Explanatory Note

(This does not form part of the notification, but is intended to indicate the general purpose.)

The land as per the schedule above was originally notified under Section 3 (3) of the Kerala Forest (Vesting and

Management of Ecologically Fragile Lands) Ordinance, 2000 vide Notification No. C4-21437/2000 dated 20-10-2000 and

published in Kerala Gazette No. 1, dated 2-1-2001 as Sl. No. 6 and 10. In that Notification, Locality and Survey Numbers

were shown erroneously whereas the correct details in respect of the land notified as Ecologically Fragile Land are shown

in the revised schedule as above. Hence this Erratum Notification is published with the intention to achieve the above

objective.

It is hereby notified for the information of the public

that the Tender/Auction sale of Machineries (shown in

the appended schedule) involved in the OR. 17/04 of

Walayar Forest Range and confiscated to Government

vide Order No. O2.OR. 17/04 dated 25-1-2006 of Divisional

Forest Officer, Palakkad will be conducted by the

Divisional Forest Officer, Palakkad or any other Officer

authorized by him on 6-11-2008.

The Tender/Auction sale will be as per the sale

condition in the notification No. Pro(5) 2613/08 dated

12-6-2008 published in Gazette No. 26 dated 24-6-2008.

Sealed tenders are invited for the above Tender/

Auction sale. The Tender form will be issued from this

officer till 1 p.m. on the same day. The filled up tender

form should be submitted before to 2.30 p.m. and will not

be accepted after 2.30 p.m. Those people who have

submitted tender form will only be permitted to participate

in tender/auction.

The sealed tender form shall be opened at 3 p.m. and

decided immediately after the auction in the presence of

the tenderers present. If the date of auction happens to

be public Holiday/Harthal and nobody came forward to

participate in tender/auction sale on 6-11-2008 the same

will be conducted on 7-11-2008 at the same place and time.

CONDITIONS

The persons who intend to participate in tender/

auction may examine the consficated materials in

Elappully Essential Oil Industries, Pattathalachy,

Elappully, Palakkad with permission and presence of

Range Officer, Walayar. No complaints about

machineries will be considered after Tender/Auction.

The persons who intend to particiapte in tender/

auction should produce any of the following to

prove their identity (1) certificate obtained from the

Village Officer (2) Election Identity Card (attested)

(3) Passport (attested).

The tender form will not be accepted after the time

prescribed.

The tender form in which the highest amount quoted

will be submitted to higher officers for consideration

and confirmation and EMD amount remitted by

others will be paid back.

The successful bidder should remit the 35% of sale

value, including EMD on the Auction day itself, if

the sale value is higher than EMD amont. The

balance amount & other taxes should be remitted

and remove the machineries within 40 days from the

date of confirmation. If the same is not removed

within the 40 days, another 30 days time will be

granted to remove the machineries on request of

bidder. The balance amount with 18% interest and

Rs. 20 per day for ground rent should be remitted for

the above 30 days.

If the machineries are not removed within the above

period, the same shall be re-auctioned at the risk and

loss of defaulter and amount remitted by the defaulter

will be forfeited to Government. If the sale value in

the reauction is lower than the amount bid earlier,

action will be taken to recover loss amount from

dafaulter.

The Tender/Auction shall be cancelled or changes

made, if it is necessary, subject to the discretionary

power of the Divisional Forest Officer.
