के अÛतर राͧश का भुगतान एवं पɅशन पुनरȣ¢ण हेतु माननीय उÍच Ûयायालय, झारखÖड मɅWP (S) No.-
6704 /2023 बीरा राम बनाम झारखÖड राÏय एवं अÛय दायर ͩकया गया ।
2. माननीय उÍच Ûयायालय, झारखÖड ɮवारा WP (S) No.-6704 /2023 मɅ Ǒदनांक 04.09.2024 को
Ǔनàन Ûयाय Ǔनण[य पाǐरत ͩकया गया :-

“15. Having regard to the aforesaid discussion, so far as 1st grievance
of the petitioner is concerned; he would be entitled for full salary for the
respective post and the differential salary shall be paid to him. Thus, 1st issue
goes in favour of this petitioner.
16. However, the stand of the State counsel with regard to laches will
certainly apply in the 2nd issue i.e. in case of the punishment order imposed
upon the petitioner in the year 2007. The petitioner really slept over the matter
and knocked the door of this Court after almost 15 years; as such, this Court
is of the opinion that for such act, he is not entitled for full salary for the
suspension period. Further, there is no document or specific representation has
been demonstrated by learned counsel for the petitioner in order to show that
immediately, after such order, he has represented the department for such
relief; as such, he is not entitled for full salary for the period of suspension.
Accordingly, the 2nd issue goes against the petitioner.
17. Accordingly, the concerned respondent is directed to make
calculation of amount payable to the petitioner in the light of observation made
herein above. As stated hereinabove, the petitioner would be entitled for full
salary for the respective post as such, the concerned respondent is directed to
calculate the differential salary i.e. the difference of salary for the period from
28.03.2003 to 02.08.2008 in pay-scale of Superintending Engineer when the
petitioner was working in the capacity of Superintending Engineer, but receiving
the salary in the pay-scale of Executive Engineer, and also difference of salary
in the payscale of Chief Engineer from 30.07.2008 to 06.07.2010 and Engineer-
in-Chief from 07.07.2010 to 31.01.2013, as the petitioner was working in the
capacity of Chief Engineer and Engineer-in-Chief, respectively, but receiving the
salary of Executive Engineer. It is made clear that the entire exercise shall be
completed within a period of twelve weeks from the date of receipt/production
of copy of this order.
18. As a result, the instant writ application stands partly allowed in the
manner indicated hereinabove.“
3. उÈत पाǐरत Ûयायादेश के ͪवǽɮध ͪवभाग के ɮवारा माननीय झारखÖड उÍच Ûयायालय मɅ LPA
Filing No. 2947/2025 झारखÖड राÏय एवं अÛय बनाम बीरा राम दायर ͩकया गया है। उÈत
LPA माननीय झारखÖड उÍच Ûयायालय मɅ ͪवचाराधीन है।
4. Įी बीरा राम अपने हȣ वेतन माÛमɅ èवतंğ चालू Ĥभार के तहत Ǒदनांक 28.03.2003 से
02.08.2008 तक अधी¢ण अͧभयंता, Ǒदनांक 30.07.2008 से 06.07.2010 तक मुÉय अͧभयंता
एवं Ǒदनांक 07.07.2010 से 31.01.2013 तक अͧभयंता Ĥमुख- II,के पद पर काय[रत रहे हɇ ।
माननीय उÍच Ûयायालय के उपरेाÈत Ûयाय Ǔनणय[ के आलोक मɅ Įी बीरा राम को उनके ɮवारा
धाǐरत उÍचतर पद के वेतन के अÛतर राͧश का भुगतान ͩकया जाना है।

5. उÍचतर पद पर èवतंğ चालू Ĥभार मɅ काय[ करने के एवज मे ͩकसी अǓतǐरÈत वेतन/भƣा के भुगतान
के संदभ[ मɅ कोई Ĥावधान नहȣं है । सेवा संǑहता के Ǔनयम-58 एवं ͪवƣीय Ǔनयमावलȣ के Ǔनयम-74
के आलोक मɅ पद Ēहण कȧ Ǔतͬथ से संबंͬधत Substantive पद का वेतन एवं भƣा पद धारक को
देय होता है । परÛतु माननीय उÍच Ûयायालय, झारखÖड ɮवारा पाǐरत Ûयायादेश Ǒदनांक
04.09.2024 का अनुपालन ͪवभाग हेतु बाÚयकारȣ है।
6. यह मामला èथाͪपत ͪवƣीय Ǔनयमɉ के संगत नहȣं है। साथ हȣ इस संबंध मɅ राÏय सरकार अÛतग[त
कोई ͪवͧशçट Ǔनयम Ĥवृƣ नहȣं है।
7. अतएव, उपरोÈत वͨण[त िèथǓत मɅ WP (S) No.-6704/ 2023 मɅ Ǒदनांक 04.09.2024 को पाǐरत
Ûयाय Ǔनण[य के अनुपालन हेतु महालेखाकार काया[लय से वेतन पचȸ Ǔनग[त होने के उपराÛत Įी बीरा
राम को èवतंğ चालू Ĥभार के तहत Ǒदनांक 28.03.2003 से 02.08.2008 तक अधी¢ण अͧभयंता,
Ǒदनांक 30.07.2008 से 06.07.2010 तक मुÉय अͧभयंता एवं Ǒदनांक 07.07.2010 से
31.01.2013 तक अͧभयंता Ĥमुख-II के पद पर काय[रत अवͬध के वेतन के अÛतर राͧश के भुगतान
कȧ èवीकृǓत इस शत[ के साथ दȣ जाती है ͩक ͪवषय गत मामले मɅ दायर LPA Filing No. 2947/
2025 मɅ पाǐरत अंǓतम Ûयाय Ǔनण[य से यह अनुपालन आÍछाǑदत होगा ।
8. Ĥèताव पर मंǒğपǐरषɮ, झारखÖड सरकार ɮवारा Ǒदनांक 12.03.2026 कȧ बैठक के मद संÉया-33 मɅ
èवीकृǓत दȣ गयी है।
