(AMENDMENT) BILL, 2026

(LA Bill No. 25 of 2026)

A Bill further to amend the Karnataka Government Parks (Preservation)

Act, 1975.

Whereas, it is expedient further to amend the Karnataka Government Parks

(Preservation) Act, 1975 (Karnataka Act 23 of 1975), for the purposes hereinafter

appearing;

Be it enacted by the Karnataka State Legislature in the seventy seventh year

of the Republic of India, as follows:-

1. Short title and commencement.-(1) This Act may be called the

Karnataka Government Parks (Preservation) (Amendment) Act, 2026.

(2) It shall come into force at once.

2. Amendment of section 5.- In the Karnataka Government Parks

(Preservation) Act, 1975 (Karnataka Act 23 of 1975),in section 5,-

(i) the existing provision shall be numbered as sub-section (1); and

(ii) after sub-section (1) as so numbered, the following shall be inserted,

namely:-

“(2) Notwithstanding anything contained in section 4 and without prejudice

to the provisions of sub-section (1), on the basis of the recommendations of the

High Level Committee constituted under this section, where the State Government

considers it to be expedient in public interest to permit the utilization of any land

or building or parts thereof comprised in a Park or Garden to which this Act applies,

it may alienateby means of sale, lease, gift, exchange, mortgage or otherwise or

permit the use of such land or building or parts thereof in favor of any Department

of the State Government, Statutory Authority, Government Company or local

authority up to an area not exceeding five percent of the total area of such park,

subject to such conditions and restrictionsas may be prescribedwith regards to

construction, maintenance, management, protection of ecology and environment,

etc.,

(3)The utilization of any land or building or parts thereof comprised in a

Park or Garden for implementation of public infrastructure or publicutility projects

shall be considered as being in furtherance of public interest.

(4) The State Government shall constitute a High Level Committee headed

by an officer not below the rank of Additional Chief Secretary to Government along

with such number of officers and domain experts as may be considered appropriate

by the State Government to make recommendations under sub-section (2).

(5)Five percent of the total area of any land or building or parts thereof

comprised in a Park or Garden shall be inclusive of any area, which is already

alienated by means of sale, lease, gift, exchange, mortgage or otherwise. This shall

not be construed as affecting the utility or development of any structure by the

Horticulture Department for their own use including development of Horticulture,

its allied activities and administrative purposes.

(6) Notwithstanding anything contained in section 4 and without prejudice

to the provisions of this section, on the basis of the recommendations of the High

Level Committee constituted under sub-section (4), with recorded reasons

demonstrating public interest and necessity where the State Government considers

it to be expedient as to the beneficial utilization of any land or building or parts

thereof comprised in any Horticulture Farm to which this Act applies, in the

interest of the farming community in any area of the State, it may alienate or permit

the use of such minimum extent of land or building or parts thereof in necessary

for implementation of Horticulture project in any Horticulture Farm for

implementation of any Horticulture Project, subject to suchconditions as and

restrictions as may be prescribed with regards construction, maintenance,

management, protection of ecology and environment and like matters etc.,.

Explanation:- The Horticulture Project shall mean project involving

development of Farm, Nursery, Production of improved varieties, post harvest

management, value addition, horticulture produce based industries, cold storage,

sales and storage, grading, sorting, packing etc., of horticulture produce and such

other activities closely related to horticulture.

STATEMENT OF OBJECTS AND REASONS

It is considered necessary further to amend the Karnataka Government

Parks (Preservation) Act, 1975 (Karnataka Act 23 of 1975) to,-

(a) explicitly permit the State Government, notwithstanding restrictions in

section 5, to alienate park land by way of sale, lease, gift, exchange,

mortgage, or otherwise, up to an absolute limit of five percent (5%) of the

total area. This applies strictly in favor of Government Departments,

Statutory Authorities, Government Companies, or Local Authorities for

public utility projects.

(b) establish an authoritative evaluation mechanism headed by the

Additional Chief Secretary to Government, alongside designated officers

and expert domain professionals, ensuring that any proposed land

utilization is thoroughly evaluated before any recommendation is made to

the State Government.

(c)

statutorily mandate that the five percent (5%) spatial ceiling is strictly

inclusive of any and all lands previously alienated, thereby safeguarding

the remaining natural ecosystem. It further clarifies that standard

developments by the Horticulture Department for its own administrative

and allied use fall entirely outside this restriction.

(d) provide a specialized legal pathway for utilizing minimal areas within

Horticulture Farms for implementing core Horticulture Projects. This

includes post-processing facilities, cold storage units, production of

improved varieties, and agro-based industries directly beneficial to the

local farming community, backed by recorded reasons demonstrating

public interest and absolute necessity.

Hence, the Bill.

FINANCIAL MEMORANDUM

There is no extra expenditure involved in the proposed Legislative measure.

MEMORANDUM REGARDING DELIGATED LEGISLATION

Clause 2

(a)

sub-section (2) of section 5 proposed to inserted empowers the

State Government to prescribe by rules such conditions and

restrictions to permit utilization of any land or building or

parts thereof.

(b)

sub-section (6) of section 5 proposed to inserted empowers the

State Government to prescribe by rules such conditions and

restrictions to alienate or permit use of such minimum extent

of land or building or parts thereof.

gate towards western side of the park (presently called R.V. Road) to Bangalore

Metro Rail Corporation Limited for the purpose of construction of elevated Station

for Metro Rail Project of Bangalore”

and Karnataka High Court Building, East: Park area of survey No. 1284; West:

Survey No. 570; North: Park area in survey No. 1284 linking to the nursery and

South: Park area of survey No. 1284 opposite to High Court;

(d) 11,160 sq. mtrs area of Cubbon Park located between East: High Court

of Karnataka in survey No. 1284; West: Existing Road between Vidhana Soudha,

and High Court in the Cubbon Park area of survey No. 1284; North: General Post

Office and South: Cubbon Park area of survey No. 1284.

(e) 18028.35 Square meters between High Court Building and Old KGID
