THE KARNATAKA ESSENTIAL SERVICES MAINTENANCE

(AMENDMENT) ACT, 2025

(Received the assent of the Governor on the 10^th day of September, 2025)

An Act to amend the Karnataka Essential Services Maintenance Act, 2013;

Whereas it is expedient to amend the Karnataka Essential Services

Maintenance Act, 2013 (Karnataka Act 25 of 2015) and for matters connected

therewith for the purposes hereinafter appearing.

Be it enacted by the Karnataka State Legislature in the seventy sixth year of

the Republic of India, as follows:-

1. Short title and commencement.- (1) This Act may be called the

Karnataka Essential Services Maintenance (Amendment) Act, 2025.

(2) It shall come into force at once.

2. Amendment of section 1.- In the Karnataka Essential Services

Maintenance Act, 2013 (Karnataka Act 25 of 2015) (hereinafter referred to as the

Principal Act). In section 1, in sub-section (3) for the words “for a period of ten

years” the words “for a period of twenty years” shall be deemed to have been

substituted with effect from twenty seventh day of May, 2025.

3. Amendment of section 8.- In the Principal Act, in section 8 for the words,

figures and brackets “the Code of Criminal Procedure, 1973 (Central Act 2 of 1974)”

the words, figures and brackets “the Bharatiya Nagarik Suraksha Sanhitha, 2023

(Central Act 46 of 2023)”, shall be substituted.

4. Insertion of new section 10.- In the Principal Act, after section 9, the

following shall be inserted, namely:-

“10. Power to remove difficulty.- (1) If any difficulty arises in giving effect

to the provisions of this Act, then the State Government may, by notification in

the Official Gazette, make such provisions as may appear to it to be necessary or

expedient for purpose of removing the difficulty.

(2) Every order made under sub-section (1), shall as soon as after it is made,

be laid before the State Legislature.”
