ĤखÖड ͪवकास पदाͬधकारȣ, रमकÖडा, गढ़वा, Ĥभारȣ ĤखÖड ͪवकास पदाͬधकारȣ, ͬचǓनया एवं भÖडǐरया के
पद पर काया[वͬध मɅ ĤǓतवेǑदत आरोपɉ हेतु ͪवभागीय संकãप संÉया-4884, Ǒदनांक 07.06.2013 ɮवारा तथा
इनके ĤखÖड ͪवकास पदाͬधकारȣ, बगोदर, ͬगǐरडीह के पद पर काया[वͬध मɅ ĤǓतवेǑदत आरोपɉ हेतु ͪवभागीय
संकãप संÉया-7963, Ǒदनांक 02.09.2013 ɮवारा ͪवभागीय काय[वाहȣ संचाͧलत कȧ गयी ।

संचालन पदाͬधकारȣ के पğांक-168, Ǒदनांक 28.03.2014 एवं पğांक-189, Ǒदनांक
11.04.2014 ɮवारा जाँच-ĤǓतवेदन उपलÞध कराया गया है, िजनमɅ ͪवषयगत दोनɉ आरोपɉ को Ĥमाͨणत
पाया गया है ।

Įी ͧसंह के ͪवǾɮध ĤǓतवेǑदत आरोप, इनके बचाव बयान एवं संचालन पदाͬधकारȣ के जाँच
ĤǓतवेदन कȧ समी¢ा कȧ गयी। समी¢ोपराÛत, Įी ͧसंह के उभय èथानɉ (ĤखÖड ͪवकास पदाͬधकारȣ,
रमकÖडा, गढ़वा, Ĥभारȣ ĤखÖड ͪवकास पदाͬधकारȣ, ͬचǓनयाँ एवं भÖडǐरया तथा ĤखÖड ͪवकास पदाͬधकारȣ,
बगोदर, ͬगǐरडीह) के पदèथापन काल के Ĥमाͨणत आरापɉ हेतु काल-वेतन मान मɅ Ǔनàनतर èतर पर
अवनǓत का दÖड Ĥèताͪवत ͩकया गया ।

उÈत Ĥèताͪवत दÖड पर ͪवभागीय पğांक-8026, Ǒदनांक 08.08.2014 एवं èमार पğांक-
9334, Ǒदनांक 15.09.2014 ɮवारा Įी ͧसंह से ɮͪवतीय कारण पृÍछा कȧ माँग कȧ गई ।

Įी ͧसंह के पğांक-1445, Ǒदनांक 26.09.2014 ɮवारा ɮͪवतीय कारण पृÍछा का जवाब
समͪप[त ͩकया गया, िजसमɅ कोई नया तØय Ĥèतुत नहȣं ͩकया गया ।

समी¢ोपरांत, ͪवभागीय संकãप सं0-3977, Ǒदनांक 29.04.2015 ɮवारा Įी ͧसंह पर काल-
वेतन मान मɅ Ǔनàनतर èतर पर अवनǓत का दÖड अͬधरोͪपत ͩकया गया ।

उÈत अͬधरोͪपत दÖड के ͪवǾɮध Įी ͧसंह ɮवारा माननीय उÍच Ûयायालय मɅ W.P.(S)
No. 2129 of 2017 महावीर ͧसंह बनाम झारखÖड राÏय एवं अÛय दायर ͩकया गया। उÈत वाद मɅ मा०
Ûयायालय ɮवारा Ǒदनांक 19.09.2022 ɮवारा पाǐरत आदेश मɅ वाद को खाǐरज कर Ǒदया गया। मा०
Ûयायालय ɮवारा पाǐरत Ûयायादेश का काय[कारȣ अंश Ǔनàनवत् है-
"I find no merit in this writ petition. This writ petition is, accordingly,
dismissed."

मा० Ûयायालय ɮवारा पाǐरत उÈत आदेश के ͪवǾɮध Įी ͧसंह ɮवारा माननीय उÍच
Ûयायालय मɅ L.P.A. No. 602 of 2022 महावीर ͧसंह बनाम झारखÖड राÏय एवं अÛय 2 दायर ͩकया
गया। उÈत वाद मɅ मा० Ûयायालय ɮवारा Ǒदनांक 06.12.2023 ɮवारा पाǐरत आदेश मɅ L.P.A को खाǐरज
कर Ǒदया गया। मा० Ûयायालय ɮवारा पाǐरत Ûयायादेश का काय[कारȣ अंश Ǔनàनवत् है-
"14. Having regard to the aforesaid circumstances in the case, the writ
Court rightly refused to interfere with the punishment order because interference with the
said order would have perpetuated illegality.
15. For the aforesaid reasons, finding not merit in this Letters Patent
Appeal, L.P.A. No. 602 of 2022 is dismissed."

उÈत पाǐरत आदेश के ͪवǾɮध Įी ͧसंह ɮवारा माननीय सवȾÍच Ûयायालय मɅ S.L.P.(C)
No. 17428 of 2024 दायर ͩकया गया। उÈत वाद मɅ मा० सवȾÍच Ûयायालय ɮवारा Ǒदनांक 02.12.2025
को पाǐरत Ûयायादेश का काय[कारȣ अंश Ǔनàनवत् है-
“2. The short issue in this appeal is with respect to the non-specification of
a time period in the order of punishment, wherein the appellant's pay-scale has been
reduced to a lower level. Admittedly, no period has been specified in the order of
punishment. Limited notice was issued by us only with respect to the unspecified period
of reduction in the pay-scale.
3. In our considered view, even assuming the Central Civil Services
(Classification, Control and Appeal) Rules, 1930, do not make it mandatory to specify a
time period, the same cannot be a ground to justify the unlimited period. In other words,
the existence of power is one thing and its exercise is another. A perusal of the decision
made by the respondent(s) would show that such an exercise was not undertaken.

4. In such view of the matter, by taking note of the facts and circumstances
of the case, we hold that the order of reduction in the pay-scale shall be in application
till the end of December, 2025.
5. Further, the appellant has attained the age of superannuation in the year
2018 itself. Therefore, from the month of January, 2026 onwards, his pensionary benefits
will have to be calculated on the basis of the pay-scale which was applicable to him
prior to the order of reduction. We make it clear that the appellant is not entitled for any
arrears.
6. The appeal is allowed in part, accordingly.
7. Pending application(s), if any, shall stand disposed of"

अतः S.L.P. (C) No. 17428 of 2024 मɅ माननीय सवȾÍच Ûयायालय ɮवारा Ǒदनांक
02.12.2025 को पाǐरत Ûयायादेश कȧ कंͫडका-4 के आलोक मɅ Įी महावीर ͧसंह पर काल-वेतन मान मɅ
Ǔनàनतर èतर पर अवनǓत का दÖड Ǒदनांक 31.12.2025 तक Ĥभावी रहेगी।
आदेश :- आदेश Ǒदया जाता है ͩक इस संकãप को झारखÖड राजपğ के आसाधारण अंक मɅ Ĥकाͧशत ͩकया
जाय तथा इसकȧ एक ĤǓत Įी महावीर ͧसंह, सेवाǓनवृƣ झा०Ĥ०से० एवं अÛय संबंͬधत को
दȣ जाय।
