NOTIFICATION

In the Budget of 2025-26, the State Government on 07.03.2025 has proposed to

allocate the unused liquor licences through a transparent electronic auction which

is expected to aid in additional resource mobilisation to the State.

1. Amendments -

In order to facilitate the e-Auction of CL (2-A) and CL (9-A) Licences, the

Amendments to the following three Excise Rules have been issued vide

Notification-I,

The Karnataka Excise (Sale of Indian and Foreign Liquors) Rules, 1968.

The Government is hereby pleased to announce the e-Auctioning of the CL(2-

A) and CL(9-A) Excise Licences for the vend of Indian Liquor or Foreign Liquor

or both and Refreshment Room (Bar) Licences respectively, through electronic

auction.

Details of Nodal officers for e-auction of Excise Licence are as per Annexure-1.

3. Period of Licence (Tenure) -

The auctioned licence will be granted for a period of 5 excise years, i.e., 2026-

27 to 2030-31.

4. Type of Licences for e-Auction -

i. CL (2-A) Licence : These licences shall be granted through e-auction in

Form CL-2A which is retail off shop licences for vend of Indian or Foreign

Liquor or both, not to be drunk in the premises and,

ii. CL (9-A) Refreshment Room (Bar) Licence : These licences shall be

granted through e-auction in Form CL-9A for the Sale of Indian or Foreign

Liquor or both combined with the supply of meals or eatables.

The provisions contained in sub-rule (2) and sub-rule (9) of Rule 3 of

Karnataka Excise (Sale of Indian and Foreign Liquors) Rules, 1968 pertaining to

the functioning of CL-2 and CL-9 Licences shall mutatis mutandis apply to the

CL(2-A) and CL(9-A) Licences respectively.

5. Eligibility and Disqualification -

Any

individual/Limited

Liability

Partnership

(LLP)/Partnership

Firm/Trust/Society/Company registered under the relevant laws in India are

eligible to apply.

5.1

The Bidders should not have the following disqualification and should

furnish an undertaking as per Rule 4-B of the Karnataka Excise (Sale of

Indian & Foreign Liquors) Rules, 1968 as below.

4-B. Disqualification:- (1) A person shall be disqualified from submitting an

application for obtaining or renewal of licence under these rules if he:-

(i)

has not paid the arrears of any excise dues in respect of liquor sold by

him

(ii)

has not produced a valid income-tax clearance certificate or has not

produced any document in proof of filing the latest income-tax return

before the Income-tax-Department in respect of his income.

(iii)

is holding an office of profit under the State Government or Central

Government.

(iv)

if he is below the age of twenty one years or an undischarged

insolvent or is of unsound mind.

(v)

has been convicted of any cognisable and non-bailable offence under

any Act, or any offence under the Narcotic Drugs and Psychotropic

Substances Act, 1985, or an offence under Section 481, 482, 483, 484,

485, 486, 487 or 489 of the Indian Penal Code, 1860.

Also the bidders should not have been convicted of an offence under Sections

345 (2), 345 (3), 347 (1), 347 (2), 348, 349, 350 (1) or 346 of the Bharathiya

Nyaya Sanhitha (BNS) 2023.

A company, firm or other body corporate shall be deemed to have incurred

the disqualification if the person in charge of and responsible for the conduct of

the business of such company, firm or other body corporate has incurred the

disqualification.

If, after obtaining the licence from the Excise Department by participating in

the bid, the ineligibility of the bidder becomes known, the issued licence shall be

liable for cancellation, and all amounts deposited by such disqualified bidder

shall be forfeited to the Excise Department.

5.2 Participation in E-Bid by LLP/Partnership Firm/Trust/Society/ Company.

In addition to individual e-bids, participation in the e-bid is allowed through

LLP/Partnership Firm/Trust/Society/Company registered under relevant laws

in India, as detailed below:

i.

If a LLP/Partnership Firm/Trust/Society/Company participates in the e-

auction, the name of the entity must be entered as the bidder.

ii.

Person in charge of and responsible for the conduct of the business of

LLP/Partnership

Firm/Trust/Society/Company,

must

complete

all

necessary formalities for registration and e-auction participation on behalf of

such entity. Such person shall submit a copy of the Authorization Letter to

the Excise Department at the time of applying for the Grant of Licence.

iii.

If an LLP/Partnership Firm/Trust/Society/Company emerges as H-1 bidder,

all individuals included in the entity shall be jointly and individually liable

for the fulfilment of the Bid Amount, Annual Licence Fee, other fees and

departmental arrears. Excise Department shall not be concerned with the

entity’s internal arrangement regarding the division of liabilities.

iv.

The

individuals

included

in

such

LLP/Partnership

Firm/Trust/Society/Company shall not be different from the list presented

by the entity to the applicable authorities concerned.

v.

If any partners in LLP or Partnership firm /Trustees in Trust/Members of

societies/ Shareholders of company included in the licence withdraws from

LLP/Partnership Firm/Trust/Society/Company during the term of the

licence, the licence shall be deemed to have been cancelled, and all amounts

deposited by the licensees shall be forfeited by the Excise Department.

vi.

If a LLP/Partnership Firm/Trust/Society/Company participates in the e-

auction, relevant documents relating to the entity must be provided at the

time of applying for the Grant of Licence.

Example-1:- in case of Company, copy of the Certificate of

Incorporation, Memorandum of Association (MoA) and Articles of

Association (AoA) etc.,

Example-2:- in case of LLP/Partnership Firm/Trust/Society, Copy

of the Certificate of Registration, Partnership Deed, Form-A, List of

Trustees/Members, etc., as the case may be.

6. Reservation -

The Rule 5 of Karnataka Excise (Sale of Indian & Foreign Liquors) Rules,

1968, has been amended to provide reservation in e-auction of CL(2-A) and CL(9-

A) licences. The percentage of reservation in e-auction of CL(2-A) and CL(9-A)

licences is as below.

Details of number of licences reserved to the above Categories are as per

Annexure-2 & 3.

If LLP/Partnership Firm/Trust/Society/Company claims reservation, all the

partners in LLP or Partnership firm /all Trustees in Trust/all Members of

Societies/ all Shareholders of company must belong to the same category as

mentioned in the previous para.

The Caste list of the corresponding categories issued by the Government of

Karnataka from time to time is “mutatis mutandis” applicable for any individuals

claiming

reservation

for

the

purpose

of

e-auction

of

licences.

No

concession/exemption is provided in payment of Registration Fee/Application

Fee/EMD amount.

If any Successful bidder (H-1) Claiming Reservation fails to submit the

reservation certificate issued by the competent authorities of Government of

Karnataka, his bid stands cancelled, any EMD /Bid Amount/any other Fees paid

shall be forfeited and legal action will be taken as per law.

7. Number of Licences for e-Auction -

District wise allocation of Licences for e-Auction are as shown in Annexure-

2 & 3.

8. Schedule of e-Auction -

The schedule for e-Auction is provided in Annexure-4 & 4A and will be

available

9. Registration Process -

Interested Bidders may register in the electronic auction platform well before

the start of bidding. The registration process will start after the publication of

the advertisement for the e-auction of licences in the website of the Department

and e-auction platform. The interested bidder has to register online in the e-

Auction platform Portal of MSTC Limited https://www.mstcecommerce.com.

During the registration, entry of PAN is mandatory. If bidder is LLP/Partnership

Firm/Trust/Society/Company, PAN of the entity must be entered. The bidder

has to pay the registration fee of Rs.1,000/- plus applicable GST online.

10. Application Fee -

The Application Fee for each application shall be Rs.50,000/- (Fifty

Thousand Only) which is Non-Refundable.

11. Number of Applications -

Bidders are permitted to file Applications for more than one licences, i.e., one

application for each Licence separately, subject to payment of separate

Application Fee and separate Earnest Money Deposit (EMD) for each application.

12. Base Price -

The

Base

Price

for

each

type

of

licence

is

detailed

in

Annexure-5.

13. Earnest Money Deposit (EMD) -

The EMD shall be 2 % of the Base Price of the licence which has to be paid

online at the time of submitting an application.

14. Bidding Increments -

The bid will start from the Base Price of the respective licences. Bidders have

to bid for an increment of Rs. 2 lakh or its multiple for each bid.

15. Selection Process through Electronic Auction System -

Selection of Successful bidder (H1) shall be done through an online

e-Auction. For this purpose, the e-Auction shall be conducted in e-Portal of

MSTC Limited, a Government of India undertaking.

i.

Anyone intending to participate in e-auction of Excise Licences has to Log

into the e-Auction Portal https://www.mstcecommerce.com . On this page

navigate to e-AuctionOther ProductsKarnataka Excise E-Auction of

Licences.

ii.

To register afresh, click on the link provided: ‘Register as Bidder’.

iii.

Bidder's Registration Form will appear on the screen. Fill up the required

information and provide the necessary undertaking and submit the form.

iv.

The User ID and Password generated through the form maybe noted for

future transactions in this portal.

v.

After successful registration, bidder has to log in using registered User ID

and the password created during registration. OTP is sent for verification to

registered email id and mobile numbers.

vi.

Bidder has to pay the registration fee of Rs.1,000/- plus applicable GST

amount online to activate bidder account.

vii.

After payment of registration fees, bidder can access the homepage with

various options.

viii.

Bidder can check “View Forthcoming auctions” page to check complete

details of the upcoming Excise licence auctions.

ix.

Bidder may click on “Generate VAN (Virtual Account Number)” link to

generate a virtual account number (which is a wallet account). Bidder can

use this bank details to deposit the requisite EMD and Application fee for all

the interested licences.

x.

To check payment status, click on "EMD Ledger." (which is a virtual Account

number)

xi.

To bid for a licence, bidder has to pay the application fee using “Pay

Application fees” link. Bidder shall ensure that the EMD ledger has sufficient

balance to match specified EMDs for the shops the bidder intends to

compete.

Example:

If the bidder is applying for 2 licences -

Licence 1: Application Fee = ₹50,000/-, EMD = ₹1,00,000/-

Licence 2: Application Fee = ₹50,000/-, EMD = ₹2,00,000/-

Total = ₹4,00,000/-. Bidder has to deposit ₹4,00,000/- in the

EMD ledger.

xii.

To charge the EMD Ledger, click on "Generate VAN" link and transfer the

amount to the mentioned bank account number and IFSC.

xiii.

On generating the virtual account details, bidder can pay the requisite

amount

to

the

generated

VAN

using

online

mode

of

payment

(e-Payment/RTGS/NEFT). Upon successful payment, the amount will reflect

in EMD ledger after about four hours, subject to the confirmation from the

bank. Bidders are advised to remit the amount at least two banking days

before the auction to avoid any last-minute issues. In the pay application fee

option, you can first select auction ref no. and then select the requisite shops

within the particular auction. The application fee is deducted instantly which

is non-refundable. Bidders are advised to select only intended Licences.

xiv.

All Licences under a particular auction will be displayed.

xv.

Select the checkbox next to the shops you intend to bid in and click "Submit."

Selection of shops should be done before the auction closing time.

i. Example: If scheduled closing is at 04:00 PM, selection

must be done before 04:00 PM. No selection is allowed

beyond scheduled closing time.

xvi.

Clicking "Submit" shows a message: "The total application fee and EMD shall

be deducted..." Click OK only after reading. The fee will be immediately

deducted. Remaining amount is displayed in the EMD ledger after deduction.

xvii.

Upon successful addition of shops, the system will show a success message.

xviii.

Click "EMD ledger" to view details and payment status of selected Licence.

xix.

Bidder Ledger will update accordingly after Licence addition.

xx.

To add more Licence, click "Pay Application fee" again.

xxi.

Click "Live Auction" to view ongoing auctions.

xxii.

Clicking on an auction will open the bid floor showing all lots (Shops).

xxiii.

8 minutes delta time period will be given at the end of each auction slot, if

the bidder bids in the last 8 minutes of the closer of the slot.

xxiv.

Bidder has to enter the bid in the provided space. Bids below base price will

not be allowed by the system.

xxv.

The bid will start from the Base Price of the shop. Bidders have to bid for an

increment of Rs.2 lakh or its multiple for each bid.

xxvi.

On submitting a bid, specified EMD amount will be consumed. Confirm by

clicking OK.

xxvii.

After bidding, the last bid will be updated accordingly.

xxviii.

After placing the bid, a pop up will show "Your bid is ……."

xxix.

On Clicking on ‘ok’, the system will accept the increased bid.

xxx.

When bidding on another shop, proportional EMD will be deducted and

Remaining EMD is updated.

xxxi.

When another bidder places a bid, the last bid updates accordingly.

xxxii.

Bidder has to Click "Bid History" to view the last 10 bids with amount, time

and date.

xxxiii.

The bidder can use "H1 Check" to verify if the bid is Successful. If yes, a pop

up will say "You are H1 bidder."

xxxiv.

If not, it will say "You are not H1 bidder."

xxxv.

After the conclusion of bidding process, EMD amount for the particular

Licence is deducted from bidder ledger of the H1 bidder.

xxxvi.

EMD amount of unsuccessful bidder will be refunded back to EMD ledger,

immediately after the closure of e-auction.

16. Rejection of Bids -

The e-Auction Awarding Authority reserves the right to reject/terminate any

Bid/winning bid at any time during or after the conclusion of auction, if:

a) at any time, a material misrepresentation is made or uncovered, or has

given any materially incorrect or false information.

b) the Bidder fails to make the payments within the stipulated time.

17. Successful Bidder (H-1) -

a) The bidder who quotes the winning Bid amount shall be declared as the

‘Successful Bidder’ (H-1). A Provisional Intimation Letter will be sent to

Successful (H1) bidder via email provided during the registration process.

b) Payment of Transaction fee - The Successful bidder shall pay 0.42% plus

applicable GST of the winning bid amount as transaction fee to MSTC

Limited in https://www.mstcecommerce.com portal within 7 working days

from the date of Provisional Intimation.

c) The Successful bidder (H-1), shall make payment of minimum of 50% of

the winning Bid amount from dated 03.08.2026 to 11.08.2026. However,

the option is available to the Successful bidder (H-1) to make full payment.

result in forfeiture of the EMD and all other fees already paid.

d) The Letter of Acceptance (LOA) - shall be issued by the Additional

Commissioner (HQ & I), State Excise Department after the payment of

MSTC transaction fee and minimum of 50% of the winning bid amount.

e) After the LOA is issued, the Successful bidder (H-1) may apply to the

Deputy Commissioner (Revenue) for Grant of Licence by logging into Excise

Services website hƩps://ksbclonline.karnataka.gov.in/EXCISE-ERP/#/auth/signin.

f) The remaining winning bid amount shall be paid on or before 31.10.2026

by logging into hƩps://ksbclonline.karnataka.gov.in/EXCISE-ERP/#/auth/signin after

adjusting the EMD amount. Failure to do so will result in forfeiture of the

EMD/Bid Amount/any other Fees paid and Cancellation of Licence if

granted.

g) Payment of Licence Fee - The Successful bidder (H-1) is exempted from

the payment of licence fee for the 1^st Excise year of the tenure (Excise year

2026-27). However, Successful bidder (H-1) has to pay the Annual Licence

Renewal fee and Additional Licence fee every year for the next 04 years of

the tenure starting from Excise year 2027-28.

h) Annual Licence Renewal fee and Additional Licence fee applicable for CL-2

and CL-9 will be applicable to CL (2-A) and CL(9-A) respectively.

18. Location of Licences -

The Successful bidder (H-1) shall locate the licence anywhere within the

allotted Range, subject to the provisions of Rule 5 of the Karnataka Excise

(General Conditions of Licences) Rules, 1967, and also in accordance with other

relevant rules.

19. Establishment of Liquor Shops -

The Successful bidder (H-1) after obtaining LOA shall file an application

through

https://ksbclonline.karnataka.gov.in/EXCISE-ERP/#/auth/signin in Form-1A for Grant

of Licence as per the procedure prescribed in Karnataka Excise (Sale of Indian

& Foreign Liquors) Rules, 1968.

Further, it is the responsibility of the Successful bidder (H-1) to arrange

suitable building and other requirements as per the Karnataka Excise Act, 1965

and Rules framed thereunder. The Department is not responsible for any delay

in commencement of the liquor shops in any manner.

Neither extension in time nor concession in any fee/refund shall be allowed

on account of failure of the Successful bidder (H-1) to arrange the premises for

making the licence operational.

20. Procedure to be followed in case of Death of the bidder -

(i) Participating Bidder - In case of death of the Participating Bidder, during

any stage of the bidding process, before declaring a successful bidder, the

applicants claiming to be the legal heirs of the deceased bidder, may claim

refund of the EMD paid by the deceased bidder by furnishing the relevant

documents obtained from competent authority to substantiate their claim.

(ii) Successful bidder (H-1) - In case of death of the Successful bidder (H-1),

to whom system generated email has been sent, the applicants claiming to

be the legal heirs of the deceased Successful bidder (H-1) can submit relevant

documents obtained from competent authorities to substantiate their claim

and proceed with further e-auction process.

21. Shifting of licence -

Rule 23 of the Karnataka Excise (General Conditions of Licences) Rules, 1967

shall be applicable for shifting of licence.

22. Transfer of Licence -

In case of death of the Licensee, transfer of licence under Rule 17-A of the

Karnataka Excise (General Conditions of Licences) Rules, 1967, is applicable to

the licences auctioned under this Notification.

Transfer of licence under Rule 17-B of the Karnataka Excise (General

Conditions of Licences) Rules, 1967, is not permitted for the licences auctioned

under this Notification.

23. Obligations of the Licensee -

The licensee shall be bound by the provisions of the Karnataka Excise Act,

1965, and the Rules framed thereunder, and Notifications / Guidelines issued

by the State Government, directions issued through Circulars or Orders passed

by the Excise Commissioner, Orders passed by the Deputy Commissioner /

Deputy Commissioner of Excise from time to time.

24. Suspension/Cancellation of Licence -

The licensee shall not be eligible for refund of any bid amount or licence

fee or any other fees remitted in the event of any penal action taken as per the

provisions of the Karnataka Excise Act, 1965, consequent to breach of licence

conditions or violation of Act and Rules and also for surrender of licence.

25. Force Majeure -

Government of Karnataka/State Excise Department shall not be liable for

any failure or delay in performing its obligations as per this Notification, due to

any cause beyond its reasonable control, including but not limited to, acts of

God, war, terrorism, riots, fire, flood, earthquake, or Government actions.

Bidder/Licensee as the case may be, shall not be entitled for any compensation.

26. Settlement of Disputes -

Regarding any dispute or difference or claim arising out of, or in

connection with, or relating to the bid, the decision of the committee formed at

the level of Excise Commissioner shall be final.

27. Jurisdiction -

The Courts situated within the city of Bengaluru alone shall have the

jurisdiction in the matter.

28. Reporting of e-Auction Proceedings -

After completion of entire bidding process, the e-auction Awarding

Authority shall submit to the Excise Commissioner, the details pertaining to

the e-Auction such as Proceedings of Bid finalized, copy of LOA, along with

other relevant documents, details of the licences allotted to the bidders and list

of remaining undisposed licences.

29. Undisposed Licences -

The undisposed / discontinued / forfeited/ non-renewed / un-started /

withdrawn / cancelled / terminated / surrendered licences if any shall fall into

the Auction pool.

30. Instructions to the bidders -

i.

The bidders shall carefully examine the Notification issued by the

Government and understand the terms and conditions of the e-

auction before the registration.

ii.

The bidder is advised to check the username and the password

before the e-Auction and is advised not to reveal it to anyone else so

as to prevent misuse of the same. Any bid placed using the bidder's

username and the password shall be deemed to be placed by the

bidder and the bidder shall be solely and fully responsible for all

the activities that may occur under such username and password.

iii.

Registration Fee, Application Fee, EMD and other payments made

are non-transferable.

iv.

All Participating bidders are advised to ensure that the registration

process is completed and their wallet is having sufficient money

Two (02) days prior to scheduled e-Auction of respective slots

(Excluding Central / State Government Holidays). This is to avoid

any delays at the last minute due to holidays, network failure or

technical issues.

v.

In case of non-availability of money in the wallet during the e-

auction, neither the Government of Karnataka nor the e-auction

platform

will

be

responsible

in

any

manner

for

the

Bidder/Participant not being able to participate in the auction.

vi.

Once the bid is placed, the bidder will not be allowed to

cancel/withdraw the bid.

vii.

The Successful bidder (H-1) will receive communication regarding

his selection as Successful H-1 bidder through system generated

email. The EMD amount paid will be adjusted during the Final

instalment or Full payment of the bid amount.

viii.

Failure to pay Transaction fee/Bid amount or non-acceptance of

LOA by the successful bidder shall result in the forfeiture of the

EMD /Bid Amount/any other Fees paid, and the bidder is liable to

be blacklisted by the Chief Controlling Authority under the

Karnataka Excise Act, 1965.

ix.

Neither the Government of Karnataka nor the e-auction Portal shall

be responsible for any failure of power, network, server, bandwidth

problems, internet connectivity, ISP or otherwise or the slowness to

access e-Auction Portal and no compensation will be paid. In case,

e-auctions cannot be held on scheduled date due to any unforeseen

reasons, the e-auctions will be rescheduled and will be held on t h e

same day or any other day, as decided by the Chief Controlling

Authority under the Karnataka Excise Act, 1965. The details of

such date/s and time will be notified in the website of Excise

Department/e-Auction portal only and no further communications

will be issued to the bidders individually. Hence, bidders are

advised to monitor and watch the above mentioned web portals.

x.

Any information submitted by the bidder found to be incorrect on

subsequent verification will result in termination of bid or

cancellation of licence besides other legal actions.

xi.

The bidders shall acquaint themselves with all applicable Acts,

Rules, Government Orders, Notifications, Circulars, Regulations,

Taxes, Levies, other charges and other legal provisions relating to

the e-auction and Grant of Licence.

xii.

Any negligence or omission or failure on the part of the bidder in

obtaining necessary and reliable information upon the foregoing or

any other matter affecting the bid shall not absolve them of any risk

or liabilities or responsibilities for Grant of Licence.

xiii.

xiv.

In case of any conflict/contradiction between English and Kannada

versions of the Notification, English version will prevail.

4-B. Disqualification:- (1) A person shall be disqualified from submitting an application for

obtaining or renewal of licence under these rules if he:-

(i)

has not paid the arrears of any excise dues in respect of liquor sold by him

(ii)

has not produced a valid income-tax clearance certificate or has not produced any

document in proof of filing the latest income-tax return before the Income-tax-

Department in respect of his income.

(iii)

is holding an office of profit under the State Government or Central Government.

(iv)

if he is below the age of twenty one years or an undischarged insolvent or is of

unsound mind.

(v)

has been convicted of any cognisable and non-bailable offence under any Act, or any

offence under the Narcotic Drugs and Psychotropic Substances Act, 1985, or an

offence under Section 481, 482, 483, 484, 485, 486, 487 or 489 of the Indian Penal

Code, 1860.
