(i)

Writ Petition is allowed

(ii) Mandamus issues to the respondents/State to consitute a Commision of Inquiry in

terms of the Commission of Inquiry Act, 19582 on the subject matter and the

appointed Commission of Inquiry should be single member or a multi member

headed by a retire judge of this Court.

(iii)

The Commission of Inquiry so appointed shall submit its report within theree

months of such appointment.

(iv)

The other reliefs sought would remain subject to the report of the Inquiry.

(v)

The State shall place its decision on the Inquiry report before this Court in due

sourse.

Accordingly, the writ appeal stands disposed of directing the

appellant/State and its authorities to conduct an enquiry into the

incident that took place on 10.12.2024 at Belagavi city through a

retired District Judge and submit a report within a within a period

of six weeks from today. The impugned order passed by the

learned Single Judge is accordingly modified.

The appeal is accordingly disposed of.
