Whereas the Government of Kerala has published Act No. 21 of 2005, namely, the Kerala Forest (Vesting and

Management of Ecologically Fragile Lands) Act 2003, which came into effect from 2nd day of June 2000 for the

conservation and management of ecologically fragile lands, prevention of degradation of the Eco-System and Biological

Diversity therein.

Now, it is hereby notified for the information of the public that the ownership and possession of the land as per the

details shown in the schedule hereto, in the District of Kannur has been vested with the Government of Kerala free from

all encumbrances and the right, title and interest of the owner or any other person thereon shall stand extinguished from

the date of commencement of the Act, i.e. 2nd June 2000.

The publication of the notification is made as requied under section 3(2) of the Kerala Forest (Vesting and

Management of Ecologically Fragile Lands) Act, 2003 as per Government Notification No. 15567/Leg. B1/01/Law dated 3rd

May 2005 and published in Kerala Gazette No. 929 dated 3rd May 2005.

not conducted due to some technical reasons on

It is hereby notified for the information of the public

that the Tender-cum-Auction sale of usufructs collected

from the resumed estates of Rosary Estate in

Nelliyampathy Range under Nemmara Division will be

conducted by the Divisional Forest Officer, Nemmara or

any other officer authorized by him as per the sale

conditions appended below and other tender/auction sale

conditions prevailing in the Forest Department. The

usufructs are organic and are stored in the godowns of

the concerned estate buildings. If the date of auction

happens to be a public holiday, local holiday or harthal,

the sale will be conducted on the next working day at the

stipulated place and time.

CONDITIONS

1. Those who intend to participate in the tender/auction

should produce their valid Identity Card such as

Certificate attesting signature and permanent address

obtained from Village Officer or attested Election

Identity Card/Driving Licence/Passport before

remitting the EMD. They should also file an

undertaking agreeing that they will personally held

responsible for the loss if any, sustained to

Government due to the breach of any sale conditions.

2. Those who intend to participate in the tender/auction

should ensure themselves of the quality, quantity etc.

of the produce before the tender/auction. Complaints

if any, in this regard will not be entertained after the

sale.

3. The produce will be put up for sale in lots. The

tender should be submitted by quoting the rate for

1 Kg. for each lot. The tender will be opened and

finalized in the presence of the tenderers present on

completion of the auction procedure.

4. The successful tenderer/bidder should remit the full

sale value if the total sale amount is below Rs. 20,000

and if it exceeds, he should remit the 35% of the bid

amount subject to a minimum of Rs. 20,000 and

maximum of Rs. 1,00,000 in cash or by DD on the

same day. If the 35% bid amount is more than 1,00,000

the amount exceeding 1 lakh has to be remitted in the

treasury and the receipt produced within 7 working

days after the auction sale. If anybody fails to remit

the balance amount, the amount already remitted by

them will be forfeited to Government.

5. Balance bid amount and taxes thereon should be

remitted to Government Treasury within 40 days from

the date of communication of the confirmation orders.

6. An extension of 30 days time will be allowed on

payment of 18% interest and a further extension of

30 days on payment of 24% interest + 2½ % surcharge

on interest. Another 30 days extension will be

granted on payment of 36% interest with 5%

surcharge on interest. There will be no extension

beyond the above 90 days. If the bidder fails to remit

the amount within the extended period the amount

already remitted by the defaulters will be forfeited to

Government and the produce will be re-tendered/

re-auctioned at the risk and loss of the defaulter.

7. If the bidder fails to remit all the amount within 130

days from the date of communication of the

confiscation order, the tender/auction will be

cancelled and the produce will be re-tendered/

re-auctioned at the risk and loss of the defaulter after

issuing a notice to the defaulter with 10 days

validity.

8. The following powers of the undersigned are

unquestionable.

(a) The EMD of any person/firm can be denied

without assigning any reason.

(b) Any notified lots can be excluded from the sale

or any additional lots can be put up for sale.

(c) Any person/firm can be expelled from the

auction process if the person/firm is believed to

be involved in any activities against the

(d) Auction process can be stopped by the

undersigend at any time if the participants are

indulged in activities which are detrimental to

Government interest.

9. Post offer will be accepted within 7 days from the

date of tender/auction. The same will be considered

as per the prevailing rules in this respect.

Nelliyampathy, Kollengode and Alathur during office

hours.

10. The general conditions regarding tender/auction

published in Kerala Gazette No. 26 dated 24-6-2008

vide Notification No. Pro. (5)-2613/08 dated 12-6-2008

are also applicable for this tender/auction.

If nobody come forward to participate in the tender/

auction sale or on cancellation of tender/auction on

17-12-2008, the produce shown in the scheduled will be

sold out by tender/auction sale in the subsequent days on

18-12-2008 & 22-12-2008.
