(कोǑट Đमांक-334/20), त×कालȣन ĤखÖड ͪवकास पदाͬधकारȣ, ͬचǓनयां, गढ़वा के ͪवǽɮध फजȸ

तरȣके से दूसरे åयिÈत के खǓतयान एवं गलत शपथ-पğ के आधार पर ͪपछड़ा वग[-1 का जाǓत

Ĥमाण-पğ बनवाकर चतुथ[ जे०पी०एस०सी० परȣ¢ा के ɮवारा झारखÖड ĤशासǓनक सेवा मɅ ǓनयुिÈत

ĤाÜत करने तथा मामले कȧ जाँच Ĥारंभ ͩकये जाने पर िजला के पदाͬधकाǐरयɉ के हèता¢र से

फजȸ पğ भेजकर ͪवभाग को गुमराह करने संबंधी आरोपɉ के ͧलए ͪवभागीय काय[वाहȣ के

समी¢ोपरांत इनके ͪवǽɮध Ĥमाͨणत आरोपɉ हेतु ͪवभागीय पğांक-8916, Ǒदनांक 18.10.2016

ɮवारा इÛहɅ सेवा से बखा[èत करने हेतु ɮͪवतीय कारण पृÍछा कȧ गयी है ।

2. Įी Ǿपेश कुमार से ɮͪवतीय कारण पृÍछा अĤाÜत रहने पर ͪवभागीय पğांक-7688,

Ǒदनांक 04.07.2017 ɮवारा पुनः ɮͪवतीय कारण पृÍछा कȧ माँग कȧ गयी, परÛतु Įी Ǿपेश कुमार

ɮवारा उƣर समͪप[त न कर पğ मɅ कहा गया है ͩक उनके ɮवारा माननीय उÍच Ûयायालय मɅ

याͬचका W.P. (S) No. 6507/2016 दायर कȧ गयी है ।

3. ͪवषयगत मामले के समी¢ोपरांत ͪवभागीय अͬधसूचना सं0-924 (HRMS), Ǒदनांक

05.07.2018 ɮवारा Įी Ǿपेश कुमार को Ǔनलंǒबत ͩकया गया है ।

4. W.P.(S) No. 6507/2016 Ǿपेश कुमार बनाम झारखÖड राÏय एवं अÛय मɅ माननीय

उÍच Ûयायालय ɮवारा Ǒदनांक 15.07.2023 को पाǐरत Ûयायादेश के ɮवारा Įी Ǿपेश कुमार के

ͪवǽɮध गǑठत आरोप पğ एवं Įी Ǿपेश कुमार को Ǔनलंǒबत करने से संबंͬधत ͪवभागीय अͬधसूचना

संÉया-924 (HRMS), Ǒदनांक 05.07.2018 को Ǔनरèत कर Ǒदया गया। पाǐरत Ûयायादेश का

काय[कारȣ अंश Ǔनàनवत् है-

".........6. Having heard learned counsel for the parties and from perusal of

record, it appears:

(i). that although the departmental proceeding has been initiated with the

approval of the State Government, but the Memo of charge has never been

approved by the council of the Minister or by the Hon'ble Chief Minister of the

State. The judgment of the Hon'ble Apex Court, as noted above, is clear on this

point. Further, Rule 17(3) of the Jharkhand Government Servants (Classification,

Control & Appeal) Rules, 2016, which covers the field, also clarifies the position

that the Memo of charge has to be issued by the appointing authority. Non-

approval of the Memo of charge by the appointing authority makes it unauthorized

and nullity in the eyes of law. It is settled principle of law that an action can only

be taken by an authorized person, who is authorized in law, otherwise, the action

itself is without jurisdiction and void ab-initio, Since the present Memo of charge

has been issued without the approval of the State Government and as such this

Court finds that the Memo of charge-sheet dated 08.07.2015 is not sustainable in

the eye of law and accordingly, the same is hereby, quashed and set aside.

(ii). So far as the second issue regarding the cancellation of caste

certificate by the Sub-Divisional Officer is concerned, this Court finds that the

Circular relied upon by the petitioner is not applicable in the case of the

petitioner as because the said Circular covers only for the members belonging to

the Scheduled Caste and Scheduled Tribe. The Caste Scrutiny Committee, which

has been constituted, has not been authorized to look into the caste certificate,

issued to the members of the other backward class. In the absence of

authorization by the circular itself, the reliance upon the said circular by the

petitioner is of no use and accordingly, this Court finds no force in the

submission of learned counsel for the petitioner and accordingly, the same is,

hereby, rejected.

(iii). Since in the present case, the issue involved is the ouster of Sub-

Divisional Officer on the strength of Caste Scrutiny Committee constituted vide

Circular dated 08.07.2004, has not been accepted by this Court and on this score

the challenge to the order of the Sub-Divisional Officer cancelling the caste

certificate, has been rejected by this Court. However, it is clarified that the issue

of the caste has not been decided by this Court on merit and it is, hereby, kept

open to be decided by the competent authority in accordance with law.

The liberty is reserved with the petitioner to challenge the order of

cancellation of the caste certificate in the appropriate proceeding in accordance

with law.

(iv). So far as the second show cause is concerned, the evidence has

been discussed and the reasons have been assigned by the authority while

issuing the second show cause and the same has been supplied along with the

second show cause itself. It is settled principle of law that the format has not to

be seen rather substance has to be seen. Since in substance the reasons have

been shown for differing with the finding recorded by the Enquiry Officer by

referring to the evidence available on record and as such this Court finds no

illegality in issuance of second show cause notice on the ground of non-

assignment of reasons. Accordingly, the contention of the learned counsel for the

petitioner on this score is also not tenable.

(v). Since this Court finds that the issuance of Memo of charge itself is

unauthorized and as such the entire proceedings from the stage of issuance of

the charge-sheet is bad in law and unauthorized and as such the same is

hereby, quashed and set aside.

Since the charge-sheet has been quashed and as such the suspension

order contained in Memo No. 924 dated 05.07.2018 also stands quashed.

7. With the above observations and directions, the present writ petition

stands disposed of.

8. Pending interlocutory application, if any, also stands disposed of."

5. W.P.(S) No. 6507/2016 मɅ पाǐरत Ûयायादेश के ͪवǽɮध ͪवभाग कȧ ओर से माननीय

झारखÖड उÍच Ûयायालय मɅ LPA No.- 33/2024 झारखÖड राÏय एवं अÛय बनाम Ǿपेश कुमार

दायर ͩकया गया है। उÈत LPA बाद मɅ माननीय उÍच Ûयायालय के ɮवारा Ǒदनांक 18.07.2024

को पाǐरत Ûयायादेश के ɮवारा नये ͧसरे से Įी Ǿपेश कुमार के ͪवǾɮध आरोप पğ गǑठत करते हुए

ͪवभागीय काय[वाहȣ करने कȧ छूट Ĥदान कȧ गयी। पाǐरत Ûयायादेश का काय[कारȣ अंश Ǔनàनवत् है-

"13. The learned Single Judge while disposing of the writ petition has not

considered the aforesaid aspect that the State be given a liberty to proceed

afresh against the writ petitioner. For the ends of justice and looking into the

allegations levelled against the writ petitioner, it would suffice if a direction is

given to the respondent-State to proceed in accordance with law after issuance of

a fresh charge-sheet.

14. The order of the learned Single Judge is modified to the extent that the

appellant-State is at liberty to proceed in the matter at the stage of issuance of

fresh memo of charge in accordance with law.

15. This intra-court appeal is partly allowed to the aforesaid extent only."

6. LPA No.- 33/2024 झारखÖड राÏय एवं अÛय बनाम Ǿपेश कुमार मɅ माननीय

झारखÖड उÍच Ûयायालय के ɮवारा Ǒदनांक 18.07.2024 को पाǐरत Ûयायादेश के आलोक मɅ Įी

Ǿपेश कुमार के ͪवǾɮध ͪवभाग èतर पर नये ͧसरे से आरोप गǑठत ͩकया गया है तथा गǑठत

आरोपɉ कȧ जाँच हेतु ͪवभागीय संकãप संÉया-31932(HRMS), Ǒदनांक 15.07.2025 ɮवारा

Įी Ǿपेश कुमार के ͪवǽɮध ͪवभागीय काय[वाहȣ संचाͧलत कȧ गयी है, िजसका जाँच ĤǓतवेदन

अĤाÜत है ।

7. Įी Ǿपेश कुमार कȧ प×नी Įीमती नेहा कुमारȣ के ɮवारा Ǒदनांक 28.05.2025 को

अßयावेदन समͪप[त ͩकया गया है, िजसमɅ उनके ɮवारा माननीय उÍच Ûयायालय के ɮवारा

W.P.(S) No. 6507/2016 Ǿपेश कुमार बनाम झारखÖड राÏय एवं अÛय मɅ Ǒदनांक 15.07.2023

कȧ पाǐरत Ûयायादेश एवं त×संबंधी LPA No.- 33/2024 झारखÖड राÏय एवं अÛय बनाम Ǿपेश

कुमार मɅ Ǒदनांक 18.07.2024 को पाǐरत Ûयायादेश के आलोक मɅ Įी कुमार को Ǔनलंबन से मुÈत

करने का अनुरोध ͩकया गया है। साथ हȣ आवेदन मɅ Įीमती नेहा कुमारȣ के ɮवारा अंͩकत ͩकया

गया है ͩक वत[मान मɅ वे गभ[वती हɇ। उनके पǓत काफȧ सालɉ से Ǔनलंǒबत है। उनके Ǔनलंǒबत रहने

के कारण इनकȧ मानͧसक, शारȣǐरक, आͬथ[क आǑद िèथǓत काफȧ दयनीय हो गयी है ।

8. Įी Ǿपेश कुमार कȧ प×नी Įीमती नेहा कुमारȣ ɮवारा समͪप[त आवेदन एवं झारखÖड

सरकारȣ सेवक (वगȸकरण, Ǔनयंğण एवं अपील) Ǔनयमावलȣ, 2016 के Ǔनयम-9(1) मɅ वͨण[त

Ĥावधान के आलोक मɅ संबंͬधत मामले कȧ समी¢ा कȧ गई। समी¢ा मɅ पाया गया ͩक LPA No.-

33/2024 मɅ पाǐरत Ûयायादेश के उपरांत Įी कुमार के ͪवǽɮध गलत जाǓत Ĥमाण बनवाकर कर

नौकरȣ लेने एवं जाँच Ĥारंभ ͩकये जाने के उपरांत िजला के पदाͬधकारȣ के फजȸ हèता¢र से पğ

भेजकर ͪवभाग को गुमराह करने से संबंͬधत आरोप कȧ जाँच हेतु ͪवभागीय काय[वाहȣ संचाͧलत कȧ

गई, जो ͪवचाराधीन है। Įी कुमार के ͪवǾɮध ĤǓतवेǑदत आरोप काफȧ गंभीर ĤकृǓत के हɇ। अतएव

जाँच पूण[ होने तक Įी कुमार को Ǔनलंǒबत रखा जाना समीचीन Ĥतीत होता है ।

9. अतः समी¢ोपरांत, माननीय उÍच Ûयायालय के ɮवारा W.P. (S) No. 6507/2016

Ǿपेश कुमार बनाम झारखÖड राÏय एवं अÛय मɅ Ǒदनांक 15.07.2023 को पाǐरत Ûयायादेश एवं

त×संबंधी LPA No.- 33/2024 झारखÖड राÏय एवं अÛय बनाम Ǿपेश कुमार मɅ Ǒदनांक

18.07.2024 को पाǐरत Ûयायादेश के आलोक मɅ Ǔनàनवत् Ǔनण[य ͧलया जाता है-

(क) Įी Ǿपेश कुमार को Ǔनलंǒबत करने से संबंͬधत ͪवभागीय अͬधसूचना संÉया-924

(HRMS), Ǒदनांक 05.07.2018 को ͪवलोͪपत ͩकया जाता है ।

(ख) Įी Ǿपेश कुमार को झारखÖड सरकारȣ सेवक (वगȸकरण, Ǔनयंğण एवं अपील)

Ǔनयमावलȣ, 2016 के Ǔनयम-9(1)(क) के तहत् Ǒदनांक 05.07.2018 के Ĥभाव से पुनः Ǔनलंǒबत

ͩकया जाता है ।

(वगȸकरण, Ǔनयंğण एवं अपील) Ǔनयमावलȣ, 2016 के Ǔनयम-10 के तहत् जीवन Ǔनवा[ह भƣा देय

होगा ।
