Preamble:

The Proposal of M/s. N.K. Utilities Ltd., to establish “300 MW Coal Based Power

Plant” at Kagalagomba Village, Bagalkot District with an investment of Rs.1740

crore, generating employment to about 500 persons was approved in the 16^th SHLCC

meeting held on 19.11.2008. Subsequently, in the 20^th SHLCC meeting held on 05.01.2010,

the committee approved to establish unit in 500 acres of land (225 acres U/s 109 of KLR

Act and 275 acres from KIADB as SUC) and also approved for change of location to

Achanur Village, Bagalkot District. Accordingly, Government Order vide read (1) above

was issued.

Further, 33^rd SHLCC in its meeting held on 19.11.2013 accorded approval for

extension of time to implement the project for further period of two years. Accordingly,

Government Order vide read (2) above was issued.

Further, in the 43^rdState High Level Clearance Committee (SHLCC) meeting held

on 01.02.2016 had granted extension of time for period of two years. Accordingly, the

Government Order was issued read at (3) above.

In the 93^rd State Level Single Window Clearance Committee (SLSWCC) Meeting

held on 03.08.2016. The Committee after detailed discussions noted that acquisition of

land through KIADB has got stuck in litigation and the company wishes to go ahead

with 180.09 acres of land purchased by them u/s 109 of KLR Act. Accordingly, it was

resolved to approve the following:

 Change of activity from “300 MW Coal Based Power Plant” to “50 MW Solar

Power Plant”.

 Change in investment to Rs.350.00 crore.

Accordingly, Government Order vide read (4) above was issued.

Now, the Company has requested the following:-

1. Approval of revised project of M/s. N K Utilities to set up 50 MW Solar Power

Plant with an investment of Rs.200.00 crore in 182 acres of land (Which

comprises of 118.37 acres of land purchased with permission U/s. 109 of KLR

Act and 63.05 acres of land acquired and allotted by KIADB as SUC) out of

233.24 acres of land which was originally proposed for the project.

2. Transfer 25.32 acres of land at different Sy. Nos of Achanur village, Bagalkot

District out of 118.37 acres of land purchased by the company with permission

U/s. 109 of KLR Act to their associate company M/s. Balan Agro Products Pvt.

Ltd to set up Acetic Anhydride Plant” with an investment of Rs.35.00 crore.

3. Transfer 25.32 acres of land at different Sy. Nos of Achanur village, Bagalkot

District out of 118.37 acres of land purchased by the company with permission

U/s. 109 of KLR Act to their associate company M/s. Balan Engineering Pvt.

Ltd to set up a unit for manufacture of Electric Vehicle with an investment of

Rs.25 crore in 25.30.

The subject was discussed in the 73^rd LAC meeting held on 11.08.2020 and it was

decided in the meeting that;

1. Ms/. N.K. Utilities shall provide details on definitive time lines to implement

the revised project and also 2 more projects proposed through their associate

companies along with details on preparations if any already made in support

of their seriousness to implement the project as the said land was allotted to

them more than 10 years back and till date the same is not utilized.

2. To hold a separate meeting under the Chairmanship of Commissioner for

Industries with the project proponents, KIADB and Energy department for

review of the same.

3. Therefore, the Committee decided to discuss the above project after the issue

is reviewed as suggested above.

Accordingly a meeting was conducted on 27.08.2020 under the Chairmanship of

Commissioner of Industries. The discussion and recommendation made in the said

meeting are as here under;

“The representative of the company explained the effective steps taken to

implement the project and has informed that;

 The possession of 63 acres 5 guntas of land required for

compactness of land (Total 233.24 acres) was handed over to the

company by KIADB on 12.01.2018 and subsequently they have

undertaken land formation works.

 Due to improvement in the solar power generation technology, now

182 acres of land is sufficient to put up 50 MW of solar power

generation project and hence they have planned to put up 2

separate projects through their other group companies in the

balance 51 acres. One is Acetic Anhydride Plant with an investment of

Rs.35 crore in 25.32 acres of land through M/s. Balan Agro

Products Pvt. Ltd. and other one is EV Manufacturing unit in 25.30

acres of land with an investment of Rs.25 crore through M/s. Balan

Engineering Pvt. Ltd.

 They have obtained approval from Energy Department vide G.O. No.

Energy/15/NCE/2019 dated: 15.05.2019 for generation of 8 MW Solar

Power and also a letter of intent dated: 05.06.2020 from ITI Ltd. to

sell the said 8MU solar power.

 As far as their EV manufacturing in concerned he mentioned that

they will manufacture only the goods carrying EVs. The design for

the same is completed and they have already manufactured 4 types

of goods carriage demo vehicles and their commercial product will

be released within a years time.

After detailed discussions, it was decided in the meeting to make the following

recommendations.

1. Recommend to SLSWCC for approval of revised project of

M/s. N.K. Utilities to set up 50 MW Solar Power Plant with an

investment of Rs.200.00 crore in 182 acres of land (Which comprises

2. Recommend to LAC to consider the following project proposals of

the group companies of M/s. N K Utilities.

a. Project proposal of M/s. Balan Agro Products Pvt. Ltd.

(a group company of N.K. Utilities) to set up Acetic Anhydride

Plant” with an investment of Rs.35.00 crore in 25.32 acres of land

to be transferred from M/s. N.K. Utilities as Achanur Village,

Bagalkot District.

b. Project proposal of M/s. Balan Engineering Pvt. Ltd (a group

company of M/s. N K Utilities) to set up a unit for manufacture of

Electric Vehicle with an investment of Rs. 25 crores in 25.30 acres

to be transferred from M/s. N K Utilites at Achanur Village,

Bagalkot District.

Recommendation of the 74^th Land Audit Committee meeting held on 14.09.2020 :

The representative of the company appeared before the Committee and

explained the proposal.

The Committee noted the request of the Company and recommendation made in

the meeting held on 27.08.2020 under the Chairmanship of Commissioner for Industrial

Development and after detailed discussion resolved to recommend to SLSWCC for

approval of the following;

The proposal was examined & approved in the 121^st State Level Single Window

Clearance Committee (SLSWCC) Meeting held on 01.10.2020.

Government has examined the recommendations made by the 121^st SLSWCC

meeting held on 01.10.2020 in all aspects.

Hence the following order.

GOVERNMENT ORDER No. CI 202 SPI 2020 , BENGALURU, DATED 07.11.2020

Government is pleased to approve the following proposals of M/s. N.K. Utilities

Ltd. to implement the project approved vide Government Order No. CI 261 SPI 2010,

dated: 18.06.2010:-

1. Approval of revised project of M/s. N.K. Utilities to set up 50 MW Solar Power Plant

with an investment of Rs.200 crore in 182 acres of land (Which comprises of 118.37

acres of land purchased with permission U/s. 109 of KLR Act and 63.05 acres of land

acquired and allotted by KIADB as SUC) out of 233.24 acres of land which was

originally proposed for the project.

Preamble:

The State High Level Clearance Committee (SHLCC) in its 27^th meeting held on

13.04.2012 has approved the Project proposal of M/s. Favorich Infra Pvt. Ltd., to

establish a “Mega Food Park” with an investment of Rs.99.52 crore, generating

employment to about 2000 persons in 300 acres of land to be acquired and allotted as

SUC by KIADB (out of the land notified by KIADB for formation of Industrial Area) at

Bannenahalli Village, Bookankere Hobli, Krishnarajpet, Mandya District. Accordingly,

Government Order read at (1) above was issued.

In the 88^th SLSWCC held on 12.01.2016 has approved for setting up of “50 MW

Solar Plant”, within the Food Park with an additional investment of Rs.300 crore and

extension of time by 2 years to implement the project. Accordingly, Government Order

read at (2) above was issued.

In the 108^th SLSWCC meeting held on 27.02.2018 has approved the extension of

time by 30 months to implement the project with a condition that further request for

extension of time to implement the project will not be considered. Accordingly,

Government Order read at (3) above was issued.

Further, 111^thSLSWCC meeting held on 01.08.2018 was approved the proposal of

the company for inclusion of additional activity viz., “Industrial Warehousing and

Logistics Park” in land other than the 60 acres earmarked for Mega Food Park, for

allotting to various supporting ancillary industries. Accordingly, Government Order read

at (4) above was issued.

In the 114^th SLSWCC held on 27.02.2019 accorded the approval for the following:

a) Establishment of primary processing centre-1 in 4 acres of land at Sy.

Nos. 90/1 & 90/2 in the industrial park belonged to Favorich Agro Pvt.

In the 117^th SLSWCC held on 03.10.2019 accorded the approval for the request of

the company to delete the condition of allotting facility in the “Industrial and Logistics

Park” only for Food Park Ancillary Industries.

Further, company in its letter informed that they have taken following effective

steps to implement the project.

1. Obtained Final approval from Ministry of Food Processing Industries (MoFPI), GoI

on 22.12.2017 for the Mega Food Park project.

2. Obtained Terms loan sanction from M/s. Union Bank of India for the project.

3. Obtained CFE from Karnataka State Pollution Control Board.

4. Obtained Stamp Duty Exemption and Concessional Charges for Registration

Certificate for Sub-lessee.

5. Obtained Industrial Entrepreneurs Memorandum (IEM) from Government of

India.

6. Obtained NOC from Airport Authority of India.

7. Obtained Master layout and building plan approval from KIADB.

8. Received approval for drawing 2.75 MLD water from Hemavathi River.

9. Obtained General License & NOC from local Gram Panchyathi.

10. Contracts have been awarded and works have been started for development

works, Warehouse, Cold storage, processing unit and other buildings.

11. Power connection, Water connection, site office building has been completed.

12. 15 acres of land has been subleased to 7 entrepreneurs for setting up of food

processing units.

13. KIADB has allotted land at Hassan, Chamarajanagar and Nagamangala during

March 2020, which is expected to be completed by March 2021.

The company vide its letter dated 14.09.2020 requested SLSWCC to amend the

existing Government for setting up of “Industrial and Logistics Park” in the land other

than the 60 acres enmarked for the Mega Food Park for allotting the plots to General

manufacturing and service Industries. Since there is huge demand for general industries

like Warehousing, textiles, Garments, Food processing and other manufacturing units.

The company is implementing Mega Food Park project in the phase-I in an area of

60 acres out of 129.03 acres of land allotted and expected to be completed by March –

2021. Due to COVID – 19, the company has lost more than 4 months of time for project

In view of the above, the company has requested SLSWCC approval for extension

of time by 30 months for completion of the project.

Recommendation of the 75^th Land Audit Committee meeting held on 23.09.2020:

The Vice President of the company appeared before the Committee and

requested for approval of the above.

The Committee noted the request of the company and after detailed discussions,

resolved to recommend to SLSWCC for approval for extension of time by 30 months for

crore, generating employment to about 400 persons in 100 acres 2 guntas of land (20

acres 2 guntas of land to be acquired and allotted by KIADB as SUC at Sy. Nos. 12, 48, 49,

50, 51, 52, 53 of Jalikatti Village, Ramdurga Taluk, Belgavi District and remaining 80 acres

of land to be purchased U/s 109 of KLR Act), subject to cane area allocation from Cane

Commissioner. Accordingly, Government Order read at reference (2) above was issued.

Subsequently, SLSWCC in its 108^th meeting held on 27.02.2018 has accorded

approval for the following

Inclusion of 120 KLPD Distillery (Ethanol Unit) activity.

Correction of water requirement as:-

10 Lakh LPD from Malaprabha River.

II. 2 Lakh LPD from Ground Water.

III. 8 Lakh LPD from Recycled Water.

2. Permission to purchase 71 acres of land U/s 109 of KLR Act at Sy. No. 24, 32/1, 32/2,

Sindagi Taluk, Bijapur District.

3. Extension of time for 2 years to implement the project.

Accordingly, Government Order vide read (3) above was issued.

Further, in the 116^th State Level Single Window Clearance Committee meeting

held on 15.06.2019 has approved to grant extension of time by 2 years to implement the

project to M/s. Sangamanath Sugars Ltd. with a condition that further request for

extension of time will not be considered. Accordingly, Government Order vide read (5)

above was issued.

Company in its letter has stated that cost of the project has been increased by

Rs.100.50 crore since there is enhancement in rate of machinery, equipment and other

civil work for Sugar plant & Co-gen.

Further it is mentioned that they have taken the following effective steps to

implement the project:-

1. The Secretary, Commerce & Industry Department, GoK has issued Cane Area

9. The company agreessively has targeted to start the trial/commercial production

due to increase in cost of machinery, equipment and other Civil works for construction

of 5000 TCD Sugar manufacturing unit with 21 MW Co-generation of power plant.

500 persons in 50 acres of land at Vemgal Industrial Area, Kolar District was approved in

the 32^nd SHLCC meeting held on 23.08.2013. Accordingly, Government Order vide read

(2) above was issued.

In the 117^th SLSWCC Meeting held on 03.10.2019, accorded approval for extension

of time to implement the project for further period of two years. Accordingly,

Government Order vide read (4) above was issued. .

Now, the company vide letter dated 07.09.2020 has informed the following:

 The Lease Deed signed between KIADB and The Tata Power Company Ltd.

(“TPCL”). TPCL is a listed public company promoted by Tata Sons Ltd. and

other Tata companies.

 TPCL proposes to transfer its Strategic Engineering Division (“SED”) as a

going concern by way of slump sale pursuant to a scheme of arrangement

under Sections 230 to 232 (and other applicable provisions) of the

Companies Act, 2013, to Tata Advanced Systems Limited (“TASL”), a wholly-

owned subsidiary of Tata Sons Limited. TASL is a company incorporated

under the Companies Act, 2013 (CIN: U72900TG2006PLC077939) with its

registered office situated at Plot No.1/1 Sy No. 21, Hardware Park, Imarat

Kancha, Ravirala Village, Ranga Reddy District, Telangana. In this regard

TPCL and TASL has obtained approval from NCLT Authorities for the Scheme

of Arrangements.

 The aforementioned Schedule Premises is currently under occupation by

SED vide the Lease Deed. TPCL has completed the construction of the

proposed Industrial Unit for carrying out authorised operations as approved

in the Letter of Approval Factory and Boilers, Karnataka State Pollution

Control Board and KIADB, We Started operations on 01st Sep 2020 wherein

it is manufacturing items as described in the lease deed.

 As per the above mentioned scheme, all rights and obligations in respect of

the Schedule Premises that are vested in SED under the Lease Deed shall

stand transferred to TASL on the effective date of the scheme. The said

Scheme has received approval from the Hon’ble National Company Law

Tribunal at Mumbai vide its order dated 12.12.2019.

 Both TPCL and TASL are promoted by the same entity i.e Tata Sons and that

the aforementioned business transfer is taking place within the Tata Sons

group only.

 The above transfer would be covered under clause 20 of the above Lease

Deed being a transfer due to operation of law consequent to transfer of SED

by TPCL to TASL by way of a Court Order i.e by order of the National

Company Law Tribunals pursuant to the petitions filed under Sections 230 to

232 of the Companies Act, 2013.

M/s. Formel Labs Pvt. Ltd. has proposed to establish a unit for manufacture of

“Pharmaceutical Products, Active Pharmaceutical Ingredients” with an investment of

Rs.102.50 crore, generating employment to about 9 persons at Kadechur Industrial Area,

Yadgir District.

In the 74^th Land Audit Committee meeting held on 14.09.2020, the Director of the

company appeared before the committee and highlighted the project proposal and

requested for allotment of 20 acres of land at Plot Nos.290,291,292, and 293 or Plot

Nos.306,307,308 and 309 of Kadechur Industrial Area, Yadgir District.

They had earlier planned to invest Rs.42.50 crore in the project; however, after

revision of their project parameters they have now decided to enhance the investment

to Rs. 102.50 crore.

The Director of the company also informed that the directors of this company are

associated with the following Hyderabad based companies;

KIM’S Hospital; is one of the largest corporate hospital in south India with

over 3000 beds.

2. SCL Infra Tech Limited; is a public infrastructure company which under takes

works such as Railways bridges, irrigation works and projects with annual

group turnover of Rs. 800 crore.

3. Lotus Hospital; a woman and child hospital in Hyderabad.

4. BSCPL Infratech Limited; Infrastructure Development Company engaged in

execution of road projects, irrigation projects and real estate with a turnover of

more than Rs. 2000 crore.

local people. A copy of Human Resources Development plan shall be sent to the

Commissioner for Industrial Development & Director of Industries and Commerce for

monitoring.

3. Vendor Development: Wherever there is scope for vendor development for the

project, the company shall prepare a vendor development plan, develop local vendors

and procure the required inputs, components and sub-assemblies from these local

vendor units. A copy of the vendor development plan shall be sent to the Commissioner

for Industrial Development & Director of Industries and Commerce for monitoring.

4. Social Infrastructure Development: The Company is advised to take up social

infrastructure development projects in the vicinity of the proposed location of the unit

and comply with the stipulation of Company Act 2013. A copy of such projects shall be

5. Others:

a. The company shall adopt rainwater harvesting, waste water recycling and

water conservation techniques. Zero discharge facility should be adopted

wherever applicable.

b. The company shall take all statutory and other necessary clearances from the

competent authorities including Govt. of India.

c. As part of “Ease of Doing Business” Government vide order No. CI 89 SPI

2013, Dated: 20.12.2014 has accorded approval to operationalise e-Udyami

Phase II for obtaining various clearances / approvals / licenses etc. through

common e-platform for the projects approved through District Level Single

Window Clearance Committee (DLSWCC) or State Level Single Window

Clearance Committee (SLSWCC) or State High Level Clearance Committee

Preamble:

M/s. ITC Indivision Ltd. has proposed to establish a unit for manufacture of

“Nicotine and Nicotine Bitartrate Dihydrate” with an investment of Rs.265 crore,

generating employment to about 205 persons at Immavu, Nanjangud Taluk, Mysuru

District.

In the 74^th Land Audit Committee meeting held on 14.09.2020, the representative

of the company appeared before the committee and highlighted the project proposal.

The representative of the company also informed that;

1. ITC indivision Ltd is a wholly owned subsidiary of ITC Limited and is an SPV for

manufacture of Nicotine and its derivatives.

2. Presently, Crude Nicotine is exported to European nation. This is then further

purified and value added there and India receives a small share of purified

Nicotine. The state-of-the-art facility proposed by the company would position

India as one of the purest Nicotine manufactureres in the World.

3. KIADB has allotted 102 acres of land to ITC Limited at Immavu, Nanjangud Taluk

and sale deed is executed for the same. 33,281 sq.mts of land required for the

present project will be taken on lease from ITC Ltd.

The representative of the company has requested KIADB to consider 33281 Sq.

mts of land being taken on lease as part of 102 acres of land allotted to ITC Ltd. for

deciding the FAR, Plot coverage, Setback and other norms as per building byelaws.

The Committee noted the request of the company, land utilisation details,

opinion of CEO & EM, KIADB and after detailed discussions, resolved to recommend to

SLSWCC for approval of the project of M/s. ITC Indivision Ltd. to establish a unit for

manufacture of “Nicotine and Nicotine Bitartrate Dihydrate” in 33,281 Sq. mtrs. of land

to be taken on lease from ITC Ltd. at Sy.No.367/1, 367/2A1, 367/2A2, 369, 371, 539, 538/1,

538/2 at Immavu, Nanjangud Taluk, Mysuru District.

In the 121^st State Level Single Window Clearance Committee (SLSWCC) meeting

held on 01.10.2020, the proposal of the Company was discussed and approved.

Government has examined the recommendations made by the SLSWCC in its 121^st

Meeting held on 01.10.2020, in all aspects.
