संÉया :- 4/ĤोÛनǓत-201/2026 का॰ 2705--W.P.(S) No. 3340/2021- अͨखलेश कुमार बनाम
झारखÖड राÏय एवं अÛय वाद मɅ माननीय झारखÖड उÍच Ûयायालय के ɮवारा Ǒदनांक-01.08.2024 को
पाǐरत आदेश का काय[कारȣ अंश Ǔनàनवत् है :-
"12. Having regard to the aforesaid discussions, the enquiry report itself
deserves to be, and, is hereby, quashed and set aside. Further, the
disciplinary authority without application of mind has completely relied
upon the enquiry report and passed the order of punishment; as such
since this Court has already held that the enquiry report is not
sustainable and is against the settled proposition of service jurisprudence
and the law laid down by the Hon'ble Apex Court in several cases
including the cases referred to hereinabove; the order of punishment is
not sustainable in the eye of law; accordingly, the same is also quashed
and set-aside.

It goes without saying that since the order of punishment is quashed
and set aside, entire consequential benefits shall be extended to
the
petitioner as early as possible, but not beyond twelve weeks from the
date of receipt/production of copy of this order.

As a result, the instant writ application stands allowed in the manner
indicated hereinabove."

उÈत Ûयायादेश के ͪवǾɮध राÏय सरकार कȧ ओर से माननीय झारखÖड उÍच Ûयायालय मɅ
LPA No. 127/2025- झारखÖड राÏय एवं अÛय बनाम अͨखलेश कुमार दायर ͩकया गया, िजसकȧ सुनवाई
अबतक लिàबत है ।

वादȣ Įी अͨखलेश कुमार ɮवारा W.P.(S) No.- 3340/2021 मɅ Ǒदनांक-01.08.2024 को
पाǐरत Ûयायादेश के अनुपालन हेतु Contempt Case (C) No. 45/2025- अͨखलेश कुमार बनाम झारखÖड
राÏय एवं अÛय दायर ͩकया गया है, िजसमɅ माननीय झारखÖड उÍच Ûयायालय के ɮवारा Ǒदनांक-
20.04.2026 को Ǔनàनांͩकत आदेश पाǐरत ͩकया गया है :-
"In spite of orders dated 02.05.2025 & 20.03.2026, neither any stay order
has been placed before this Court nor the order has been complied,
subject to final outcome of L.P.A.
2. Forced with this situation, this Court intends to issue Form-I; as such,
issue notice to opposite party no. 2 under Rule 393 of the High Court of
Jharkhand Rules, 2001 in Form-I as to why a contempt proceeding be
not initiated against the opposite party no. 2 for which a reply shall be
filed before the next date of hearing.
3. It goes without saying that if the order will be complied before the next
date of hearing; then, the issuance of Form-I shall stand cancelled.

ͪवभागीय काया[लय आदेश संÉया-170 Ǒदनांक-10.07.2012 ɮवारा वादȣ Įी अͨखलेश कुमार,
त×कालȣन सहायक, गृह ͪवभाग, झारखÖड, राँची के ͪवǾɮध आदेश कȧ अवहेलना, अनुमोǑदत ĤाǾप मɅ
अÛतवȶशन एवं संͬचका मɅ गलत तØयɉ के आधार पर Ĥèताव उपèथाͪपत करने के आरोप मɅ Ǔनàनांͩकत
शािèत अͬधरोͪपत कȧ गई थी :-
i) ǓनÛदनः
ii) तीन वेतन वृɮͬध पर संचया×मक Ĥभाव से रोक ।

Įी कुमार ɮवारा उÈत अͬधरोͪपत शािèत एवं अपीलȣय Ĥाͬधकार ɮवारा पाǐरत
आदेश Ǒदनांक-13.05.2013 के ͪवǾɮध माननीय झारखÖड उÍच Ûयायालय मɅ वाद संÉया-W.P.(S)
No.-5559/2014- अͨखलेश कुमार बनाम झारखÖड राÏय एवं अÛय वाद दायर ͩकया गया, िजसमɅ Ǒदनांक-
22.10.2018 को पाǐरत आदेश का काय[कारȣ अंश Ǔनàनवत् है :-

"The short legal plea raised by the petitioner and taken note above,
evidently stands substantiated on account of specific statements made by
respondent no.-5. Non furnishing of inquiry report and second show cause
notice has vitiated the departmental proceeding from that stage. Non service
of report has also caused prejudice to the petitioner as he was not in a
position to offer his reply to the proposed punishment though a major
penalty has been imposed upon him. Therefore, on this ground alone
impugned order dated 10th July, 2012 (Annexure-10) and appellate order
dated 13th May, 2013 (Annexure-12) cannot be sustained in the eye of law.
They are accordingly quashed. This Court has, however, not made any
comments on the merits of the finding arrived at in the departmental
enquiry. The disciplinary authority shall proceed from the stage of second
show cause notice and take a final decision in the matter within a period of
12 weeks from the date of receipt of a copy of this order. The Disciplinary
Authority shall furnish a copy of the enquiry report along with the second
show cause to enable the petitioner to offer his reply thereupon. Petitioner
shall cooperate in the matter. In case, he fails to cooperate, the Disciplinary
Authority shall proceed to take a decision in the matter within the aforesaid
period."

ͪवभागीय आदेश संÉया-3245 Ǒदनांक- 16.07.2021 ɮवारा माननीय झारखÖड उÍच
Ûयायालय, राँची के उÈत Ûयायादेश के अनुपालन मɅ Įी अͨखलेश कुमार से कȧ गई ɮͪवतीय कारणपृÍछा,
उÈत ɮͪवतीय कारणपृÍछा पर उनके ɮवारा समͪप[त उƣर एवं Ĥशासी ͪवभाग से ĤाÜत मंतåय कȧ
समी¢ोपरांत पुनः Įी कुमार के ͪवǾɮध Ǔनàनांͩकत दÖड अͬधरोͪपत ͩकया गया है :-
i) ǓनÛदन कȧ सजा ।
ii) तीन वेतन वृɮͬध पर संचया×मक Ĥभाव से रोक ।

Įी अͨखलेश कुमार ɮवारा उपयु[Èत शािèत अͬधरोपन आदेश को Ǔनरèत ͩकये जाने के साथ
हȣ पूरे ͪवभागीय काय[वाहȣ को Ǔनरèत करने हेतु W.P.(S) No.- 3340/2021- अͨखलेश कुमार बनाम
झारखÖड राÏय एवं अÛय दायर ͩकया गया। िजसमɅ माननीय झारखÖड उÍच Ûयायालय के ɮवारा Ǒदनांक-
01.08.2024 को पाǐरत Ûयायादेश ɮवारा वादȣ के ͪवǾɮध अͬधरोͪपत उÈत दÖडादेश को पुनः रɮद करते हुए
सभी अनुमाÛय लाभ Ĥदान करने का Ǔनदेश Ǒदया गया ।

ͪवभागीय अͬधसूचना संÉया-2181 Ǒदनांक-13.04.2026 ɮवारा उÈत W.P.(S) No.-
3340/2021 एवं Contempt Case (C) No. 45/2025 मɅ पाǐरत आदेश के अनुपालन मɅ Įी अͨखलेश
कुमार, त×कालȣन सहायक, गृह ͪवभाग सàĤǓत अवर सͬचव, अनुसूͬचत जनजाǓत, अनुसूͬचत जाǓत,
अãपसंÉयक एवं ͪपछड़ा वग[ कãयाण ͪवभाग (आǑदवासी कãयाण आयुÈत का काया[लय), झारखÖड, राँची के
ͪवǾɮध ͪवभागीय आदेश संÉया-3245 Ǒदनांक-16.07.2021 ɮवारा अͬधरोͪपत दÖडादेश को Ǔनरèत ͩकया
गया है ।

उÈत अͬधसूचना ɮवारा दÖड ͪवलोपन के फलèवǾप Įी कुमार को LPA No. 127/2025 के
अंǓतम फलाफल के आधार पर सभी देय लाभ अनुमाÛय ͩकया गया है ।

Įी अͨखलेश कुमार कȧ वरȣयता Đमांक-692 है। उनसे कनीय Įी मधुकाÛत ǒğपाठȤ
(वरȣ०Đ0-693) को Ǒदनांक- 01.11.2012 को Ĥशाखा पदाͬधकारȣ के पद पर ĤोÛनǓत Ĥदान कȧ गई है ।

वͨण[त तØयɉ, माननीय झारखÖड उÍच Ûयायालय, राँची ɮवारा पाǐरत उपयु[Èत Ûयायादेशɉ के
अनुपालन तथा Ǒदनांक-05.05.2026 को ͪवभागीय ĤोÛनǓत सͧमǓत ɮवारा कȧ गई अनुशंसा के आलोक मɅ
Įी अͨखलेश कुमार, अवर सͬचव, अनुसूͬचत जनजाǓत, अनुसूͬचत जाǓत, अãपसंÉयक एवं ͪपछड़ा वग[
कãयाण ͪवभाग (आǑदवासी कãयाण आयुÈत का काया[लय) को उनसे कनीय Įी मधुकाÛत ǒğपाठȤ
(वरȣ०Đ0-693) को Ǒदनांक-01.11.2012 के Ĥभाव से Ĥशाखा पदाͬधकारȣ (पी.बी.-॥, पे. बैÖड Ǿ0 9300-
34800/-, Ēेड पे- ǽ0 4800, पुनरȣͯ¢त वेतनमान मैǑĚÈस लेवल-8) के पद पर दȣ गई ĤोÛनǓत कȧ Ǔतͬथ
से ĤोÛनǓत Ĥदान कȧ जाती है ।

यह आदेश ͪवभाग कȧ ओर से दायर LPA No. 127/2025- झारखÖड राÏय एवं अÛय
बनाम अͨखलेश कुमार मɅ माननीय झारखÖड उÍच Ûयायालय ɮवारा पाǐरत आदेश के फलाफल से Ĥभाͪवत
होगा ।
