संƥा- 02/भा॰व॰से॰ (̾ था॰)- 03/2018- 1629--िदनांक 29.08.2016 को सɼɄ िवभागीय चयन सिमित की

अनुशंसा के आलोक मŐ ŵी आर॰आर॰ हेʀम, भा॰व॰से॰ (झा॰-83) की Ůधान मुƥ वन संरƗक (HoFF) के पद पर

िनयुİƅ की गई थी। उƅ िनयुİƅ के िवŝȠ ŵी Ůदीप कुमार, िदनांक 30.09.2016 को सेवािनवृत भा॰व॰से॰ (झा॰-

82) Ȫारा माननीय Central Administrative Tribunal, Patna Bench, Circuit Bench Ranchi मŐ एक वाद

संƥा- OA/051/00132/2016 दायर िकया गया। उƅ वाद मŐ माननीय Ɋायािधकरण Ȫारा िदनांक-24.05.2017 Ȫारा

िनɻ आदेश पाįरत िकया गया-

“In view of the aforesaid facts, we are constrained and compelled to conclude that Sri R.R.

Hembrom was not holding the post of PCCF and thus not eligible to be considered for HoFF when

the SCM took place at about 3.30 PM on 29.08.2016. Consequently, in our considered opinion, the

applicant was the sole eligible candidate for selection as HoFF at that time.

In conclusion, the selection committee proceeding dated 29.08.2016 for HoFF and

consequent notification No. 4106 dated 01.09.2016 selecting and notifying Shri R.R. Hembrom to

the post of HoFF in the pay scale of Rs. 80,000/- (Fixed) are quashed and set aside as being illegal

as he was not eligible for the post. The respondent State of Jharkhand is at liberty to convene a

Selection Committee meeting for selection to this post as per law. Since the applicant has retired in

the meanwhile, the respondent authorities are directed to consider granting him notional benefit and

pension fixation in the Apex Pay Scale, if found suitable as on 29.08.2016. No order as to costs.”

माननीय Ɋायािधकरण के उपयुŊƅ िनदेश के अनुपालन मŐ िदनांक-05.07.2017 को िवभागीय चयन सिमित की

बैठक आयोिजत की गई। उƅ बैठक मŐ िदनांक 29.08.2016 को ŵी हेʀम के अलावा शेष योƶ पदािधकाįरयों, िजनमŐ

ŵी Ůदीप कुमार का नाम भी शािमल था, पर िवचार िकया गया था। ŵी कुमार की वषŊ 2009-10 से 2014-15 तक की

अविध मŐ एक ए॰सी॰आर॰ की अɷुİƅ (ˋोर- 7) आउटːœिडंग की ŵेणी मŐ नहीं आने एवं उɎŐ 06.05.2011 को

िनȽन का दǷ अिधरोिपत होने के ̊ िʼपथ उƅ पद के चयन हेतु योƶ नहीं माना।

सिमित के अनुशंसा के आलोक मŐ राǛ सरकार ने यह िनणŊय िलया िक ŵी कुमार िदनांक-29.08.2016 को

Ůधान मुƥ वन संरƗक (HoFF) के पद पर िनयुİƅ हेतु योƶ नहीं थे। एतद् िवषयक िवभागीय आदेश ǒापांक-2928,

िदनांक-17.07.2017 के Ȫारा िनगŊत आदेश की Ůित ŵी कुमार को भी Ůेिषत की गई।

ŵी कुमार Ȫारा िवभागीय आदेश ǒापन संƥा- 2928, िदनांक-17.07.2017 को quash करने तथा उɎŐ

िदनांक-29.08.2016 के Ůभाव से Ůधान मुƥ वन संरƗक (HoFF) के वेतनमान मŐ Notionally select कर

तद्नुसार उनके पŐशन को संशोिधत करने के संबंध मŐ माननीय Central Administrative Tribunal (CAT), Patna

Bench, Circuit Bench Ranchi मŐ एक वाद सं॰- OA/051/00130/2017दायर िकया गया।

माननीय Ɋायािधकरण Ȫारा उƅ वाद मŐ िदनांक-10.08.2018 को पाįरत आदेश का ऑपरेिटव पाटŊ

िनɻवत् हœ◌ः-

“12. Be that as it may, the applicant has already superannuated from service on 30.09.2016.

Even if it is held that he has been unfairly ignored for the post of PCCF (HOFF), he cannot be

brought back to the said post now. We, therefore, feel that ends of justice would be met only by

allowing the applicant at least the pensionary benefits commensurate with the pay scale of PCCF

(HOFF).

13. In the conspectus of the discussions in the foregoing paragraphs, the impugned order

dated 17.07.2017 (Annexure A/2) is quashed and set aside. The respondents are directed to fix the

pension of the applicant in the pay scale of PCCF (HOFF) i.e. Rs. 80,000 (Fixed) Pre-revised. We

also direct that the applicant shall be given all consequential retiral benefits but without any interest.

14. The directions contained in para (13) shall be complied with by the respondents within

a period of three months from the date of receipt of a copy of this order.

15. The OA is disposed of accordingly. No order as to costs.”

उƅ आदेश के िवŝȠ िवभाग Ȫारा महािधवƅा से परामशŊ Ůाɑ करते Šए माननीय झारखǷ उǄ

Ɋायालय, राँची मŐ अपीलवाद संƥा- WP(S) No. 6206/2018दायर िकया गया।

ŵी Ůदीप कुमार Ȫारा OA/051/00130/2017 मŐ माननीय CAT Ȫारा िदनांक-10.08.2018 को पाįरत आदेश

के Ţम मŐ CAT मŐ अवमानना वाद- CP No.-89/2018 दायर िकया गया।

WP(S) No. 6206/2018मŐ िदनांक-05.02.2025 को पाįरत Ɋायादेश का कायŊकारी अंश िनɻवत् हœ◌ः-

“15. Selection Committee dated 17.07.2017 is that the competency and specific suitability

for the post has been overshadowed by absence of outstanding merit and absolute integrity.

‘Absolute Integrity’ in the context of the selection would mean a high degree of integrity with

moral and ethical values of the highest quality and non-compromising level of honesty

accompanying the centre stage. As we have noticed above there is not much difference between the

capability and competency of the respondent no. 1 and Sri A.K. Prabhakar in the context to the

selection for the post of Principal Chief Conservator of Forest (HoFF) and in some of the APR's,

the respondent no. 1 outshines and outweighs Sri A.K. Prabhakar. The only bottleneck seems to be

the punishment of Censure imposed upon the respondent no. 1 which was also with effect from the

year 1994 and which with the passage of time has lost its force. The respondent no. 1, therefore,

fulfills the initial two conditions and such findings would automatically trigger his competence and

suitability for the post of Principal Chief Conservator of Forest (HoFF).

16. The learned Central Administrative Tribunal in the impugned order dated 10.08.2018

has considered the relevant issues in its proper perspective and have accordingly quashed the

decision of the Selection Committee as contained in Memo No. 2928 dated 17.07.2017 with a

further direction to fix the pension of the respondent no. 1 in the Pay scale of Principal Chief

Conservator of Forest (HoFF) along with all consequential retiral benefits but without any interest.

We do not find any reason to cause interference in such findings and consequently we dismiss this

writ application.

17. Pending I.A.s, if any, stands closed.

िवȪान महािधवƅा से परामशŊ Ůाɑ कर माननीय सवŖǄ Ɋायालय मŐ Special Leave Petition दायर िकया

गया, िजसका डायरी संƥा- 38560/2025 हœ। वाद मŐ माननीय Ɋायालय Ȫारा िदनांक-14.11.2025 को िनɻ आदेश

पाįरत िकया गया हœ-

2. Delay condoned.

3. We have heard learned counsel for the parties.

4. Having considered the contentions made across the Bar, we do not find any reason to grant

Special Leave to Appeal.

5. As such, the present Special Leave Petition is dismissed, leaving the question of law open.

ŵी Ůदीप कुमार, भा॰व॰से॰ (सेवािनवृत) के संबंध मŐ मंिũमǷल सिचवालय एवं िनगरानी िवभाग (िनगरानी),

झारखǷ, राँची तथा लोकायुƅ कायाŊलय, झारखǷ, राँची से अȨतन ˢǅता Ůमाण-पũ Ůाɑ हœ। साथ ही आंतįरक

आरोप की अȨतन İ̾ थित भी Ůाɑ हœ। ŵी Ůदीप कुमार के िवŝȠ सɽित कोई आरोप यथा-

जांच/काǷ/अिभयोजन/िवभागीय कायŊवाही संचािलत/लंिबत नहीं हœ।

झारखǷ राǛ एवं अɊ बनाम Ůदीप कुमार मŐ माननीय सवŖǄ Ɋायालय Ȫारा िदनांक-14.11.2025 को

पाįरत Ɋायादेश के अनुपालन मŐ ŵी Ůदीप कुमार, सेवािनवृत भा॰व॰से॰ पदािधकारी को उनकी सेवािनवृित की ितिथ-

30.09.2016 के Ůभाव से Ůधान मुƥ वन संरƗक (HoFF) के वेतनमान (पे मैिटŌ ƛ लेवल-17) मŐ पŐशन एवं पįरणामी

लाभों के िनधाŊरण की ˢीकृित Ůदान करते Šए िबना िकसी ɯाज के भुगतान का आदेश िदया जाता हœ।

उपयुŊƅ Ůˑाव पर िदनांक-28.04.2026 को सɼɄ बैठक मŐ मद संƥा- 10 के ŝप मŐ मंिũपįरषद् की

ˢीकृित Ůाɑ हœ।
