पय[टन ͪवकास Ĥाͬधकारɉ के ͩĐयाÛवयन मɅ सरलता, ×वǐरत काय[ संचालन एवं ĤशासǓनक समèयाओं के Ǔनराकरण

के ͧलए Ĥͬधकार के èवǾप मɅ बदलाव हेतु झारखÖड पय[टन ͪवकास एवं Ǔनबंधन (सशोधन) अͬधǓनयम,

2025 अͬधǓनयͧमत हो।

झारखÖड ͪवधानसभा ɮवारा भारत के गणराÏय के Ǔछहतरवे वष[ मɅ अͬधǓनयͧमत ͩकया जाता है।

1.संͯ¢Üत नाम, ͪवèतार एवं Ĥारंभ -

(क) यह अͬधǓनयम झारखÖड पय[टन ͪवकास और Ǔनबंधन (संशोधन) अͬधǓनयम, 2025 कहलाएगा।

(ख) यह झारखÖड राÏय के सàपूण[ ¢ेğ पर लागू होगा।

(ग) यह राजकȧय गजट मɅ Ĥकाͧशत होने कȧ Ǔतͬथ से लागू होगा।

2. अÚयाय -2 कȧ धारा 4 कȧ उपधारा (3)(i) मɅ संशोधन

झारखÖड पय[टन ͪवकास और Ǔनबंधन अͬधǓनयम, 2015 अÚयाय -2 कȧ धारा 4 कȧ उपधारा (3)(i) को Ǔनàनͧलͨखत Ǿप

से संशोͬधत ͩकया जाता है:- “Ĥाͬधकार मɅ एक अÚय¢, एक Ĥबंध Ǔनदेशक एवं एक सदèय सͬचव होगा, जो राÏय

सरकार ɮवारा नाͧमत ͩकए जायɅगे।“

3. अÚयाय -2 कȧ धारा 4 कȧ उपधारा (3)(ii) को ͪवलोͪपत ͩकया जाता है।

4.अÚयाय -2 कȧ धारा 4 कȧ उपधारा (3)(iii) मɅ संशोधन

झारखÖड पय[टन ͪवकास और Ǔनबंधन अͬधǓनयम, 2015 अÚयाय -2 कȧ धारा 4 कȧ उपधारा (3)(iii) को Ǔनàनͧलͨखत

Ǿप से संशोͬधत ͩकया जाता है:-

“संबंͬधत िजले के उपायुÈत Ĥाͬधकार के अÚय¢ हɉगे।“अगर ͩकसी Ĥाͬधकार के अÛतग[त दो िजलɉ के ¢ेğ आएँगे तो

¢ेğफल व सुगमता के आधार पर ͩकसी एक िजले के उपायुÈत को अÚय¢ व इसी Ĥकार अÛय सèदयɉ को ͪवभाग ɮवारा

नाͧमत ͩकया जाएगा।

5. अÚयाय -2 कȧ धारा 4 कȧ उपधारा (4)(i) मɅ संशोधन

झारखÖड पय[टन ͪवकास और Ǔनबंधन अͬधǓनयम, 2015 अÚयाय -2 कȧ धारा 4 कȧ उपधारा (4)(i) को Ǔनàनͧलͨखत Ǿप

से संशोͬधत ͩकया जाता है:-

“संबंͬधत िजले का उप ͪवकास आयुÈत या जैसा सरकार ɮवारा अͬधसूͬचत ͩकया गया पदाͬधकारȣ Ĥाͬधकार का Ĥबंध

Ǔनदेशक होगा। Ĥबंध Ǔनदेशक Ĥाͬधकार का उपाÚय¢ भी होगा तथा इससे संबंͬधत समèत कायɟ का Ǔनवा[हन करेगा।“

6. अÚयाय -2 कȧ धारा 4 कȧ उपधारा (4)(ii) मɅ संशोधन

झारखÖड पय[टन ͪवकास और Ǔनबंधन अͬधǓनयम, 2015 अÚयाय -2 कȧ धारा 4 कȧ उपधारा (4)(ii) को Ǔनàनͧलͨखत

Ǿप से संशोͬधत ͩकया जाता है:-

“Ĥाͬधकार के सदèय सͬचव के Ǿप मɅ िजला पय[टन नोडल पदाͬधकारȣ अथवा राÏय ĤशासǓनक सेवा के (मूल कोǑट) के

पद से अÛयुन èतर के पदाͬधकारȣ को नाͧमत ͩकया जायेगा।“

7. अÚयाय -2 कȧ धारा 4 कȧ उपधारा (4)(iii) मɅ संशोधन

झारखÖड पय[टन ͪवकास और Ǔनबंधन अͬधǓनयम, 2015 अÚयाय -2 कȧ धारा 4 कȧ उपधारा (4)(iii) को Ǔनàनͧलͨखत

Ǿप से संशोͬधत ͩकया जाता है:-

“Ĥाͬधकार के सदèय सͬचव अÚय¢ अथवा Ĥबंध Ǔनदेशक के सामाÛय माग[दश[न के अधीन अÛय बातɉ के साथ-साथ

Ǔनàनͧलͨखत कƣ[åयɉ का पालन करेगा“

(क)

वह Ĥाͬधकार कȧ ओर से सभी धन ĤाÜत करेगा तथा उसके ͧलए रसीद देगा और उसका समुͬचत लेखा रखेगा;

(ख)

वह Ĥाͬधकार कȧ Ǔनͬध से वेतन और भƣɉ के भुगतान तथा Ĥाͬधकार के खचȾ को पूरा करने के ͧलए धन

Ǔनकालेगा;

(ग)

वह Ĥाͬधकार के ͩकसी आदेश को अͧभĤमाͨणत करेगा;

अÚयाय -2 कȧ धारा 4 कȧ उपधारा (5) को ͪवलोͪपत ͩकया जाता है।

अÚयाय -2 कȧ धारा 5 को ͪवलोͪपत ͩकया जाता है।

अÚयाय -2 कȧ धारा 7 कȧ उपधारा (1) मɅ संशोधन

झारखÖड पय[टन ͪवकास और Ǔनबंधन अͬधǓनयम, 2015 अÚयाय -2 कȧ धारा 7 कȧ उपधारा (1) को Ǔनàनͧलͨखत Ǿप

से संशोͬधत ͩकया जाता है:-

“Ĥाͬधकार कȧ साधारण बैठक, ĤǓतमाह अÚय¢ ɮवारा Ǔनयत Ǔतͬथ, समय और èथान पर होगी।“

11. अÚयाय -2 कȧ धारा 4 कȧ उपधारा 8 (3)(झ) मɅ संशोधन

झारखÖड पय[टन ͪवकास और Ǔनबंधन अͬधǓनयम, 2015 अÚयाय -2 कȧ धारा 4 कȧ उपधारा 8(3)(झ) को Ǔनàनͧलͨखत

Ǿप से संशोͬधत ͩकया जाता है:-

‘‘को अपने ¢ेğ कȧ सड़को, मकान कȧ नाͧलयɉ, भूͧम और Ĥाͬधकार कȧ सàपǓत पर हुए अǓतĐमण को हटाने के

Ĥयोजनाथ[ झारखÖड नगरपाͧलका अͬधǓनयम 2011 अÚयाय-17, 25, 26, 27, 37 एवं धारा 606 (2) मɅ यथा ǓनͪवǑद[çट

नगरपाͧलका के स¢म Ĥाͬधकार कȧ शिÈतयाँ हɉगी।

“12. झारखÖड पय[टन ͪवकास और Ǔनबंधन अͬधǓनयम, 2015 कȧ शेष धाराएँ यथावत् रहेगी।

संÉया- एल0जी0-06/2025-08/लेज--झारखंड ͪवधान सभा ɮवारा यथा पाǐरत और

माननीय राÏयपाल ɮवारा Ǒदनांक-09/03/2026 को अनुमत झारखÖड पय[टन ͪवकास और Ǔनबंधन

(संशोधन) अͬधǓनयम, 2025 का Ǔनàनांͩकत अंĒेजी अनुवाद झारखंड राÏयपाल के Ĥाͬधकार से

इसके ɮवारा Ĥकाͧशत ͩकया जाता है, िजसे भारत का संͪवधान के अनुÍछेद 348 के खंड

(3) के अधीन उÈत अͬधǓनयम का अंĒेजी भाषा मɅ Ĥाͬधकृत पाठ समझा जाएगा।

Jharkhand Tourism Development and Registration (Amendment) Act, 2025.

(Jharkhand Act- 03, 2026)

Jharkhand Tourism Development and Registration (Amendment) Act, 2025 should

be enacted to change the form of the authority for ease of implementation of tourism

development authorities, quick work transaction and resolution of administrative problems.

Enacted by the Jharkhand Legislative Assembly in the Seventy-sixth Year of the

Republic of India.

Short title, extent and commencement -

(a)

This Act may be called the Jharkhand Tourism Development and

Registration (Amendment) Act, 2025.

(b)

It extends to the whole of the State of Jharkhand.

(c)

It shall come into force from the date of publication in the Official Gazette.

Amendment in sub-section (3)(i) of section 4 of chapter-2

Sub-section (3)(i) of section 4 of chapter-2 of Jharkhand Tourism Development

and Registration Act, 2015 is amended as follows:-

“The Authority shall consist of a Chairman, a Managing Director and a

Member Secretary, who shall be nominated by the State Government.”

Sub-section (3)(ii) of section 4 of Chapter-II is omitted.

Amendment in sub-section (3)(ii) of section 4 of chapter-2

Sub-section (3)(ii) of section 4 of chapter-2 of Jharkhand Tourism Development

and Registration Act, 2015 is amended as follows:-

“The Deputy Commissioner of the concerned district shall be the Chairman of

the Authority.”

If any authority covers areas of two districts then on the basis of area and

accessibility, the Deputy Commissioner of one of the districts will be nominated as

Chairman and similarly other members will be nominated by the department.

Amendment in sub-section (4)(i) of section 4 of chapter-2

Sub-section (4)(i) of section 4 of chapter-2 of Jharkhand Tourism Development and

Registration Act, 2015 is amended as follows:-

“The Deputy Development Commissioner of the concerned district or such officer

as may be notified by the Government shall be the Managing Director of the

Authority. The Managing Director will also be the Vice-Chairman of the Authority

and carry out all the appertain functions in this regard.”

Amendment in sub-section (4)(ii) of section 4 of chapter-2

Sub-section (4)(ii) of section 4 of chapter-2 of Jharkhand Tourism Development and

Registration Act, 2015 is amended as follows:-

“The District Tourism Nodal Officer or an officer not below the rank of State

Administrative Service (basic grade) shall be nominated as Member Secretary of

the Authority.”

Amendment in sub-section (4)(ii) of section 4 of chapter-2

Sub-section (4)(ii) of section 4 of chapter-2 of Jharkhand Tourism Development and

Registration Act, 2015 is amended as follows:-

“The Member Secretary of the Authority shall, under the general guidance of the

Chairman or Managing Director, among other things, perform the following duties:-

(a) He shall receive all the monies on behalf of the Authority and issue

receipt and maintain proper accounts for the same;

(b) He shall withdraw money from the Fund of the Authority to make

payment

of salaries and allowances and for the expenses of the Authority;

Sub-section (5) of section 4 of Chapter-II is omitted.

Section 5 of Chapter-II is omitted.

10.

Amendment in sub-section (1) of section 7 of chapter-2

Sub-section (1) of section 7 of chapter-2 of Jharkhand Tourism Development and

Registration Act, 2015 is amended as follows:-

“The ordinary meeting of the Authority shall be held every month on the date, time

and place as may be determined by the Chairman.”

Amendment in sub-section 8 (3) (i) of section 4 of chapter-2

Sub-section 8 (3) i of section 4 of chapter-2 of Jharkhand Tourism Development and

Registration Act, 2015 is amended as follows:-

He shall have the powers of the Competent Authority as specified in Chapters 17,

25, 26, 27, 37 and section 606 (2) of the Jharkhand Municipal Act, 2011 for the

purposes of removal of encroachments on roads, house drains, land in the

development area and properties of the Authority.

12. The remaining sections of Jharkhand Tourism Development and Registration Act,

2015 will remain the same.
