संÉया-03/ Ǔन०सं०-09-24/2015 का॰ 8770--Įीमती Ïयो×सना ͧसंह, झा०Ĥ०से० (कोǑट Đमांक-

733/03), झारखÖड ĤशासǓनक सेवा कȧ पदाͬधकारȣ हɇ। इÛहɉने Ǒदनांक 22.06.1995 को सेवा मɅ योगदान

Ǒदया है तथा संĤǓत अपर सͬचव, नगर ͪवकास एवं आवास ͪवभाग, झारखÖड, राँची के पद पर काय[रत हɇ ।

2. Įीमती ͧसंह के ͪवǽɮध ĤखÖड ͪवकास पदाͬधकारȣ, चंदवा, लातेहार के पद पर काया[वͬध मɅ

रोकड़ पंजी मɅ छेड़छाड़ कर सरकारȣ राͧश के अͬधकाई åयय / दुͪव[Ǔनयोग के आरोपɉ के ͧलए ͪवभागीय

संकãप संÉया 6518 Ǒदनांक 25.05.2017 ɮवारा ͪवभागीय काय[वाहȣ संचाͧलत कȧ गई थी। उÈत ͪवभागीय

काय[वाहȣ मɅ ͪवभागीय संकãप संÉया 26125 (HRMS) Ǒदनांक 15.10.2019 ɮवारा Įीमती ͧसंह को

संचया×मक Ĥभाव से 03 वेतनवृɮͬध पर रोक का दÖड अͬधरोͪपत ͩकया गया था ।

3. उÈत दÖडादेश के ͪवǽɮध Įीमती ͧसंह ɮवारा पुनͪव[चार अßयावेदन समͪप[त ͩकया गया।

ͪवभागीय संकãप संÉया 5451 (HRMS) Ǒदनांक 19.05.2020 ɮवारा Įीमती ͧसंह के उपरोÈत पुनͪव[चार

अßयावेदन को अपीलȣय Ĥाͬधकार ɮवारा अèवीकृत ͩकया गया तथा उनके ͪवǽɮध अͬधरोͪपत दÖड को

यथावत रखा गया ।

4. अपीलȣय Ĥाͬधकार ɮवारा पुनͪव[चार अßयावेदन को अèवीकृत ͩकए जाने कȧ कार[वाई के ͪवǽɮध

Įीमती ͧसंह ɮवारा माननीय झारखÖड उÍच Ûयायालय मɅ याͬचका WP (S) No. 2005/2020 दायर ͩकया

गया, िजसमɅ Ǒदनांक 09.09.2022 को पाǐरत Ûयायादेश का काय[कारȣ अंश Ǔनàनवत है :-

"45. While considering the present case in the light of the aforesaid

judgement, this Court finds no error, much less any manifest error of law and procedure

leading to any injustice to the petitioner. It is well settled that judicial review is an

evaluation of the decision-making process, and not the merits of the decision itself.

Judicial review seeks to ensure fairness in treatment and not fairness of conclusion.

There is no allegation of any bias and no case has been made out alleging gross

unreasonableness of outcome. There is no scope for reconsidering the materials

produced before the enquiry officer and coming to a different finding. All the issues

framed based on the arguments of the parties having been decided in favour of the

Respondents as aforesaid, there is no scope for any interference in the impugned order

and proceedings under Article 226 of the Constitution of India.

Accordingly, the present writ petition is dismissed.

46. Pending interlocutory application, if any, is closed.

माननीय झारखÖड उÍच Ûयायालय ɮवारा Įीमती ͧसंह के उपरोÈत याͬचका को dismiss

कर Ǒदए जाने कारण Įीमती ͧसंह ने माननीय झारखÖड उÍच Ûयायालय मɅ LPA No. 467/2022

Ïयो×सना ͧसंह बनाम झारखÖड राÏय एवं अÛय दायर ͩकया, िजसमɅ Ǒदनांक 29.03.2023 को पाǐरत

Ûयायादेश का काय[कारȣ अंश Ǔनàनवत हैः-

“12. Thus, the Letters Patent Appeal is allowed. The judgment passed by

the learned Single Judge dated 09.09.2022 in W.P.(S) No. 2005 of 2020 is hereby, set

aside. The writ petition filed by the writ petitioner is allowed. Writ of certiorari is issued

quashing the chargesheet, the enquiry report, the order passed by the appellate and

revisional authority as well as the punishment awarded by the disciplinary authority. A

writ of mandamus is issued to consider the consequential benefits of the writ petitioner

including consideration of her case for promotion with retrospective effect.”

6. LPA No. 467/2022 मɅ Ǒदनांक 29.03.2023 को पाǐरत Ûयायादेश के आलोक मɅ

Įीमती Ïयो×सना ͧसंह, झा०Ĥ०से० के मामले मɅ ͪवभाग ɮवारा Ǔनàनͧलͨखत कार[वाई कȧ गई :-

(i) Įीमती ͧसंह के ͪवǽɮध ͪवभागीय संकãप संÉया 26125 (HRMS) Ǒदनांक 15.10.2019

ɮवारा अͬधरोͪपत दÖड को ͪवभागीय संकãप संÉया 21762 (HRMS) Ǒदनांक 21.06. 2023

ɮवारा ͪवलोͪपत करने का Ǔनण[य ͧलया गया ।

(ii) ͪवभागीय संकãप संÉया 6518 Ǒदनांक 25.05.2017 ɮवारा ͪवभागीय काय[वाहȣ संचाͧलत

रहने के फलèवǾप ĤोÛनǓत मɅ हुए ͪवलंब के कारण Įीमती ͧसंह को ͪवभागीय संकãप संÉया

3286 Ǒदनांक 04.04.2014 तथा ͪवभागीय संकãप संÉया 10483 Ǒदनांक 24.10.2014 के

झारखÖडगजट(असाधारण) गुǽवार, 29 जनवरȣ, 2026

आलोक मɅ कालावͬध मɅ छुट का लाभ अनुमाÛय नहȣं ͩकया गया। Įीमती ͧसंह का संयुÈत

सͬचव एवं समक¢ कोǑट मɅ ĤोÛनǓत हेतु 5 वष[ कȧ कालावͬध Ǒदनांक 19.05.2020 को पूण[

हो रहȣ थी। त×पæचात संयुÈत सͬचव एवं समक¢ कोǑट मɅ ĤोÛनǓत हेतु ͪवभागीय ĤोÛनǓत

सͧमǓत कȧ अगलȣ बैठक Ǒदनांक 28.11.2022 को सàपÛन हुई एवं त×संबंधी अͬधसूचना

Ǒदनांक 30.11.2022 को Ǔनग[त ͩकया गया ।

अतएव ͪवभागीय संकãप संÉया 1472 Ǒदनांक 27.02.2024 ɮवारा Įीमती ͧसंह को

ͪवभागीय अͬधसूचना संÉया 7214 Ǒदनांक 26.12.2023 ɮवारा पूव[ मɅ संयुÈत सͬचव एवं

समक¢ कोǑट मɅ Ĥदƣ ĤोÛनǓत के èथान पर Ǒदनांक 30.11.2022 के भूतल¢ी Ĥभाव से

संयुÈत सͬचव एवं समक¢ कोǑट मɅ वैचाǐरक ĤोÛनǓत Ĥदान कȧ गई। झारखÖड सेवा संǑहता

के Ǔनयम-58 तथा झारखÖड ͪवƣ Ǔनयमावलȣ के Ǔनयम-74 के आलोक मɅ ĤोÛनत पद का

वाèतͪवक ͪवƣीय लाभ एवं अÛय सुͪवधाएँ संयुÈत सͬचव एवं समक¢ कोǑट के पद पर

Ĥभार Ēहण कȧ Ǔतͬथ से अनुमाÛय ͩकया गया ।

7. उãलेखनीय है ͩक LPA No. 467/2022 मɅ Ǒदनांक 29.03.2023 को पाǐरत Ûयायादेश के

अनुपालन हेतु Įीमती ͧसंह ɮवारा माननीय झारखÖड उÍच Ûयायालय मɅ Cont. (Civil) Case No.

61/2024 दायर ͩकया गया था ।

LPA No. 467/2022 मɅ Ǒदनांक 29.03.2023 को पाǐरत आदेश के अनुपालन मɅ ͪवभाग ɮवारा

कȧ गई उपरोÈत कार[वाई कȧ सूचना के साथ ͪवभाग ɮवारा कारण पृÍछा दायर ͩकया गया, िजसके आधार

पर माननीय झारखÖड उÍच Ûयायालय ɮवारा Ǒदनांक 23.04.2024 को पाǐरत आदेश ɮवारा अवमानना कȧ

कार[वाई को समाÜत कर Ǒदया गया ।

8. Ǒदनांक 13.03.2020 के भूतल¢ी Ĥभाव से संयुÈत सͬचव एवं समक¢ कोǑट मɅ ĤोÛनǓत Ĥदान

नहȣं ͩकए जाने तथा ĤोÛनǓत का ͪवƣीय लाभ Ĥदान नहȣं ͩकए जाने के कारण Cont. (Civil) Case No.

61/2024 मɅ पाǐरत आदेश के ͪवǽɮध Įीमती ͧसंह ɮवारा माननीय सवȾÍच Ûयायालय मɅ SLP (Civil) No.

15932/2024 Ïयो×सना ͧसंह बनाम झारखÖड राÏय एवं अÛय दायर ͩकया गया ।

9. SLP (Civil) No. 15932/2024 Ïयो×सना ͧसंह बनाम झारखÖड राÏय एवं अÛय मɅ Ǒदनांक

22.09.2025 को पाǐरत Ûयायादेश का काय[कारȣ अंश Ǔनàनवत है :-

"9. The punishment has been set aside and the departmental proceeding found

to be in violation of established principles. Consequential benefits including retrospective

promotion was directed. The appellant should be considered for promotion from the date

on which her immediate junior, Mrs. Uma Mahato was considered in the DPC. Since

there is no other allegation against the appellant in strict compliance/directions issued by

the Division Bench in LPA No.467 of 2022, the State ought to have promoted the

appellant to the post of Joint Secretary, on the date on which her immediate junior, Mrs.

Uma Mahato was promoted; giving her relaxation in the minimum experience for

consideration for promotion as has been done in the case of Mrs. Uma Mahato.

10. The appellant is also entitled to consequential benefits as directed in LPA

No.467 of 2022 which includes the entire pay and allowances and also, in the event of

the appellant having retired, fixation of pension as per the last pay drawn on the

retrospective promotion granted. Appropriate orders shall be passed by the respondents,

and the appellant shall be paid the entire arrears of pay and allowances as a Joint

Secretary right from the date on which her immediate junior, Mrs. Uma Mahato was

promoted and her pension shall be refixed and arrears paid accordingly, if she has

retired.

11. The above exercise shall be completed within a period of four months and the

entire amounts due shall be paid to the appellant within the stipulated time, along with

the written computation of the financial facilities granted on such retrospective promotion.

There shall be no interest claimed by the appellant if the amounts are paid within the

stipulated time and if the State fails to carry out the directions in this judgment, the

appellant shall be entitled to 7% interest on the arrears computed, from today and if the

failure to comply with the directions in this judgment is by any officer/s of the State, the

State shall be free to recover the additional liability of interest from such

officers/employees occasioning the delay after issuing notice and taking appropriate

proceedings against the said officers/employees.

12. The appeal stands allowed with the above directions.

10. उãलेखनीय है ͩक Ǒदनांक 16.01.2020 को सàपÛन ͪवभागीय ĤोÛनǓत सͧमǓत कȧ बैठक मɅ

ͩकए गए अनुशंसा के आलोक मɅ ͪवभागीय अͬधसूचना संÉया 792 Ǒदनांक 03.02.2020 ɮवारा Įीमती उमा

महतो, झा०Ĥ०से० (कोǑट Đमांक-734/03) को संयुÈत सͬचव एवं समक¢ कोǑट मɅ ĤोÛनǓत Ĥदान कȧ

गई है ।

ͪवभागीय अͬधसूचना संÉया 1874 Ǒदनांक 13.03.2020 ɮवारा Įीमती उमा महतो, त×कालȣन

Ǔनदेशक, लेखा Ĥशासन एवं èवǓनयोजन, िजला Ēामीण ͪवकास अͧभकरण, हजारȣबाग को संयुÈत सͬचव एवं

समक¢ कोǑट मɅ ĤोÛनǓत के उपरांत उनके ɮवारा धाǐरत पद को संयुÈत सͬचव एवं समक¢ कोǑट मɅ

उ×Đͧमत करते हुए पदèथाͪपत ͩकया गया था। उÈत के आलोक मɅ Įीमती महतो को ĤोÛनत पद का

वाèतͪवक ͪवƣीय लाभ Ǒदनांक 13.03.2020 के Ĥभाव से ĤाÜत हुआ है ।

11. ͪवǑदत हो ͩक Ǒदनांक 16.01.2020 को सàपÛन ͪवभागीय ĤोÛनǓत सͧमǓत कȧ बैठक मɅ Įीमती

Ïयो×सना ͧसंह को ͪवभागीय संकãप संÉया 26125 (HRMS) Ǒदनांक 15.10.2019 ɮवारा अͬधरोͪपत

संचया×मक Ĥभाव से तीन वेतन वृɮͬध पर रोक का दÖड Ĥभावी रहने के कारण ĤोÛनǓत के अयोÊय कȧ

अनुशंसा कȧ गयी थी ।

13. उपरोÈत वͨण[त पǐरĤेêय मɅ SLP (Civil) No. 15932/2024 Ïयो×सना ͧसंह बनाम झारखÖड

राÏय एवं अÛय मɅ Ǒदनांक 22.09.2025 को पाǐरत Ûयायादेश के आलोक मɅ Ǔनàन Ǔनण[य ͧलया गया है:-

(i) Įीमती Ïयो×सना ͧसंह, झा०Ĥ०से० (कोǑट Đमांक-733/03) को ͪवभागीय संकãप संÉया

1472 Ǒदनांक 27.02.2024 ɮवारा Ǒदनांक 30.11.2022 के भूतल¢ी Ĥभाव से संयुÈत

सͬचव एवं समक¢ कोǑट मɅ Ĥदƣ वैचाǐरक ĤोÛनǓत के èथान पर उनसे कनीय Įीमती

उमा महतो, झा०Ĥ०से० (कोǑट Đमांक-734/03) को संयुÈत सͬचव एवं समक¢ कोǑट मɅ

Ĥदƣ ĤोÛनǓत कȧ Ǔतͬथ Ǒदनांक 03.02.2020 के भूतल¢ी Ĥभाव से संयुÈत सͬचव एवं

समक¢ कोǑट मɅ ĤोÛनǓत Ĥदान करते हुए Ǒदनांक 13.03.2020 के भूतल¢ी Ĥभाव से

ĤोÛनत पद का सभी वाèतͪवक ͪवƣीय लाभ Ĥदान ͩकया जाता है ।

(ii) Įीमती Ïयो×सना ͧसंह, झा०Ĥ०से० को Ǒदनांक 13.03.2020 के भूतल¢ी Ĥभाव से सभी

वाèतͪवक ͪवƣीय लाभ Ĥदान करने हेतु इनके मामले मɅ झारखÖड सेवा संǑहता के Ǔनयम-

58 तथा झारखÖड ͪवƣ Ǔनयमावलȣ के Ǔनयम-74 के Ĥावधानɉ को ¢ाÛत ͩकया जाता है।

- इसे पूवȾɮधारण नहȣं समझा जाएगा ।

14. उÈत Ĥèताव पर राÏय मंǒğपǐरषɮ कȧ Ǒदनांक 23.12.2025 को सàपÛन बैठक मɅ मद

संÉया- 29 के Ǿप मɅ èवीकृǓत ĤाÜत है ।
