Sanction of the above infrastructure facilities incentives and concessions is subject to the following terms and conditions :

Environment : The company to obtain Consent for Establishment and Consent for Operation from KSPCB and environmental

clearance from MoEF, Govt. of India or the Dept of Forest, Ecology & Environment, Govt. of Karnataka, if applicable.

Employment : The Company shall comply with the provisions of applicable policy of Govt. of Karnataka with respect to local

employment on the project. Prepare a plan for development of Human Resources required for the project, train local people. A

copy of Human Resources Development plan shall be sent to the Commissioner for Industrial Development & Director of

Industries and Commerce for monitoring.

Vendor Development : Wherever there is scope for vendor development for the project, the company shall prepare a vendor

development plan, develop local vendors and procure the required inputs, components and sub-assemblies from these local

vendor units. A copy of the vendor development plan shall be sent to the Commissioner for Industrial Development & Director

of Industries and Commerce for monitoring.

Social Infrastructure Development : The Company is advised to take up social infrastructure development projects in the

vicinity of the proposed location of the unit and comply with the stipulation of Company Act 2013. A copy of such projects shall

be sent to the Commissioner for Industrial Development & Director of Industries and Commerce for monitoring.

Others :

The company shall adopt rainwater harvesting, waste water recycling and water conservation techniques Zero

discharge facility should be adopted wherever applicable.

The company shall take all statutory and other necessary clearances from the competent authorities including Govt. of

India.

As part of "Ease of Doing Business" Government vide order No. CI 89 SPI 2013, Dated: 20.12.2014 has accorded

approval to operationalise e-Udyami Phase II for obtaining various clearances approvals/licenses etc. through common

e-platform for the projects approved through District Level Single Window Clearance Committee (DLSWCC) or State

Level Single Window Clearance Committee (SLSWCC) or State High Level Clearance Committee (SHLCC) w.e.f.

01.01.2015.

Karnataka Udyog Mitra (KUM) would provide the necessary escort services for the speedy implementation of your

project. You are requested to inform the progress made in the implementation of the project every quarter in the

proforma.

This approval is valid for a period of two years from the date of issue of this Government Order.

Preamble :

The Proposal of M/s Nirani Sugars Ltd., for establishment of "120 KLPD Distillery Unit and to increase the Cane Crushing

Capacity from 10000 to 15000 TCD and Co-generation Power from 62 MW to 67 MW", with an investment `. 87.10 crores, generating

employment to about 500 persons at Kulali Cross, Jamakhandi Road, Mudhol, Jamkhandi Taluk, Bagalakote District was approved in

the 21^st SHLCC meeting held on 29.03.2010 read at (1) above. The Government Order was issued vide Government Order No. CI 155

SPI 2010, dated: 27.04.2010 read at (2) above.

In the Government Order No. CI 155 SPI 2010, dated: 25.08.2010 read at (3) above approval is given for acquisition and

allotment of 44 acres 36 guntas of land in Malapur and Mudhol Villages, Mudhol Taluk, Bagalakote District by KIADB in favour of

M/s Nirani Sugars Ltd. for establishment of 120 KLPD Distillery unit and for increasing the Cane Crushing Capacity from 10000 to 15000

TCD.

Now, M/s Nirani Sugars Ltd., has proposes for expansion of Sugar Plant capacity from 15000 TCD to 20000 TCD with an

investment `. 113.95 crores, generating employment to about 70 persons at 100 acres of existing land at Kulalli Cross Road, Mudhol,

Jamkhandi Taluk, Bagalkote.

In the 28^th Land Audit Committee meeting held on 27.04.2016, the Committee noted the land utilization details. After detailed

discussions, the Committee resolved to recommend to SLSWCC for approval of the proposed expansion project to be set up in

100 acres of their own existing land with a condition of no additional cane area allotment.

The proposal was examined & approved in the 91^st State Level Single Window Clearance Committee (SLSWCC) Meeting

held on 30.04.2016. Government has examined the recommendations made by the State Level Single Window Clearance Committee in

all aspects.

Hence the following order.

held on 19.11.2013 read at (1) above. The Government Order was issued vide Government Order No. CI 3 SPI 2014,

dated : 03.01.2014 was issued read at (2) above.

In the Government Order read at (4) above it is permitted to purchase 35.12 acres of land U/s 109 of KLR Act by M/s Mylar

Sugars Ltd., and 22.4 acres of land to be acquired by KIADB as SUC in different Sy. Nos. of Hoovina Hadagali, Ballari District, based on

the consent obtained from farmers by the company for the project approved vide Government Order No. CI 3 SPI 2014,

dated : 03.01.2014.

Now, the company has requested that they have completed civil work of both Sugar and Co-gen and erection work is under

progress. But, the project could not be implemented in time due to delay in obtaining various permissions and licenses and procurement

of land and conversion. Further, the implementation of distillery plant will take another one year and requested extension of time for a

period of 2 years to implement the project.

In the 22^nd Land Audit Committee Meeting held on 28.12.2015 and 91^st State Level Single Window Clearance Committee

(SLSWCC) meeting held on 30.04.2016, the committees resolved to approve extension of time for implementation of the project by two

years.

Government has examined the recommendations made by the 91^st State Level Single Window Clearance Committee

(SLSWCC) meeting held on 30.04.2016, in all aspects.

Hence the following order.

Preamble :

In the 5^th SHLCC meeting held on 10.10.2005 read at (1) above the Government approved the proposal of M/s Indian Cane

Power Limited for establishment of Sugar factory of 2500 TCD capacity at Uttur Village, Mudhol Taluk, Bagalakote District. Accordingly,

Government Order read at (2) above was issued.

Further, expansion proposal from 5,000 TCD to 12,000 TCD & Cogen from 28MW to 78MW was approved in 31^st SHLCC

meeting held on 17.06.2013 read at (3) above. Accordingly Government Order read at (4) above was issued.

Further, approval to increase Sugar Crushing capacity from 12,000 TCD to 24,000 TCD and Co-gen Power 78 MW to 83 MW

with additional investment of `. 350 crore with additional land of 50 acres by KIADB as SUC Uttur Village, Mudhol Taluk, Bagalakote

District was approved vide Government Order No. CI 108 SPI 2013, dated: 31.07.2015 read at (6) above.

However, it is found that one of the Sy. No. of Uttar Village in which the land is to be acquired in the said Government Order is

mentioned wrongly as 18/1 instead of 118/1.

The SHLCC in its 35^th and 36^th meeting has authorized Additional Chief Secreatry to Govt. C&I Department to approve the

following amendments to avoid delay in waiting for SHLCC / SLSWCC meetings to be conducted.

Order No. CI 133 SPI 2010, dated: 26.04.2010 read at (2) above.

Now, the company has requested that the financial closure for expansion project is finalized and the bank has released 5% of

the sanctioned term loan. They have completed vendor selection for supply of machinery and also approached KPTCL for approval of

evacuation scheme of the 18 MW gross co-generation. They have requested extension of time upto December, 2016 for completion of

the project.

In the 22^nd Land Audit Committee Meeting held on 28.12.2015 and 91^st State Level Single Window Clearance Committee

(SLSWCC) meeting held on 30.04.2016, the committees resolved to approve extension of time for implementation of the project by one

year.

Standard Operating Procedure to process applications for grant of Mining Lease where Prospecting has been

completed through Prospecting Licence under Section l0A (2) (b) of MMDR Act,1957-reg.

Preamble:

The Government of India has amended the Mines and Minerals (Development and Regulation) Act, 1957 and published in the

Official Gazette the Mines and Minerals (Development and Regulation) Amendment Act, 2015 on 27.03.2015 w.e.f. 12.01.2015 read at

(l) above.

Vide this amendment, as per Section 10A (2) (b) :

"where before the commencement of the Mines and Minerals (Development and Regulation) Amendment Act, 2015 a reconnaissance

permit or prospecting licence has been granted in respect of any land for any mineral, the permit holder or the licensee shall have a right

for obtaining a prospecting licence followed by a mining lease as the case may be, in respect of that mineral in that land, if the State

Government is satisfied that the permit holder or the licensee, as the case may be,-

(i) has undertaken reconnaissance operations or prospecting , operations, as the case may be, to establish the existence of

mineral contents in such land in accordance with such parameters as may be prescribed by the Central Government;

(ii) has not committed any breach of the terms and conditions of the reconnaissance permit or the prospecting licence;

(iii) has not become ineligible under the provisions of this Act; and .

(iv) has not failed to apply for grant of prospecting licence or mining lease, as the case may be, within a period of three months

after the expiry of reconnaissance permit or prospecting licence, as the case may be, or within such further period not exceeding

six months as may be extended by the State Government. "

There is no Standard Operating Procedure (SOP) to process the application for grant of mining lease (ML) wherein the

applicants have completed the prospecting through the prospecting licence (PL). Such application has to be considered under Section

l0A (2) (b) of the Act. A SOP needs to be prescribed in the form of checklist and procedures to be followed.

The Commissioner, Department of Mines and Geology has sent a proposal Read at (2) and (3) above, including a check list for

SOP to process seamless transfer of PL to ML cases. Thereafter, the Principal Secretary, Commerce and Industries held several

meetings to finalise the SOP to be issued for the cases where the applicants have applied for grant of mining lease after completing

prospecting under Prospecting Licence (PL).

After consideration of the fact that there is no Standard Operating Procedure for processing seamless transfer of applications

from PL to ML and based on discussions held with the Commissioner, Department of Mines and Geology along with his Officers, the

Government issues the following Standard Operating Procedure (SOP) for building up and scrutiny of the proposals that need to be

considered under Section 10 A (2) (b) of the MMDR Act, 1957.

Hence, the following order :

GOVERNMENT ORDER NO. CI 30 CMC 2015, BENGALURU, DATED: 25.05.2016

The matter has been examined in the light of above mentioned facts and circumstances as detailed in the preamble and

following standard operating procedure (SOP) is laid down along with attached checklist for consideration of proposals under

Section 10 A (2) (b) of the MMDR Act, 1957.

Building up of the proposal in file with necessary documents shall be the. responsibility of the Mining Lease Section of the

Department of Mines and Geology.

After that, for proper scrutiny at all levels the checklist attached to the Government Order shall be prepared, duly filled and

followed at every level.

Part I of the checklist shall be duly filled up by the Mining lease section of the Department of Mines and Geology along with

cross reference of necessary papers and documents in the file, as well with cross reference to other parts of the checklist,

wherever necessary.

Part-Il of the checklist shall be duly verified by the Drawing Branch of the Department of Mines and Geology with respect to

the status of the applied area.

Part III A of the checklist shall be verified by the Indian Bureau of Mines (IBM) under various provisions of the Mineral

Conservation and Development Rules, 1988, (MCDR,1988). The Mineral (Evidence of Mineral Contents) Rules, 2015 and the

Government of India guidelines issued on 24.06.2009 and 30.10.2014 as well as with respect to the additional conditions, if

any, imposed by the Central or the State Government.

A technical scrutiny of the report of IBM as well as reports submitted by the PL holder to the State Government shall be done

by the Senior Geologist of the ML Section as well as the Geologist (P & M) who looks after the exploration. They will fill up

Part IIIB of the checklist.

A Scrutiny Committee of the Department of Mines and Geology comprising of Geologist (P & M), Senior Geologist (MLS) and

Senior Geologist (P&M) will verify the compliance under Section 10A(2)(b) of MMDR Act, 2015 and the comments shall be

recorded in part IV of the check list.

All the aspects of part I to IV will be appraised by an Appraisal Committee comprising of Senior Geologist (P&M), Deputy

Director (R&D) and Additional Director (Minerals) and their findings will be recorded in Part V of the checklist.

In the part VI of the check list the Director/Commissioner, Department of Mines and Geology shall then based on examination

of checklist and recommendation of the Appraisal Committee and examination of necessary papers and document in the file,

finally record his opinion on whether the application is eligible for grant of Mining Lease under Section 10A(2)(b) of MMDR

Act, 1957.

10. All due diligence including examination of all papers and documents and then filling up of checklist must be completed in the

Department of Mines and Geology before the proposal is sent to the Government.

11. Each page of the checklist must be signed by the concerned who are supposed to fill the checklist as indicated in this

Government Order. Also, on each page of the checklist the AML File No and name of the applicant must be mentioned.

12. Government will examine the recommendation of the Appraisal Committee and that of the Director/Commissioner,

Department of Mines and Geology and proceed to take decision in the matter in accordance with law with regards to eligibility

of the applicant for being considered under Section 10 A (2) (b) of MMDR Act, 1957.

13. All provisions of Rule 7 of the Mineral (other than Atomic and Hydrocarbons Energy Minerals) Concession Rule, 2016 shall

also be complied with for grant of Mining Lease.
