PREAMBLE:

Under Government order No. RD 57 WES 2002, dt:20-01-2003 Sri Liyakat was appointed as Khazi of Afzalpur Tq. with 90

surrounding villages. Subsequently one Sri Syed Ghousuddin had challenge the said order before the Hon’ble High Court of Karnataka

in WP No. 4942/2003 and 4943/2003. The Hon’ble High Court had quashed the order of Sri Liyakat Khazi of Afzalpur and the remitted

it back to the Government for fresh consideration.

Sri Syed Ghousuddin preferred an appeal before the Appellant authority the then Principal Secretary, Minority Welfare Department

on the above grounds. The Appellant authority while allowing the Appeal appointed Sri Syed Ghousuddin as Khazi of Afzalpur Tq. 90

surrounding villages vide Order No. MWD 51 WES 2010 dt. 13-05-2011.

The above Petitioners filed a Writ Petition in the Hon’ble High Court of Karnataka Circuit Bench, Kalburgi vide W.P.

No.84085/2011 and 84135/2011 challenging the order of Sri Syed Ghousuddin Khazi of Afzalpur. The Hon’ble High Court of Karnataka

Circuit Bench, Kalburgi allowed the WP and passed orders directing the Respondent-1 Secretary to Government, Minority Welfare

Department to appoint the Petitioners as Khazis of Afzalpur consisting of three Circles and 90 villages coming thereunder.

In pursuant to the W.P. No.84085/2011 and 84135/2011, the Respondent Sri Ghousuddin Khazi and another filed an appeal

before the Hon’ble High Court of Karnataka, Circuit Bench, Kalburgi in W.A. No. 50307/2012 A/W W.A. 50308/2012 & 50347/2012

(GM-RES). The said appeal was dispose of by Hon’ble Court which reads as under.

“ In the said view of the matter, the Writ Appeals are disposed of and Government is directed to consider the

request of the Writ Petitioner for appointment as Khazis based on the recommendations of the Principal Mohammadan

residents of the area and select one or more fit person/s and appoint him/them as Khazis of the area. It is open to the

appellant to putforth their objections, if any, before the Government and it is for the Government to consider the matter

in the light of the provisions contained in S.2 of the Act.”

As per the directions of the Hon’ble High Court of Karnataka Circuit Bench, Kalburgi, the then Secretary, MWD requested the

Deputy Commissioner, Kalburgi to ascertain and communicate the recommendations of the Principal Mohammadan residence of the

area for the selection of one or more persons as Kahazis for appointment as Khazis of Afzalpur Tq. vide D.O.letter read at (2) above.

The Respondent Sri Syed Ghousuddin and another filed a W.P. in the Hon’ble High Court of Karnataka in W.P. No.205665 &

206231/2015 (GM RES) against the D.O. letter No. MWD 102 WES 2014, dt:07.09.2015 issued by Secretary to Government, Minority

Welfare Haj & Wakf Department to the Deputy Commissioner, Kalburgi. The said W.P. in question is rejected by the Hon’ble High Court

on 10-02-2016.

In pursuant to the Judgment dated:10-02-2016 in W.P. No. 205665 & 206231/2015 (GM RES) the Respondents Sri Syed

Ghousuddin and another preferred an Appeal before the Hon’ble High Court of Karnataka in W.A. No. 200087-200088/2016 and the

said Appeal was also disposed of as premature on 19-04-2017.

After pursuing the matter with the Deputy Commissioner by repeated reminders, recently he has submitted a report

on 19-02-2018 read at (3) above stating that the jurisdictional Assistant Commissioner and Tasildar of Afzalpur Tq. after holding a

meeting with the Principal Mohammadan of the area have recommended to appoint the Petitioners appeared in W.P. No.84085/2011

and 84135/2011 viz, Riyazuddin Khazi and five others at the rate of two Khazis in three circles of Afzalpur Tq. with 90 surrounding

villages.

While disposing the W.P. on 06-06-2012, Sri Liyakhat who was earlier appointed as Khazi and also the Petitioner in the above

W.P. was alive. Subsequently he expired on 20-07-2014. In the absence of any provision under the Law, there is no scope to consider

the request of Sri Moinuddin Khazi S/o late Afzalpasha Khazi Brother of the deceased Sri Liyakat to appoint him has Khazi in place of

his Brother Sri Late Liyakat as neither the Deputy Commissioner Kalburgi nor opined by the Law Department in this behalf.

The Petitioners in the above W.P. have submitted applications dt:24-02-2018 to consider their request and appoint them as Khazis

of Afzalpur as per the directions of the Hon’ble High Court of Karnataka in W.P. No.84085/2011 and 84135/2011 as well as on the

recommendations of the local Mohammadans as reported by the Deputy Commissioner Kalburgi vide his letter dated: 19-02-2018 read

at (3) above.

Though the Khazi of 1880 repealed on 19-03-2013 (Karnataka Act No. 39 of 2013 by the Law and Parliamentary Affairs and

Legislation Department as per Karnataka Repealing of Certain Enactments and Regional Laws Act 2013, as per Saving Clause-4, the

Khazis who were performing duties of Khazis prior to the Repealing of Khazi Act 1880 are continue to function as Khazis in the

Hyderabad Karnataka area till they alive.

Preamble:

In the Government Order read at (1) above, the proposal of M/s Hindustan Aeronautics Limited, Bengaluru to establish a green

field project for manufacture, repair and overhaul of helicopters in Gubbi Taluk, Tumakuru District with an investment of `.4,OOO crore

and employment opportunities to about 3,000 persons has been approved. Government of Karnataka has sanctioned infrastructure

facilitates, incentives and concessions and allotted 610 acres of Government land in Bidarahallakaval Village, Nittur Hobli, Gubbi Taluk,

Tumakuru District. HAL has been permitted to draw 43.77 MCFT of water from Kadaba tank of Hemavathi project during June

to October and create required infrastructure for storage of water during November to May.

In the letter read at (2) above, HAL has expressed its inability to create water storage facility within the allotted premises to store

water during the months from November to May, and has requested for modification of the Government order dated 09.07.2014 read

at (1) above, permitting the company to draw water from the Kadaba tank throughout the year, within the overall allocation of 43.77

MCFT.

In the letter read at (3) above, the Managing Director, Cauvery Neeravari Nigama Ltd., after examining the total storage capacity

of Kadaba tank and the requirement of water in the atchkat as per the tank register has opined that the request of HAL can be

considered.

The subject was examined in detail by the Cabinet during the meeting held on 05.08.2017. Government has considered the

proposal.

Hence the order.

In the circumstances explained in the preamble, and in partial modification of the Government Order No. CI 47 SPI 2013,

pay water charges fixed by M/s Cauvery Neeravari Nigama Ltd.

 Water supply to the existing local farmers should not be affected.

This order is issued with the concurrence of Water Resources Department vide note No. d¸ÀAE 15 J£ïJAJ¸ï 2014,

Preamble:

The project proposal of M/s. Anamitra Warehousing Pvt. Ltd., to establish an "Ware housing and Inland Container Depot" for

modern and mechanized bulk handling inland container Depot having open stacking yard and enclosed warehouses catering to different

export oriented sectors in 241 acres 27 guntas of land to be acquired and allotted by KIADB at Maralakunte Village, Jala Hobli.

Bengaluru North Taluk, with an investment of `. 366.04 crore, generating employment to about 9112 persons was approved in 19

SHLCC meeting held on 31.08.2009. Accordingly Government Order was issued vide Government Order No. CI 270 SPI 2009, dated:

29.10.2009 read at (2) above.

SLSWCC in its 90

th meeting held on 01.02.2016 approved extension of time for implementation of the project for a period of two

years. Accordingly, Government Order was issued vide read at (4) above.

The company in their letter dated 31.10.2017 have requested for approval for additional investment, change of activity and

Extension of time to implement the project.

The company has informed that on enquire with Ministry of Commerce, Government of India, they have been informed that New

Inland Container Depot (ICDs) are not permitted within the radius of 50 KM from the existing ICD facility. They have further informed that

the proposed land for the project is within the radius of 50 KMs from the nearest ICD at Whitefield which belongs to Container

Corporation of India.

As they have informed that they have already invested efforts and money in the project and have done a market survey and

have identified Industrial Township Development as the next alternate viable activity at the identified location.

Now, the company has requested following assistance from Government;

a) Approval for additional investment of `. 100.00 crore from `. 366.04 crore to 466.04 crore.

b) Change of activity form "Warehousing and Inland Container Depot" to "Industrial Township Development"

comprising Industrial, Residential and Commercial development.

c) Extension of time to implement the project by 3 years.

Government has examined the recommendations made by the 104

th State Level Single Window Clearance Committee

(SLSWCC) meeting held on 15.11.2017, in all aspects.

acres of land respectively for two SEZ’s and remaining land for non SEZ area in 103 acres 17 guntas of land at different Sy. Nos.

in Hulimangala, Gollahalli, Thiruplya & Maragondanahalli Villages Anekal Taluk, Bengaluru Urban District with an investment of `.490.00

crore and Government Order was issued read at (1) above.

In view of thr recommendation of the 16

th State High Level Clearance Committee meeting held on 19.11.2008, in the order

proposal of M/s. Patel Engineering Company Limited to establish Intergrated Township including Residential, Commercial and IT Park

project 147 acres 10.4 guntas of land to be acquired by KIADB an allotted as SUC at Hulimangala, Gollahalli, Thirupalya &

Maragondanahalli Villages Anekal Taluk, Bengaluru Urban District with an investment of `.2,025.00 crore generating employment to

about 51,452 persons and the Government Order had been issued on 21.04.2012 read at (4) above.

SHLCC in its 28

th meeting held on 23.5.2012 had approved the extension of time for 3 years from 28.5.2012 for

th SHLCC).



Accordingly, G.O. was issued on 28.5.2012 read at (6) above.

Further G.O. vide No.CI 137 SPI 2012, Bengaluru dt: 6.06.2012 was issued approving extension of time by 3 years from

6.06.2012 for implementation of the project and to consider the two projects approved earlier vide G.O. referred at (1), (2) & (4) above

as single entity or as single project with following details:



To establish two separate Sector Specific SEZs in Electronic Hardware/Software/IT & ITES area through two SPVs

created by the subsidiaries of M/s Patel Engineering Limited namely: M/s Hera Realcon Pvt. Ltd., and M/s Hebe

Infracon Pvt. Ltd. in 25.375 and 25.81 acres of land respectively and remaining land for Non-SEZ area in 103 acres, 17

guntas of land at Hulimangala, Gollahalli, Thirupalya and Maragondanahalli Villages of Anekal Taluk Bengaluru Urban

District with an investment of `. 490 crore as approved vide G.O. No. ITD/32/MDA/2007, dated: 17.3.2008 and

Addendum vide No. ITD 02 2009, dt: 16.01.2009.



Intergrated township with Residential mixed use including Residential, Commercial and IT Park project in 147 Acres

10.4 guntas of land at different Sy. Nos. in Hulimangala, Gollahalli, Thirupalya and Maragondanahalli Villages of Anekal

Taluk Bengaluru Urban District (approved in 27

G.O.No. CI 137 SPI 2012 dt: 28.05.2012 stands withdrawn and other terms and conditions remain the same as in the

G.O. dt: 17.03.2008, 16.1.2009 and 21.4.2012.

At the request of the company, 96

th State Level Single Window Clearance Committee meeting held on 20.1.2017 resolved to

accord approval for the change of activity from “Electronic Hardware/Software/IT and ITES SEZ” to “IT & ITES facility” in and extent of

25.81 acres of land out of the total extent approved & G.O. was issued on 15.02.2017 read at (9) above.

Now, the Company vide its letter dt:27.12.2017 has submitted the updated status of the project and effective steps taken

towards implementation of the project as follows;



KIADB has sanctioned the development plan of the Land on September 29, 2009 which has been modified from time to

time and also accorded building plan approvals in respect of the varied development activities.



Owing to the slowdown in the global economy and poor response received from the market for the completed stock of

IT/ITES built up area that has been remained unsold. The approval granted to M/s. Hebe infracon Pvt. Ltd., for setting

up of sector specific SEZ in 25.81 acres of the project land for Electronic Hardware/ software/IT and ITEs activity was

withdrawn and the SEZ was de-notified on April 20

th, 2010 by Government of India.



Pursuant to this government order, KIADB approved a revised master plan on 18.2.2017.

The Company has submitted that it has taken following steps for implementation of the project:



Development in 52.2 acres if land approved in 10

th SHLCC meeting has been completed and selling process of the

same is under progress.



Obtained building plan approval from KIADB.



Obtained NOC from Airprot Authority of India.



Obtained clearance from Karnataka State Pollution Control Board.



Obtained Environmental clearance from Department of Forest, Ecology & Environment on 18.4.2017.



Applied to Fire & Safety department for the clearance. Same is under process.



Applied to BESCOM for power Sanction.

Further, the Company has also submitted that it has acquired 10 acres 14 guntas of land in Sy. No. 53/1, 53/2, 54/1, 54/2, 54/3,

54/4 and 54/5 of Maragondanahalli Village Anekal Taluk, Bengaluru Urban District and 9 acres 26.5 guntas of land is Sy. No. 18 and 28

situated at Gollahalli Village, Anekal Taluk total of 20 acres which is contiguous with the existing land. Company planned to develop

IT/ITES facilities with and additional investment of ` 490.00 crore in 20 acres of above said land.

The Company had also informed that as per the zoning regulations approved by the Government of Karnataka for the City of

Bengaluru i.e., the Revised Master plan, 2015 the land and additional land falls partly within the ‘Industrial Hi-Tech’ zone and partly

within the ‘Residential (Main)’ zone and requested that while approving this revised proposal of the project, the SHLCC also be kind

enough to recommend that zoning be changed for the land and additional land to ‘IT/ITES Facilities’ which is further to the quick

implementation of the project.

The Company had requested for the following amendments;



The land approved earlier and additional land be Approved as an “Intergrated infrastructure project developed as a

township with mixed use for IT/ITES Facilities and comprising information technology activity, retail cum commercial

establishments etc.” Instead of the earlier approved proposal of SEZ project over 25.375 & 25.81 acres of land and

KIADB to continue to act as the competent authority for approval of the development and building plans of the project

along with the expansion of 20 acres of land.



Permit change of land use for the land and additional land form Industrial Hi-Tech and Residential (Main) to residential

Mixed use u/s 14A of the Karnataka Town and Country Planning Act, 1961.



Directions to all relevant competent authorities including State Environmental Impact Assessment Authority Karnataka

State Pollution Control Board, Fire Department and Airport Authority of India etc. to issue necessary approvals (or

modifications to existing approvals) for purposes fo implementing the project along with the additional land as said

above.



The project continued to be considered as a single project/entity along with the intergrated township project.



Approval for additional investment of `. 490.00 crore in 10 acres 14 guntas at Sy. Nos. 53/1, 53/2, 54/1, 54/2, 54/3, 54/4,

and 54/5 of Maragondanagalli Village Anekal Taluk, Bengaluru Urban District and 9 acres 26.5 guntas of land in

Sy No. 18 and 28 situtated at Gollahalli Village, Anekal Taluk total of 20 acres which is contiguous to the existing land.



Extension of time by 5 years to carry out the development activites and to implement the project.

The Company has also submitted that the project along with the additional “proposed land far expansion are will within the

norms of the present CDP.

Further, Letter to BDA and KIADB dated 5.02.2018 have been sent seeking opinion on Zonal regulations as per Revised Master

plan and on the request of the company.

The proposal of the Company has been placed in the 50

th LAC meeting held on 01.03.2018. The promoter of the Company

requested for the following:



The land approved earlier and additional land be approved as on “Integrated infrastructure project developed as

a township with mixed use of IT/ITES Facilities and comprising information technology activity, retail cum commercial

establishments etc” instead of the earlier approved proposal of SEZ project over 25.375 acres of the land and balance

52.2 acres of the land for non-SEZ purposes;



KIADB to continue to act as the competent authority for approval of the development and building plans of the project.



Extension of time by 5 years to carry out the development activites & to implement the project.

They would not go ahead with the approval in 147 acres 10.4 guntas of land in different Sy. Nos. of Hulimangala,

Gollahalli, Thirupalya and Marangondanahalli Villages, Anekal Taluk, Bengaluru Urban District, and hence to drop this

approval.

The land audit committee after detailed discussions, resolved to recommend to SHLCC for approval of the following:

Preamble:

The Project proposal of M/s Mangalore Refinery and Petrochemicals Ltd to establish a unit for manufacture of LPG MS Mixed,

Xylene Naphtha, SKO HSD, ATF, VGO, GO Asphalt, CRMB, Sulphur, Pet Coke and Polypropylene at Thokur, Baikampadi, Thannirbavi,

Kalavar, Bala, Jokatte, Permude, Kuthethoor Soorinje and Delanthabett Villages, Mangaluru Taluk, Dakshina Kannada District with an

investment of Rs. 20,000 crores was approved in 39

th SHLCC meeting held on 29.08.2015. Accordingly Government Order has been

issued read at (2) above.

At the request of the company during January 2016, Government has approved for the following vide Government Order

read at (5) above.

Change of products name as "Linier Alkyl Benzene (LAB), Ethylene Recovery Pet Coke Gasification, Crude Oil Refinery

(Expansion)".

Thenkayekkaru, Mulur and Kandavara Villages of Mangaluru Taluk are included as additional three Villages for proposed

expansion.

The Validity of approval GO has expired on 13.9.2017.

Now the company vide letter dated 04.09.2017 has informed that it has taken following effective steps to implement the project:

 The company has Paid `.694.67 Crores to KIADB towards land cost.

 KIADB has issued 28(4) notification to acquire the land & the land acquisition is in process with KIADB.

The company has requested for extension of time by 3 years.

The proposal was examined and approved in the 51

st State High Level Clearance Committee (SHLCC) Meeting held

on 02.03.2018.

Government has examined the recommendations made by the SHLCC in all aspects.

In the Government Order No: CI 04 SPI 2018 dated: 05.01.2018 while approving the infrastructure assistances, incentives and

concessions under the land portion the Village name is mentioned as Baikampady.

After issue of Govt. order, M/s Indian Coast Guard has submitted the representation to change the name of the viIlage in the

said Government Order as Kenjaru instead of Baikampady vide letter read at (3) above, since the JESCO land is in Kenjarru not

in Baikampady.

In the 35

th SHLCC meeting held on 14.05.2014, the committee authorized Additional Chief Secretary to Government,

Commerce and Industries Department to amend the earlier issued Government Orders/Approval letters which require minor changes

and to place such issues before the next SHLCC/SLSWCC for ratification vide Proceedings read at (4) above which includes the

correction in the name of the Villages also.

Therefore, in the Government Order No: CI 04 SPI 2018, dated: 05.01.2018 in place of order portion, the words;
