Draft NOTIFICATION

PREAMBLE:

The Section 16 of the Electricity Act, 2003 empowers the Appropriate Commission to

specify, within one year from the appointed date, such general or specific conditions of

licence as may be applicable to the Licensees referred to in the first to fifth provisos to

Section 14 of the Act;

And whereas, in exercise of the powers conferred under Section 16 and Section 50 of the

Electricity Act, 2003, read with the relevant provisions of the Karnataka Electricity Reform

Act, 1999, the Commission has notified the KERC (Conditions of Licence to ESCOMs)

Regulations, 2004;

And whereas, “Conditions of Supply of Electricity of the Distribution Licensees in the State

of Karnataka” (CoS) were notified in the Gazette on 17th June, 2006 and have since

been amended from time to time;

Section 46 of the Electricity Act, 2003 authorizes the State Commission to empower, by

Regulations, a Distribution Licensee to recover from any person requiring supply of

electricity under Section 43, the expenses reasonably incurred in providing any electric

line or plant for the purpose of supply; and in exercise of the powers under Sections 46

and 181 of the Act, the Commission notified the KERC (Recovery of Expenditure for Supply

of Electricity) Regulations, 2004, as amended from time to time;

The Hon’ble Appellate Tribunal for Electricity, in Appeal No. 181 of 2008, directed the

Secretary of the Forum of Regulators (FOR) to undertake a comparative study of the

Standards of Performance and Supply Codes notified by various State Commissions to

identify variations and gaps requiring rectification; pursuant thereto, the FOR formulated

a Model Supply Code in 2011 incorporating mandatory statutory provisions and best

practices relating to consumer service, after due consultation with Regulatory

Commissions and stakeholders;

And whereas, in its 82nd Meeting held on 16th September, 2022, the Forum of Regulators

considered the reference from the Ministry of Power dated 28th July, 2022 regarding

simplification of the process for amendment of Supply Codes notified by State Electricity

Regulatory Commissions (SERCs), and resolved to constitute a Working Group to update

the Model Supply Code by incorporating recent developments; the revised Model

Supply Code was thereafter finalized;

Considering the above, the Commission felt it necessary to simplify by taking up

comprehensive review and updating the existing CoS and other regulations relating to

supply of electricity into a consolidated one. Therefore, with a view to consolidate the

existing regulatory framework relating to supply of electricity, eliminate duplication by

removing the inconsistencies between the provisions of various regulations relating to

supply, and ensure clarity and uniformity, the Commission has considered it expedient to

repeal the following Regulations:

1.

KERC (Electricity Supply) Code, 2004;

2.

KERC (Recovery of Expenditure for Supply of Electricity) Regulations, 2004 and

amendments thereto;

3.

KERC (Interest on Security Deposit) Regulations, 2005 and amendments thereto;

4.

KERC (Procedures for filing Appeal Before the Appellate Authority) Regulations,

2005 and its Amendments thereto;

5.

Conditions of Supply (CoS) of Electricity of Distribution Licensees in the State of

Karnataka, 2006 and Amendments thereto;

6.

KERC (Security Deposit) Regulations, 2007 and Amendments thereto;

These Regulations are intended to comprehensively govern matters relating to supply of

electricity to various categories of consumers, including procedures for grant of new

connections, disconnection and reconnection, assessment and modification of

sanctioned load, change of name, change of tariff category, regularization of

unauthorized use, and other alterations in existing service connections;

The Regulations also prescribe the practices relating to consumer metering, billing and

payment of electricity charges, and specify the fee structure, security deposits and other

amounts recoverable from consumers in accordance with law;

Now, therefore, the Distribution Licensee shall, in discharge of its statutory obligations and

in providing supply and related services to consumers, comply with all applicable

technical standards and safety requirements specified by the Central Electricity Authority

(CEA) under the Electricity Act, 2003, and Electricity Distribution Code including but not

limited to the following Regulations, as amended from time to time:

1.

and Electric Lines) Regulations, 2022, and its Amendments thereof;

2.

Central Electricity Authority (Technical Standards for Connectivity to the Grid)

Regulations, 2007, and its Amendments thereof;

3.

Central Electricity Authority (Installation and Operation of Meters) Regulations, 2006

and Amendments thereof;

4.

Central Electricity Authority (Safety Requirements for Construction, Operation and

Maintenance of Electrical Plants and Electric Lines) Regulations, 2011, and its

Amendments thereof;

The Distribution Licensee shall ensure strict adherence to the aforesaid standards in

respect of safety, metering, construction of electrical plants and lines, grid connectivity

and all other related technical aspects, and shall host updated and downloadable

copies of the relevant Regulations on its official website for public access.

Therefore, in exercise of the powers conferred by Section 50 read with subsection (1) of
