honorary degrees;
28.1.1.8
The provisions regarding exemptions from payment of tuition fee and
awarding scholarship and fellowship to the students;
28.1.1.9
Framing of policy for admission, including regulation of reservation of
seats; and
28.1.1.10
Fees to be charged from students.
28.2
The first statutes of the Sports University shall be made by the Governing body and
shall be submitted to the State Government for its approval.
28.3
The State Government shall consider the First Statutes, submitted by the Sports
University and shall approve it within sixty days from the date of its receipt, with or
without modifications as it may deem necessary.
28.4
The Sports University shall communicate its agreement to the first Statutes as approve
by the State Government, and if it desires not to give effect to any or all the
modifications made by the State Government under sub-section (3) it may give

reasons therefore and after considering such reason, the State Government may or
may not accept the suggestions made by the Sports University.
28.5
The State Government shall publish the First statutes as finally approved by it, in the
Official Gazette, and there after itself come into force from the date of such publication.
29.
Subsequent Statutes:
29.1
Subject to the provisions of this Act and the rules made thereafter, the subsequent
statutes of the University may provide for all or any of the following matters, namely :-
(a)
Creation of new authorities of the Sports University;
(b)
Accounting policy and financial procedure;
(c)
representation of Teachers in the authorities of the Sports University;
(d)
Creation of new departments and abolition or restructuring of existing
Departments;
(e)
Institutions of medals and prizes;
(f)
Procedure for creation and abolition of posts;
(g)
Revision of fees;
(h)
Alteration of the number of seats in different disciplines; and
(i)
All other matters which by or under the provision of this Act required to be
prescribed by the statutes.
29.2
The Statutes of the University other than the first statutes shall be made by the board
of management with the approval of the Governing Body.
29.3
The Statutes made under sub section (2) shall be submitted to the State Government
and it may approve or, if considers necessary, give suggestions for modification as far
as possible within two months from the date of receipt of the statutes.
29.4
The Governing Body shall consider the modifications suggested by the State
Government and return the Statutes to it with its agreement to such changes or with its
comments on the suggestions made by the State Government.
29.5
The State Government shall consider the comments of the Government Body and may
approve the Statutes with or without modifications and it shall be publish by it in the
Official Gazette, and shall come into force from the date of such publication.

30.
First Ordinance:
30.1
Subject to the provisions of this Act, the rules and the Statutes made there under,
the First Ordinances may provide for all or any of the following matter, namely :-
30.1.1 The admission of students to the Sports University and their enrolments as
such
30.1.2 The courses of study to be laid down for degrees diploma and certificates of
the Sports University;
30.1.3 The award of degree , diploma, certificates and other academic distinctions ,
the minimum qualifications for the same ;
30.1.4 The conditions for award of fellowships, scholarships, stipends, medals and
prizes;
30.1.5 The conduct of examinations, including the terms of office and manner of
appointment and the duties of examining bodies examiners and moderators;
30.1.6 Fees to be charged for the various course examinations, degrees or diplomas
of the Sports University.
30.1.7 The conditions of residence of the students of the Sports University.
30.1.8 Provision regarding disciplinary action against the students;
30.1.9 The creation, composition and functions of any other body which is considered
necessary for improving the academic life of the Sports University.
30.1.10 The manner of co-operation and collaboration with other sports Universities,
institutions of higher educations, Universities (both national and International)
30.1.11 Such other matter which are required to be provided by the Ordinances by or
under this Act.
30.2
The First Ordinance of Sports University shall be made by the Chancellor which after
being approved by the Governing Body, shall be submitted to the State Government
for its approval.
30.3
The State Government shall consider the First Ordinance submitted by the Chancellor
under sub-section (2) within sixty days from the date of its receipt and may approve it
or give suggestions for modifications therein.
30.4
The Chancellor shall either modify the Ordinance incorporating the suggestion of the
State Government or give reasons for not incorporating any of the suggestions made
by the State Government and shall return the First Ordinance along with such

reasons , if any, to the State Government and on receipt of the same , it shall consider
the comments of the Chancellor and may approve the First Ordinances of the Sports
University with or without such modifications and it shall come into force from the date
of such publication.
31.
Subsequent Ordinances
31.1
All Ordinance other than the First Ordinance shall be made by the Academic Council
which after being approved by the Governing Body shall be submitted to the State
Government for its approval.
31.2
The State Government shall consider the ordinances submitted by the Academic
Council under sub- section (1) as far as possible within two months from the date of
its receipt and may approve it or give suggestion for modifications therein.
31.3
The Academic Council shall either modify the Ordinance incorporating the suggestions
of the State Government or give reasons for not incorporating any of the suggestions
made by the State Government and shall return the Ordinance along with reasons , if
any, to the State Government on receipt of the same it shall consider the comments
of the Academic Council and may approve the Ordinance with or without modification
and it shall be published in the Official Gazette, and shall come into force from the date
of such publication.
32.
Regulations:
The authorities of the Sports University may, subject to the prior approval of the
Governing Body make Regulation, consistent with this Act, the Statutes and the Ordinances
made there under, for the conduct of business of the each such authority and committee
constituted by each such authority.
33.
Powers of State Government to give directions:
33.1
The State Government may, for the purpose of ascertaining the standards of teaching,
examination and research or any other matter relating to the Sports University, cause
an assessment to be made in such manner as may be prescribed, by such person or
persons as it may deem fit.
33.2
The State Government shall communicate its recommendations to the Sports
University on the basis of such assessment for corrective action. The Sports University
may adopt such corrective measures and make efforts so as to ensure the compliance
of the recommendations.
33.3
The State Government may give such directions as it may deem fit if the Sports
University fails to comply with the recommendation made under sub section (2) within
the time so prescribed by the State Government. The directions given by the State
Government shall be immediately compiled by the Sports University.

FUNDS OF UNIVERSITY
34.
Endowment Fund:
34.1
The Sponsoring body shall establish an Endowment Fund for the Sports University
within amount specified in the letter of intent.
34.2 The Endowment Fund shall be used as security deposit to ensure that the Sports
University complies with the provisions of this Act and functions as per the provisions
of this Act, the statutes and the Ordinances. The State Government shall have the
power to forfeit, a part or whole of the Endowment Fund in case the University or the
sponsoring body contravenes the provisions of this Act, statutes, the Ordinances, the
regulations or the rules made there under.
34.3
The Sports University may utilise the income from the Endowment Fund for the
development of infrastructure of the University and not to meet the recurring
expenditure of the University.
34.4
The amount of Endowment Fund shall be invested in such instruments as the
Government may prescribe and kept invested until the dissolutions of the Sports
University.
34.5
In case of investment in long term security, the certificate of the securities shall be kept
in the safe custody of the Government and in case of deposits in the interest bearing
Personal Deposit account in the Government treasury, deposit shall be made with the
condition that the amount shall not be withdrawn without the permission of
Government.
35.
General Fund:
35.1
The Sports University shall establish a fund, which shall be called the General fund to
which the following shall be credited, namely:
35.1.1 Fees and other charges received by the Sports University;
35.1.2 Any contribution made by the Sponsoring body;
35.1.3 Any income received from consultancy and other work undertaken by the
Sports University in pursuance of its objective;
35.1.4 Trust, bequests, donations, endowments and any other grants; and
35.1.5 All other sums received by the Sports University.
35.2
The General Fund shall be utilized for the following objects, namely:
35.2.1 For the repayment of debts including interest charges thereto incurred by the
University for the purposes of this Act and the Statutes, the Ordinances, the
regulations, and the rules made there under with the prior approval of the
Governing body;
35.2.2 To upkeep the assets of the University;

35.2.3 For the payment of the fee for audit of the funds created under sections 7 and
8;
35.2.4 To meet with the expenses of any suit or proceedings by or against the
University;
35.2.5 For the payment of salaries, allowances, provident fund contributions, Gratuity
and other benefits to the Officers, employees and members of the teaching/
non teaching and research staff.
35.2.6 For the payment of travelling and other allowances of the members of the
Governing Body, the Board of Management, the Academic Council, other
authorities and the member of any committee appointed by any of the authority
or the President of the sponsoring body or the Chancellor as per their
entitlements.
35.2.7 For the payment of fellowships, freeships, scholarships, assistantships and
other awards to the students belonging to economically weaker sections of the
society or research associates, trainees or, as the case may be, in any student
otherwise eligible for such awards under the statutes, the Ordinances, the
regulations or the rules;
35.2.8 For the payment of any expenses incurred by the University in carrying out the
provisions of Act, statutes, the Ordinances, the regulations or the rules;
35.2.9 For the payment of cost of capital, not exceeding the prime lending rate from
time to time of the State Bank of India, incurred by the sponsoring body for
setting up the University and the investments made therefore;
35.2.10
For the payment of charges and expenditure relating to the consultancy
work undertaken by the Sports University in pursuance of this Act, Statutes the
Ordinances, the regulations or the rules;
35.2.11
For the payment of any other expenses including service fee payble to
any organization charged with the responsibility of providing any specific
service, including the managerial services to the University, on behalf of the
sponsoring body as approved by the Governing body to be an expense for the
purposes of the Sports University;
Provided that no expenditure shall be incurred by the sports university in
excess of the limits for total recurring expenditure and total non-recurring expenditure
for the year, as may be fixed by the Governing Body, without prior approval of the
Governing Body.

ACCOUNTS, AUDIT AND ANNUAL REPORT
36.
Annual Report:
The Annual report of the Sports University shall be prepared by the University which
shall include among other matters, the steps taken by the University towards the fulfilment of
its objects and shall be submitted to the State Government.
37.
Audit and Annual Accounts:
37.1
The annual accounts including balance sheet of the Sports University shall be
prepared by the University and the Annual accounts shall be audited at least once in
every year by the auditors appointed by the Finance Department on demand of Sports
University for this purpose.
37.2
A copy of the annual accounts together with the audit report shall be submitted to the
State Government.
WINDING UP OF UNIVERSITY
38.
Winding up of University:
38.1
If the sponsoring body proposes to dissolve itself according to the provisions of law
governing its constitution or incorporation; it shall give at least six months prior notice
to the State Government.
38.2
The State Government shall, on receipt of such notice make such arrangements as
may be necessary, for the administrations of the Sports University from the Date of
dissolution of the sponsoring body till the completion of syllabus by the last batch of
students admitted to the Sports University and may also cause the functioning of the
University to continue by appointing an administrator in place of the sponsoring body,
who shall be entrusted with the powers, duties and functions of the sponsoring body,
duties and functions of the sponsoring body as prescribed under this Act.
39.
Dissolution of University:
39.1
The sponsoring body who intends to dissolve the Sports University shall give a notice
to that effect in the prescribed manner to the State Government. The State
Government, after due consideration, may dissolve the University in the manner as
may be prescribed;
Provided that the dissolution of the Sports University shall have effect only after
the last batches of students of the regular courses have completed their courses and
they have been awarded degrees, diplomas or, as the case may be, awards.

39.2 On the dissolution of the Sports University all the assets and liabilities of the University
shall vest in the sponsoring body in the manner as may be prescribed.
39.3
where the State Government decides under sub-section (1) to dissolve University, it
may vest the powers of Governing body in prescribed manner to other bodies having
similar objects till the dissolution of the university takes effect under the provision to
the sub- section (1).
40.
Special powers of the State Government under certain circumstances:
40.1
Where the State Government is of the opinion that the university has contravened any
of the provision of this Act, the rules, the statutes or the ordinances made thereunder
or has violated any of the direction issued by it under this Act or a situation of financial
mismanagement or mal-administration has arisen in the Sports University, it shall
issue the notice requiring the University to Show cause within 45 days as to why
administrator be not appointed.
40.2
On receipt of reply of the University on the notice issued under sub-section (1), if the
State Government is satisfied that there is prima facie case of contravention of any of
the provision of this Act, the rules, the Statutes or the Ordinances made thereunder or
violation of directions issued by it under this Act or there is financial mismanagement
or mal-administration, it shall make an order of such enquiry as it may consider
necessary.
40.3
The State Government shall, for the purposes of any such enquiry under sub-section
(2), appoint an Inquiry Officer or Officers to inquire into any of the allegations and to
make report thereon.
40.4
The Inquiry Officer or Officers appointed under sub-section (3) shall have the same
powers as are vested in a Civil Court under the Code of Civil Procedure, 1908 while
trying a suit in respect of following matters, namely:-
(a)
Summoning and enforcing the attendance of any person and examining
him on oath;
(b)
Requiring the discovery and production of any such document or any other
material as may be predicable in evidence;
(c)
requisitioning any public record from any court or office.
40.5
On receipt of the inquiry report from the Officer or Officers appointed under sub
section (3), if the State Government is satisfied that the Sports University has
contravened all or any of the provisions of this Act, the rules, the Statutes or the
Ordinances made thereunder or has violated any of the directions issued by it under

this Act or a situation of financial mismatch and mal-administration has arisen in the
university which threatens the academic standard of the Sports University, it may
appoint an administrator.
40.6
The administrator appointed under sub section (5) shall exercise all the powers and
perform all the duties of the Governing bodies and the Board of Management under
this Act and shall administer the affairs of the Sports University until the last batch of
Students of the regular courses have completed their courses and they have been
awarded with degrees, diplomas or , as the case may be, awards.
40.7 After having been awarded the degrees, diplomas or, as the case may be , to the last
batches of the students of the regular courses, the administrator shall make a report to
that effect to the State Government.
40.8
On receipt of the report under sub section (7), the State Government shall dissolve the
University and on dissolution of the University, all the assets and liabilities of the
Sports University shall vest in the sponsoring body.
MISCELLANEOUS
41.
Power of the State Government to make rules:
41.1 The State Government may, by notification in the official gazette, make rules for
carrying out the purposes of this Act.
41.2
All rules made under this section shall be laid for not less than 30days before the State
legislature or to such modification as the State Legisture may make during session in
which they are so laid for the session immediately following.
42.
Completion of course of Students:
Notwithstanding anything contained in this Act or the regulation, any student of the
constituent colleges or institutes of the sports university specified in the schedule and affiliated
to any University who immediately before the commencement of this Act was studying or was
eligible for any examination of that University shall be permitted to complete his course in
preparation therefor, and the university shall provide for the instruction, teaching, training and
examination of such students, in accordance with the course of studies of the respective
university in such manner and for such period as may be prescribed.
43.
Power to remove difficulties.
43.1
If any difficulty arises in giving effect to the provisions of this Act, the State
Government may, by order published in the Official Gazette, make provisions not
inconsistent with the provisions of the provisions of this Act, as appear to it to be
necessary or expedient for removing the difficulty.

Provided that no notification order under sub section (1) shall be made after the
expiration of a period of three years from the commencement of this Act.
43.2
Every order made under this section shall, as soon as after it is made, be laid before,
the State Legislature.
SCHEDULE - A
(1)
May acquire not less than 10 acres of land for its main Campus after starting the
functioning of the University.
(2)
May construct academic building including library, lectures theatres, laboratories etc.
adequate residential accommodations for teachers, guest houses , hostels which shall
gradually be increased to accommodate at least 25 % of the total students strength in
each course within 3 years of its coming into existence. In case the Sports University is
conducting professional programmes of study, prevailing norms and standards of
respective statutory body shall be applicable. Existing institutes must undertake
expansion/ renovation/restructuring to meet the prescribed norms of the State
Government.
