झारखÖड सूêम, लघु एवं मÚयम उɮयम (ͪवशेष छूट) अͬधǓनयम, 2025

समावेशी आͬथ[क ͪवकास एवं रोजगार सृजन को बढ़ावा देने के उɮदेæय से, राÏय का लêय सूêम, लघु और

मÚयम उɮयमɉ कȧ ͪवͧशçट आवæयकताओं का समाधान करना और उɮयमशीलता को बढ़ावा देना है। यह

समीचीन है ͩक कुछ अनुमोदनɉ और Ǔनरȣ¢णɉ से, सूêम, लघु और मÚयम उɮयमɉ के सुगम संचालन एवं

èथापना मɅ छूट दȣ जाय।

सूêम, लघु और मÚयम उɮयमɉ कȧ èथापना और संचालन के ͧलए अनुमोदनɉ और Ǔनरȣ¢णɉ से छूट

Ĥदान करना एवं उसके आनुषंͬगक मामलɉ के Ǔनçपादन हेतु झारखÖड ͪवधानसभा, भारत गणराÏय के पच हतरवɅ

वष[ मɅ ǓनàनǾपेण अͬधǓनयम बनाती हैः-

1. संͯ¢Üत शीष[क, ͪवèतार और Ĥारंभः

(1) यह अͬधǓनयम ’’झारखÖड सूêम, लघु एवं मÚयम उɮयम (ͪवशेष छूट) अͬधǓनयम 2025’’

कहलायेगा।

(2) इसका ͪवèतार सàपूण[ झारखÖड राÏय मɅ होगा।

(3) यह उस तारȣख से Ĥवृत होगा िजस Ǒदन यह झारखÖड सरकार के राजपğ मɅ Ĥकाͧशत होगा।

2. इस अͬधǓनयम कȧ पǐरभाषाएँ, जब तक ͩक संदभ[ से अÛयथा अपेͯ¢त न होः

(क) ’’ अͧभèवीकृǓत Ĥमाण-पğ’’ से अͧभĤेत है इस अͬधǓनयम कȧ धारा-5 के तहत जारȣ ͩकया गया

अͧभèवीकृǓत Ĥमाण-पğ।

(ख) ’’अͬधǓनयम’’ से अͧभĤेत है झारखÖड सूêम, लघु एवं मÚयम उɮयम (ͪवशेष छूट) अͬधǓनयम

2025

(ग) ’’अनुमोदन’’ से अͧभĤेत है राÏय मɅ ͩकसी उɮयम कȧ èथापना या संचालन के ͧलए अनुसूची मɅ

उãलेͨखत ͩकसी राÏय के कानून के तहत आवæयक कोई अनुमǓत, अनापͪƣ Ĥमाण-पğ, मंजूरȣ,

सहमǓत, अनुमोदन, पंजीकरण, लाईसɅस और समǾप मामले।

(घ) ’’स¢म Ĥाͬधकार’’ से अͧभĤेत है राÏय सरकार का कोई भी ͪवभाग अथवा एजɅसी, èथानीय

Ĥाͬधकार, वैधाǓनक Ǔनकाय, राÏय के èवाͧम×व वाला Ǔनगम, पंचायती राज संèथान, नगरपाͧलका, नगर

ͪवकास Ĥाͬधकार एवं राÏय के कानून ɮवारा गǑठत राÏय सरकार के ĤशासǓनक Ǔनयंğणाधीन वैसे सभी

Ĥाͬधकार अथवा एजɅसी िजÛहɅ राÏय के तहत उɮयोगɉ कȧ èथापना अथवा संचालन हेतु èवीकृǓत Ǔनग[त

करने का अͬधकार एवं दाǓय×व Ĥदत है।

ड.)

’’संयुÈत आवेदन Ĥपğ’’ का अथ[ ऐसे इलेÈĚॉǓनक फॉम[ से है जो झारखÖड एकल ͨखड़कȧ मंजूरȣ

अͬधǓनयम, 2015 के तहत Ǔनधा[ǐरत है िजसमɅ सभी मंजूरȣ के ͧलए एक åयिÈतगत आवेदन Ĥपğ

शाͧमल हɇ।

(च)

’’ͪवभाग’’ से ता×पय[ है झारखÖड सरकार का उɮयोग ͪवभाग।

(छ)

’’उɮयम’’ का वहȣ अथ[ होगा जो भारत सरकार के सूêम, लघु और मÚयम उɮयम (एमएसएमई)

ͪवकास अͬधǓनयम, 2006 कȧ धारा 2 (ई) मɅ है (सं0 2006 का 27)।

(ज)

’’नोडल एजɅसी’’ का अथ[ है धारा 3 मɅ ǓनǑद[çट नोडल एजɅसी।

(i) ’अͬधसूचना’ का अथ[ है राजपğ (ई-गजट), झारखÖड मɅ Ĥकाͧशत अͬधसूचना।

(ii) ’ͪवǑहत’ का अथ[ है इस अͬधǓनयम के तहत बनाए गए Ǔनयमɉ ɮवारा ͪवǑहत।

(झ) ’अनुसूची’ का अथ[ है इस अͬधǓनयम से जुड़ी अनुसूची।

(´)

’राÏय सरकार’ का अथ[ है झारखÖड राÏय सरकार।

(ट)

’उɮयोग आधार’ का ता×पय[ औɮयोͬगक इकाईयɉ कȧ ऐसी पंजीकरण संÉया से है, जो समय-समय पर

केÛġȣय सूêम, लघु और मÚयम उɮयम मंğालय ɮवारा Ǔनधा[रत कȧ जाती है।

3. नोडल एजɅसीः-

(1) सरकार के अधी¢ण, Ǔनदȶशन एवं Ǔनयंğण के अधीन झारखÖड ͧसंगल ͪवÖडो ÈलȣयरɅस ऐÈट 2015

(अͬधǓनयम-10, 2016) मɅ यथा पǐरभाͪषत ͧसंगल ͪवÖडो ÈलȣयरɅस कͧमटȣ के ͧलए एम0 एस0 एम0 ई0

Ǔनदेशालय इस ऐÈट के उɮदेæयɉ कȧ पूǓत[ के ͧलए राÏय èतरȣय नोडल एजɅसी होगी।

(2) सरकार के अधी¢ण, Ǔनदȶशन और Ǔनयंğण के अधीन झारखÖड मɅ ͧसंगल ͪवÖडो ÈलȣयरɅस अͬधǓनयम 2015

(झारखÖड अͬधǓनयम-10, 2016) मɅ पǐरभाͪषत िजला एम0 एस0 एम0 ई0 केÛġ (DMC) इस अͬधǓनयम

पǐरयोजनɉ के ͧलए उनके अͬधकार ¢ेğ के अÛतग[त आनेवाले ¢ेğ कȧ िजला èतरȣय नोडल एजɅसी होगी।

4. नोडल एजɅसी कȧ शिÈतयाँ एवं काय[ः-

1) सरकार के अधी¢ण, Ǔनदȶशन और Ǔनयंğण के अधीन नोडल एजɅसी कȧ शिÈतयाँ और काय[ ǓनàनǾपेण हɉगे-

(क) राÏय मɅ उɮयमɉ कȧ èथापना मɅ सहायता एवं सुͪवधा Ĥदान करना।

(ख) इस अͬधǓनयम के तहत ĤाÜत आशय कȧ घोषणा और जारȣ ͩकये गये पावती Ĥमाण-पğ का

ǐरकॉड[ रखना।

(ग) राÏय èतरȣय नोडल एजɅसी, इस अͬधǓनयम कȧ धारा-7 मɅ उãलेͨखत िजàमेदाǐरयɉ से उɮयम

ɮवारा ͪवचलन से संबंͬधत जानकारȣ के मामले मɅ संबंͬधत ͪवभाग/एजɅसी को पूछताछ/ Ǔनरȣ¢ण के

ͧलए Ǔनदȶͧशत/अनुरोध करेगी।

2) सरकार इस अͬधǓनयम के Ĥावधानɉ को Ĥभावी करने के ͧलए नोडल एजɅसी को ऐसी अÛय शिÈतयाँ और

काय[ सɋप सकती है जो वह उͬचत समझɅ।

5. घोषणा और अͧभèवीकृǓत Ĥमाण-पğ दाͨखल करना-

(1) कोई भी åयिÈत जो उɮयम शुǾ करने का इरादा रखता है वह नोडल एजɅसी को उɮयम शुǾ करने के इरादे

कȧ घोषणा Ĥèतुत कर सकता है।

èपçटȣकरणः- कोई भी उɮयम, जो इस अͬधǓनयम के Ĥारंभ होने से पहले ͩकसी भी अनुमोदन को ĤाÜत करने

के ͧलए स¢म Ĥाͬधकार के पास गया है और वह इस अनुमोदन को इस अͬधǓनयम कȧ Ĥभावी तारȣख तक

ĤाÜत नहȣं ͩकया है, वह भी इस उपधारा के अÛतग[त उɮयम शुǾ करने के इरादे कȧ घोषणा Ĥèतुत करने का

ͪवकãप भी चुन सकता है।

(2) उɮयम, उɮयोग ͪवभाग कȧ ͧसंगल ͪवÖडो ÈलȣयरɅस ͧसèटम के वेबसाईट पर आशय कȧ घोषणा आवेदन

जमा करके कर सकता है। वैकिãपक Ǿप से, उɮयम सरकार ɮवारा जारȣ वैध फोटो आई0डी0 Ĥमाण जैसे-बɇक

फोटो पासबुक, मतदाता पहचान-पğ, पासपोट[, Ĝाईͪवंग लाईसɅस, पैन काड[ के साथ तीसरȣ मंिजल, नेपाल हाऊस

ǒबिãडंग मɅ िèथत उɮयोग ͪवभाग के ͧसंगल ͪवÖडो काया[लय मɅ जाकर आशय कȧ घोषणा भर सकता है।

(3) इस अͬधǓनयम के तहत आवेदन करने के ͧलए कोई आवेदन या कोई अÛय अǓतǐरÈत शुãक नहȣं लगेगा।

(4) सभी Ĥकार से पूण[ घोषणा ĤाÜत होने पर नोडल एजɅसी तुरंत उस उɮयम को एक यथा Ǔनधा[ǐरत पावती

Ĥमाण-पğ जारȣ करेगा।

6. अͧभèवीकृǓत Ĥमाण-पğ का Ĥभाव-

(1) उɮयम को आशय कȧ घोषणा कȧ पुिçट के Ĥमाण के Ǿप मɅ एक कàÜयूटर जǓनत अͧभèवीकृǓत ĤाÜत होगा।

(2) धारा-5 के तहत Ǔनग[त अͧभèवीकृǓत Ĥमाण-पğ, सभी उɮदेæयɉ के ͧलए ऐसा Ĥभाव रखेगा मानो ͩक उस

उɮयम को पावती कȧ सूचना से अगले तीन वषɟ तक अथवा वाͨणिÏयक उ×पादन के Ĥारंभ होने कȧ Ǔतͬथ

अथवा संचाͧलत होने कȧ Ǔतͬथ, जो भी पहले हो, तक Ĥभावी रहेगा।

(क) बशतȶ ͩक अͧभèवीकृǓत Ĥमाण-पğ जारȣ होने के बाद उɮयम ऐसे अनुमोदन के ͧलए सभी

आवæयकताओं का पालन करेगा।

(ख) बशतȶ ͩक जहां भी ऐसी योजना लागू है अͧभèवीकृǓत Ĥमाण-पğ ͩकसी åयिÈत को माèटर Üलान

मɅ ǓनǑद[çट भूͧम उपयोग से इतर मɅ भूͧम का उपयोग करने का अͬधकार नहȣं देगा ।

(ग) बशतȶ ͩक यǑद उɮयम पूव[वतȸ परÛतुक आवæयकताओं का पालन करने मɅ ͪवफल रहता है तो

कानून के तहत उɮयम के ͨखलाफ अपेͯ¢त कार[वाई कȧ सकेगी।

(3) तीन वष[ कȧ अवͬध के दौरान कोई भी स¢म पदाͬधकारȣ ͩकसी भी अनुमोदन के उɮदेæय से या उसके संबंध

मɅ कोई Ǔनरȣ¢ण नहȣं करेगा जबतक कȧ जीवन और सुर¢ा को खतरा न हो। यǑद कǓतपय कारणɉ से ͩकसी

उɮयम का Ǔनरȣ¢ण करना हो तो िजला मिजèĚेट/Ǔनदेशक, एम0एस0एम0ई0 कȧ अनुमǓत ĤाÜत कȧ जायेगी।

7. उɮयम कȧ िजàमेदाǐरयाँ-

(1) अͧभèवीकृǓत Ĥमाण-पğ कȧ समािÜत के बाद उɮयम को अͧभèवीकृǓत Ĥमाण-पğ कȧ वैधता कȧ Ǔतͬथ से छः

महȣने के भीतर आवæयक अनुमोदन ĤाÜत करना होगा।

(2) उɮयम, Ĥासंͬगक सुर¢ा कोड मɅ Ǔनधा[ǐरत मानकɉ को बनाये रखेगा और कम[चाǐरयɉ या Įͧमकɉ कȧ सुर¢ा

एवं èवाèØय के ͧलए आपातकालȣन तैयारȣ बनाये रखेगा।

(3) उɮयम ऐसी ͩकसी भी ͪवǓनमा[ण और सेवा संबंधी ͩĐया-कलाप मɅ संलÊन नहȣं रहा हो जो ͩकसी भी

साव[जǓनक èवाèØय या कानून åयवèथा के तहत Ǔनͪषɮध है या जो गंभीर खतरा पैदा कर सकता है।

(4) उɮयम आशय कȧ घोषणा ɮवारा Ĥदान कȧ गयी जानकारȣ मɅ ͩकसी भी बदलाव कȧ सूचना देगा।

8. छूट-

सरकार या उसके अधीन कोई भी Ĥाͬधकार िजÛहɅ ͩकसी केÛġȣय अͬधǓनयम के तहत ͩकसी उɮयम को ͩकसी

अनुमोदन या Ǔनरȣ¢ण या इनसे संबंͬधत ͩकसी Ĥावधान से छूट देने का अͬधकार हो तो सरकार या कोई

Ĥाͬधकार, जैसा भी मामला हो, केÛġȣय अͬधǓनयम के Ĥावधानɉ के अधीन रहते हुए अͧभèवीकृǓत Ĥमाण-पğ

जारȣ होने कȧ तारȣख से कम से कम तीन वषɟ कȧ अवͬध के ͧलए इस Ĥकार का छूट देने कȧ शिÈत का Ĥयोग

कर सकɅ गे।

9. सदभावनापूव[क कȧ गयी कार[वाई का संर¢ण-

इस अͬधǓनयम या उसके तहत बनाये गये ͩकसी भी Ǔनयम के तहत सदभावना से ͩकये गये या ͩकये जानेवाले

ͩकसी भी काय[ के ͧलए सरकार या नोडल एजɅसी का कम[चारȣ, नोडल एजɅसी या ͩकसी åयिÈत के ͪवǾɮध कोई

मुकदमा, अͧभयोजन या अÛय कानूनी काय[वाहȣ नहȣं होगी।

10. अͬधǓनयम का अÚयारोहȣ Ĥभाव होना-

झारखÖडगजट(असाधारण) बुधवार, 12 नवàबर, 2025

राÏय के ͩकसी भी अÛय कानून मɅ ǓनǑहत Ĥावधानɉ मɅ कुछ भी असंगत होने ͩक िèथǓत मɅ इस अͬधǓनयम का

Ĥावधान Ĥभावी होगा।

11. बचत-

इस अͬधǓनयम के धारा-6 और 7 के Ĥावधानɉ के अधीन अͬधǓनयम मɅ èपçट Ǿप से Ĥदान कȧ गयी समय-सीमा

को छोड़कर ͩकसी भी उɮयम को उस समय लागू ͩकसी भी कानून के Ĥावधानɉ या उसके तहत ǓनǑद[çट ͩकसी

भी Ǔनयामक उपायɉ और मानकɉ को आवेदन से छूट देने के Ǿप मɅ नहȣं माना जायेगा।

12. अनुसूची मɅ संशोधन करने कȧ शिÈत-

राÏय सरकार अͬधसूचना के ɮवारा अनुसूची कȧ ͩकसी भी Ĥͪविçट को जोड़ या हटा सकती है अथवा अनुसूची

मɅ संशोधन कर सकती है तथा िजसके बाद अनुसूची को संशोͬधत माना जायेगा।

13. अͧभèवीकृǓत Ĥमाण-पğ को ĤǓतसंहरण करने कȧ शिÈत-

अͧभèवीकृǓत Ĥमाण-पğ को Ǔनàनͧलͨखत शतɟ के तहत ĤǓतसंहरण ͩकया जा सकता है-

(1) इरादे कȧ घोषणा मɅ जानबूझकर गलत जानकारȣ Ĥèतुत करना।

(2) अͬधǓनयम और Ǔनयम के ͩकसी भी Ĥावधान का उãलंघन करना।

(3) यǑद उɮयम सूêम, लघु एवं मÚयम उɮयम नहȣं रह जाता है।

(4) यǑद उɮयम आशय कȧ घोषणा मɅ उãलेͨखत ͪव-Ǔनमा[ण या सेवा गǓतͪवͬध का èथान बदलता है।

(5) यǑद ͪवलय या ͪवभाजन या पृथककरण या अͬधĒहण या समामेलन के कारण उɮयम का अिèत×व समाÜत

हो जाता है और उɮयम ऐसी åयवèथा का Ǒहèसा होता है।

14. कǑठनाईयɉ को दूर करने कȧ शिÈत-

(1) यǑद इस अͬधǓनयम के Ĥावधानɉ को Ĥभावी करने मɅ कोई कǑठनाई उ×पÛन होती है तो राÏय सरकार

सामाÛय या आͬधकाǐरक राजपğ मɅ आदेश Ĥकाͧशत कर ऐसे Ĥावधान कर सकती है जो इस अͬधǓनयम के

Ĥावधानɉ से असंगत न हो और जो उसे उÈत कǑठनाई को दूर करने के ͧलए आवæयक Ĥतीत हो।

परÛतुक इस Ĥकार का कोई भी आदेश इस अͬधǓनयम के Ĥवृ× त होने के Ǔतͬथ से तीन वष[ कȧ अवͬध

åयतीत हो जाने के उपरांत Ǔनग[त नहȣं कȧ जा सकेगी।

(2) इस धारा के तहत Ǔनग[त ͩकया गया Ĥ×येक आदेश राÏय ͪवधानसभा के सम¢ यथाशीē रखा जायेगा।

15. Ǔनयम बनाने कȧ शिÈƣ-

(1) राÏय सरकार अͬधसूचना के माÚयम से अͬधǓनयम या अͬधǓनयम का कोई उɮदेæय पूरा करने के ͧलए

Ǔनयम बना सकती है।

(2) इस अͬधǓनयम के तहत राÏय सरकार ɮवारा बनाये गये Ĥ×येक Ǔनयम को राÏय ͪवधानसभा के सम¢ रखा

जायेगा।

16. Ǔनरसन और åयावृ ͪƣ -

इस अͬधǓनयम के Ĥवृ× त होने से पहले सूêम, लघु और मÚयम उɮयमɉ के संबंध मɅ ͪवͧभÛन औɮयोͬगक

नीǓतयɉ और Ǔनयमɉ के तहत ͩकया गया कोई भी काय[ या कोई कार[वाई इस अͬधǓनयम से संबंͬधत Ĥावधानɉ

के तहत वैध Ǿप से कȧ गयी मानी जायेगी।

अंĒेजी अनुवाद झारखंड राÏयपाल के Ĥाͬधकार से इसके ɮवारा Ĥकाͧशत ͩकया जाता है, िजसे भारत का संͪवधान

के अनुÍछेद 348 के खंड (3) के अधीन उÈत अͬधǓनयम का अंĒेजी भाषा मɅ Ĥाͬधकृत पाठ समझा जाएगा।

JHARKHAND MICRO, SMALL AND MEDIUM ENTERPRISES (SPECIAL CONCESSION) ACT, 2025

(Jharkhand Act- 10, 2025)

An Act with a view to promote inclusive economic growth and employment generation, the State aims

to address the specific needs of the Micro, Small and Medium enterprises and to promote

entrepreneurship. It is expedient to give effect to exemption from certain approvals and inspections

required for establishment and operation of micro, small and medium enterprises.

To provide for exemption from certain approvals and inspections for establishment and operation of

the micro, small and medium enterprises in Jharkhand and matters connected therewith or incidental

there to be it enacted by the Legislature of the State of Jharkhand in the Seventy fifth Year of the

Republic of India as follows:

1. Short Title, extent and commencement:

(1)

This Act may be called the Jharkhand Micro, Small and Medium Enterprises (Special

Concession) Act, 2025

(2) It shall extend to the whole of the state of Jharkhand

(3)

It shall come into force from the date on which it is published in the Gazette of the

Government of Jharkhand.

Definitions- In this Act, unless the context otherwise requires:

(a) “Acknowledgement Certificate” means the acknowledgement certificate issued under

section 5;

(b) “Act” means the Jharkhand Micro, Small and Medium Enterprises (Special Concession) Act,

2025;

registration, licence and the like, required under any State law as mentioned in THE

SCHEDULE for the establishment or operation of an enterprise in the State;

(d) “Competent Authority” means any department or agency of the Government, a local

authority,

statutory

body,

State

owned

corporation,

Panchayati

Raj

Institution,

Municipality,Urban Development Authorities or any other authority or agency constituted or

established by or under any State Law or under administrative control of the Government,

which is entrusted with the powers or responsibilities to grant or issue approval for

establishment or operation of an enterprise in the State;

(e) “Combined Application Form” means such electronic form as may be prescribed under the

Jharkhand Single Window Clearance Act, 2015 which includes individual application forms

for all clearances;

(f) “Department” means the Department of Industries of the Government of Jharkhand;

(g) “Enterprise” shall have the same meaning as in Section 2 (e) of The Micro, Small and

Medium Enterprises (MSME) Development Act, 2006 [No. 27 of 2006]; of Govt. of India.

(h) “Nodal agency” means the nodal agency referred to in Section 3;

(i) “notification” means a notification published in the Rajpatra (e-Gazette), Jharkhand;

(j) “prescribed” means prescribed by the rules made under this Act;

(k) “SCHEDULE” means THE SCHEDULE appended to this Act;

(l) “State Government” means the State Government of Jharkhand;

(m) “Udyog Aadhar” means such registration number of industrial units as are laid down by the

Union Ministry of Micro, Small and Medium Enterprises from time to time;

Nodal agency

(1) Subject to superintendence, direction and control of the Government, Single Window

Clearance Committee (SWCC) as defined in JHARKHAND SINGLE WINDOW CLEARANCE

ACT,2015 (Jharkhand Act-10,2016), Directorate MSME shall be the State level Nodal Agency

for the purpose of this Act.

(2) Subject to superintendence, direction and control of the Government and the District

Executive Committee (DEC) as defined in JHARKHAND SINGLE WINDOW CLEARANCE

ACT, 2015 (Jharkhand Act-10,2016) District MSME Centre (DMC) of different areas, shall be

the district level nodal agency for the areas under their jurisdiction for the purposes of this Act.

Powers and functions of nodal agency

(1) Subject to the superintendence, direction and control of the Government, the powers and

functions of the nodal agency shall be as follows:

(a)

to assist and facilitate establishment of enterprises in the State; and

(b)

to maintain the record of declaration of intent received and Acknowledgement

Certificate issued under this Act.

(c)

State level Nodal Agency to direct the concerned department / agency for

enquiry/inspection in case of information pertaining to deviation by Enterprise

from

the Responsibilities as mentioned in the Section 7 of this Act.

(2) The Government may assign such other powers and functions to the nodal agency as it may

deem fit for giving effect to the provisions of this Act.

Filing of declaration and Acknowledgement Certificate

(1) Any person who intends to start an enterprise may furnish to the nodal agency a

declaration of intent to start an enterprise.

Explanation: Any enterprise that has moved to the Competent Authority to obtain allor any

of the approval (s) before the commencement of this Act and has not received it on the date

of commencement, may also opt to furnish declaration of intent to start an enterprise under

this sub-section.

(2) Enterprise can apply by submitting Declaration of Intent on the website of Single Window

clearance system of Department of Industries. Alternatively, enterprise may fill the

Declaration of Intent by visiting the Single Window office of Department of Industries, 3^rd

Floor, Nepal House Building along with either of the valid photo id proof issued by the

Government, viz-a-viz bank photo passbook, voter ID Card, passport, driving license, PAN

card. Only in case of special circumstances or failure of electronic system due to unforeseen

circumstances, the enterprise may submit Declaration of Intent in prescribed form, in

physical format to the Single Window Office of Department of Industries.

(3) There will be no application or any other additional fee for applying under the Act.

(4) On receipt of a declaration complete in all respects, the nodal agency shall, forthwith, issue

an Acknowledgement Certificate, in such form as may be prescribed, to the enterprise.

Effect of the Acknowledgement Certificate

(1) The enterprise will receive a computer-generated Acknowledgement Certificate for

confirmation of receipt of declaration of intent.

(2) An Acknowledgement Certificate issued under section 5 shall, for all purposes, have effect

as if it is an approval for a period of three years from the date of its issuance till the date of

commencement of commercial production or operation, whichever is earlier:

a. Provided that subsequent to the issuance of the Acknowledgement Certificate, the

enterprise shall adhere to all the requirements for such approval.

b. Provided that the Acknowledgement Certificate shall not entitle a person to use a

land in deviation to the land use specified in the master plan wherever such plan is in

force.

c. Provided further that in case the enterprise fails to adhere to the requirements of the

preceding provison, action as required by or under the law may be initiated against

the enterprise.

(3) During the period of three years, no Competent Authority shall undertake any inspection

under the laws as mentioned in schedule as appended for the purpose of, or in connection

with, any approval unless there is threat to life and safety. In case an enterprise has to be

inspected for certain reasons the permission of the District Magistrate/Director MSME shall

be obtained.

Responsibilities of the Enterprise

(1) After the expiry of the Acknowledgement Certificate, the enterprise will have to obtain

required approvals, within six months from the validity date of Acknowledgement

Certificate.

(2) The enterprise shall maintain the standards prescribed in the relevant safety codes and

maintain emergency preparedness for safety and health of the employees or workers.

(3) The enterprise shall not engage in any manufacturing and service activity which is prohibited

under any law or which may pose serious threat to public health or law and order.

(4) The enterprise shall inform any change in the information provided by it in the Declaration of

Intent.

Exemption

Where the Government or any authority under it is empowered to exempt any enterprise from

any approval or inspection or any provisions in relation thereto under any Central Act, the

Government or any such authority, as the case may be, shall, subject to the provisions of

such Central Act, exercise such powers to grant such exemption to an enterprise established

in the State for at least a period of three years from the date of issuance of the

Acknowledgement Certificate.

Protection of action taken in good faith

No suit, prosecution or other legal proceedings shall lie against the Government or Nodal

Agency employee of the Government, Nodal Agency or any person for anything which is

done or intended to be done in good faith under this Act or any rules made thereunder.

11.

Act to have an overriding effect

The provisions of this Act shall have effect, not withstanding anything inconsistent therewith

contained in any State law as mentioned in schedule appended for the time being in force.

12.

Savings

Subject to the provisions of Sections 6 and 7, nothing contained in this Act shall be construed

as exempting any enterprise from the application of the provisions of any law for the time

being in force, or any regulatory measures and standards specified thereunder, except to the

extent expressly provided in this Act.

13.

Power to amend THE SCHEDULE

The State Government may, by notification add to or delete any entry of THE SCHEDULE, or

otherwise amend THE SCHEDULE, and thereupon THE SCHEDULE shall be deemed to

have been amended.

14.

Power to revoke Acknowledgement Certificate

Acknowledgement Certificate can be revoked under the following conditions:

I. Wilful submission of wrong information in Declaration of Intent.

II. Breach or contravention of any of the provisions of the Act and the rules.

III. If the enterprise cease to be a micro, small or medium enterprise.

IV. If the enterprise changes the location of manufacturing or service activity asmentioned in

Declaration of Intent.

V. If the enterprise ceases to exist due to merger or split or demerger or acquisition or

amalgamation and the enterprise is a part of such arrangement.

15. Power to remove difficulties.

(1) If any difficulty arises in giving effect to the provisions of this Act, the State Government

may, by general or order published in the Official Gazette, make such provisions not

inconsistent with the provisions of this Act, as may appear to it to be necessary for

removing the said difficulty:

Provided that no such order shall be made after the expiry of a period of three years from

the date of commencement of this Act.

(2) Every order made under this section shall be laid, as soon as may be, after it is made,

before the State Legislature.

16. Power to make rules

(1) The State Government may, by notification, make rules for carrying out all or any of the

purposes of this Act.

(2) Every rule made under this Act shall be laid before the State Legislature by the State

Government.

17. Repeal and savings.

Anything done or any action taken under different industrial polices and rules regarding

micro, small and medium enterprises, before the commencement of this act, shall be

deemed to have been validly done or taken under the corresponding provisions of this Act.
