effect from 7th April 1950. This Convention No. 81 of ILO provides for maintenance of a system of labour inspection in industrial and
commercial workplaces. The Labour Laws, have specific provisions for appointment and empowerment of labour-Inspectors, The ILO
Convention No. 81, mandates that the labour inspectors shall be recruited with sole regard to their qualifications and adequately trained
for the performance of their duties.
The labour inspection as a process is one of the core functions of the State to ensure decent conditions of service and healthy
industrial relations climate in workplaces. However keeping in mind the size of the Labour Inspectorate, the Government of Karnataka
hereby introduce this Scheme.
Through this Scheme, the State Government intends to empanel and accredit-the third party agencies, who shall verify the
status of labour law compliance in intending industry / unit / establishment that volunteers to take benefit of this Scheme. The single-
most important purpose of the scheme is to allow the industry to file a third party certificate to the concerned authorities of the
Department of Labour to state that labour norms are implemented in the unit/establishment.
The third party certification is a method of assessing, understanding, reporting and finally improving. performance of the
industry / establishment / unit, against standards prescribed under labour laws. The third party certification scheme is designed with an
intention of narrowing down gaps between statutory standards and reality in workplace and it creates an impact on governance of
industry. The third party certification is a continuous process and not an event.
Therefore Government of Karnataka is pleased to introduce this scheme, which provides an extended and supplementary
mechanism to assist the state inspection machinery to streamline compliance by medium and low risk industries located in the State of
Karnataka.

NOTIFICATION
No. LD 396 LET 2015 Bengaluru, Dated: 24-10-2017
Whereas the draft of the "Classification of Industries to streamline and simplify the inspection system" was published in
Notification No: LD 396 LET 2015, dated 05-10- -2016 in part IVA of the Karnataka Gazette No: 152 dated 06/04/2017 inviting
objections and suggestions from all the persons likely to be affected thereby within 30 days from the date of its publication in the Official
Gazette. The said Gazette was made available to the public on 06/04/2017.
And whereas, no suggestions or objections have been received on the said draft by the State Government.
Now, therefore Government of Karnataka hereby notifies the following inspection system:-
The Department of Labour has taken certain measures to bring reforms in the inspection system under all labour laws being
enforced -by the Department. Inspection system is a mechanism to ensure the statutory and welfare benefits and decent livelihood to
the working community. Normally an inspector is appointed by the competent authority through delegation of powers by government
notification under each Act. The notified inspector inspects an establishment exercising the delegated powers in order to ensure these
provisions. It is observed that all categories of industries / establishments do not require same frequency of inspections. Several
establishments / industries are voluntarily complying with the provisions of various labour laws, and some are complying with the
intervention of the Department. Hence the inspection requirement varies from establishment to establishment.
Recognising the voluntary compliance by certain industries, the government intends to fix the frequency of inspection
accordingly, Therefore the government has classified the establishments Into 3 categories as high risk, medium risk and low risk
industry, which require different levels of inspections; considering the nature of employment, awareness level among the workers,
dxistence of internal. unions, past history of compliances, mutual settlements, absence of industrial disputes and so on. The parameters
for classification of establishments are as follows:-
