“In case after a tender for assignment of advertisement rights under this

Rule fails to attract any bid then for reasons to be recorded in writing and

with prior approval of the Government, the requirement in next tender to

pay the Advertisement Fee after the preparatory period and with effect

from the Effective Date may be reduced to 40% (forty percent) of the total

advertisement space assigned in the tender or the advertisement space

Provided further that in case even after 12-months of date of signing of

the Agreement, the bid winner fails to start payment of full advertisement

space assigned to him then for the roads and areas for which he has failed

to start the payment of the assigned advertisement space, the tender

for the said roads and areas or part thereof shall be deemed to have been

terminated and shall become available to the City Corporation for re-

tender, free from any claims or encumbrances of the existing bid winner.

The Bid Security already furnished by the existing bid winner shall not be

refunded either partly or in full in such cases.”.
