NOTIFICATION

The draft of the Karnataka State Civil Services (Recruitment of Persons

Awarded with Medals at Olympics, Paralympics, Asian Games and Commonwealth

Games to Certain Posts) (Special) Rules, 2023, which the Government of Karnataka

proposes to make in exercise of the powers conferred by sub-section (1) of section

3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka

Act 14 of 1990) is hereby published as required by clause (a) of sub-section (2) of

section 3 of the said Act for the information of all persons likely to be affected

thereby and notice is hereby given that the said draft will be taken into

consideration after fifteen days from the date of its publication in Official Gazette.

Any objection or suggestion which may be received by the State Government

from any person with respect to the said draft before the expiry of the period

specified above will be considered by the State Government. Objections and

suggestions may be addressed to the Secretary to Government, Department of

Personnel and Administrative Reforms, Vidhana Soudha, Bengaluru -560 001.

DRAFT RULES

1. Title, commencement and application:- (1) These rules may be called the

Karnataka State Civil Services (Recruitment of Persons Awarded with Medals at

Olympics, Paralympics, Asian Games and Commonwealth Games to Certain Posts)

(Special) Rules, 2023.

(2) They shall come into force from the date of their final publication in the Official

Gazette.

(3) They shall apply for direct recruitment to the Group-A and Group-B services in

the Civil Services of the State specified in column (2) relating to the cadre or posts

as specified in column (3) of the Schedule thereof:

Provided that, these rules shall also be applicable to such medalist, possessing an

educational qualification lower than a Bachelor’s Degree, for selection to any of the

Group-C or Group-D posts in the Civil Services of the State in accordance with

serial Number 4 of the table specified in sub-rule (2) of rule 3 thereof.

2. Definitions:- (1) In these rules, unless the context otherwise requires,-

(a)

'Asian Games' means the games organized by the Olympic

Council of Asia having its headquarters at Kuwait and recognized by

the International Olympic Committee;

(b)

'Commonwealth Games' means the games organized

quadrennially by the Commonwealth Games Federation, an

international organization, having its Headquarters at London,

England and United Kingdom;

(c)

‘Form’ means Form appended to these rules;

(d)

"Government' means the Government of Karnataka;

(e)

'Medallist' means a citizen of India and a resident of

Karnataka for a minimum period of ten years prior to representing

Karnataka at National level and has won Gold or Silver or Bronze

medal in the Olympic or Paralympic or Asian or Commonwealth

Games, as the case may be;

Explanation: The term “medallist” includes medallists who have

already won medals on or before the date of commencement of these

rules and are eligible to be considered for recruitment under these

rules.

(f)

'Olympics’ means the Summer Olympic Games organized by

the International Olympic Committee having its headquarters at

Lausanne, Switzerland and does not include Winter Olympic Games

or any other Olympic Games;

(g)

‘Paralympics’ means the Paralympic Games organized by

the International Paralympic Committee (IPC);

(h)

‘Schedule’ means, the Schedule appended to these rules;

and

'Selection Committee' means the committee constituted under

these rules for selection of medallist.

(2) All other words and expressions used in these rules but not defined shall have

the same meaning assigned to them in the Karnataka Civil Services (General

Recruitment) Rules, 1977 or any other rules framed by the Government for

governing recruitment and conditions of service of civil servants.

3. Selection of medallist:- (1) Notwithstanding anything contained in the rules of

recruitment specially made or deemed to have been made under the Karnataka

State Civil Services Act, 1978 (Karnataka Act 14 of 1990), in respect of Group-A

and Group-B Cadre or Posts in the Civil Services of the State specified in the

Schedule and any of the Group-C and Group-D Cadre or Posts in the Civil Services

of the State, the medallist who won the medals before and after the commencement

of these rules shall be selected in accordance with the provisions of these rules.

(2) Subject to their eligibility and suitability, the various categories of medallists

mentioned in column (2) of the table below and possessing educational qualification

specified therein shall be considered for selection to the corresponding posts

specified in column (3) thereof:

4. Upper limit relating to number of posts to which selection may be made:-

(1) The maximum number of posts to which selection may be made under these

rules in each cadre specified in the schedule shall be as specified below,-

(a) A total of five posts in Group-A from among the nine

cadres specified against serial numbers (1) to (9) in

column (3) of the Schedule;

(b) Five posts in Group-B in each of the fifteen cadres

specified against serial numbers (10) to (24) in column (3)

of the Schedule; and

(c) Any number of posts with no upper limit in each of

the cadres in Group-C and Group-D in any of the civil

services of the State.

(2) For this purpose, the Member-Secretary of the Selection Committee shall

maintain a register in the Form and apprise the Selection Committee of the details

contained therein with specific reference to the number of posts to which selection

has already been made on previous occasions and the remaining number of posts

available for selection in accordance with the limits specified in these rule.

5. Selection Committee:- (1) There shall be a Selection Committee for selection of

medallist considered as candidates for selection under these rules, comprising of

the members specified in the table below, namely:-

(2) The Member-Secretary of the Selection Committee, in the case of Olympics or

Asian Games or Commonwealth Games, as the case may be, shall contact the

"Indian Olympics Association, Olympic Bhavan, B-29, Qutub Institutional Area,

New Delhi 110016" and in the case of Paralypmic Games, shall contact ‘Paralypmic

Committee of India’ and obtain the list of medallists in the concluded games and

take action to convene meetings of the Selection Committee.

(3) For the purpose of selection under these rules, the Selection Committee shall

obtain bio-data of the medallist and such details or documents as it may deem

necessary for determining their eligibility and suitability for selection.

(4) The Selection Committee shall decide on the allocation of a candidate to a post

in a service and/or department based on the availability of vacancies and

suitability of the candidate. The decision of the Selection Committee in this regard

shall be final.

6. Power to amend the table:- The Government may, by orders issued in this

behalf, amend the table contained in sub-rule (1) of rule 5 for the purpose of

including therein or excluding there from members of the Selection Committee.

7. Reservation:- Orders made by the Government with regard to reservation in

direct recruitment under clause (4) of Article 16 of the Constitution of India shall

not be applicable for the purpose of recruitment under these rules in accordance

with clause (h) of section 3 of the Karnataka Scheduled Castes, Scheduled Tribes

and Other Backward Classes (Reservation of Appointments, etc.,) Act, 1990

(Karnataka Act 7 of 1991).

8. Availability of vacancies:- Recruitment under these rules shall be subject to

availability of vacancies in the direct recruitment quota specified in the rules of

recruitment specially made in respect of the posts referred in column (3) of the

table in sub-rule (2) of rule 3.

9. Relaxation of upper age limits:- For the purpose of recruitment under these

rules, the upper age limit specified for recruitment to the posts referred in column

(3) of the table in sub-rule (2) of rule 3 shall be relaxed by ten years.

10. Continuity of Civil Service:- A medallist, who is in Government service on

the date of his appointment under these rules, shall be accorded the benefit of

continuity of service, if any, available under the relevant rules.

11. Offer letter and selection of medallist:- (1) The Selection Committee shall

offer the medallist the post to which he is selected through a letter of offer.

(2) If the medallist accepts the offer, the Selection Committee shall record the

selection of the medallist through an Official Memorandum furnishing all the

necessary particulars of the selected medallist and forward the same to the

appointing authority concerned.

12. Appointment of the selected medallist:- The appointing authority concerned

shall, as soon as it receives the Official Memorandum of selection of the medallist,

appoint him by a notification after satisfying itself about the suitability of the

candidate in accordance with the provisions of the Karnataka Civil Services

(General Recruitment) Rules, 1977. The notification shall be despatched to the

selected medallist by registered post or speed post. The period within which he

shall report to duty shall also be indicated in the notification.

13. Application of other rules:- The Karnataka Civil Services (General

Recruitment) Rules, 1977, the Karnataka Civil Services (Probation) Rules, 1977

and all other rules governing recruitment and the conditions of service of civil

servants, issued or deemed to have been issued under the Karnataka State Civil

Services Act, 1978 ( Karnataka Act 14 of 1990) from time to time, in so far as they

are not inconsistent with the provisions of these rules, shall apply mutatis

mutandis.
