िवषय-राǛ सरकार के िविभɄ िवभाग (कायŊ िवभाग सिहत) िनदेशालय, बोडŊ / िनगम,
सोसायटी/िनकाय इȑािद Ȫारा िकये जाने वाले एकरारनामा / कायाŊदेश / आपूितŊआदेश/Standard
Bidding Document/F2 Tender Document मŐe-Bank Guarantee के ŝप मŐ Ůितभूित
(Performance Security) Ůाɑ करने तथा Dispute Resolution संबंधी Ůावधान अȶवőिशत करने
तथा’ Jharkhand Procurement of Goods and Services Manual’ को एतदथŊ संशोिधत करने
के संबंध मŐ।
राǛ सरकार के लगभग सभी िवभागों के अȶगŊत िविभɄ Ůकार की सामिŤयों एवं सेवाओं का अिधŮापण
िकया जाता है । साथ ही िवशेष कर कायŊ िवभागों Ȫारा िनमाŊण-कायŘ आिद से संबंिधत कायाŊदेश िनगŊत िकया
जाता है । उपयुŊƅ उȞेʴों के िलए झारखǷ राǛ अथवा राǛ के बाहर के आपूितŊकȅाŊओं/सेवाŮदाताओं
तथा संवेदकों के साथ िकये जाने वाले एकरारनामा मŐ बŠधा Arbitration and Conciliation Act,1996 (यथा
संशोिधत) के अंतगŊत िववादों के समाधान संबंधी Ůावधानों का समावेश िकया जाता है । साथ ही राǛ सरकार
Ȫारा एकरारनामा/कायाŊवंटन/आपूितŊ आदेश िनगŊत करने के पूवŊ सफल िनिवदादाताओं से Ůितभूित
(Performance Security) भी Ůाɑ की जाती है । उपयुŊƅ िब̢दुओं पर िदनांक 13.10.2025 को मुƥ
सिचव की अȯƗता मŐ सɼɄ िविभɄ िवभागों के सिचव ˑरीय बैठक मŐ िवमशŊ के दौरान कितपय
ŮिŢयाȏक संशोधन की आवʴकता महसूस की गयी ।

2- सरकार के संǒान मŐ ऐसे कई मामले आये हœ िजसमŐ सरकार का पƗ सही तरीके से नहीं रखे जाने के
कारण Arbitration का Award राǛ सरकार के पƗ मŐ नहीं हो पाता है । इसके पीछे Arbitration and
Conciliation Act,1996 (यथा संशोिधत) के Ůावधानों के Ůित संबंिधत पदािधकारी के समुिचत जानकारी का
अभाव, Place of Arbitration का राँची से अɊũ होने, मामले के ससमय संǒान मŐ नहीं आने जैसे कई
कारण हœ । राǛ सरकार को Adverse Arbital Awards के कारण आिथŊक Ɨित उठानी पड़ती है । Place
of Arbitration के राँची से अɊũ होने की İ˕ित मŐ पदािधकाįरयों के याũा-भȅा आिद मŐ भी बड़ी रािश खचŊ
करनी पड़ती है । इसके अितįरƅ राǛ सरकार को Arbitrator Fee के ŝप मŐ भी अȑिधक ʩय करना
पड़ता है ।

Arbitration and Conciliation Act,1996 (यथा संशोिधत) मŐ Ůदȅ शİƅयों के आलोक मŐ
Arbitrator Ȫारा राǛ सरकार के िवŝȠ Exorbitant Punitive Rate of Interest अिधरोिपत िकया गया
है । कई मामलों मŐ 18 Ůितशत वािषŊक चŢवृİȠ तक की दर पर ɯाज अिधरोिपत िकया गया है । ऐसे
कितपय ̊ʼांत संǒान मŐ आये हœ िजनमŐ मूलधन से कई गुना अिधक ɯाज का भुगतान राǛ सरकार को
करना पड़ा है ।
4. इसके िवपरीत राǛाȶगŊत िसिवल Ɋायालयों मŐ राǛ सरकार का पƗ रखा जाना अपेƗाकृत सरल एवं
कम खचŎला है । राǛ के सभी िजलों मŐ Civil Courts गिठत
हœ िजससे राǛ सरकार का पƗ रखने मŐ न केवल लोक-धन की बİʋ सरकार के बŠमूʞ समय की भी
बचत होगी । Civil Suits का पयŊवेƗण भी िविभɄ िवभागों/कायाŊलय ˑर से िकया जाना आसान है।
5. िनʺषŊतः Arbitration and Conciliation Act,1996 (यथा संशोिधत) के बजाय Civil Suits के माȯम
से
मामलों
का
िन˃ादन
तुलनाȏक
ŝप
से
राǛिहत
के
अिधक
उपयुƅ
है।
अतः
आपूितŊकȅाŊओं/सेवाŮदाताओं/संवेदकों आिद के साथ िकये जाने वाले एकरारनामा/Standard Bidding
Document/F2 Tender Agreement मŐ Dispute Resolution के िनिमȅ यह शतŊ सामाɊतः जोड़ी जानी
चािहए-
“Disputes arising out of this contract shall be subject to jurisdiction of Courts located within state
of Jharkhand only.”
6. अपवािदक मामले िजनमŐ सरकार Ȫारा िकये जा रहे एकरारनामे मŐ Arbitration Clause रखने की
अपįरहायŊता हो, (यथा-World Bank, Asian Development Bank, International Fund for
Agricultural Development आिद Ȫारा Externally Funded Projects, भारत सरकार के िदशा-िनदőश
अथवा अɊ राǛ/देश की सरकार के साथ िकये जाने वाले एकरारना मे आिद) वहाँ एकरारनामा मŐ यह शतŊ
यथा संभव शािमल की जानी चािहए िकस भी पƗ राǛ सरकार Ȫारा तैयार पैनल से Arbitrator नािमत करने
हेतु सहमत हœ । साथ ही राǛ सरकार Ȫारा िकये जा रहे एकरारनामा मŐ Place of Arbitration के िलए
झारखǷ राǛ के अंतगŊतİ˕त ˕ान को Ůाथिमकता दी जाय।
7. िविध िवभाग Ȫारा एतदथŊ राǛ मŐ वरीय पदािधकाįरयों का Panel तैयार िकया जायेगा जो राǛ सरकार
से संबंिधत मामलों मŐ Arbitrators की भूिमका िनभायŐगे । िन˃Ɨता के ̊िʼकोण से यह सुिनिʮत िकया
जायेगा िक िजस िवभाग Ȫारा एकरारनामा िकया गया है, उस िवभाग के Empanelled पदािधकारी उस
मामले िवशेष के िलए Arbitrator नािमत नहीं िकये जा सकŐ गे।

8. यह आवʴक है िक राǛ सरकार Ȫारा Ůितभूित (Performance Security Deposit) के ŝप मŐ ली
जाने वाली Bank Guarantee को Electronic Form मŐ अथाŊत e-Bank Guarantee के ŝप मŐ ˢीकार
िकया जाय।
9. उपयुŊƅ पįरŮेƙ मŐ राǛ के िविभɄ िवभागों Ȫारा वˑुओं एवं सामिŤयों के अिधŮाİɑ को िविनयिमत
करने हेतु िवȅ िवभाग के अिधसूचना संƥा 2315 िदनांक 04.10.2024 Ȫारा अिधसूिचत ‘Jharkhand
Procurement of Goods and Services Manual’ को िनɻवत संशोिधत करने का Ůˑाव है-
(A)
‘Jharkhand Procurement of Goods and Services Manual’ के ‘Chapter-IV Open
Competitive Bid Process Management’ की कंिडका 6.28.2 को िनɻवत Ůित˕ािपत िकया
जाता है-

Performance security shall be furnished by the successful bidder in
the electronic form i.e. as e-Bank Guarantee from only those banks
which are empanelled by Department of Finance, Government of
Jharkhand for handling government business and taking deposits
from state governmentorganisations. The procuring entity shall
verify the e-BG fromonline platform as prescribed by the
Department of Finance before signing of the agreement.**

‘Jharkhand Procurement of Goods and Services Manual’ के ‘Chapter-V
Supplier Relations Management’मŐ कंिडका 9.3 िनɻवत अंतः˕ािपत की जाती है-
“9.3
Dispute Resolution
9-3-1
Disputes arising out of application of the provisions of this manual
shall be subject to jurisdiction of Courts located within state of
Jharkhand only. For a contractin which dispute resolution under
Arbitration & Conciliation Act, 1996 (as amended) has been
necessitated, a clause may preferably be inserted in the contract
that all the parties to the contract agree to nominate an arbitrator
from the panel of arbitrators prepared by the Government of
Jharkhand. In such cases place for arbitration proceedings will
preferably be located within state of Jharkhand. Department of Law,
Government of Jharkhand shall notify a panel of arbitrators
comprising of senior officers serving under Government of
Jharkhand. An officer serving in the department which is party to an
arbitration proceeding, shall not be nominated as an arbitrator in
that particular arbitration proceeding.
10. सभी कायŊ िवभागों Ȫारा Electronic Bank Guarantee के ŝप मŐ Performance Security Ůाɑ
करने तथा उपयुŊƅ विणŊत रीित से ‘Dispute Resolution’संबंधी Ůावधान का समावेश िवभागीय ‘F2
Tender/Standard Bidding Document’ मŐ भी िकया जायेगा।

11. उपयुŊƅ िवषयक िवȅ िवभागीय संलेख ǒापांक 644/िव॰, िदनांक 24.02.2026 मŐ िनिहत Ůˑाव पर
िदनांक 12.03.2026 को सɼɄ मंिũपįरषद की बैठक मŐ मद संƥा-14 के ŝप मŐ ˢीकृित Ůदान की गयी है।
