NOTIFICATION
Whereas, upon considering the investigation reports submitted to Government by Superintendent of Police, Udupi District, Udupi
and Police Inspector and Investigation Officer, Cyber Crime, Economic Offences and Narcotics Police Station Udupi District, with respect to
Crime No. 0031/2021, Dated: 15-03-2021 registered at Kundapura Police Station regarding Gold Jewellers, Kundapura Taluk Scam case, the
Government has issued provisional attachment notification under sub section (3) of Section 7 of the Banning of Unregulated Deposit Schemes
Act, 2019 (Central Act 21 of 2019) by attaching the movable and immovable properties belonging to the accused in the said case vide
Government Notification No. E-RD 58 GRC 2021, Dated: 29-01-2022 and corrigendum was issued on 05-05-2022 for the said notification.
Accordingly, petitions were filed vide Misc. No. 1122, 1123, 1124, 1125, 1126, 1127/2023 before the Hon’ble Special Court for KPIDFE
Cases i.e., Hon’ble XCI Additional City Civil and Sessions Judge Bengaluru (CCH-92) for seeking the attachment to be made absolute under section

14(1) and 16(1) of Banning of Unregulated Deposit Schemes Act, 2019 (Central Act 21 of 2019), after hearing the cases, Hon’ble Special Court
rejected all the petitions filed as the same are not maintainable in the present form vide orders dated: 16-11-2023 and 17-11-2023.
Hence in view of the above, in order to protect the interest of the depositors and to take further action in the case under the provisions
of KPIDFE Act 2004, the provisional attachment Government Notification No. E-RD 58 GRC 2021, Dated: 29-01-2022 and corrigendum Dated: 05-
05-2022 issued under the BUDS Act 2019 in respect of Gold Jewellers, Kundapura Taluk Scam case is withdrawn with immediate effect.

NOTIFICATION
It has come to the notice of the Government, that the financial establishment viz., Gold Jewellers Kundapura
Taluk is involved in the fraudulent transactions and failed to return deposits to their depositors. Hence, the
Government has decided to initiate action as per the provisions specified under the Karnataka Protection of Interest
of Depositors in Financial Establishments Act, 2004 (Karnataka Act 30 of 2005).
The Properties belonging to the said financial entity may have spread over in various districts and depositors
are scattered throughout the State of Karnataka and possibly in other States also. In order to avoid duplication of

efforts, necessity has arisen to authorize Competent Authority to call for claims from all the depositors of Gold
Jewellers, Kundapura Taluk.
Therefore, in exercise of the powers conferred by Section 5(1) of The Karnataka Protection of Interest of
Depositors in Financial Establishments Act,2004 (Karnataka Act.30 of 2005), the Government of Karnataka, hereby
appoint Assistant Commissioner, Kundapura Sub Division, Kundapura, Udupi District as the ‘Competent Authority’ in
respect of Gold Jewellers, Kundapura Taluk with immediate effect.

NOTIFICATION
Whereas, upon considering the investigation report of the Superintendent of Police, Udupi District, Udupi and
Police Inspector and Investigation Officer, Cyber Crime, Economic Offences & Narcotics Police Station, Udupi
District, Udupi and after due investigation of the complaints of depositors it has come to the notice of the
Government, that the Gold Jewellers Kundapura Taluk is involved in fraudulent transactions by clandestinely and
illegally collecting deposits or money from the general public and thereafter have failed to return the same either

after maturity or on demand made by the depositors or complainants with promised interest and other assured
benefits and thereby have failed to render the services promised to them.
And whereas, it has further come to the notice of the Government that Gold Jewellers Kundapura Taluk and
people associating with them have been acquiring lands, movable and immovable properties, cash and others from
and out of the deposits or money so collected, from the depositors or complainants and thereby deviating from the
intended purposes of accepting the deposits or money.
And whereas, the Government has reason to believe that the actions of Gold Jewellers Kundapura Taluk and
people associating with them are acting in and detrimental to the interest of the depositors or complainants whose
intention was to defraud the innocent depositors, and it has become necessary to protect the interest of the
depositors of the Gold Jewellers Kundapura Taluk.
And whereas, now the Government after considering the report of the Superintendent of Police, Udupi District,
Udupi and Police Inspector and Investigation Officer, Cyber Crime, Economic Offences & Narcotics Police Station,
Udupi District, Udupi and satisfying itself about the urgent need to protect the interest of the depositors and in
exercise of the powers conferred by sub-section (2) of Section (3) of the Karnataka Protection of interest of
Depositors in Financial Establishment Act, 2004 (Karnataka Act 30 of 2005) hereby makes the following order,
namely:
“ORDER’’
Now therefore, in exercise of the powers conferred by sub-section (2) of Section (3) of the Karnataka
Protection of interest of Depositors in Financial Establishment Act, 2004 (Karnataka Act 30 of 2005), the
Government under the circumstances stated above having satisfied that in order to protect the interest of
depositors it is necessary to attach the movable and immovable properties believed to belong to Gold Jewellers
Kundapura Taluk .

Therefore, the Government hereby attaches movable and immovable properties as specified in the Annexure1
and 2 to this order believed to have been acquired by the Gold Jewellers Kundapura Taluk either in its own
name or in the name of any other person from and out of the deposits collected by the Gold Jewellers Kundapura
Taluk and where it transpires that such money or such other properties of the said financial establishment, or the
personal assets of the promoters, partners, directors, managers or members or any other person of the said
financial establishment is not sufficient for the repayment of the deposits or interest or such other assured benefits
to the depositors.
Note: All the aforesaid movable and immovable properties from the date of publication of this order in the Official
Gazette, shall forth with vest with the Competent Authority, who has been appointed by the Government, pending
further orders from the Special Court.
